CONSTRUCTION PROGRESS REPORT NO. 3 Elmworth Section Reporting Period – January 1 to 15, 2021

1.0 REPORT OVERVIEW The Elmworth Section consists of approximately 47 km of 1,219 mm (NPS 48) outside diameter (OD) pipeline, a mainline block valve and associated crossover assemblies. The Elmworth Section begins at NW 24-68-07 W6M and ends at SE 12-71-10 W6M. Section 58 construction activities commenced on December 9, 2020. No Section 52 construction activities have commenced.

This construction progress report (Report) complies with Condition 19 of Certificate GC-129 and Condition 17 of Order XG-001-2020 (as amended), which requires NGTL to report on the following: · information on the activities carried out during the reporting period, any environmental, socio-economic, safety and security issues and issues of non- compliance; and the measures undertaken for the resolution of each issue and non-compliance.

This Report discusses the construction activities for the Elmworth Section that occurred between January 1 to 15, 2021, (Reporting Period).

3.0 ENVIRONMENT

3.1 Environmental Issues

During clearing activities on January 7, 2021, within SW 11-70-8 W6M a feller-buncher brought down a large deciduous tree. After the tree was on the ground, the clearing crew inspected the area of the felled tree and found a deceased black bear lying next to the tree. Clearing activities were immediately shut down by the contractor undertaking the work and notified NGTL. Immediately after being notified, NGTL’s lead Environmental Inspector was dispatched to the site to confirm details of the incident. Alberta Environment and Parks (AEP) Land Use Officer, Senior Wildlife Biologist and Fish and Wildlife officer were informed about the incident on January 7, 2021. Post-incident evaluation by the Alberta Fish and Wildlife officer identified an entrance approximately 40 feet above ground to the hollow interior of the tree. The Wildlife officer concluded this hollow was being used as a den. NGTL conducted a bear den sweep through the area by a NGTL-contracted environmental consultant and Indigenous participants in advance of construction and in adherence to the appropriate methodology and did not identify a bear den in the relevant area. While the denning location is considered uncommon, future den survey crews will be requested to be vigilant for large over-mature trees, and signs of bear climbing and potential denning activity. NGTL notified the CER of the incident by

phone on January 12, 2021. NGTL also notified Aboriginal groups via email on January 12, 2021.

The Deep Valley North Section begins at SE 25-58-24 W5M and ends at W1/2 28-63-1 W6. Section 58 construction activities commenced on December 10, 2020. No Section 52 construction activities have commenced.
