The Owner shall submit an appraisal of the Subject Lands, in accordance with Section 42 of the Planning Act, prepared by an accredited appraiser for approval by the Office of the City Solicitor, Real Estate Department, and the approved appraisal shall form the basis of the cash-in-lieu payment.”

Purpose To seek Council approval to proclaim October as Learning Disabilities Awareness Month and to post the proclamation on the City’s website.

Report Highlights • Respond to the request received from the Learning Disabilities Association of York Region. • Proclamation requested for October 2018.

Recommendations 1. That October be proclaimed as Learning Disabilities Awareness Month; and 2. That the proclamation be posted on the City’s website.

Background Correspondence from Learning Disabilities Association of York Region (LDAYR) requesting this proclamation was forwarded from the Office of the Mayor and received in the Office of the City Clerk on September 20, 2018.

October is Public Awareness Month for Learning Disabilities across Canada. This year’s campaign theme is “Don’t Dis My Abilities”. This theme focuses on youth and adults with Learning Disabilities and seeks to encourage young people to reach their full potential. With more awareness Learning Disabilities can be identified at a younger age, which can mean earlier intervention and support.

Resolution of Regional Councillor Rosati

Whereas, York Region Transit (YRT) provides Transit Services for Vaughan Citizens travelling throughout the Region; and

Whereas, YRT continues to work with Metrolinx and other transit agencies across the Greater Toronto and Hamilton Area on an integrated fare strategy (fare integration); and

Whereas, YRT service routes to York University were realigned in early September 2018 eliminating direct bus routes to the university; and

Whereas, approximately 4,600 travellers to York University are impacted by the service change which results in the rider paying a full fare to YRT and TTC; and

Whereas, Regional Council adopted recommendations of Report No. 1, of the Commissioner of Transportation Services, titled “York Region Transit Cross- Boundary Travel and Greater Toronto and Hamilton Area Fare Integration”, at its meeting on September 20, 2018 (Attachment 1); and

Whereas, the following recommendations approved at the York Region Council meeting of September 20, 2018, read: 1. Council pass a resolution seeking commitment from the Board of Directors of Metrolinx to finalize a Greater Toronto and Hamilton Area wide fare integration solution by 2019, to allow for full implementation as part of the PRESTO device refresh, scheduled for 2020 or sooner.

2. The Regional Chair forward the resolution to The Honourable John Yakabuski, Minister of Transportation, with a copy to Local Members of Provincial Parliament and the Chair of Metrolinx, highlighting the urgency and the importance to have this issue addressed.

3. This Council resolution and report be circulated to the Clerks of the Regional Municipality of Durham, City of Toronto, City of Brampton, City of Mississauga, City of Milton, City of Oakville, City of Burlington, and the City of Hamilton.

4. Staff request the TTC to consider an exception to the 2009 Memorandum of Understanding signed by York Region, City of Toronto and TTC allowing service to continue to York University until fare integration is implemented.

Whereas, one of Vaughan Council’s 2014-2018 Term of Council Priorities is to continue to develop transit, cycling and pedestrian options to get around the City; It is therefore recommended:

1. That Council support the recommendations noted above adopted by at its meeting of September 20, 2018; and

2. That Council request the City Clerk to forward this resolution to the following: The Toronto Transit Commission, the Region of York, Metrolinx, and the Ministry of Transportation.

The Inaugural meeting of Council commenced at 7:00 in the City Hall Council Chamber, Vaughan, Ontario.

The following members were present:

The City Clerk, Mr. Todd Coles, called the Inaugural Meeting of Council to order at 7:00 p.m.

The Mayor and Members of Council Elect entered the Chambers led the Piper, the Vaughan Fire & Rescue Honour Guard and the By-Law & Compliance Honour Guard.

The meeting commenced with the singing of the bilingual National Anthem by the Herbert H. Carnegie Public School Choir.

Ms. Angelica Di Castro performed the song Reach.

The Honourable Phillip Sutherland of the Ontario Superior Court of Justice administered the Declaration of Office to the Mayor and Members of Council.

The City Clerk presented the Chain of Office to Mayor Maurizio Bevilacqua.

Mayor Maurizio Bevilacqua introduced the City of Vaughan Council for the 2018 – 2022 term, and each Member of Council gave their Inaugural address.

