20/086 To confirm the Minutes of the PARISH COUNCIL MEETING held on Monday 13 JULY 2020 The minutes were approved and recorded as a true and accurate record of the meeting.

20/087 R&BBC Mayor Rosemary Absolam Address Mayor of Reigate & Banstead Borough Council, Cllr Rosemary Absalom thanked the Parish Council for allowing her to attend the meeting. Her theme for the year is ‘Support others today and support tomorrow’ and she stated S&SPC were the very best example of demonstrating this. At the start of the Covid 19 pandemic, when there was an initial call out for volunteers, the Parish Council answered the request and went the extra mile. They arranged to have volunteers in place to look after vulnerable residents and initiated a grant funding scheme which generated an amazing £5,665 which was 41% of the overall financial donations made. This was all a wonderful testament to community support.

Cllr Absalom knew none of this would be possible without so many people’s help and support but she wanted to give special mention to a few including Cllr Caroline Clarke for distributing flyers, help setting up the foodbank and

1 August 2020 collecting prescriptions, residents Hazel Weaver, Alison Cass and Denise Knight for their help running the foodbank and Bob Barnes, who was one of the Sidlow representatives, who brought donations over week and maintained communications. Finally, a special thanks had to go to the Clerk, Claire Minter, who initiated and managed all the work during the pandemic from setting up the volunteers, foodbank liaising with R&BBC and providing reassurance to residents whilst keeping on top of the busy workload of Parish Council business.

Mayor Absalom thanked and congratulated everyone who had been involved to support her cause for the year.

20/088 Planning / Licence Applications A To review and agree responses to Planning / Licence Applications received July / August 2020 i. See attached Appendix B –July/ August 2020 Planning List with full commentary.

JB advised 5 of the 8 Councillors attended the Councillor surgery on Friday 7 August when all planning applications were reviewed. The Councillors agreed to respond to 6 planning applications with 1 object and 3, no objection with comment and 2 no observation. ii. Picketts Lane JB/WC and CM and two residents met with Nancy Astley (Enforcement Officer) and Andrew Benson (Head of Planning) to discuss Picketts Lane. Colin Smith was also in attendance. Picketts Lane is quite complicated with three cases/ appeals in play: - 1. Enforcement 2. Certificate of lawfulness 3. Planning application

R&BBC is waiting for the Inspectors decision on which cases will/ will not be heard as part of the Public Inquiry and depending which decision is made has an impact on the technical and legal aspects of what can / should be heard. The main material difference for S&SPC / residents to maintain with Rule 6 status is to ensure that residents views are put across properly and robustly. Residents and JB/WC understand that R&BBC have been very thorough with their approach and have lined up several expert witnesses so are unsure what benefit S&SPC/ Residents could bring to maintain the Rule 6 status.

Councillors agreed to relinquish Rule 6 status but to request to speak at the Public Inquiry in both resident and S&SPC capacity. iii. JB/WC and CM met with Andrew Benson to discuss RAL. Colin Smith was also in attendance

Redhill Aerodrome has submitted another planning application similar to 2016. As RAL have not paid the planning application fee R&BBC have not yet accepted it. However, TDC are processing it so S&SPC will respond accordingly – see planning above

The main difference between R&BBC Rule 6 statement and S&SPC/ NPC is

we have put more emphasis on the landscape character and the other harms

2 August 2020 to this. R&BBC have included it but with lesser impact and it falls within part of the GB harm.

Cllrs agreed to retain Rule 6 status until it is clear what is happening with the new planning application. It was also recommended to look to explore options to gain resident feedback on noise nuisance for those who are affected. SR had drafted a letter and Cllrs had provided feedback. SR would arrange for this to be printed with CM assistance for distribution. CC/ ML confirmed they would deliver the letters. iv. Horse Hill - UKOG The Appeal Judge, Lord Justice Lewison, granted Sarah Finch permission to apply for judicial review. He said that her argument that national planning policy isn't in line with EU law is important and should be considered at a full hearing and that her other climate grounds are arguable. This means it will be a full court hearing. This is likely to take place in October or November but she does not know yet if it will be in person or online.

