Minutes of 190 th SEAC Meeting Date: 12/09/2014

The 190 th meeting of SEAC was held in Directorate of Environment, U.P. on 12/09/2014. Following members were present in the meeting along with Secretary, SEAC:

The Chairman welcomed the members to the 190 th SEAC meeting.

The Members of SEAC unanimously taken following decisions on the agenda points discussed:

1- Sand Mining Project Vill-Sivane, Tehsil-Maudaha, Distt-Hamirpur U.P. (Leased Area-4.04 Ha.) Sri ChandraBhan Soni, Kotbazar Rath, Distt-Hamirpur, U.P. File No. 2144/DD-DS

A presentation was made by the Shri Vashisht Kumar, authorized representative of project proponent alongwith their consultant M/s Eko Pro Engineers Pvt. Ltd. The proponent, through the documents submitted and presentation made, informed the committee that:

1. The environmental clearance is sought for proposed Sand/morum Mining at Khasra No-1 Village-Sivane, Tehsil-Maudaha, District-Hamirpur, . (Leased Area 4.04 Ha). 2. As per the form-1 the collection of 40,000 TPA Sand is proposed from 4.04 Ha mining lease area. 3. The mining is proposed from the river bed of river Berma. 4. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-RQP/DDN/165/2005/A). 5. Lease for the project was applied by Shri Chandrabhan Soni on 03/12/2009 for a period of 03 years. Renewal has been applied. 6. 225 days are proposed for mining. 7. Mining will be opencast type and manual. No drilling and blasting is proposed. 8. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14-09-2006. 9. During operation the maximum number of workers is 43. 10. The water requirement will be limited to 3.5 KLD (Drinking- 2.0 KLD and dust suppression- 1.0 KLD & Green belt 0.5 KLD). 11. The ultimate depth of mining will be restricted to 03 meter/water table, whichever is less. The mining would be restricted to unsaturated zone only above the phreatic water table and will not intersect the ground water table at any point of time. 12. 13. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006 as per affidavit dated 04/08/2014 submitted by the project proponent. 14. The project proposal fall under category – 1(a) of EIA Notification, 2006 (as amended). 15. There is no litigation pending in any court regarding the project.

The committee discussed the proposals and observed that production capacity is given as 40,000 TPA in form-1 whereas it is being presented as 2,19,225 TPA in the presentation/mining plan. The project proponent was directed to submit a calculation sheet for proposed production. The project proponent should also submit revised form-1 as per correct production capacity. The committee also directed that RQP, who has prepared the mining plan should also be present in the meeting for clarifications. The committee deliberated to defer the matter till submission of information as above.

2- Stone Mining Project at Vill-Makarbai (Survey No-989/17) -Mahoba. (Leased Area-4.04 Hac) Sri Dilip Kr Singh, Kalookuaon, Distt-Banda, U.P. File No. 2150/AD-H

A presentation was made by Shri Rahul Singh, authorized representative of project proponent alongwith their consultant M/s GRC Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Khanda, Gitti and Boulder (Granite) Stone Mining project at Survey No- 989/17, Village-Makarbai, Tehsil & District-Mahoba, Uttar Pradesh (Leased area- 4.04 Ha). 2. Mining Lease area was granted to the applicant Shri Dilip Kumar Singh from 12/05/2011 to 11/05/2021. 3. 78,000 MTPA Khanda, Gitti and Boulder Stone collections are proposed. 4. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-RQP/DDN/165/2005/A). 5. The water requirement will be limited to 0.96 KLD from borewell. 6. During operation the maximum no. of workers will not be more than 48. 7. The topsoil will be scrapped and stacked separately to use for plantation. 8. A 7.5 wide strip will be left at periphery of the lease area which will be used to store overburden generated and later will be converted into green belt. 9. The mining will be opencast type and carried out semi mechanized. The mining machinery shall include spades, hammer, crowbar, chisel etc. 10. Mining will be done from top to bottom by making benches having height of 3 m and width of 3 m. 11. The ultimate depth of mining will be restricted to 18 m. 12. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006. 13. The mining operation will not be carried out in safety zone of any bridge or embankment or in eco- fragile zone such as habitat of any wild fauna. 14. Regarding the project, no litigation is pending in any court. 15. The Project proposal falls under category – 1(a) of EIA Notification, 2006 (as amended).

The committee examined the proposals alongwith mining plan related to the project. The committee observed that in the presentation made before committee the project proponent has mentioned that the lease has been granted in the name of Shri Dilip Kumar Singh dated 12/05/2011 for the term of 10 years from 12/05/2011 to 11/05/2021 whereas in the mining plan it is mentioned that the lease deed was executed on 05/04/2010 and the area was valid till 04/04/2020. The committee directed to clarify this mismatch and to submit the correct information. The committee also observed that Vijay Sagar Wild List Sanctuary has been mentioned to be at a distance of 08 K.M. from the project site. The committee directed that an affidavit mentioning status of the project site with reference to general conditions as given in EIA notification, 2006 should be submitted. Also, an affidavit mentioning the information about existing operating mines within 500 m of the project site should also be submitted. The committee deliberated to defer the matter till submission of information as above.

3- Stone Mining Project at Vill-Makarbai (Survey No-1076/3) Mahoba. (Leased Area-2.89 Ha.) Sri Dilip Kr Singh, Vill- Kalookuaon, Distt-Banda, U.P. File No. 2156/DD-Sh.

