Hourly or day-rated employees

For those employees who are paid on an hourly or day rated basis and have been employed for a full twelve months prior to the claim, average monthly earnings before tax from the 2019-20 tax year will be used to calculate the furlough payment.

For those employees who have been employed for less than 12 months, average monthly earnings before tax based on the total period of employment will be used to calculate the furlough payment.

For those employees with earnings which vary due to number of days worked as a result of not being assigned to a regular rotation, average monthly earnings before tax based on the total period of employment, up to twelve months, will be used to calculate the furlough payment.

For those employees who started work in February 2020, their pro rata earnings before tax for that month will be used to calculate the furlough payment.

In each case the furlough payment will be restricted to 80% of earnings with a cap of £2,500 per month / £576.92 per week, which will then be subject to normal payroll deductions.

Furlough leave arrangements may continue for the duration of the CJRS or the Company may, at its option, elect to terminate the furlough at an earlier date by notice in writing.

If suitable alternative work becomes available during this time period, the Company may contact employees at short notice to advise them of this. Employees may therefore be asked to switch from furlough status back

to their standard employment Terms and Conditions as required by the Company. Wood will try to provide as much notice as possible in this respect but will have to react to the changing needs of the business.

Therefore, furloughed workers, who are not working, must be paid the lower of 80% of their salary, or £2,500 even if, based on their usual working hours, this would be below NLW/NMW. The only exception to this is where we have agreed that you undertake training during a period of furlough.

49. Training during furlough Furloughed employees can engage in training, as long as in undertaking the training the employee does not provide services to, or generate revenue for, or on behalf of their organisation or a linked or associated organisation.

Where the Company requests furloughed employees to undertake training (e.g. computer based training) those employees are entitled to be paid at least their appropriate national minimum wage for this time. In most cases, the furlough payment of 80% of an employee’s regular wage, up to the value of £2,500, will provide sufficient monies to cover these training hours. However, where the time spent training attracts a minimum wage entitlement in excess of the furlough payment, the employee will be paid the additional amount.

The only exception to this may be if employees are asked to work part-time (flexible furlough).

54. Can I be furloughed part time? From 1st July employers may decide to ask employees to work part-time hours whilst on furlough. It will be up to the Company to determine the split of part-time hours worked during furlough subject to the operational needs of the business. Employees that were not cur- rently on furlough but had participated in the scheme previously, satisfying the 3 consecutive week qualifying period, may have be added back onto the scheme after the 10th June 2020. This cut-off date did not apply to any employee who is on a period of statutory leave such as maternity or paternity leave and is due to re- turn to work after 10th June 2020.
