"While I sympathise with what happened to Rafizi. I hope I will not fall into the same situation," Muhyiddin said after spending two hours in Bukit Aman to record his statement. "This is because I do believe that when I speak in Parliament, I do have the right to speak and I do have immunity." He was asked if he was worried that he would end up like Rafizi, who was convicted and sentenced to 18 months' jail under the OSA for leaking Page 98 of the auditor-general's report on 1MDB. Muhyiddin is currently being investigated under Section 8 of the OSA and Section 4 of the Sedition Act for his budget debate on Oct 26, which touched on 1MDB. Meanwhile, Sepang MP Hanipa Maidin ( photo ) said there is nothing wrong for any parliamentarian in the Dewan Rakyat to touch on matters under the OSA. Hanipa said this is based on the fact that elected representatives are protected by parliamentary immunity, and as such they cannot be charged for speaking out in the House. He said action could only be taken against an MP who utters remarks deemed to be seditious. “The speech by Pagoh (Muhyiddin) has no seditious elements and if what he said had touched on any official secret under the Standing Orders, or on any official matter, (he) cannot be charged under the OSA.

    Mekanisme Pengawalan Bahasa Kurang Sopan (Unparliamentary Language) di dalam Dewan Rakyat: Perspektif Perundangan The Control Mechanism of Unparliamentary Language in the Dewan Rakyat: A Legal Perspective Idzuafi Hadi Kamilan* and Muthanna Saari** Abstrak Kekerapan insiden penggunaan bahasa kurang sopan di Parlimen merupakan cabaran besar dalam memastikan kelakuan tertib khususnya semasa perbahasan di dalam Parlimen. Pernyataan seksis, perkataan kesat, serangan peribadi termasuk pernyataan merendah-rendahkan orang (condescending) adalah dianggap sebagai bahasa kurang sopan dalam Parlimen yang tidak seharusnya mempunyai tempat dalam mana- mana badan perundangan. Penulisan ini menelusuri insiden penggunaan bahasa kurang sopan yang tidak berkesudahan di Dewan Rakyat, Parlimen Malaysia meskipun pelbagai peraturan dan Petua Speaker telah dibuat terhadap penggunaan bahasa sedemikian. Peraturan Mesyuarat 36(4) Peraturan-peraturan Majlis Mesyuarat Dewan Rakyat merupakan pengawal utama terhadap kesalahan menggunakan bahasa kesat dan pernyataan seksis di dalam Dewan Rakyat. Usaha untuk mendisiplinkan ahli Parlimen berkenaan penggunaan bahasa kurang sopan melalui pelbagai pendekatan perundangan sedia ada dipercayai sudah tidak berkesan. Oleh itu, penulisan ini menganalisis bagaimana bahasa kurang sopan dikawal di badan perundangan negara lain, seterusnya mencadangkan mekanisme pengawalan yang lebih baik dalam mentadbir ketidak tertiban penggunaan bahasa kurang sopan di Dewan Rakyat.