Following the earlier hearings, she has narrowed down the issues she is challenging and are now focussing only on the climate-related grounds: The Council's failure to assess the indirect greenhouse gas impact of the use of the oil produced from this development, and its failure to properly consider up-to-date climate policies. The Appeal judge agreed that these grounds justify a public hearing. He also gave a helpful nod towards another ground concerning the lack of conformity of national planning policy with EU law. She is currently discussing an amendment to her fixed fee agreement with the legal team as they have had to do some work on the new ground – she is confident that she can raise the extra money.

Sarah has said she is very grateful to the Parish Council for our moral

support and our pledge of £5,000 to cover the County Council's legal costs

should she lose. She hopes not to have to draw on this but it has been

extremely reassuring to know the pledge was there.

On another matter, the CC Planning Committee's decision to refuse planning permission for oil and gas exploration at Dunsfold has now been ruled invalid following problems during the committee meeting, which was conducted online. The meeting was beset by technical problems with the live feed dropping out and one committee member not being able to be heard so communicating via chat. So, there will now be further training for councillors and the decision will be taken again - I hope that the Committee reaches the same decision. v. Route 4 Plane Wrong have abandoned their proposed legal action against the CAA.

CM had provided Case Officer reports as a lot of decisions opposed S&SPC original comment. JB had reviewed these in detail: - 20/01102, Woodside Way was for a first-floor side extension which was refused although this did not seem excessive and appeared to make the house similar to its attached neighbour. S&SPC made no observation.

20/00816, 12 Fairacres, was approved. The committee report says: - "We have been informed the building is not in the position shown on the plan, this is possibly to make the building look less obtrusive to the neighbours when considering the application. That said it is clearly visible from the Axes Lane and New House Lane as well as nearby residential properties." The officer did not mention this in his verbal presentation to the committee. It was explained that the land is Green Belt so requires very special circumstances if it is to be approved and, he said, these have been demonstrated. Only one Borough Cllr spoke on this saying the building is large and not where it is supposed to be but he would vote to grant the application. It was with 11 votes for and 3 abstentions.

Councillors discussed this and wondered if the possibility that permission that has been granted is for a building located as shown on the plan not where it now is. If so, does this mean the building should be moved?

CM was asked to contact R&BBC to clarify situation 20/00816, 12 Fairacres with building in incorrect location compared to plan which has been approved.

Another application which may be relevant to future thinking is 19/00211 to extend 2 Crossways Cottages, Note - not the same as the application to amend this application). The application to extend the cottage was refused by R&BBC on the grounds that it would constitute disproportionate additions above and beyond the original building. The extension and proposed driveway ground works, would harm the openness of the Green Belt and constitute an inappropriate form of development for which there were no very special circumstances that would outweigh the harm. This was appealed and the inspector said the Council rule of thumb to allow extensions in the Green Belt to increase the floor space or building volume by up to approximately one third (a 30 - 40%) increase as a percentage of the original floor area/volume was neither in the NPPF nor the Borough development plan policies. He also said he could not see why an increase of 57% should, in itself, necessarily be considered to constitute an increase of such an extent as to be disproportionate. He also doubted the Borough calculation that the increase would be 57%. The appeal was allowed and permission granted. This may be relevant to 20/00952, Sidlow Nurseries, which was refused for similar reasons although the increase was calculated at more than double the footprint if they decide to appeal.

Action ▪ CM to contact R&BBC about Fairacres 20/00816/RET to confirm if the barn needs to be moved and how a decision can be made with a building CM placed in the wrong position.

4 August 2020 20/089 Meeting Reports The following meetings had been attended: - - 11/7/20 - Local Partnership Board – WC/ CM - 16/7/20 – CAGNE Meeting - JB - 28/7/20 – APCAG Meeting - JB

A Local Partnership Board High level meeting with various different organisations led by Tim Oliver and Mark Brunt – social and healthcare involvement to discuss impact of Covid 19 and how partnerships can work together.

B CAGNE Parish Council Forum JB has circulated notes. Points to note is whether S&SPC want to make a financial donation to CAGNE Parish Council forum for support of website and remote meetings.

The secretary re-iterated that the Forum is run by councillors for council and

operates under the council’s code of conduct. The Forum is separate from

the CAGNE lobbying group.