Whereas, Traffic Engineering staff conducted an operational review of Lady Fenyrose Avenue and determined that there are operational considerations with vehicles parked on both sides of Lady Fenyrose Avenue opposite to the Woodrose Park; and Whereas, a survey was initiated by Traffic Engineering staff proposing to install a “No Parking” prohibition with No Parking signs on the west side of Lady Fenyrose Avenue between Janessa Court/Midvale Heights Lane and Lady Jessica Drive/Dimarino Drive for the hours of 6:00-9:00 p.m., Mondays to Fridays, and from 9:00 a.m. to 5:00 p.m., Saturday, from May 1st to October 31st to improve traffic operations on Lady Fenyrose Avenue; and Whereas, the survey was distributed to the 19 homes that are directly impacted by the parking concerns and will be adjacent to the proposed no parking prohibition; and Whereas, of the 19 surveys distributed, 16 surveys were returned (84% response rate) with 12 surveys (75% of those responding) in favour of implementing the no parking prohibition and 4 surveys in favour of the “do nothing” approach (25% of those responding); It therefore recommended that a “No Parking” prohibition with No Parking signs be implemented on the west side of Lady Fenyrose Avenue between Janessa Court/ Midvale Heights Lane and Lady Jessica Drive/ Dimarino Drive for the hours of 6:00-9:00 p.m., Mondays to Fridays, and from 9:00 a.m. to 5:00 p.m., Saturday, from May 1st to October 31st; and That the Parking Bylaw be amended to reflect the proposed No Parking prohibition; and That all signage related to the No Parking prohibition be installed by May 1, 2019. 9. A previous Part Lot Control By-law (By-law 173-2018) was passed on September 27, 2018 with respect to the subject lands. A By-law to amend City of Vaughan By-law 1-88.

WHEREAS the matters herein set out are in conformity with the Official Plan of the Vaughan

Planning Area, which is approved and in force at this time;

AND WHEREAS there has been no amendment to the Vaughan Official Plan adopted by Council but not approved at this time, with which the matters herein set out are not in conformity;

NOW THEREFORE the Council of the Corporation of the City of Vaughan ENACTS AS

FOLLOWS:

1. That City of Vaughan By-law Number 1-88, as amended, be and it is hereby further amended by:

a) Rezoning the lands referred to as Part “A” (Parts 1 and 2 on Reference Plan 65R-37397)

of the “Subject Lands” from “PB1S Parkway Belt Linear Facilities Zone” to “PB1(S)

Parkway Belt Linear Facilities Zone, subject to Exception 9(1067), in the manner shown on

Schedule “1”.

b) Rezoning the lands referred to as Part “B” (Parts 3 and 5 on Reference Plan 65R-37397)

of the “Subject Lands” from “PB1S Parkway Belt Linear Facilities Zone” to “PBM7 Parkway

Belt Industrial Zone”, subject to Exception 9(1067), in the manner shown on Schedule “1”.

c) Adding the following clause to Exception Paragraph 9(1067) after clause d):

“e) Subsection 3.10 respecting Public Uses”

d) Adding the following clause to Exception Paragraph 9(1067) after clause di):

“ei) Interim industrial uses shall be permitted on Part “A” (Parts 1 and

2 on Reference Plan 65R-37397). Permanent buildings and/or structures

are prohibited. For added clarity, interim industrial uses shall be limited to

e) Deleting Schedule “E-1167” and substituting therefor the Schedule “E-1167” attached

Schedule “2”.

WHEREAS Subsection 69(1) of the Planning Act, R.S.O. 1990, c.P. 13, as amended, permits a municipality to enact a by-law to impose a Tariff of Fees for the processing of Planning Applications;

AND WHEREAS the Council of The Corporation of the City of Vaughan deems it appropriate to amend the existing Tariff of Fees for the processing of Planning Applications;

NOW THEREFORE the Council of the Corporation of the City of Vaughan ENACTS AS

FOLLOWS:

1. The fees for the processing of Planning Applications commencing in 2019 shall be as set out in

Schedule “A” attached hereto, as may be amended:

3. By-law Number 018-2018 shall be repealed on the date this By-law comes into full force and effect.

NOTES:

1. Any application fees paid prior to the date this By-law comes into force, shall be credited to the amount(s) due under this By-law.

2. If an application is withdrawn in writing by the Applicant:

a) prior to a technical report proceeding to Committee of the Whole, 25% of the fee may be refunded; or b) prior to a Public Meeting, 50% of the fee may be refunded.

3. Should the Applicant request that a Public Meeting be cancelled (after Notices have been mailed out) and held at a later date, the total cost incurred for the second mailing of a Public Meeting Notice shall be borne by the applicant.

4. An appeal of any of the Planning Applications identified in this By-law to the Ontario Municipal Board and/or the Local Planning Appeal Tribunal shall be subject to a $787.00 Planning Department Administrative fee, to be paid by the Appellant.

5. Site Development applications for new individual (excluding new detached residential dwelling developments(s) proceeding through the plan of subdivision approval process) detached dwellings that are to be constructed within any Heritage Conservation District Study and Plan, as defined by Vaughan Official Plan 2010, are subject only to the Simple Revision fee for Site Development Applications, and will require Council approval of the application. The Heritage Review fee shall also apply.

6. For a Mixed-Use development, where more than one use is proposed on a site, the applicable Site Development application fee shall be the Base fee, plus the total of the fees for each individual use/units added together. For a Zoning By-law Amendment Application, Site Development Application and Draft Plan of Subdivision Application, where residential uses are proposed, the per unit residential fee shall apply to each unit.

7. Minor Official Plan Amendment: A “Minor” Official Plan amendment is an Official Plan amendment that:

a) proposes a small-scale exception to a specific Official Plan standard (e.g., minor changes to the number of permitted units; building height; gross floor area; or to add a site-specific use limited in scale); b) proposes a minor change to a specific policy that is limited in scope and typically to one property; c) maintains the intent and purpose of the Official Plan; and d) shall have limited impact or policy implications beyond the subject lands.

