According to standard practice, the Board wrote to the Alberta Energy and Utilities Board (AEUB) asking whether the matters included in these Notices of Appeal had been the subject of a review or hearing under the AEUB’s legislation. The AEUB advised the Board that it had held a hearing in relation to the Shell Scotford Chemical Plant. In response to this, the Board asked for submissions from Mr. Dzurny, Mr. Procyk, Shell Canada, and Alberta Environment as to whether the matters included in the Notices of Appeal had been the subject of a review or hearing under the AEUB’s legislation. Upon reviewing the documents provided by the AEUB and the submissions from the Parties to these appeals, the Board has concluded that the matters included in the Notices of Appeal were previously dealt with by the AEUB.

    CN Railway Derailments, Other Accidents and Incidents Prepared by Railroaded – Updated Oct 25, 2013 (This is a small sample of the thousands of CN derailments, spills, fires and other accidents. Past CN employees indicate that CN intentionally does not report many derailments.) Oct 19, 2013. Gainford, Alberta. A 134-car CN train carrying crude oil and liquefied petroleum gas (propane) derailed about 90 km west of Edmonton, causing explosions and a massive fire. 9 of the 13 derailed tank cars were carrying propane and 4 carried crude oil. 1 of the cars carrying propane exploded and 3 others also caught fire. The amount of petroleum product spilled and the extent of environmental and property damages were not disclosed. A state of emergency was ordered for the entire area. All 100 Gainford residents and another 25 people living within 2 km of the derailment site were evacuated for 4 days due to the fear of additional explosions, fires and noxious fumes. The intensity of the fire was so severe, firefighters were forced to let the fire burn itself out, which took 4 days. The main east-west highway (Yellowhead No. 16) and the main east-west rail line (Trans-Continental) through western Canada were closed for 5 days. One of the derailed tank cars was leaning and sinking. Anhydrous ammonia is a dangerous good. In the absence of receiving any information from CN, Sexsmith fire resources ordered an evacuation of about 150 homes.