Guest Speaker was Tim Johnson Director of Aviation Environmental Federation (AEF) - Committee on Climate Change update and environmental issues in relation to aviation.

AEF – the national airspace modernisation plan needs to be underpinned by

a long-term traffic forecasts and a master plan of the changes required.

Without it, communities won’t understand the national context for airspace

changes proposed by airports. To date, responsibility to produce a master

plan has been passed down the line from the Department for Transport to

Civil Aviation Authority, and currently rests with NATS overseen by ACOG.

ACOG (the Airspace Change Organising Committee) the government/industry body set up to ensure the modernisation of airspace is delivered, has seen little progress during lockdown due to lack of funding as funded by industry. ACOG may approach government to ask for funding (use public funds) to move ahead. Please see link below to the ACOG report released after the meeting. If public money is used for ACOG, there should be a public benefit: noise and environmental concerns should receive a higher priority in the airspace change process.

New forecasts are expected from the international aviation body ICAO.

Industry predicts it will be a 4-year recovery, some being more positive with

an end of 2021 forecast for a return to pre-Covid levels.

Most companies, including the UN ICAO, have moved all their meetings to video conferencing platforms and these have been successful. Many are questioning themselves if they need to fly in the future. Although business travel accounts for only 10% of UK air passengers, they contribute 50-70% of airline profits so this could have fundamental implications for the way the industry is structured, and ticket prices for leisure travel.

Government has set up a Restart and Recovery group which, in its second phase, will address how the industry can become greener. While some airlines have benefitted from Bank of loans at commercial rates, the UK government has been reluctant to bail out. The recently announced Jet Zero Council is expected to engage in new forms of powering flight, like electric and hydrogen, as well as the production of biofuels for aviation.

The Aviation Strategy white paper continues to be delayed and may be

replaced with a ‘light’ policy document in the autumn. So far, Government

has not responded to the Committee on Climate Change’s (CCC)

5 August 2020 recommendations on aviation and net zero emissions. There is no strong policy direction coming from the government which is disappointing. CCC June report details ‘gaps in the policies’ to get to net zero, including for aviation, and how to encourage a green recovery. It calls for the government to set milestones for green fuels, and to divert supply of these fuels from road to aviation. The CCC also recommend managing demand for aviation, either through price or by reviewing airport capacity decisions, to get this sector to net zero.

Since 1990, aviation emissions have grown by 124% aviation, peaking at

39MTonnes in 2018. [CCC report says 36.7Mt from international flights,

1.5Mt from domestic and 1.1Mt from military]. The Government’s target

currently ignores international emissions from aviation, so there needs to be

a legal way to lock the industry into reducing all its emissions, not just those

from domestic flights. The CCC also recommends a household and business

survey to ascertain public attitudes – do we see the consumer perception of

flying changing and thus the government forecasts are out of date? Contrails

– white cloud from aircraft above 20,000ft – also contribute to heating up of

the planet but are not addressed by policy.

MB thanked JB for attending this meeting and taking the time to follow up on the CAGNE information on Route 4 and clarifying the S&SPC situation.

Councillors agreed to make a £4 donation to CAGNE

APCAG Meeting C APCAG website shows their aim is: - “To seek to protect the people in the

APCAG member Councils’ Parishes and others from unacceptable noise

from aircraft movement and, by working with other stakeholders, to manage

the effect of all changes to aircraft movements affecting these areas.” “We

want a constructive engagement with . . . crucially one that

protects those who live close to the airport.” They also want fair and

equitable distribution but say “We acknowledge that this policy is counter to

current government policy that states the fewest number should be affected.”

There were 5 Parish Councils present with reps from PAGNE and GACC,

APCAG full members pay £100, associates (most including SSPC) pay nothing. It seems there are only two full members. APCAG have about £300 with much of the expense going on website upkeep.

The Chairman provided his report which mainly covered the NMB (Noise Management Board). The new structure of Community Forum and Executive Board has been created. The Community Forum met in February and Covid 19 has meant no other meetings of either group.

JB asked if they thought the new 2-layer NMB structure would work and it is hoped it would mean better representation. The Chairman said the original NMB, with 28 members, was too big to be effective.