8. Major Official Plan Amendment: A “Major” Official Plan amendment is an Official Plan amendment that:

a) any proposed redesignation or change in land use for a property(ies); b) requires many changes to the policies and schedules of the Official Plan; c) is more significant in scale and scope than a minor Official Plan amendment, and which may have greater impact or policy implications beyond the subject lands. Applications relating to more than one property would normally be in this category; d) a site-specific application representing a large-scale development/redevelopment or a change in use. An application involving significant changes to the text or policies of the Official Plan would also fall in this category; and e) an Official Plan amendment within a Heritage Conservation District.

9. Official Plan, Zoning By-law Amendment, Site Development, Block Plan and Secondary Plan Applications – Recirculation fee applicable when substantial changes are initiated by the applicant that requires a full recirculation for review and comment prior to Council approval. When more than one related application (e.g., Official Plan and Zoning By-law Amendment) is filed, the fee shall only be applied for one of the related applications.

10. For the purposes of calculating the applicable surcharges the VMC, Intensification Areas and Infill Development are defined as follows:

a) VMC - Any Development Planning application for a property located within the boundary of the Vaughan Metropolitan Centre (VMC), as defined by the VMC Secondary Plan.

b) Intensification Areas - Any Development Planning application for a property located within an Intensification Area identified on Schedule 1 - Urban Structure of Vaughan Official Plan (VOP) 2010, or any Secondary Plan Policies (Section 11), Area Specific Polices (Section 12), or Site-Specific Policies (Section 13) constituting Volume 2 of VOP 2010. The surcharge will apply to Development Planning applications that facilitate new development and redevelopment proposals.

c) Infill Development - Any Development Planning application for a property where the proposal is for development that meets the following definition:

Infill Development means the development or redevelopment of a property, site or area with new development at a higher density or building height than is currently permitted by the Official Plan. The surcharge fee will not apply to a Development Planning application for street townhouse development, but shall apply to all other forms of townhouse development (e.g. common element, back-to-back, row, stacked, etc.). Infill development also includes all residential apartment and mixed-use buildings.

In each case above (i.e. VMC, Intensification Area and Infill Development) the surcharge will not apply to development that is minor in nature, such as additions or expansions of existing buildings, a change in use in an existing building, or an amendment to a development standard (e.g. number of units or gross floor area).

d) Heritage Conservation Districts (HCD): Intensification Areas and Infill Development fees do not apply to any Development Planning application that will facilitate the retention, adaptive reuse, or a minor alteration(s) (e.g. addition) of an existing building that is designated as Part 4 or Part 5 under the Ontario Heritage Act or recognized in the City’s Built Heritage Inventory. However, any Development Planning application for new development / redevelopment within a HCD is subject to the Intensification Area/Infill surcharge.

e) The VMC, Intensification Areas, Infill Development and Heritage (where applicable) surcharges shall be paid for each application type. (Example: If a Zoning By-law Amendment and Site Development application are required for a residential development in the VMC, the applicable Zoning By-law Amendment surcharge of $15,708 and the Site Development application surcharge of $4,780 shall apply.)

11. OTHER GENERAL FEES:

$589.00 per year Maintenance Fee charged to files inactive for over 1 year (where the Applicant prefers not to close the file).

12. Fees for Landscape Inspection and Landscape Review are subject to HST.

13. Per unit fee charge is based on a decreasing per unit rate. For example, a Zoning By-law Amendment application for a proposed residential development with 250 units, the fee is calculated as follows:

The lands subject to this By-law are located on the east side of Pine Valley Drive and south of Teston Road, being Part of Lots 24 and 25, Concession 6, City of Vaughan. The subject lands are located within Plan of Subdivision 19T-03V05 (Prima Vista Estates Inc. and 840999 Ontario Limited).

The purpose of this By-law is to remove the Holding Symbol “(H)” from the subject lands that are zoned RD2(H) Residential Detached Zone Two and RD3(H) Residential Detached Zone Three both with the addition of the Holding Symbol “(H)” by Zoning By-law 1-88, subject to Exception 9(1455). Removal of the Holding Symbol “(H)” will facilitate the development of 160 detached dwelling units and 8 blocks to be developed with the adjacent lands for 8 detached dwelling units. The subject lands were originally zoned with the Holding Symbol “(H)” by By-law 67-2018, until such time that the following condition was satisfied:

“2. Prior to the removal of the Holding Symbol “(H)” from the Subject Lands as shown on Schedule “E-1585A” and “E-1585B”, the requirements of a Remedial Action Plan and the submission of a record of site condition must be successfully filed with the Ministry of the Environment on the Environmental Site Registry to the satisfaction of the City.”

The Holding Symbol “(H)” can be removed from the subject lands as the condition respecting the holding provision has been satisfied as follows effectively zoning the subject lands, RD2 Residential Detached Zone Two and RD3 Residential Detached Zone Three:

• The Development Engineering Department, in correspondence dated November 29, 2018, advised that the Record of Site Condition has been successfully filed with the Ministry of the Environment, Conservation and Parks on the Environmental Site Registry to the satisfaction of the City.

