Edible Plagiarism: Reconsidering Recipe Copyright in the Digital Age ABSTRACT Sharing recipes through food blogs is an increasingly popular activity. Bloggers publish their own recipes, claiming copyright protection, but they also publish others' recipes. Food publishers who distribute recipes online may be harmed when bloggers include the entire text of the food publisher's recipe on a blog without the publisher's knowledge or permission. The blogger's inclusion of an entire recipe often reduces site traffic to the food publisher's website, thereby damaging advertising revenues. Copyright law, as courts interpret it today, does not provide these publishers with recourse against bloggers who publish their recipes without permission. This Note analyzes the various issues related to the copyrightability of recipes, beginning with the current rule on copyright protection for recipes. -

Streams of Manhattan residents and workers flow along Broadway in Date the East Tribeca neighborhood, huddled against a bitter February wind, umbrellas fighting for sidewalk space. At the corner of Broadway and Worth, though, warm light illuminates the dreary morning, pouring from floor-to-ceiling glass windows. Through sheer windowpanes, passersby can see into an open two-story space decorated with green panels, slatted wood, and terracotta tiles. They can see a neatly organized menuboard hanging above a narrow, rectangular window that offers a peek into a kitchen. They can see a make line that has become emblematic of the fast casuals lining so many U.S. city streets. On this particular weekday morning, the restaurant is closed—a pesky permitting issue that’s quickly resolved—but that doesn’t stop several shivering New Yorkers from trying to duck into the space. Those who pull open the one unlocked door are politely turned away. Others gape in the windows. No doubt some of the gapers study the man who hovers near the front door. He wears a corduroy blazer and a gray beard. One sharply dressed 20-something who makes it into the restaurant, oblivious to requests to please come back later, sees the bearded man and, as if they were due to meet, strides up, extends his hand, and introduces himself. “Hi,” the bearded man replies. “I’m Tom.” The 20-something is quiet a second, reflective. -

Mr. Kerry Heffernan Biography Born in Pennsylvania and raised in Connecticut, Kerry Heffernan began working in restaurants at age 15. Following high school, Kerry bicycled through Europe, eventually setting up camp in the South of France baking croissants. He returned home to attend the Culinary Institute of America, graduating second in his class. After spending another year cooking and traveling throughout Europe, Kerry came back to New York City, honing his skills at such highly regarded restaurants as Montrachet, Le Régence, Restaurant Bouley and Mondrian with Tom Colicchio before landing his first job as Chef de Cuisine at One Fifth Avenue. Kerry later became the Executive Chef of the Westbury Hotel's famed Polo Restaurant, training ground of such extraordinary talents as Thomas Keller and Daniel Boulud. Soon afterward Kerry opened Union Square Hospitality Group's Eleven Madison Park as Executive Chef and eventually became partner. Under his leadership, the restaurant received numerous accolades, including a tie with Per Se on Zagat Survey's "Top 20 Most Popular Restaurants in New York," The James Beard Foundation's Award for Outstanding Service in America, and Esquire Magazine's "Best New Restaurant." Kerry is currently Chef at Grand Banks, a seasonal Oyster Bar and galley on the deck of a historic cod fishing schooner moored at Pier 25 New York. He previously spent a five-year tenure as Executive Chef of New York City's South Gate, and created the restaurant at "15 CPW," a private restaurant at Manhattan's toniest address. Kerry remains active outside the kitchen in philanthropy, serving on the City Harvest Food Council and cooking for Share Our Strength, Project by Project, and both the Central Park and Madison Square Park Conservancies and as an advisor to several nonprofit agencies charged with seafood sustainability and conservation. -