A presentation was made by Shri Dilip Kumar Singh, project proponent alongwith their consultant M/s GRC India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Khanda, Gitti and Boulder (Granite) Stone Mining project at Survey No- 1076/3, Village-Makarbai, Tehsil & District-Mahoba, Uttar Pradesh (Leased area- 2.89 Ha). 2. Mining Lease area was granted to the applicant Shri Dilip Kumar Singh from 28/08/2009 to 27/08/2019. 3. 2,08,000 TPA Khanda, Gitti and Boulder Stone collections are proposed as per mining plan. 4. 300 working days is proposed for mining activity. 5. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-RQP/DDN/165/2005/A). 6. The water requirement will be limited to 3.36 KLD from borewell. 7. During operation the maximum no. of workers will not be more than 48. 8. The topsoil will be scrapped and stacked separately to use for plantation. 9. The committee examined the proposals alongwith mining plan related to the project. The committee observed that in the presentation made before committee the project proponent has mentioned the production capacity as 2,08,000 TPA/80,000 cum whereas in form-1 dated 11/03/2014 submitted to the Authority, production capacity has been given as 62,400 TPA. The project proponent was directed to submit a calculation sheet for proposed production. The project proponent should also submit revised form-1 as per correct production capacity. The committee further directed that RQP, who has prepared the mining plan should also be present in the meeting for clarifications.

The committee also observed that Vijay Sagar Wild List Sanctuary has been mentioned to be at a distance of 09 K.M. from the project site. The committee directed that an affidavit mentioning status of the project site with reference to general conditions as given in EIA notification, 2006 should be submitted. Also, an affidavit mentioning the information about existing operating mines within 500 m of the project site should also be submitted. The committee deliberated to defer the matter till submission of information as above.

4- Stone Mining Project at Vill-Makarbai (Survey No-989/14) Tehsil-& Distt-Mahoba, U.P. (Leased Area-1.21 Ha) Sri Ram Kumar Dwivedi, Vill- Kalookuaon, Distt-Banda, U.P. File No. 2157/AD-H

A presentation was made by Shri Ram Kumar Dwivedi, project proponent alongwith their consultant M/s GRC India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Khanda, Gitti and Boulder (Granite) Stone Mining project at Survey No- 989/14, Village-Makarbai, Tehsil & District-Mahoba, Uttar Pradesh (Leased area- 1.21 Ha). 2. Mining Lease area was granted to the applicant Shri Ram Kumar Dwivedi from 05/04/2010 to 04/04/2020. 3. 57,200 TPA/22,000 cum Khanda, Gitti and Boulder Stone collections are proposed. 4. 300 working days is proposed for mining activity. 5. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-RQP/DDN/165/2005/A). 6. The water requirement will be limited to 2.4 KLD from borewell. 7. The mining will be opencast type and carried out semi mechanized. The mining machinery shall include spades, hammer, crowbar, chisel etc. 11. Mining will be done from top to bottom by making benches having height of 3 m and width of 3 m. 12. The ultimate depth of mining will be restricted to 33 m. 13. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006. 14. The committee directed that an affidavit mentioning status of the project site with reference to general conditions as given in EIA notification, 2006 should be submitted. Also, an affidavit mentioning the information about existing operating mines within 500 m of the project site should also be submitted. The committee directed project proponent to submit information as above. The committee deliberated to defer the matter till submission of information as above.

5- Sand Mining Project at Vill-Jujhar Survey No-2/4, Khand-07) Mahoba, U.P. (Leased Area- 1.619 Hac) Sri Wasif Jama Khan, Vill-Muhl Aliganj, Kotwali Dehat, Banda, U.P. File No. 2164/AD-H

The project proponent did not appear. The committee directed to close the case and to reopen only, if a request to this effect is received from the project proponent.

6- Stone Mining Project at Vill-Makarbai, Survey No-935, Khand-07, Mahoba. (Leased Area- 3.64 Ha) Sri Rahul singh, Raja Niwas, Kalukuan, Banda, U.P. File No. 2168/DD-Y

A presentation was made by Shri Rahul Singh, project proponent alongwith their consultant M/s GRC India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Khanda, Gitti and Boulder (Granite) Stone Mining project at Survey No- 935, Village-Makarbai, Tehsil & District-Mahoba, Uttar Pradesh (Leased area-3.64 Ha). 2. Mining Lease area was granted to the applicant from 05/04/2010 to 04/04/2020. 3. 2,60,000 TPA Khanda, Gitti and Boulder Stone collections are proposed. 4. 300 working days is proposed for mining activity. 5. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-RQP/DDN/165/2005/A). 6. The water requirement will be limited to 3.36 KLD from borewell. 7. A presentation was made by Shri Ram Kumar, project proponent alongwith their consultant M/s GRC India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Khanda, Gitti and Boulder (Granite) Stone Mining project at Survey No- 989/11, Village-Makarbai, Tehsil & District-Mahoba, Uttar Pradesh (Leased area- 0.809 Ha). 2. Mining Lease area was granted to the applicant Shri Ram Kumar Dwivedi from 05/04/2010 to 04/04/2020. 3. 39,000 TPA Khanda, Gitti and Boulder Stone collections are proposed. 4. 300 working days is proposed for mining activity. 5. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-RQP/DDN/165/2005/A). 6. The water requirement will be limited to 1.74 KLD from borewell. 7. Mining will be done from top to bottom by making benches having height of 3 m and width of 3 m. 12. The ultimate depth of mining will be restricted to 27 m.

8- Sand /Morum Mining Project at Arazi N0- 01, 02, Khand-2, Vill-Pura Ganesh, Tehsil- Sakaldiha, Distt-Chandauli (Leased Area 4.04 Hac) Smt Shanti Devi, Vill/Post-Kethi, Distt- Varansi. File No. 2182/DD-Y

A presentation was made by the Shri Santosh Kumar Singh, authorized representative of project proponent alongwith their consultant M/s ENV DAS India Pvt. Ltd. The proponent informed the committee that mining lease for the project was granted from 15/02/2011 to 14/02/2014. District Magistrate, Chanduli through his letter dated 27/08/2013 directed to stop the work and suspended the mining lease till the project proponent obtains environmental clearance from MoEF/SEIAA. The project proponent applied to SEIAA for environmental clearance through his application dated 13/03/2014. The committee noted that the mining lease has expired on 14/02/2014 and is no more valid. The committee directed the proponent to submit current status of mining lease alongwith communication from District Administration/Mining Department regarding claim of project proponent on the said mining lease after 14/02/2014. Also, the project proponent should apply with specific period, for which environmental clearance is required. The committee directed project proponent to submit information as above. The committee deliberated to defer the matter till submission of information as above.