This By-law also amends sub-paragraph 2 in Paragraph A, Exception 9(1455) to delete reference to Schedule “E-1585A” in the Zoning By-law as the Holding Symbol “(H)” will be removed.

MEMORANDUM OF ORAL DECISION DELIVERED BY HUGH S. WILKINS ON AUGUST 13, 2018 AND ORDER OF THE TRIBUNAL

INTRODUCTION

[1] 152533 Ontario Incorporated (“Appellant”) made Official Plan Amendment and Zoning By-law Amendment applications to the City of Vaughan (“City”) regarding a proposed development at 8265 Islington Avenue (“subject lands”). The City failed to make decisions on the applications and the Appellant filed appeals under s. 22(7) and 34(11) of the Planning Act.

[2] The subject property is located on the east side of Islington Avenue between Willis Road and Hartman Avenue. The subject property is 0.75 hectares with 52.9 metres of frontage on Islington Avenue. It slopes downwards towards the Humber River to the east. The subject property presently has one residential dwelling on it, which is

proposed to be demolished. A mix of residential building types is located along Islington Avenue near the subject property. On the other side of the Humber River is a low-rise residential neighbourhood.

[3] The subject property is designated “Low-Rise Residential (2)” and “Low Rise Residential (1)” under the City’s Official Plan 2010 and is subject to the provisions of the Woodbridge Centre Secondary Plan (“Secondary Plan”). A portion of the subject property is located in a Special Policy Area to address flood plain management issues.

[4] The purpose of the proposed Official Plan Amendment is to alter the density plan and building height maximums set out in Schedules 3 and 4 of the Secondary Plan to permit a residential apartment building containing 74 residential dwelling units with a maximum density of 2.5 Floor Space Index (“FSI”) and a maximum building height of six storeys.

[5] The purpose of the proposed Zoning By-law Amendment is to rezone the subject property from “R2 Residential Zone” and “OS1 Open Space Conservation Zone” in Zoning By-law No. 1-88 to “RA3(H) Apartment Residential Zone with the Holding Symbol (H)” and “OS1 Open Space Conservation Zone”.

[6] A settlement was reached that includes all of the Parties. On August 13, 2018, the Tribunal convened a settlement hearing at which it heard land-use planning evidence in support of the proposed settlement. None of the Participants elected to make a presentation at the settlement hearing.

EVIDENCE, SUBMISSIONS AND FINDINGS

[7] John Zipay was qualified and provided land-use planning opinion evidence on behalf of the Appellant. Mr. Zipay stated that the proposed Official Plan Amendment would not change the existing designations on the subject property. He said they alter only the maximum density and maximum height permitted. He said the Special Policy Area would not change and that although there would be a driveway and underground parking there, none of the proposed development’s habitable space would be in the

Special Policy Area. The proposed uses within the Special Policy Area have been agreed to by the Toronto and Region Conservation Authority (“TRCA”), the Ministry of Natural Resources and Forestry and the Ministry of Municipal Affairs.

[8] The proposed Zoning By-law Amendment sets out site specific zoning requirements for the subject property addressing maximum developable lot area and maximum gross floor area, setbacks, height restrictions, maximum FSI requirements, minimum lot area per unit requirements, and parking and amenity area requirements. Mr. Zipay stated that a site plan will be required and that an agreement under s. 37 of the Planning Act for increased height and density has been concluded. The Section 37 Agreement requires the Appellant to pay funds to the City for park and multi-use trail improvements in the area. The Holding Symbol is included in the proposed Zoning By- law Amendment to ensure that issues regarding sanitary sewage, water supply, flood proofing and safe access to the site are addressed.

[9] Mr. Zipay opined that the proposed Official Plan and Zoning By-law amendments are consistent with the Provincial Policy Statement, 2014 (“PPS”) and conform with the Growth Plan for the Greater Golden Horseshoe, 2017 (“Growth Plan”), the Regional Municipality of York Official Plan (“Region’s Official Plan”), and the City’s Official Plan. He said the proposed amendments represent efficient land use providing appropriate intensification. He said the subject property is well-serviced and close to transit and local amenities. He said conditions are included that address sewage and water supply issues and the proposed amendments satisfy the TRCA’s requirements for flood protection and safe access to the site. He said the proposed amendments also meet the intensification requirements in the City’s Official Plan.

[10] Having considered the uncontradicted opinion evidence of Mr. Zipay, the Tribunal found that the proposed Official Plan and Zoning By-law Amendments are consistent with the PPS, and conform with the Growth Plan, the Region’s Official Plan and the City’s Official Plan. At the settlement hearing, the Tribunal approved both the Official Plan Amendment and Zoning By-law Amendment in principle.

ORDER

[11] The Tribunal orders that:

a. the official plan amendment appeal is allowed in part, and the proposed Official Plan Amendment No. 23 to the Vaughan Official Plan 2010 of the Vaughan Planning Area is approved in the form attached as Attachment 1 to this Decision;

b. the zoning by-law appeal is allowed in part, and the proposed Zoning By- law Amendment to amend City of Vaughan By-law No. 1-88, as amended, is approved in the form attached as Attachment 2 to this Decision.

