A bid submission fee shall be remitted online during the time of bid submission. All bid/tender documents are to be submitted online only and in the designated cover(s) / envelope(s) on the e-GP website. Tenders/bids shall be accepted only through online mode on the e-GP website and no manual submission of the same shall be entertained. Late tenders will not be accepted. The scanned copies of registration certificate duly attested by an Engineer not below the rank of Assistant Engineer, PWD / LSGD, Kerala, preliminary agreement and EMD exemption certificate (if any) shall be submitted online and subsequently in a separate cover physically before the time fixed for tender opening. More details on EMD and cost of tender documents / bid submission fee are mentioned in this document. The bids shall be opened online at the Office of the Assistant Executive Engineer, LSGD Sub Division, Iritty Block Panchayath on 29/11/2016 11:00 AM by the Assistant Executive Engineer in the presence of the bidders / their representatives who wish to attend at the above address. If the tender opening date happens to be a holiday or non-working day due to any other valid reason, the tender opening process will be done on the next working day at the same time and place. Online tenders/bids are to be accompanied with a preliminary agreement executed in Kerala stamp paper worth Rs. 200/-. Tenders/bids received online without scanned copy of contractor's license, preliminary agreement, e-payment form and filled tender documents will not be considered and shall be summarily rejected. Further details can be had from the NIT or from the Office of the Assistant Executive Engineer, LSGD Sub Division, Iritty Block Panchayath during working hours. This e-tender use the Item-Rate BoQs and the bidders have to quote rate for each item separately [as per GO (P) No. 31/2016/Fin dated 29/02/2016]. In case of tarring works, the contractor himself purchase the necessary bitumen (Purchases from Indian Oil Corporation, Bharath Petroleum Corporation, Hindustan Petroleum only) and the original of the bill should be submitted along with work bill. ABDUL NAZEER, J. 1. This appeal is directed against the judgment in M.F.A No. 1247 of 2000 dated 18.09.2007, whereby the High Court of Kerala has allowed the appeal while setting aside the order of the Forest Tribunal dated 22.07.2000 in O.A No. 46/99 filed by the respondents under Section 8 of the Kerala Private Forests (Vesting and Assignment) Act, 1971 (for short 'KPF Act'). 2. The respondents filed the aforesaid petition before the Forest Tribunal for a declaration that 1 acre 30 cents of land in survey No. 1293 of Ayyankunnu village, Tellichery Taluk of Kannur district (hereinafter referred to as 'schedule property'), is not a private forest as defined in the KPF Act. 2 3. By relying on a Commissioner's report in a civil case, the respondents contended that the schedule property was under cultivation when the KPF Act came into force. They further contended that the certificate of purchase has been issued in their favour by the Land Tribunal under the provisions of the Kerala Land Reforms Act, 1963. The appellants opposed the application contending that the schedule property is a private forest, vested in the State Government under the provisions of the KPF Act. 4. Having heard learned counsel for the parties, we do not find any merit in this appeal.
