In the previous installment in this series, Agatha Raisin has been making steady progress at moving past her obsession with James Lacey, and is really coming into her own as a mature woman. Measures considered under suspension of the rules are not subject to floor amendments, and few amendments are proposed to bills and resolutions considered in the House or in the House as in Committee of the Whole. The House’s procedures recognize distinctions between first- and second-degree amendments, between perfecting and substitute amendments, and among amendments in the forms of motions to strike, to insert, and to strike out and insert. An amendment in the nature of a substitute proposes to replace the entire text of a bill or resolution. All amendments must be germane to the text they would amend, and they are subject to other general prohibitions such as that against proposing only to re-amend language that has already been fully amended. SB 289 would enact the Frontline Service Pay Act. The bill would establish the COVID- 19 Frontline Service Fund within the Department of Commerce. The bill specifies that during FY 2021 and FY 2022, the Director of the Budget would determine the amount of monies received by the state from the Federal Consolidated Appropriations Act, 2021, public law 116-260, and any other federal law that appropriates funding to Kansas for coronavirus relief aid that are identified as funds that may be expended at the discretion of the state. The Director of the Budget would certify the amount to the Director of Accounts and Reports. If the amount certified is greater than $50.0 million, the Director of Accounts and Reports would transfer $50.0 million of that amount from the identified federal funds to the COVID-19 Frontline Service Fund. The transferred funds would be distributed to eligible employers as determined by the Department of Commerce. Upon receipt of the certification, the Governor may determine an additional amount of monies greater than $50.0 million received by the state from the Federal Consolidated Appropriations Act, 2021, public law 116-260, and any other federal law that appropriates funding to Kansas for coronavirus relief aid that are identified as funds that may be expended at the discretion of the state to be transferred to the COVID-19 Frontline Service Fund.

Committee amendments are considered first; then Senators can offer amendments to any part of the bill, generally, in any order. Senators may debate each amendment without limit unless the Senate (1) agrees to a motion to table (kill) the amendment, (2) agrees to a unanimous consent request to limit debate on the amendment, or (3) invokes cloture, limiting debate on the amendment or on the bill and all amendments to it. There are several different types of amendments. A first-degree amendment proposes to change the text of the bill; a second-degree amendment proposes to change the text of a first-degree amendment that the Senate is considering. Third-degree amendments are not allowed. An amendment may propose to strike out language from a bill (or a first-degree amendment), insert new language, or replace language by striking out and inserting. In general, an amendment that proposes to replace the entire text of a bill is known as an amendment in the nature of a substitute; an amendment to replace the entire text of a first-degree amendment is known as a substitute amendment. An amendment, especially in the second degree, that makes some lesser change is known as a perfecting amendment. Depending on the kinds of amendments that Senators offer and the order in which they are recognized to offer their amendments, Senators can offer anywhere from three to 11 amendments before the Senate has to vote on any of them.

Analysis by the Legislative Reference Bureau The Advisory Committee on Immunization Practices (ACIP) is a committee of medical and public health professionals that are selected by the federal Department of Health and Human Services for the purpose of making recommendations on vaccines. If those ACIP recommendations are approved by the federal Centers for Disease Control and Prevention, they become the CDC recommendations for vaccination. ACIP has made recommendations on the vaccine against the SARS-CoV-2 coronavirus, which causes COVID-19, including recommendations on vaccine allocation among prioritized groups. Each state creates its own vaccine allocation plan. This bill requires the Department of Health Services to include in the highest level of priority for SARS-CoV-2 vaccine individuals aged 60 or older. DHS is also required to allow a vaccinator to administer the vaccine to the next level of prioritization based on either the ACIP recommendations or recommendations issued by DHS if the demand on the vaccinator for vaccine has been met at the current prioritization level. For purposes of prioritization, the bill defines who DHS and vaccinators must consider frontline essential workers. Certain pharmacies are part of the federal Pharmacy Partnership for Long-Term