I PURPOSE

The purpose of this Amendment to Vaughan Official Plan 2010 (VOP 2010) is to amend

Schedule “3” – Density Plan and Schedule “4” – Building Height Maximums of the

Woodbridge Centre Secondary Plan to permit a residential apartment building containing

74 residential dwelling units, having a maximum density of 2.5 Floor Space Index (F.S.I.) and a maximum building height of 6-storeys (19 metres) on Part “A” of the Subject Lands.

No habitable area of the building is permitted within the Special Policy Area identified as

“Part “B” on Schedule “2” – Land Use Plan.

II LOCATION

The lands subject to this Amendment, hereinafter referred to as the “Subject Lands”, are

shown on Schedule “1” as Part “A”, “B” and “C” attached hereto as “Area Subject to

Amendment No. 23”. The Subject Lands are located on the east side of Islington Avenue,

north of Willis Road, and are municipally known as 8265 Islington Avenue, being Lots 7,

7A and 8, Plan M-117, in the City of Vaughan.

III BASIS

The decision to amend Vaughan Official Plan (VOP 2010) is based on the following

considerations:

1. The Statutory Public Hearing on this matter was held on June 11, 2013 for File

Nos. OP.13.002 and Z.13.004. The development applications were subsequently

appealed by the applicant to the Ontario Municipal Board (Case No. PL170558).

The applicant has also appealed VOP 2010. On November 21, 2017 Council

endorsed a settlement for files OP.13.002 and Z.13.004 in respect of the Subject

Lands.

2. The Provincial Policy Statement, 2014 (PPS) and the Provincial Growth Plan for

the Greater Golden Horseshoe 2017 (the Growth Plan), contain policies which

promote intensification and efficient use of land, infrastructure and public facilities

and promote the use of public transit.

99 3. The following policies in the PPS, among others, are supportive of the proposed

amendment:

i) 1.1 Managing and Directing Land Use to achieve Efficient Development and

Land Use Patterns and sub-clauses 1.1.1 (a), (b), (c), (d), (e).

ii) 1.1.3 Settlement Areas

1.1.3.1 Settlement areas shall be the focus of growth and development, and

their vitality and regeneration shall be promoted.

1.1.3.2 Land use patterns within settlement areas shall be based on:

(a) densities and a mix of land uses which:

1. efficiently use land and resources;

2. are appropriate for, and efficiently use, the infrastructure and

public service facilities which are planned or available, and avoid the

need for their unjustified and/or uneconomical expansion; and,

3. minimize negative impacts to air quality and climate change,

and promote energy efficiency.

(b) a range of uses and opportunities for intensification and redevelopment

in accordance with the criteria in policy 1.1.3.3, where this can be

accommodated.

1.1.3.3 Planning authorities shall identify and promote opportunities for

intensification and redevelopment where this can be accommodated taking

into account existing building stock or areas, including brownfield sites, and

the availability of suitable existing or planned infrastructure and public

service facilities required to accommodate projected needs.

1.1.3.4 Appropriate development standards should be promoted which

facilitate intensification, redevelopment and compact form, while avoiding

or mitigating risks to public health and safety.

iii) Policy 3.1.2 and 3.1.4 Development and site alteration may be permitted in

Special Policy Area lands where no modifications to the official plan policies,

land use designations or boundaries occur and shall be carried out in

accordance with floodproofing standards, protection works standards and

access standards. No modifications to official plan policies or boundaries

to the Special Policy Area are proposed by this Amendment. The building’s

habitable area shall be located outside of the Special Policy Area.

4. The York Region Official Plan and VOP 2010 contain numerous policies which

support intensification through the efficient use of land, resources, infrastructure

and promote public transit.

5. The site will be serviced by public transit, with York Region Transit services

available within 169 metres of the subject lands, which provides a connection to

York Region Rapid Transit (VIVA).

6. There is an adequate level of service infrastructure to accommodate traffic,

sewage and water, as demonstrated through the various consultant reports

submitted with the application.

7. The proposed use, form, scale, height all demonstrate compatibility with land use

and building forms in proximity of the site. Specifically, the Terraces on the Green

Development, which is located on the south side of the Subject Lands, has a height

of 19 metres whereas the proposed building is 6 storeys or 19 metres, exclusive

of the mechanical room.

8. This site-specific amendment, presented to the Ontario Municipal Board on August

13, 2018, permits a residential apartment building use on Part “A” of the Subject

Lands with maximum building height of 6 storeys, or 19 metres, exclusive of the

rooftop mechanical penthouse, and a maximum FSI of 2.5 times the area of the

lot. Part “B” shall only be used for driveway access and underground garage and

no habitable area is permitted.

