PNB SCAM : EXPOSURE OF ILLS IN INDIAN BANKING SYSTEM The nuts and bolts of a fraud : on PNB scam Diamond merchant Nirav Modi has been accused of siphoning off funds worth about Rs. 12,636 crore from the public sector bank, PNB. A key element of the scam is the Society for Worldwide Interbank Financial Telecommunication (SWIFT), a messaging network that connects banks and other financial institutions across the world. Among other things, a bank that is part of SWIFT can use the system to convey credit instruments called Letters of Undertaking (LoUs) to other banks located overseas. An LoU is simply a request made to another bank in the SWIFT network to loan money to a client. The bank that issues the LoU essentially guarantees the bank that receives the LoU request that it stands by the creditworthiness of the borrower. That is, in case of a default, the bank that issued the LoU stands liable to compensate the bank that made the loan to the borrower. PNB alleges that employees at one of its branches in Mumbai issued fraudulent LoUs that were not authorised by its management. This allegedly allowed Mr. Modi’s companies to obtain loans from the overseas branches of various Indian banks. Why did it happen? PNB’s internal information systems were not seamlessly linked to SWIFT. It is claimed that the huge fund transfers made via SWIFT to Mr. Modi’s companies by a few PNB employees went undetected for many years. Many critics, however, contend that the fraud is not simply a matter of the failure of PNB’s internal control system. Instead, they blame flaws in the ownership of public sector banks. In fact, the PNB scam came to light only after a whistle-blower exposed it. Is this the first time? No. SWIFT has been gamed by miscreants on a number of occasions. In 2016, there was a cyber-heist of $81 million from Bangladesh’s central bank. Russia’s central bank recently reported that $6 million was stolen from a Russian bank last year by exploiting the SWIFT system. Even the Reserve Bank of India stated this week that it had privately warned Indian banks about the prospect of misuse of SWIFT at least three times since August 2016. Under the new system, every transporters will have to carry a system-generated bill to move goods from one place to another. • Under the Goods and Services Tax, inter-state transportation of goods beyond 10 kilometres with a value of 50,000 rupees and above, will mandatorily require e-way bill. • Last month, the GST Council decided to implement the e-way bill mechanism throughout the country from 1st of February, 2018. What is e-way bill? E-way bill is an electronic way bill for movement of goods which can be generated on the GSTN (common portal). A ‘movement’ of goods of more than Rs 50,000 in value cannot be made by a registered person without an e-way bill. It has a population of 3,68,04,660, out of which males constitute 1,86,60,570 and female 1,81,44,090. It has 51,349 villages and 138 towns and the literacy rate is 70.5 males whereas 50.5 relates to females. Odisha has rivers like Mahanadi, Brahmani, Baitarani, Tel, Rushikulya, Sabari and others. Odisha is a land of mountains, but two highest mountains named Garhjat and Mahendra Giri are notable. Chilika is the biggest lake which is 64 km long and 20 km wide.     Is This a Sudra Critique? Periyar and the Intermediate Castes Karthick Ram Manoharan* Introduction When Kancha Ilaiah published his controversial book Why I Am Not a Hindu (1996), he subtitled it A Sudra Critique of Hindutva Philosophy, Culture and Political Economy. Ilaiah’s output in contributing to this “critique” has been quite prolific, the most recent being the co-edited volume, The Shudras: Visions for a New Path (Ilaiah and Karuppusamy 2021). But why use a Sudra critique when Ilaiah himself identifies that the concept of “Sudra” is derogatory in the Brahminical vocabulary and that “It does not communicate a feeling of self-respect and political assertion” (Ilaiah 1996:vii)? For political purposes, Ilaiah prefers the term “Dalitbahujan”—building on the concept introduced by Kanshi Ram, the founder of the Bahujan Samaj Party—and defines it as “people and castes who form the exploited and suppressed majority” (Ilaiah 1996:ix). The “Sudra” concept, thus, is used as a critique of Brahminical ideals so as to arrive at a Dalitbahujan politics. The Sudras—“the numerous productive castes which have historically built the material basis of our civilization, yet have been marginalized in terms of the power and knowledge-sharing-arrangement in the Brahminical order” (Ilaiah 2021:n.p.)—, however, were limited in their conceptual under- standing as their political action was restricted to securing repre- sentation and they did not have adequate self-consciousness of the caste system and the need for Dalitbahujan unity. Ilaiah frequently cites Jotirao Phule and B. R. Ambedkar as being crucial to the development of his Sudra critique.