JB explained SSPC is under the Route 4 NPR for most of its straight section. Attendees knew nothing of the exchange between SSPC and CAGNE so all correspondence would be circulated to all.

APCAG have written to Stewart Wingate, chief executive of Gatwick Airport, who has said he is pressing ahead with growth on the main runway and seeking planning permission for a second one using the moved emergency runway. APCAG say Gatwick growth should be better not just bigger.

Action ▪ CM to make £4 donation to CAGNE CM

6 August 2020 20/090 Covid 19 Update CM advised Foodbank donations have dwindled within the last few weeks with approximately 5 to 7 deliveries a day. CM has arranged for residents to volunteer and run some of the morning sessions so she could work from home. Council noted this and thanked the various volunteers.

No one has requested the free masks and hand gel packs.

The final and fourth payment of £1,000 has been made to R&BBC. R&BBC has received £13,327 financial donations from individuals and organisations. SSPC has made 42% of total donations of £5,065 with Gift Aid to be added.

Hall re-opening CM advised she had started to review and prepare the risk assessments for the hall re-opening. Hall users are keen to return.

CM has ordered various signs including reminders for hand washing, social distance, exit and entrance only and one-way systems. Total cost £78.23 inc VAT. May need to be ordered. She has ordered bacterial sprays and wipes for hall users

CM is working on the various policies, protocols and risk assessments but based on her knowledge she recommends the hall can re-open if the policies are adhered to. CC will be working with CM on all H&S aspects.

CM needs to arrange for additional cleaning as the existing Contractor is

unable to attend on a more regular basis. CM was authorised to arrange this

in agreement with CC and WC.

Councillors agreed to re-open the hall once the Clerk has arranged for all policies, procedures and cleaning are in place and agreed with WC and CC.

S&SPC has a duty as an Employer to keep their Employees safe so it was agreed CM would potentially work from home when the hall is re-opened.

Councillors approved to delegate authority to CM with Chairman and CC guidance to make ongoing decisions in emergency situations if hall to be closed suddenly due to local outbreak, change in Government Guidelines, positive case at the village hall.

CM advised she had arranged for the main hall floor to be re-sealed – see Clerk update below.

20/091 Financial Matters – Parish Council and Village Hall A List of cheques/DD for S&SPC and the Village Hall for July 2020 were noted and approved

C External Audit CM advised PfK Little John (External Auditors) have approved the Annual

7 August 2020 Governance and Accountability Return (AGAR) with their report stating: - ‘On the basis of our review of Sections 1 and 2 of the Annual Governance and Accountability Return (AGAR), in our opinion the information in Sections 1 and 2 of the AGAR is in accordance with Proper Practices and no other matters have come to our attention giving cause for concern that relevant legislation and regulatory requirements have not been met.’

CM has prepared a Notice of Conclusion of Audit which details the rights of inspection, in line with the statutory requirements. She has published the “Notice” on the noticeboard and needs to upload the certified AGAR on the website. Residents can purchase copies of the AGAR, which must be available for 5 years, if they would like a copy.

Councillors noted the update.

CM highlighted the fact of various road closures and works including re- surfacing of A217 and that the southbound A217 at Reigate Hill will be closed from 7/9/20 for approximately 14 weeks.

8 August 2020 20/093 Clerk Report and Matters Arising See Appendices C and D for updates which were noted by Council.

A Litter Pick CC and CM propose to hold a socially distanced litter pick on Saturday 5 September – 10am to 12pm. Councillors agreed to this. CM will prepare risk assessment including review of Covid 19.

B Tree Planting Trees will be arriving September 2020 and November 2020. CM needs to arrange for a Contractor to plant the 5 large trees we are receiving. Locations still to be identified and agreed. A few residents have confirmed they want to be involved with the Tree Planting Day in November. Cubic also confirmed they wanted to be. Preparations need to be underway to arrange this.

Village Hall Lease C The hall lease has been renewed and signed with a new 50-year lease starting 30 July 2020. The agreed ground rent is £3,000 per annum to be paid quarterly in advance for the first 10 years of the term and then reviewed. A gentleman’s agreement for use of the church car park by hall hirers has been agreed,

D Village Hall Floor CM has arranged for the main hall floor to be re-sealed at a cost of £586.74 from 14 to 16 August.