9. This Amendment to VOP 2010 was approved by the Ontario Municipal Board

pursuant to Section 17(50) of the Planning Act, R.S.O. 1990, c.P.13 on August 13,

2018

I V. DETAILS OF THE AMENDMENT AND POLICIES RELATIVE THERETO

Vaughan Official Plan 2010 (VOP 2010) is hereby amended by amending the following

Schedules of Volume 2, Woodbridge Centre Secondary Plan as approved by the Board

on February 24, 2015:

1. Amending Section 4.2.2. Residential Policies by adding the following new site

specific policy:

(OPA #23) 4.2.2.2. g) 8265 Islington Avenue

i) Part “B” identified on Schedule 2 – “Land Use Plan”, shall only be used for

the purposes of driveway access and underground parking garage and no

habitable area of the development is permitted within the Special Policy

Area.

ii) Parts “A” and “B” identified on Schedule 2 – “Land Use Plan”, combined,

shall be used for the purpose of calculating the maximum permitted Floor

Space Index (FSI) for the Subject Lands, with an overall total maximum

permitted FSI of 2.5.

2. Amending Schedule 2, “Land Use Plan”, by identifying Parts “A”, “B”, and “C” on

the Subject Lands in the manner shown on Schedule “2” attached hereto.

3. Amending Schedule 3, “Density Plan”, by amending the maximum density

permitted on Part “A” of the Subject Lands from D 0.5 to D 2.5 in accordance with

Schedule “3” attached hereto.

4. Amending Schedule 4, “Building Height Maximums”, by amending the maximum

permitted height on Part “A” of the Subject Lands, from “H3.5” to “H6” in

accordance with the Schedule “4” attached hereto.

V IMPLEMENTATION

It is intended that the policies of the Official Plan of the Vaughan Planning Area pertaining

to the Subject Lands shall be implemented by way of an amendment to the City of

Vaughan Comprehensive Zoning By-law 1-88, and Site Development Approval, pursuant

to the Planning Act, R.S.O. 1990, c. P. 13.

V1 INTERPRETATION

The provisions of the Official Plan of the Vaughan Planning Area as amended from time to time regarding the interpretation of that Plan shall apply with respect to this

Amendment.

MEMORANDUM OF ORAL DECISION DELIVERED BY HUGH S. WILKINS ON AUGUST 13, 2018 AND ORDER OF THE TRIBUNAL

INTRODUCTION

[1] 152533 Ontario Incorporated (“Appellant”) made Official Plan Amendment and Zoning By-law Amendment applications to the City of Vaughan (“City”) regarding a proposed development at 8265 Islington Avenue (“subject lands”). The City failed to make decisions on the applications and the Appellant filed appeals under s. 22(7) and 34(11) of the Planning Act.

[2] The subject property is located on the east side of Islington Avenue between Willis Road and Hartman Avenue. The subject property is 0.75 hectares with 52.9 metres of frontage on Islington Avenue. It slopes downwards towards the Humber River to the east. The subject property presently has one residential dwelling on it, which is

proposed to be demolished. A mix of residential building types is located along Islington Avenue near the subject property. On the other side of the Humber River is a low-rise residential neighbourhood.

[3] The subject property is designated “Low-Rise Residential (2)” and “Low Rise Residential (1)” under the City’s Official Plan 2010 and is subject to the provisions of the Woodbridge Centre Secondary Plan (“Secondary Plan”). A portion of the subject property is located in a Special Policy Area to address flood plain management issues.

[4] The purpose of the proposed Official Plan Amendment is to alter the density plan and building height maximums set out in Schedules 3 and 4 of the Secondary Plan to permit a residential apartment building containing 74 residential dwelling units with a maximum density of 2.5 Floor Space Index (“FSI”) and a maximum building height of six storeys.

[5] The purpose of the proposed Zoning By-law Amendment is to rezone the subject property from “R2 Residential Zone” and “OS1 Open Space Conservation Zone” in Zoning By-law No. 1-88 to “RA3(H) Apartment Residential Zone with the Holding Symbol (H)” and “OS1 Open Space Conservation Zone”.

[6] A settlement was reached that includes all of the Parties. On August 13, 2018, the Tribunal convened a settlement hearing at which it heard land-use planning evidence in support of the proposed settlement. None of the Participants elected to make a presentation at the settlement hearing.

EVIDENCE, SUBMISSIONS AND FINDINGS

[7] John Zipay was qualified and provided land-use planning opinion evidence on behalf of the Appellant. Mr. Zipay stated that the proposed Official Plan Amendment would not change the existing designations on the subject property. He said they alter only the maximum density and maximum height permitted. He said the Special Policy Area would not change and that although there would be a driveway and underground parking there, none of the proposed development’s habitable space would be in the

Special Policy Area. The proposed uses within the Special Policy Area have been agreed to by the Toronto and Region Conservation Authority (“TRCA”), the Ministry of Natural Resources and Forestry and the Ministry of Municipal Affairs.

