The Appellate Authority (U/RTI Act, 2005) / The Assistant Commissioner of Police, Malkajgiri Division, Malkajgiri, Medchal Malkajgiri District. O R D E R 1. Sri P.Rajesh, Hyderabad-500013 has filed 2nd appeal dated Nil which was received by this Commission on 15-03-2017 for not getting the information sought by him from the PIO / O/o the Director General of Police, State of Telangana, Lakdi-ka-pool, Hyderabad-500004 and 1st Appellate Authority / O/o the Director General of Police,State of Telangana,Lakdi-ka-pool,Hyderabad-500004. 2. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 15-02-2017 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: 3. The Public Information Officer has not furnished the information to the appellant. 4. Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 01-03-2017 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. 5. The 1st Appellate Authority has not furnished the information to the Appellant. 6. As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 11- 12-2017. On 11-12-2017 the case is called. The appellant is absent. The Asst. Public Information Officer, O/o the DGP, Hyderabad is present. The Public Information Officer submitted that the 6(1) application and 1st appeal filed by the appellant were transferred to the Public Information Officer , O/o the Commissioner of Police, Hyderabad for furnishing information since the same relates to their office. The same fact was also informed to the appellant. The APIO further submitted that the Public Information Officer , O/o the Commissioner of Police, Hyderabad in turn informed the appellant that his application is being sent to the Rachakonda Police Commissionerate for further action as the subject matter comes under their jurisdiction. The case was adjourned to 21-2-2018. On 21-2-2018 the case is called. The appellant is absent. The Public Information Officer, Inspector of Police, Medipally PS and First Appellate Authority, ACP, Malkajgiri Division are present. The Public Information Officer submitted that information was furnished to the appellant through letter dated 19.06.2017. Perused the records. Heard the PIO and 1st Appellate Authority. The 6(1) application is in the nature of a complaint. The matter has ultimately reached the PIO, Medipally Police Station. Since information is furnished, the appeal is closed.