9- Sand /Morum Mining Project at Gata N0- 28 Ga, Vill-Aebakpur Mohana, Tehsil-Chunar, Distt-Mirzapur (Leased Area 2.02 Ha.) Sri Saroj Kumar Gautam, Vill-Araji Line, Sultanpur, Tehsil-Chunar, Distt-Mirzapur. File No. 2184/DD-Sh.

A presentation was made by the Shri Saroj Kumar Gautam, project proponent alongwith their consultant M/s ENV DAS India Pvt. Ltd. The proponent, through the documents submitted and presentation made, informed the committee that:

1. The environmental clearance is sought for proposed Sand/morum Mining at Gata No. 28 Ga, Village-Aebakpur Mohana, Tehsil-Chunar, District-Mirzapur, Uttar Pradesh. (Leased Area 2.02 Ha). 2. As per the presentation collection of 34,000 MTPA Sand is proposed from 2.02 Ha mining lease area.

3. The mining is proposed from the river bed of river Ganga. 4. The mining plan has been prepared by Dr. Abdul Rahman (RQP No.-RQP/BNG/282/2011/A). 5. Mining Lease area was granted to the applicant Shri Saroj Kumar Gautam for a period of 03 years from 30/03/2012 to 29/03/2015. 6. Mining will be opencast type and manual. No drilling and blasting is proposed. 7. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14-09-2006. 8. During operation the maximum number of workers is 30. 9. The water requirement will be limited to 1.5 KLD (Drinking- 0.9 KLD from ground water and dust suppression- 0.9 KLD from the river). 10. The ultimate depth of mining will be restricted to 03 meter/water table, whichever is less. The mining would be restricted to unsaturated zone only above the phreatic water table and will not intersect the ground water table at any point of time. 11. The mining operation will not be carried out in safety zone of any bridge or embankment or in eco-fragile zone such as habitat of any wild fauna. 12. The project proposal fall under category – 1(a) of EIA Notification, 2006 (as amended). 13. There is no litigation pending in any court regarding the project.

The committee also directed that RQP, who has prepared the mining plan should be present in the meeting for clarifications. Also, an affidavit mentioning the information about existing operating mines within 500 m of the project site should also be submitted.

The committee directed project proponent to submit information as above. The committee deliberated to defer the matter till submission of information as above.

10- Sand/Morum Mining Project at Arazi No-246/1, Lot No-11, Vill-Gurdah, Robertsganj, Sonbhadra (Leased Area 10.00 Acres) Sri Gulab, Vill-Semiya, Tehsil-Robertsganj, Sonbhadra, U.P. File No. 2185/AD-H

The project proponent did not appear. The committee directed to close the case and to reopen only, if a request to this effect is received from the project proponent.

11- Sand/Morum Mining Project at Arazi No-246/1, Lot No-9, Vill-Gurdah, Tehsil-Robertsganj, Distt-Sonbhadra (Leased Area 10.00 Acres) Sri Dwarika Prasad, Vill-Chopan, Tehsil- Robertsganj, Sonbhadra, U.P. File No. 2188/JDCA-S

The committee noted that an application dated 13/03/2014 for environmental clearance for Sand/morum Mining at Aaraji No-246/1, Lat No. 9, Village-Gurdah, Tehsil-Robertsganj, District- Sonebhadra, Uttar Pradesh. (Leased Area 4.04 Ha) has been submitted by Shri Dwarika Prasad, Vill- Chopan, Tehsil-Robertsganj, Sonebhadra, U.P. Mining plan and a certificate dated 28/06/2014 from Mining Officer, Sonebhadra regarding no other sand/moram mining area within 500 m was submitted Page 8 of 27

The project proponent has also submitted an affidavit dated 08/09/2014 that the project site is more than 05 K.M. away from Critically Polluted Areas of District-Sonebhadra. A Google map showing the project site with reference to Critically Polluted Areas of District-Sonebhadra have also been submitted. A presentation was made by the Shri Shivram Singh, authorized representative of project proponent alongwith their consultant M/s Ind Tech House Consult. The proponent, through the documents submitted and presentation made, informed the committee that:

1. The environmental clearance is sought for proposed Sand/morum Mining at Aaraji No-246/1, Lat No. 9, Village-Gurdah, Tehsil-Robertsganj, District-Sonebhadra, Uttar Pradesh. (Leased Area 4.04 Ha). 2. As per the form-1 the collection of 1,77,733 TPA Sand is proposed from 4.04 Ha mining lease area. 3. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-RQP/DDN/165/2005/A). 4. Lease for the project was sanctioned for 03 years from 12/03/2001 to 11/03/2004. Mining Department through letter no. 4466/86-2013-172/2009 dated 24/12/2013 has provided extension of mining lease for 01 year 08 months 13 days in favour of the applicant. This application relates to mining lease period of 01 year 08 months 13 days. 5. 250 working days in a year are proposed for mining. 6. Mining will be opencast type and manual. No drilling and blasting is proposed. 7. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14-09-2006. 8. During operation the maximum number of workers is 45-48. 9. The water requirement will be limited to 14 KLD (Drinking- 2 KLD and dust suppression- 10 KLD & Green belt 2 KLD). 10. A Google map showing Ariel distances of critically polluted areas of District-Sonebhadra from the project site has been submitted which shows that the project site is beyond 05 K.M. from any critical areas as identified by MoEF in District-Sonebhadra. Hence the project activities are not covered under general conditions as prescribed under EIA notification, 2006. 11. The ultimate depth of mining will be restricted to 03 meter/water table, whichever is less. The mining would be restricted to unsaturated zone only above the phreatic water table and will not intersect the ground water table at any point of time. 12. The mining operation will not be carried out in safety zone of any bridge or embankment or in eco-fragile zone such as habitat of any wild fauna. 13. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006 as per affidavit dated 04/08/2014 submitted by the project proponent. 14. The project proposal fall under category – 1(a) of EIA Notification, 2006 (as amended). 15. There is no litigation pending in any court regarding the project.