[8] The proposed Zoning By-law Amendment sets out site specific zoning requirements for the subject property addressing maximum developable lot area and maximum gross floor area, setbacks, height restrictions, maximum FSI requirements, minimum lot area per unit requirements, and parking and amenity area requirements. Mr. Zipay stated that a site plan will be required and that an agreement under s. 37 of the Planning Act for increased height and density has been concluded. The Section 37 Agreement requires the Appellant to pay funds to the City for park and multi-use trail improvements in the area. The Holding Symbol is included in the proposed Zoning By- law Amendment to ensure that issues regarding sanitary sewage, water supply, flood proofing and safe access to the site are addressed.

[9] Mr. Zipay opined that the proposed Official Plan and Zoning By-law amendments are consistent with the Provincial Policy Statement, 2014 (“PPS”) and conform with the Growth Plan for the Greater Golden Horseshoe, 2017 (“Growth Plan”), the Regional Municipality of York Official Plan (“Region’s Official Plan”), and the City’s Official Plan. He said the proposed amendments represent efficient land use providing appropriate intensification. He said the subject property is well-serviced and close to transit and local amenities. He said conditions are included that address sewage and water supply issues and the proposed amendments satisfy the TRCA’s requirements for flood protection and safe access to the site. He said the proposed amendments also meet the intensification requirements in the City’s Official Plan.

[10] Having considered the uncontradicted opinion evidence of Mr. Zipay, the Tribunal found that the proposed Official Plan and Zoning By-law Amendments are consistent with the PPS, and conform with the Growth Plan, the Region’s Official Plan and the City’s Official Plan. At the settlement hearing, the Tribunal approved both the Official Plan Amendment and Zoning By-law Amendment in principle.

ORDER

[11] The Tribunal orders that:

a. the official plan amendment appeal is allowed in part, and the proposed Official Plan Amendment No. 23 to the Vaughan Official Plan 2010 of the Vaughan Planning Area is approved in the form attached as Attachment 1 to this Decision;

b. the zoning by-law appeal is allowed in part, and the proposed Zoning By- law Amendment to amend City of Vaughan By-law No. 1-88, as amended, is approved in the form attached as Attachment 2 to this Decision.

A By-law to amend City of Vaughan By-law No. 1-88, as amended.

WHEREAS the matters herein set out are in conformity with the Official Plan of the Vaughan Planning

Area, which is approved and in force at this time;

AND WHEREAS there has been no amendment to the Official Plan adopted by Council and not approved at this time, with which the matters herein set out are not in conformity;

NOW THEREFORE the Council of the Corporation of the City of Vaughan ENACTS AS FOLLOWS:

1. That the City of Vaughan By-Law 1-88, as amended, be and it hereby further amended by:

a) Rezoning the lands shown as “Subject Lands” on Schedule “1” attached hereto, from R2

Residential Zone and OS1 Open Space Conservation Zone to RA3(H) Apartment Residential

Zone with the Holding Symbol “(H)” and OS1 Open Space Conservation Zone in the manner

shown on said Schedule “1”.

b) Adding the following Paragraph to Section 9 “EXCEPTIONS” as follows:

“(1471) A. The following provisions will apply to all lands zoned with the Holding Symbol

“(H)” until the Holding Symbol “(H)” is removed pursuant to Section 36(3) or (4) of the

Planning Act. Lands zoned with the Holding Symbol “(H)” shall be used only for the

use(s) legally existing as of the date of the enactment of By-Law 200 - 2018. The

removal of the Holding Symbol “(H)” is contingent upon the following:

a) That Council shall pass a resolution confirming the availability of sanitary

sewage capacity from the York Sewage Servicing System and water supply

from the York Water Supply System for a total of 74 residential dwelling units,

to the satisfaction of the Vaughan Development Engineering Department.

b) The Owner shall confirm that the residential development has been

floodproofed and safe access to the site is provided during a Regulatory flood

event, plus freeboard, to the satisfaction of the Toronto and Region

Conservation Authority (“TRCA”).

B. Notwithstanding the provisions of:

a) Schedule “A” Subsection 4.1.8 respecting Residential Zone Requirements

and Subsection 3.14 respecting Permitted Yard Encroachments and

Restrictions for the RA3 Apartment Residential Zone;

b) Subsection 3.8 a) b) and c) respecting Parking Requirements for Residential-

Apartment Dwelling;

115 c) Subsection 4.1.6 respecting Minimum Amenity Areas for the RA3 Apartment

Residential Zone;

d) Subsection 4.12 respecting Uses Permitted in the RA3 Apartment Residential

Zone and Subsection 7.2 OS1 Open Space Conservation Zone;

e) Subsection 3.17 respecting Portions of Buildings Below Grade.

