Antiquated Procedures or Bedrock Rights?: A Response to Professors Meares and Kahan Albert W. Alschulert and Stephen J. Schulhofertt Over the opposition of most of the African American Alder- men who voted on the issue,' the Chicago City Council enacted an "anti-gang" loitering ordinance in 1992.2 In subsequent litigation, the Illinois Appellate Court and the Illinois Supreme Court both ruled unanimously that the ordinance's sweeping, ill-defined terms rendered it void for vagueness.' The United States Su- preme Court now has granted certiorari to review the Illinois Su- preme Court's decision invalidating the ordinance.4 Tracey Meares and Dan Kahan contend that the ordinance is sufficiently clear and that the Illinois courts should have deferred to the judgments that prevailed in the political arena.5 They say that "residents of poor, minority neighborhoods favor Chicago's gang loitering ordinance,"6 and they excoriate judges for "[i]gnoring the reality of this support."7 Yet they never offer any evidence to justify their frequently repeated claim that this "re- ality" exists.8 The truth is that the anti-loitering ordinance was t Wilson-Dickinson Professor of Law and Arnold and Frieda Shure Scholar, Univer- sity of Chicago Law School. Similar flaws affect Meares and Kahan's account of the de- terminative legal issues. They simply do not discuss the serious defects that led the Illinois courts to hold the ordinance unconsti- tutional. The case they build for the ordinance seems plausible only because their discussion omits many crucial facts. On virtu- ally every essential point, the picture they paint is incorrect or seriously misleading. In Part I of this article, we describe the origins of the Chicago ordinance and African American opposition to it. In Part II, we address Meares and Kahan's bold but unsupported and unsup- portable claim that minority interests were adequately protected by the political process. In Part Ill, we discuss the ordinance it- self and the vague provisions that led the Illinois courts to hold the law invalid under the due process clause. Like Meares and Kahan, we believe that there are larger is- sues in this debate, and we turn to those issues in Part IV. The most important of these issues is not, as they claim, the need for an "updated conception of rights."" It is instead the need for citi- zens and courts to be on guard against the appealing but highly manipulable rhetoric of "community," a rhetoric that is increas- ingly prevalent in contemporary discourse. It is easy to appreci- ate the attractions of a sense of place, shared values, and neigh- borhood empowerment - the aspirations that communitarian arguments compellingly evoke. But before we agree with Meares and Kahan "not to second guess the [inner-city] community's de- termination that [anti-loitering] measures enhance rather than detract from liberty,"" we must, at a minimum, be sure that this "community" exists and that it holds the views attributed to it. Each of these claims rests on nothing more than the authors' unsupported opinions, and there is a large body of readily available evidence to the contrary. Id at 210. 215] BEDROCK RIGRTS 217 responsible treatment of the issues demands research and careful discussion, not beguiling nostrums and rosy but unexamined as- sumptions. Meares and Kahan's analysis of the Chicago anti- loitering ordinance demonstrates the dangers of their approach. Far from serving the needs of the disadvantaged, the concept of community can, in the wrong hands, become another weapon for perpetuating the disempowerment and discrimination that con- tinue to haunt urban America. I. THE POLITICAL ANATOMY OF CHICAGO'S ANTI-LOITERING ORDINANCE Concerned by the increasing presence of gangs like the "Spanish Cobras" in their neighborhoods, the Northwest Neigh- borhood Federation, a community group based in a predomi- nantly white section of Chicago, formed an Anti-Gang Task Force. Starting in early 1991, the group spent over a year re- searching and negotiating with city officials about anti-gang leg- islation.12 Two northwest side Council members, Aldermen Bi- alczak and Banks, "worked hand-in-hand with [the Federation's] research committee to develop [the] ordinance" proposed to the City Council. 3 Their wards, the 30th and 36th, were respectively 78 percent and 85 percent white. 4 In an effort to portray the anti-loitering ordinance as a measure welcomed by minority communities, Meares and Kahan assert that the ordinance originated with Chicago's African American residents. They write, "In response to voluminous citi- zen complaints ... Alderman William Beavers, the representa- tive of a predominantly black ward... sought to introduce [the] ordinance... in 1992."" This account is inaccurate. Beavers, as chair of the relevant City Council committee, forwarded the draft ordinance to the full Council after his committee held hearings on it in the spring of 1992. The proposal had been introduced six months earlier, mainly by white Aldermen with the support of the mayor and his administration. As reported by the Chicago Tribune, the "measure [was] first proposed by Alderman William Banks (36th) [who is white] last 12 Chicago City Council Committee of Police and Fire, Transcript of Proceedings 30- 32 (May 18, 1992). "16 Another Tribune news story provided additional detail: The proposed [anti-loitering ordinance and a proposed cur- few ordinance] were submitted to the City Council by four pro-[Daley] administration aldermen: Michael Wojcik (35th), William Banks (36th), and Carole Bialczak (30th), all from the [predominantly white] Northwest Side, and Lemuel Austin (34th) [a Black alderman] of the Far South Side .... Wojcik... drew up the two draft ordinances with the help of the [predominantly white] Northwest Neighborhood Federation community organization and the city law department.... 1 A later Tribune account described the ordinance as "drawn up by several white aldermen and enthusiastically endorsed by Mayor Richard Daley.""5 In sum, white Aldermen and their con- stituents took the lead in initiating the anti-loitering proposal, with strong backing and drafting assistance from the Daley ad- ministration. Once proposed, the ordinance drew support from some mi- nority residents, many of them frustrated by the lack of adequate police protection in their neighborhoods. 9 Meares and Kahan stress minority-group support for the anti-loitering ordinance and make no mention of African American opposition to it.