The committee discussed the matter and recommended grant of environmental clearance to the proposals as above along with general conditions prescribed for sand/moram mining projects and following specific conditions:

1. This environmental clearance shall be subject to valid lease in favour of project proponent for the proposed mining proposals. In case, the project proponent does not have a valid lease, this environmental clearance shall automatically become null and void. 2. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from National Board Wild Life (NBWL) even if the eco-sensitive zone is not earmarked. 4. The project proponent will submit the approved mining plan within 03 month from the date of issuance of the E.C. letter. Failing which E.C. will be deemed to be cancelled. 5. Social Corporate Responsibility (SCR) plan along with budgetary provision amounting to 5% of total project cost shall be submitted within three month on need base assessment study in the study area. Income generating measures which can help in up-liftment of weaker section of society consistent with the traditional skills of the people identified. The programme can include activities such as development of fodder farm, fruit bearing orchards, vocational training etc. In addition, vocational training for individuals shall be imparted so that poor section of society can take up self employment and jobs. Separate budget for community development activities and income generating programmes shall be specified. 6. The mining work will be open-cast and exclusively manual. No mechanical work or drilling/blasting should be involved at any stage. 7. It shall be ensured that there shall be no mining of any type within 03 m or 10% of the width which-ever is less, shall be left on both the banks of precise area to control and avoid erosion of river bank. The mining is confined to extraction of sand/moram from the river bed only. 8. The project proponent shall undertake adequate safeguard measures during extraction of river bed material and ensure that due to this activity the hydro-geological regime of the surrounding area shall not be affected. 9. The project proponent shall adhere to mining in conformity to plan submitted for the mine lease conditions and the Rules prescribed in this regard clearly showing the no work zone in the mine lease i.e. the distance from the bank of river to be left un-worked (Non mining area), distance from the bridges etc. It shall be ensured that no mining shall be carried out during the monsoon season. 10. The project proponent shall ensure that wherever deployment of labour attracts the Mines Act, the provision thereof shall be strictly followed. 11. The project proponent will provide personal protective equipment (PPE) as required, also provid adequate training and information on safety and health aspects. Periodical medical examination of the workers engaged in the project shall be carried out and records maintained. For the purpose, schedule of health examination of the workers should be drawn and followed accordingly.

12. The critical parameters such as PM 10 , PM 2.5 , SO 2 and NO x in the ambient air within the impact zone shall be monitored periodically. Further, quality of discharged water if any shall also be monitored [(TDS, DO, pH, Fecal Coliform and Total Suspended Solids (TSS)]. 13. Effective safeguard measures, such as regular water sprinkling shall be carried out in critical areas prone to air pollution and having high levels of particulate matter such as loading and

unloading point and all transfer points. Extensive water sprinkling shall be carried out on haul roads. 14. It should be ensured that the Ambient Air Quality parameters conform to the norms prescribed by the Central Pollution Control Board in this regard. 15. The extended mining scheme will be submitted by the proponent before expiry of present mining plan. 16. Four ambient air quality-monitoring stations should be established in the core zone as well as in the buffer zone for monitoring PM10, PM2.5, SO2 and NOx. Location of the stations should be decided based on the meteorological data, topographical features and environmentally and ecologically sensitive targets and frequency of monitoring should be undertaken in consultation with the State Pollution Control Board. 17. Common road for transportation of mineral is to be maintained collectively. Total cost will be shared/worked out on the basis of lease area among users. 18. Proponent will provide adequate sanitary facility in the form of mobile toilets to the labours engaged for the project work. 19. Solid waste material viz., gutkha pouchs, plastic bags, glasses etc. to be generated during project activity will be separately storage in bins and managed as per Solid Waste Management rules. 20. Green area/belt to be developed along haulage road in consultation of Gram Sabha/Panchyat. 21. Natural/customary paths used by villagers should not be obstructed at any time by the activities proposed under the project. 22. Digital processing of the entire lease area in the district using remote sensing technique should be done regularly once in three years for monitoring the change of river course by Directorate of Geology and Mining, Govt. of Uttar Pradesh. The record of such study to be maintained and report be submitted to Regional office of MoEF, SEIAA, U.P. and UPPCB. 23. A copy of clearance letter will be marked to concerned Panchayat / local NGO, if any, from whom suggestion / representation has been received while processing the proposal. The clearance letter shall also be put on the website of the company. 24. State Pollution Control Board shall display a copy of the clearance letter at the Regional office, District Industry Centre and Collector’s office/Tehsildar’s Office for 30 days. 25. The project authorities shall advertise at least in two local newspapers widely circulated, one of which shall be in the vernacular language of the locality concerned, within 7 days of the issue of the clearance letter informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution Control Board and also at web site of the SEIAA at http://www.seiaaup.com and a copy of the same shall be forwarded to the Regional Office of the Ministry located in , CPCB, State PCB. 26. The MoEF/SEIAA or any other competent authority may alter/modify the above conditions or stipulate any further condition in the interest of environment protection. 27. Concealing factual data or submission of false/fabricated data and failure to comply with any of the conditions mentioned above may result in withdrawal of this clearance and attract action under the provisions of Environment (Protection) Act, 1986.

