Appendix F Commercial and Industrial APPENDIX F COMMERCIAL AND INDUSTRIAL AF-1 Commercial/Industrial BMP Handouts AF-2 AF-3 AF-4 AF-5 Letter Sent to Industrial Facilities AF-6 AF-7 Notification Letter Sent to Businesses CITY OF SALINAS Environmental & Maintenance Services Department • 426 Work Street • Salinas, California 93901 • (831) 758-7233 IMPORTANT NOTICE DO NOT DISCARD NPDES Storm Water Inspection Fees Important Information Date or Current Owner/Operator Address/P.O. Box No. Salinas, CA 93901 Introduction: To protect public health, safety and welfare, the City of Salinas conducts NPDES storm water inspections at all high-risk commercial and industrial businesses that might pose a risk to downstream receiving waters. Your business has been identified as a participant in the annual NPDES Storm Water Inspection Program and is inspected annually for the ongoing Best Management Practices (BMP’s) that are being implemented at your facility to protect storm water quality. These inspections are required under the City’s NPDES Storm Water Permit with the Central Coast Regional Water Quality Control Board. BMP Implementation The City of Salinas has been directed by the Central Coast Regional Water Board to obtain, track and analyze parameter results reported by the industrial facilities within the Permit coverage area enrolled under the General Industrial Permit each year. The City is to obtain the data using the Stormwater Multiple Application and Report Tracking System (SMARTS) as well as by requesting information from the Central Coast Water Board any additional data submitted by enrollees in the General Industrial Permit. Facilities that maintain a General Industrial Permit were asked in March of 2014 to provide a copy of their most recent Annual report and current SWPPP for their facility. Several were submitted and the City of Salinas contracted with Brown and Caldwell to perform an analysis of the reports submitted. The City has been able to provide your facility with the results from the Brown and Caldwell Study. Inspections to Begin City inspectors are currently conducting annual NPDES storm water inspections at Commercial businesses. The inspection form to be used during your facility inspection is attached to assist you in determining your current compliance status in implementing BMP’s at your facility. If you have any questions regarding this notice, please feel free to call me at (831) 758-7921. No. 4] 14 GRANTING IN PART COSTCO WHOLESALE CORPORATION DEFENDANTS’ MOTION TO 15 et al., DISMISS 16 Defendants. [Doc. No. 3] 17 On October 28, 2011, Defendants Costco Wholesale Corporation and Keith Paget removed 18 this action from state court pursuant to 28 U.S.C. §§ 1331, 1441(b). Pending before the Court are 19 Defendants’ motion to dismiss and Plaintiff Francine Lomeli’s motion to remand. Fundamental to 20 the resolution of both motions is whether section 301 of the Labor Management Relations Act, 29 21 U.S.C. § 185, preempts Plaintiff’s state law claims. For the reasons set forth below, the Court 22 finds that section 301 preempts Plaintiff’s first claim for breach of the implied covenant of good 23 faith and fair dealing and DISMISSES the claim for failure to exhaust collective bargaining 24 grievance procedures. The Court exercises supplemental jurisdiction over Plaintiff’s claims for 25 false imprisonment and defamation and DISMISSES these claims as time-barred. Finally, the 26 Court declines to exercise supplemental jurisdiction over Plaintiff’s remaining claims for 27 intentional infliction of emotional distress and for violation of California Business and Professions 28 Code § 17200 and REMANDS these claims to the state court pursuant to 28 U.S.C.