THR spoke with Schiller — who went on to become an Emmy-winning producer (The Executioner's Song) and writer and is currently president of the Norman Mailer Center in Provincetown, Mass — about Monroe's calculated bid for publicity, her final days and how celebrity skin scandals have evolved from nude shots that seem demure today to all-out porn tapes. Next spring, Taschen will publish a book of Schiller's photographs of Monroe that will include a 25,000-word memoir of his time with the star.

    Songs of the Century T. Austin Graham hat is the time, the season, the historical context of a popular song? When is it most present in the world, best able Wto reflect, participate in, or construct some larger social reality? This essay will consider a few possible answers, exploring the ways that a song can exist in something as brief as a passing moment and as broad as a century. It will also suggest that when we hear those songs whose times have been the longest, we might not be hearing “songs” at all. Most people are likely to have an intuitive sense for how a song can contract and swell in history, suited to a certain context but capable of finding any number of others. Consider, for example, the various uses to which Joan Didion is able to put music in her generation-defining essay “Slouching Towards Bethlehem,” a meditation on drifting youth and looming apocalypse in the days of the Haight-Ashbury counterculture. Songs create a powerful sense of time and place throughout the piece, with Didion nodding to the Grateful Dead, Jefferson Airplane, Quick- silver Messenger Service, and “No Milk Today” by Herman’s Hermits, “a song I heard every morning in the cold late spring of 1967 on KRFC, the Flower Power Station, San Francisco.”1 But the music that speaks most directly and reverberates most widely in the essay is “For What It’s Worth,” the Buffalo Springfield single whose chiming guitar fifths and famous chorus—“Stop, hey, what’s that sound / Everybody look what’s going down”—make it instantly recognizable nearly five decades later.2 To listen to “For What It’s Worth” on Didion’s pages is to hear a song that exists in many registers and seems able to suffuse everything, from a snatch of conversation, to a set of political convictions, to nothing less than “The ’60s” itself.

    Geological Society of Maine 2016 Summer Field Trip Bedrock and surficial geology in the greater Belfast-Brooks area, south-central Maine David P. West, Jr. Middlebury College Woodrow B. Thompson Maine Geological Survey Roger LeB. Hooke University of Maine Stephen Pollock University of Southern Maine Field Trip Objective On this field trip we will highlight prominent bedrock and surficial features in the general area between Belfast and Brooks, Maine. Many of the individual stops visited will allow for observations of features related to both the bedrock geologic history (hundreds of millions of years old), and the much more recent glacial history (tens of thousands of years old). The bedrock portion of the trip will provide opportunities to observe representative units within four major tectonic terranes that are juxtaposed in this region (St. Croix, Fredericton, Passagassawakeag, and Casco Bay belts). Additionally, aspects of the deformation, metamorphic, and plutonic history of the region will be examined. Finally, a spectacular traverse across the high strain portion of the regionally extensive Norumbega fault system will reveal a wide variety of fault rocks (e.g., mylonite, cataclasite, pseudotachylyte), and demonstrate a complex history of superimposed faulting. The glacial portion of the trip will include localities showing impressive glacial grooves revealing ice flow directions, erratic boulders eroded from till, a new glaciomarine delta exposure, and an esker pit. Additionally there will be stops that “ground-truth” the new stunning Lidar imagery in the area that has provided evidence of widespread removal of upland till by subglacial meltwater streams which, near the glacier margin, are associated with esker nets.