12- Stone Mining Project at Araji No-1308/3, Vill-Darhiram, Tehsil & Distt-Mirzapur. (Leased Area 0.88 Ha) Si Ram Lakhan, Vill-Sidhi, Tehsil & Distt-Mirzapur, U.P. File No. 2208/AD-VB

The committee noted that an application dated 14/03/2014 for environmental clearance for Boulder/Sand Stone Mining project at Gata No- 1308/3, Village-Darhiram, Tehsil & District-Mirzapur, Uttar Pradesh (Leased area-0.88 Ha) has been submitted by Shri Ram Lakhan, Vill-Sidhi, Tehsil & Distt-Mirzapur, U.P. Mining plan was submitted through letter dated 19/08/2014 by the proponent. A presentation was made by Shri Ramashrey Bharti, authorized representative of project proponent along with their consultant M/s ENV DAS India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Boulder/Sand Stone Mining project at Gata No- 1308/3, Village-Darhiram, Tehsil & District-Mirzapur, Uttar Pradesh (Leased area-0.88 Ha). 2. The Mining Lease area was granted for a period of 05 years from 29/02/2002 to 28/02/2007. The said lease was renewed for further 05 years and the execution of lease deed was done on 02/02/2010. The present application for environmental clearance relates to lapse period of 02 years 06 months 04 days for which mining operation completely discontinued. 3. 10,750 TPA Boulder/Sand Stone collections are proposed. 4. The mining plan has been prepared by Shri Indra Singh (RQP No.-RQP/DDN/078/94-A). 5. The water requirement will be limited to 2.25 KLD from borewell. 6. During operation the maximum no. of workers will not be more than 50. 7. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006. 8. There are two other mining leases within 500 m of the proposed site. The composite area of all the 03 leases is 8.68 acres which is less than 05 ha. 9. The mining will be opencast type and carried out semi mechanized. The mining machinery shall include excavators, drill machines and trucks as per mining plan. 10. The ultimate depth of mining will be restricted to approved mining plan by Mining Department. 11. The mining operation will not be carried out in safety zone of any bridge or embankment or in eco- fragile zone such as habitat of any wild fauna. 12. Regarding the project, no litigation is pending in any court. 13. The Project proposal falls under category – 1(a) of EIA Notification, 2006 (as amended).

The committee discussed the proposals and observed that production capacity is given as 16,000 TPA in form-1 whereas it is being presented as 10,750 TPA in the presentation/mining plan. The project proponent was directed to submit a calculation sheet for proposed production. The project proponent

13- Stone Mining Project at Gata No-30/23, Vill-Sukrit, Tehsil Raburtsganj Sonebhadra. (Leased Area 2.95 Acre) Sri Ram Janam, Vill-Lohara, Tehsil-Robertsganj, Mirzapur. File No. 2209/JDCA-S

The committee noted that an application dated 14/03/2014 for environmental clearance for Sand Stone Mining project at Gata No- 30/23, Village-Sukrit, Tehsil-Robertsganj, District-Sonebhadra, Uttar Pradesh (Leased area-1.19 Ha) has been submitted by Sri Ram Janam, S/o Shri Ramdev and Shri Ramjag, S/o Shri Ram Sundar (Partnership deed), Mirzapur. Mining plan for the project was submitted through letter dated 20/08/2014. The project proponent has also submitted an affidavit dated 12/09/2014 that the project site is more than 05 K.M. away from Critically Polluted Areas of District-Sonebhadra. A Google map showing the project site with reference to Critically Polluted Areas of District-Sonebhadra have also been submitted. A presentation was made by Shri Ramjanam, project proponent along with their consultant M/s ENV DAS India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:

1. The environmental clearance is sought for Sand Stone Mining project at Gata No- 30/23, Village- Sukrit, Tehsil-Robertsganj, District-Sonebhadra, Uttar Pradesh (Leased area-1.19 Ha). 2. Mining Lease area was granted for the period of 10 years from 22/11/2011. 3. 30,000 TPA Sand Stone collections are proposed. 4. The mining plan has been prepared by Shri Indra Singh (RQP No.-RQP/DDN/078/94-A). 5. The water requirement will be limited to 2.25 KLD from borewell. 6. During operation the maximum no. of workers will not be more than 50. 7. A Google map showing Ariel distances of critically polluted areas of District-Sonebhadra from the project site has been submitted which shows that the project site is beyond 05 K.M. from any critical areas as identified by MoEF in District-Sonebhadra. Hence the project activities are not covered under general conditions. 8. The committee discussed the matter and directed the proponent to submit information of existing/operating mining lease areas within 500 m of the project site to decide about category of the project i.e. category A or category B.

The matter shall be discussed after submission of information as above.

14- Jujhar (survey N0-2/04, Khand-5) Mining Project at Vill.- Kujhar, Mahoba.(Area-1.61 hact.) Sri Muhammad Iqbal Hussain, R/O Syedwada Hamirpur, U.P. File No. 2306/AD-H

The committee noted that an application dated 15/05/2014 for environmental clearance for Khanda, Gitti and Boulder (Granite) Stone Mining project at Survey No. 2/4, Khand No. 5, Village- Jujhar, Tehsil & District-Mahoba, Uttar Pradesh (Leased area-1.61 Ha) has been submitted by Shri Muhammad Iqbal Hussain alongwith mining plan for the project. The committee noted that the mining lease was granted for 10 years from 15/01/2002 to 14/01/2012 as per mining plan submitted by the proponent. However, in the presentation made before the committee it was submitted that the lease has been granted for the terms of 10 years from 28/08/2009 to 27/08/2019. The committee directed that this mismatch regarding the lease period should be explained alongwith submission of related documents to confirm the lease period. The matter shall be discussed after submission of information as above.

15- Sand/Morum Mining at GataNo 7, 10 Khand-2 Vill.-Balwa Bhawanin Bax, Sagri, Azamgarh, (Area 2.32 Hac.) Sri Khabar Alam, Vill- & Post- Vindwal, Sagri, Azamgarh. File No. 2346/AD- Sub.

