A vehicle may be taken from a purchaser by the holder of the security interest in the vehicle or someone acting on the holder’s interest, if the purchaser defaults on the terms of the purchase agreement. To be recognized as valid for use tax purposes, the repossession must be regulated under the terms of the Uniform Commercial Code and there must be a valid lien on the title of the vehicle. To be recognized as valid for use tax purposes, repossession of a vehicle can be made by dealers, by financial institutions, and by individuals. The taxable result of repossession depends on the identity of the person doing the repossessing and the manner in which the person doing the repossessing conducts the transaction. 34.17(1) Licensed vehicle dealer. If a licensed vehicle dealer repossesses a vehicle and anticipates reselling the vehicle, then the dealer can use the dealer’s resale exemption, and no use tax is due at the time of the registration of the vehicle by the dealer. 34.17(2) Financial institution or private individual. A financial institution or a private individual may be a licensed dealer entitled to receive an exemption from use tax based on the dealer’s license when registering a repossessed vehicle. Repossessions of vehicles that will be resold by a financial institution or an individual that does not have a dealer’s license can be effectuated using a foreclosure affidavit. INTRODUCTION T HIS ARTICLE will discuss the repossession and foreclosure of an aircraft by a secured party in the context of Article 9 of the Uniform Commercial Code ("UCC"), and the applicable provisions of the Federal Aviation Act' (the "Transportation Code"). This article will also analyze the standard Certificate of Repossession form adopted and formerly approved for use by the Federal Aviation Administration ("FAA"),2 and the latest re- vision of that form,' and some procedures commonly followed by creditors who repossess in the context of Article 9 of the UCC. II. JANUARY 10, 2013 What the new high-cost mortgage protections mean for consumers If a lender offers you a high-cost mortgage, where the annual percentage rate (APR) or points and fees charged exceed certain threshold amounts, the Home Ownership and Equity Protection Act (HOEPA) provides you with special consumer protections. Starting in January 2014, stronger protections will apply to these types of loans. For example, before making a loan, your lender must: • Provide you with information in advance that explains you are getting a high-cost mortgage, and stating the terms, costs and fees associated with the loan. • Certify that you have received homeownership counseling about the particular high-cost mortgage the lender is offering you. These special protections apply to any of the following types of mortgages that also meet HOEPA’s coverage thresholds: • The first mortgage to buy your home • A loan to refinance the mortgage on your home • A home equity loan or home equity line of credit (HELOC) What’s a high-cost mortgage? You’ll get additional consumer protections if your loan is: • For a first mortgage, and your APR is more than 6.5 percentage points higher than the average prime offer rate, which is an estimate of the rate people with good credit typically pay for a similar first mortgage. • For less than $50,000, is for a personal property dwelling (such as a manufactured home), and has an APR more than 8.5 percentage points higher than the average prime offer rate for a similar mortgage. • For a second, or junior mortgage, and your APR is more than 8.5 percentage points higher than the average prime offer rate for a similar second mortgage. -

HELOCs and Foreclosure The Basics LAF What is a HELOC? • Home equity line of credit • Revolving credit that is secured by the borrower’s property. • Lender allows the borrower to draw from the funds whenever he chooses. • High limits with low-interest rates. HELOC Home Equity Loan • Line of credit • Repayment period and/or balloon payment • Fixed amount • Possibly interest only payments, or negative • Fixed interest rate amortization • Fully amortized • Lower up front costs • Flexibility of funds available • Higher up front • Promissory note costs • Promissory note Subordinance and Recourse • Normally Subordinate to primary home loans. This means that the HELOC lender has claim to any money generated by a foreclosure, only after the primary mortgage lender recoups their full loss. • Almost all HELOCs are considered “recourse loans.” The borrower is personally responsible for paying recourse loans in full, regardless of their property’s value. If the lender doesn’t recoup the full cost of the HELOC during foreclosure, they can sue the borrower for the remaining money owed. Draw Period • Span of 5-10 years during which the borrower can withdraw money whenever he chooses. • Borrower will be given a checkbook or a special credit card to use for withdrawals. • Like a credit card, when money is taken out, the borrower will receive a monthly bill and must make a minimum payment (sometimes interest- only). When no money is withdrawn, the borrower will not be charged. Reset • Many HELOCS have the option for a lower payment term for the first ten to twenty years. • Reset, in most instances to fully amortizing loans. -

Main/Box 214 Clarion, Iowa 50525 Dear Mr. Hicks: Attached is the Comprehensive Housing Needs Analysis for Wright County, Iowa conducted by Maxfield Research Inc. The study projects housing demand from 2014 through 2025, and gives recommendations on the amount and type of housing that could be built in Wright County to satisfy demand from current and future residents over the next decade. The study identifies a potential demand for about 904 new housing units through 2025. De‐ mand was divided between general‐occupancy housing (39%) and age‐restricted senior housing (61%). Our inventory of general‐occupancy rental housing found no vacancies among the inventoried rental housing stock. The low vacancy rate indicates pent‐up demand for additional rental units in Wright County. Although new residential lots will be needed over the next ten years, the current lot supply in most Wright County communities is sufficient to meet demand in the short‐term. Detailed information regarding recommended housing concepts can be found in the Conclusions and Recommendations section at the end of the report.