The following provisions shall apply to the lands identified as “Subject Lands” on

Schedule “E- 1601”, attached hereto as Schedule “2”:

ai) the maximum developable lot area shall be 2,641.84 m² and the maximum

Gross Floor Area (GFA) shall be 6,612.51 m2.;

aii) the yard setbacks shall be as shown on Schedule “E- 1601“ attached hereto as

Schedule “2” with the following minimum setbacks:

East lot line to the building (rear) 2.6 m

North Interior lot line to the parking structure/retaining wall 0.6 m

North interior lot line to the building 3.5 m

South interior lot line to the building 12 m

South interior lot line to the parking structure/retaining wall 2.9m

Front yard (Islington Avenue) to the building 6.0 m

Front yard setback to the underground parking structure 0.3 m

aiii) no portion of any building or structure shall exceed the maximum building

height shown with the letter “H” on Schedule “E-1601”, exclusive of any

accessory roof construction such as a chimney, tower, steeple, parapets,

guardrails, stair enclosures, elevator or mechanical room;

aiv) the maximum building height shall be 19 metres (6-storeys) as shown on

Schedule "E- 1601 " and shall be measured from the average grade elevation along

the Islington Avenue frontage;

av) the mechanical penthouse room above the 6-storey portion of the building shall

not exceed 6 m in height and shall be used for mechanical equipment and

elevator areas. No residential units or any other use shall be permitted above

the 6th floor. avi) the maximum Floor Space Index shall be 2.5 times the area of the lot; avii) the minimum lot area per unit shall be 35 m2 per unit based on lot area of

2,641 m2. The Lands zoned OS1 Open Space Conservation Zone shall be

excluded from the calculation of lot area.

bi) the minimum parking requirement shall be 1 parking space per dwelling unit;

bii) the minimum visitor parking requirement shall be 0.25 parking spaces per

dwelling unit;

ci) the minimum amount of combined indoor and outdoor amenity area to be

provided shall be a total of 160 m2;

116 di) the following uses shall be permitted in the RA3 Apartment Residential Zone:

• An apartment building with a maximum building height of 6 storeys (19

metres) exclusive of the rooftop mechanical room/penthouse and

containing a maximum of 74 residential dwelling units distributed over 6

residential storeys shall only be permitted on Part “A” as shown on

Schedule “E-1601“. No residential unit shall be permitted above the

6th floor/storey and the rooftop mechanical/penthouse room shall only

be used for mechanical purposes.

• A driveway access and underground parking structure shall only be

permitted on Part “B” of the Subject Lands.

• No habitable areas of the residential development are permitted within

the Flood Plain Limits/Special Policy Area Limits identified as Part “B”

on Schedule “E-1601“.

• Lands zoned OS1 Open Conservation Zone, identified as Part “C’ on

Schedule “E- 1601“, shall be conveyed into public ownership, and used

for open spaces purposes only.

ei) the minimum required setback below the finished grade shall be 0 m including

any portion of the parking garage.”,

SECTION 37

2. Pursuant to Section 37 of the Planning Act, the height and density of development otherwise

permitted by this By-law Exception are permitted on the lands shown on Schedule “E-1601“

attached hereto as Schedule “2” subject to compliance with the conditions set out in this By-law

Exception and in return for the provision of the following facilities, services, and matters:

a. A requirement that the owner of the Subject Lands make a cash contribution in the

amount of $900,000.00, for the increase in maximum permitted Height and Density,

to the City of Vaughan payable prior to the issuance of the first above-grade building

permit in respect of the zoning by-law amendment for the Subject Lands, such funds

to be used by the City of Vaughan for Park and Multi-Use trail improvements for the

community Avenue;

b. The provision of the facilities, services, and matters set out above shall be secured

in an agreement or agreements pursuant to Section 37(3) of the Planning Act in a

form satisfactory to the City Solicitor. The financial contribution referred to in Section

(a) above shall be indexed upwardly in accordance with the Statistics Canada Non-

Residential or Apartment-Building-Construction Price Index for York Region,

calculated from the date of the Section 37 Agreement to the date the payment is

made and such agreement or agreements shall be registered on title to the Subject

Lands to the satisfaction of the City Solicitor pursuant to Section 37(4) of the

Planning Act. 3

117 c. Upon execution and registration of an agreement or agreements pursuant to Section

37 of the Planning Act securing the provision of the facilities, services, and matters

set out above, the Subject Lands are subject to the provisions of this Exception,

provided that in the event the said agreement(s) require the provision of a facility,

service, or matter as a precondition to the issuance of a building permit, the owner

of the Subject Lands may not erect or use such building until such requirement has

been satisfied. f) Adding Schedule “E-1601 “ attached hereto as Schedule “2”; g) Deleting Key Map 7B and substituting therefore the Key Plan 7B, attached hereto as

Schedule “3”. h) Schedules “1”, “2” and “3” shall be and hereby form part of this By-law.

The subject lands to this by-law are located on the east side of Islington Avenue, north of Willis Street, being Lots 7, and 8, on Registered Plan 65M-1117, and are municipally known as 8265 Islington Avenue in the City of Vaughan.

The purpose of this by-law is to rezone the subject lands from R2 Residential Zone and OS1 Open Space Conservation Zone to RA3(H) Apartment Residential Zone with the Holding Symbol “(H)” and OS1 Open Space Conservation Zone with site-specific zoning exceptions to permit the development of a 6-storey residential apartment building containing 74 residential dwelling units. The development will provide for a total of 93 parking spaces located within 3 levels of underground parking. The proposed development will have a maximum building height of 6-storeys (19 meters) (exclusive of the rooftop mechanical room) and all residential units will be located within the 6-storeys, no residential dwelling units or amenity areas shall be permitted above the 6th-storey.