The committee noted that an application dated 27/05/2014 for environmental clearance of Sand/morum Mining at Aaraji No-7 Mi, 10 Mi, Khand-2, Village-Balwa Bhawani Bux, Tehsil-Sagri, District-Azamgarh, Uttar Pradesh. (Leased Area 2.32 Ha) has been submitted by Shri Khabar Aalam. Mining plan for the project was submitted through letter dated 24/07/2014. A presentation was made by the Shri Khabar Aalam, project proponent alongwith their consultant M/s ENV DAS India Pvt. Ltd. The proponent, through the documents submitted and presentation made, informed the committee that:

1. The environmental clearance is sought for proposed Sand/morum Mining at Aaraji No-7 Mi, 10 Mi, Village-Balwa Bhawani Bux, Tehsil-Sagri, District-Azamgarh, Uttar Pradesh. (Leased Area 2.32 Ha). 2. As per the form-1 the collection of 40,000 TPA/23,000 cum Sand is proposed from 2.32 Ha mining lease area. 3. The mining plan has been prepared by Shri UPS Chauhan (RQP No.-RQP/DDN/165/2005/A). 4. Lease for the project was sanctioned for 03 years from 09/01/2012 to 08/01/2015. District Magistrate, Azamgarh through his letter dated 03/09/2013 directed the project proponent to stop the mining work and to obtain and submit environmental clearance for the mining activities in wake of Hon'ble NGT order dated 05/08/2013.

The mining would be restricted to unsaturated zone only above the phreatic water table and will not intersect the ground water table at any point of time. 11. The mining operation will not be carried out in safety zone of any bridge or embankment or in eco-fragile zone such as habitat of any wild fauna. 12. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006 as per affidavit dated 04/08/2014 submitted by the project proponent. 13. The committee noted that an application dated 20/04/2011 for environmental clearance of Janwa Silica Sand Mine at Village-Janwa, Taluka-Bara, District-Allahabad, U.P. (Leased Area 17.75 ha.) was submitted by Mr. Kanhaiya Lal. SEIAA through letter dated 22/09/2011 issued terms of reference with regards to the proposals. Public hearing for the project was undertaken on 18/10/2013 under Chairmanship of ADM, Allahabad and public hearing report was communicated to Director, Environment through UPPCB letter dated 25/11/2013. Project proponent submitted final EIA report through letter dated 16/02/2014 to the Director, Environment. The committee discussed the matter in SEAC meeting dated 11/04/2014 wherein the project proponents were directed to submit following information: 1. Present status of mining lease along with relevant documents. 2. Status and period of approved mining plan. 3. Depth of proposed mining. 4. Source of data given in EIA should be submitted. 5. Washing of Silica Sand shall not be treated a part of project proposal submitted for Environmental Clearance. No silica sand washing shall be considered by the Committed for the purpose of clearance. 6. A map of mining lease area showing buffer area, plantation area, garland drains and mining area. 7. Plan for corporate social responsibility. 8. Plan for dust suppression caused by mining and transportation activities. 9. Distance of proposed site of others and self is to be shown with in 500 mts. 10. Source of collection of data regarding wind direction is to be mentioned 11. No of trees to be planted par hact to be mention in the report as per norms. 12. 7.5 mts open space to be left all round the proposed site which is to be shown as a buffer area for plantation of trees as per norms. 13. All maps/lease related documents etc. should be duly signed by the competent authority 14. The mining plan should be prepared by a mining expert and approved by the concerned department.

The project proponents submitted their replies through letter dated 29/05/2014. The matter was again listed in SEAC meeting dated 07/06/2014 wherein the project proponent did not appear. The matter rescheduled in SEAC meeting dated 12/09/2014. A presentation was made by Shri Dwarika Prasad Gupta, authorized representative of project proponent along with their consultant M/s Ascenso Management and Consulting Services Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that: 1. The Environmental clearance is sought for Janwa Silica Sand Mine at Bhukhand no. 84-87, 100, 101, 105-110, 120, 121, 123-134, 143, Village-Janwa, Tehsil-Bara, District-Allahabad, U.P. 2. Mining lease was granted over an area of 20.71 ha in favour of Kanahaiya Lal dated 25/5/1973 for a periods of 20 years. Lease was applied for first renewal on dated 18/05/1992 by Kanahaiya Lal for the period of 20 years. Later lease was renewed in favor of Kanahaiya Lal over an area of 17.75 Ha for the period of 20 Years dated 25.5.93. Currently lease is under renewal. Lease was Page 18 of 27

applied for renewal on dated 18.06.2012 for the periods of 20 years over an area of 17.75 Ha. This application relates to environmental clearance for renewal of mining lease. 3. The mining plan has been approved for the proposal period of 2010-11 to 2013-14 vide letter no. UP/Allahabad/sisd/MPLN/R-02/10-11 dated 02/05/2011. The project proponent has made a request to Indian Bureau of Mines for extension of its validity period. The mining shall be undertaken as per the proposals mentioned in mining plan. 4. Ultimate depth of the proposed project is near about 5 Meter bgl i.e. near about 139 m AMSL. 5. Washing of silica sand shall not be treated a part of project proposal submitted for Environmental clearance. 6. As per the form-1/mining plan, the collection of 25,000 TPA Silica Sand is proposed from 17.75 Ha mining lease area. 7. The mining plan has been prepared by M/s Balram Singh Associates Pvt. Ltd. (RQP No.- RQP/JBP/105/2003/B). 8. 300 working days in a year are proposed for mining. 9. Mining will be opencast type and manual. 10. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14-09-2006. 11. During operation the maximum number of workers is 42. 12. The water requirement will be limited to 6.9 KLD from the nearby sources. 13. CSR activities with Rs. 2 lacs/year shall be executed and report shall be submitted to SEIAA. 14. The mining operation will not be carried out in safety zone of any bridge or embankment or in eco-fragile zone such as habitat of any wild fauna. 15. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006 as per affidavit dated 04/08/2014 submitted by the project proponent. 16. The project proposal fall under category – 1(a) of EIA Notification, 2006 (as amended). 17. There is no litigation pending in any court regarding the project.

The committee discussed the matter and recommended grant of environmental clearance to the proposals as above along with following General and Specific Condition as prescribed by SEIAA for Silica Sand Mining proposals:

General conditions: 1. Any change in mining area, khasra numbers, entailing capacity addition with change in process and or mining technology, modernization and scope of working shall again require prior Environmental Clearance as per the provisions of EIA Notification, 2006 (as amended). 2. No change in the calendar plan including excavation, quantum of mineral silica sand and waste should be made. 3. Conservation measures for protection of flora and fauna in the core & buffer zone should be drawn up in consultation with the local forest and wildlife department. 4. Four ambient air quality-monitoring stations should be established in the core zone as well as in the buffer zone for RSPM, SPM, SO2 & NOx monitoring. decided based on the meteorological data, topographical features and environmentally and ecologically sensitive targets and frequency of monitoring should be undertaken in consultation with the State Pollution Control Board. 5. Data on ambient air quality (RSPM, SPM, SO2 & NOx) should be regularly submitted to the State level impact Assessment Authority UP, MoEF, Regional Office located at Lucknow and the U.P Pollution Control Board once in six months. 6. Fugitive dust emissions from all the sources should be controlled regularly. Water spraying arrangement on haul roads, loading and unloading and at transfer points should be provided and properly maintained. 7. Measures should be taken for control of noise levels below 85 dBA in the work environment. Workers engaged in operations of HEMM, etc. should be provided with ear plugs / muffs. 8. Industrial waste water (workshop and waste water from the mine) should be properly collected, treated so as to conform to the standards prescribed under GSR 422 (E) dated 19th May, 1993 and 31st December, 1993 or as amended from time to time. Oil and grease trap should be installed before discharge of workshop effluents. 9. Personnel working in dusty areas should wear protective respiratory devices and they should also be provided with adequate training and information on safety and health aspects. Occupational health surveillance program of the workers should be undertaken periodically to observe any contractions due to exposure to dust and take corrective measures, if needed. 10. A separate environmental management cell with suitable qualified personnel should be set-up under the control of a Senior Executive, who will report directly to the Head of the Organization. 11. The funds earmarked for environmental protection measures should be kept in separate account and should not be diverted for other purpose. Year wise expenditure should be reported to the State level impact Assessment Authority UP, MoEF, Regional Office located at Lucknow and the U.P Pollution Control Board. 12. The project authorities should inform to the MoEF, Regional Office located at Lucknow regarding date of financial closures and final approval of the project by the concerned authorities and the date of start of land development work. 13. The MoEF, Regional Office located at Lucknow shall monitor compliance of the stipulated conditions. The project authorities should extend full cooperation to the officer (s) of the MoEF, Regional Office located at Lucknow by furnishing the requisite data / information / monitoring reports. 14. The project proponent shall submit six monthly reports on the status of the implementation of the stipulated environmental safeguards to the State level impact Assessment Authority, U. P. MoEF, Regional Office, Lucknow, and U.P Pollution Control Board. 15. A copy of clearance letter will be marked to concerned Panchayat / local NGO, if any, from whom suggestion / representation has been received while processing the proposal. 16. U.P Pollution Control Board should display a copy of the clearance letter at the Regional office, District Industry Centre and Collector’s office/ Tehsildar’s Office for 30 days. 17. The project authorities should advertise at least in two local newspapers widely circulated, one of which shall be in the vernacular language of the locality concerned, within 7 days of the issue of Page 20 of 27

the clearance letter informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the U.P Pollution Control Board and also at web site of the SEIAA at http://seiaaup.com and a copy of the same should be forwarded to the MoEF, Regional Office located at Lucknow. 18. Project falling with in 10 Km. area of Wild Life Sanctuary is to obtain a clearance from National Board Wild Life (NBWL) even if the eco-sensitive zone is not earmarked.

Specific conditions: 1. The environmental clearance is subject to approval of the State Land use Department, Government of U.P for diversion of agricultural land for non-agricultural use. 2. The project proponent shall obtain Consent to Establish from the U.P State Pollution Control Board and effectively implement all the conditions stipulated therein. 3. Environmental clearance shall be subject to grant of mining lease in favour of project proponent. 4. Mining operations shall be undertaken as per approved mining plan. 5. Washing of silica sand shall not be permitted under this clearance. 6. A record of daily production capacity, engagement of man power and transport vehicles should be maintained. 7. The mining operations shall be restricted to above ground water table and it should not intersect the groundwater table. 8. The project proponent shall ensure that no natural watercourse and/or water resources are obstructed due to any mining operations. 9. The top soil shall temporarily be stored at earmarked site(s) only and it should not be kept unutilized for long. The topsoil shall be used for land reclamation and plantation. 10. The over burden (OB) generated shall be disposed off at the earmarked site in accordance with the approved mine plan. The OB dump shall not be kept active for a long period of time and its phase wise stabilization shall be carried out. The OB dump shall be properly terraced so that the overall slope of the dump shall not exceed 27 degree. The OB dump should be scientifically vegetated with suitable native species to prevent erosion and surface run off. It shall be ensured that the OB does not flow into agricultural fields. Monitoring and management of rehabilitated areas should continue until the vegetation becomes self-sustaining. Compliance status shall be submitted to the SEIAA, U. P. on six monthly basis. 11. Catch drains and siltation ponds of appropriate size shall be constructed for the working pit, soil, OB and mineral dumps to arrest flow of silt and sediment into the agricultural fields and the water bodies. The water so collected should be utilized for watering the mine area, roads, green belt development etc. The drains should be regularly de-silted particularly after the monsoon and maintained properly. Garland drains, settling tanks and check dams of appropriate size, gradient and length shall be constructed both around the mine pit and the over burden dump to prevent run off of water and flow of sediments directly into the agricultural fields and the water bodies and sump capacity should be designed keeping 50% safety margin over and above peak sudden rainfall (based on 50 years data) and maximum discharge in the area adjoining the mine site. capacity should also provide adequate retention period to allow proper settling of silt material. Sedimentation pits should be constructed at the corners of the garland drains and de silted at regular intervals. 12. The void left unfilled in the area shall be converted into the water body. The higher benches of excavated void/mining pit shall be terraced and plantation done to stabilize the slopes. The slope of higher benches shall be made gentler for easy accessibility by local people to use the water body. 13. Peripheral fencing shall be carried out along the excavated area. 14. Dimension of the retaining wall at the toe of the OB dump and the OB benches within the mine to check run-off and siltation should be based on the maximum rain fall data. 15. Plantation shall be raised as 7.5 m wide green belt in the safety zone around the mining lease, over burden dump, around water body, roads etc. by planting the native species in consultation with the local DFO/Agriculture Department. The density of the trees should be around 1000 plants per ha. 16. Effective safeguard measures, such as regular water sprinkling shall be carried out in critical

areas prone to air pollution and having high levels of SPM (PM 10 and PM 2.5 ) such as around crushing and screening plant, loading and unloading point and transfer points. Extensive water sprinkling shall be carried out on haul roads. It should be ensured that the Ambient Air Quality parameters conform to the norms prescribed by the U.P Pollution Control Board in this regard. 17. The project authority should implement suitable conservation measures to augment ground water resources in the area in consultation with the Regional Director, U.P Ground Water Board. 18. Regular monitoring of ground water level and quality shall be carried out in and around the mine lease by establishing a network of existing wells and constructing new piezo meters during the mining operation. The monitoring should be carried out four times in a year i.e., pre-monsoon, monsoon, post-monsoon and winter and the data thus collected shall be sent regularly to the SEIAA. If at any stage, it is observed that the groundwater table is getting depleted due to the mining activity; necessary corrective measures shall be carried out. 19. The project proponent shall obtain necessary prior permission of the competent authorities for drawl of requisite quantity of water (surface water and ground water, if any) for the project. 20. Suitable rainwater harvesting measures on long term basis shall be planned and implemented in consultation with the Regional Director, U.P. Ground Water Board. 21. Vehicular emissions shall be kept under control and regularly monitored. Measures shall be taken for maintenance of vehicles used in mining operations and in transportation of mineral. The mineral transportation shall be carried out through covered trucks only and the vehicles carrying the mineral shall not be overloaded. 22. Drilling and Blasting operations shall not be carried out. 23. Mineral handling area shall be provided with adequate number of high efficiency dust extraction system. Loading and unloading areas including all the transfer points should also have efficient dust control arrangements. These should be properly maintained and operated. 24. Consent to operate shall be obtained from the U.P Pollution Control Board, prior to start of enhanced production from the mine. Page 22 of 27

25. Liquid waste from toilets etc, should be properly managed so that ground water is not contaminated. 26. Pre-placement medical examination and periodical medical examination of the workers engaged in the project shall be carried out and records maintained. For the purpose, schedule of health examination of the workers should be drawn and displayed at the site and followed accordingly. 27. Provision shall be made for the housing of labour near the site with all necessary infrastructure and facilities such as fuel for cooking, sanitation, safe drinking water, medical health care, crèche etc. 28. A Final Mine Closure Plan along with details of Corpus Fund should be submitted to the SEIAA, U. P. 5 years in advance of final mine closure for approval. 29. All workers engaged must be covered under ESI as per mines act or under group insurance scheme.

The project proponent requested the committee to exempt their case from public hearing. The committee discussed the matter and observed that MoEF, Govt. of India through O.M. No. J-11013/41/2006-IA.II(I) dated 03/06/2009 have provided procedure to be adopted in the matters where exemption of public hearing can be granted. File No- 37- Soil The committee noted that the matter was earlier discussed in SEAC meeting dated 06/06/2014 wherein the committee deliberated that the recommendations for environmental clearance may be made however; the proponent should submit a certificate from Revenue Officer regarding existence of any other mining leases/activities within 500 m of the project as per MoEF OM dated 24/06/2013 and notification dated 09/09/2013. The project proponent submitted a certificate/letter dated 14/08/2014 issued by Additional District Magistrate (F/R), Unnao in this regards. The committee discussed the replies submitted by the project proponent and recommended grant of environmental clearance on the proposals as given at Para- A along with general and specific conditions as mentioned at Para-B:

Para-A: • The environmental clearance is sought for soil excavation from Gata no. 191, 194, 197, 210, 216, 218, 242, 246, 256, 258, Village-Dewara Khurd, Tehsil and District-Unnao, U.P. • Mining lease area is 4.7 ha. • Excavated soil will be utilized in the construction works of the nearby government civil works viz- construction of NH-25, SH, MDRs, site development, landscaping etc. • Proposed mining Lease period -3 years. • Project cost 60 lacs for 3 years lease period. • The proposed project falls under Sub-category B 2 with the following salient features:  It is an opencast mining of ordinary earth.  Mining Lease Area is only 4.7 Ha which is <5 Ha.  Max. 30,000 cum/year (45,000 TPA) earth material will be extracted.  No. of labours employed will not be more than 50.  Mining depth -2 m only.  No machines will be used for excavation of soil. Water  Fresh water for drinking purpose: For maximum 50 site workers @ 30 LPCD; Fresh water requirement would be 1.5 KLD  For sprinkling on haulage road: Approx. 0.5 KLD for Air Pollution control.  Total water requirement would be around 2.0 KLD which will be supplied to the site through private water tankers from existing borewells/ dugwells from nearby settlements. = 45,000 TPA Max. 45,000 TPA minor mineral will be extracted. Energy : Electricity and Fuel  Since all the mining activities will be carried out in day time only and also no housing facility for laborers is proposed, the energy requirement will be zero.

Management of borrowed soil:  Mined mineral will not be piled or stored at site but it will be transported through tractor and trolleys to the nearby construction works.  Excavated soil will be utilized in the construction works of the nearby government civil works viz- construction of NH-25, SH, MDRs, site development, landscaping etc.  Borrowing of soil from proposed gata will be done as per the need or requirement. Para-B: General condition: 1. No change is mining technology and scope of working shall be made without approval of Authority. 2. Personnel working in dusty areas shall be provided with protective respiratory devices and they shall also be imparted adequate training and information on safety and health aspects. 3. The Authority reserves the right to revoke the clearance if conditions stipulated are not implemented. The Authority will also be entitled to impose additional environmental conditions or modify the existing ones, if necessary. 4. In case of any deviation or alteration in the project proposed from those submitted to this Authority for clearance, a fresh reference should be made to the Authority to assess the adequacy of the condition(s) imposed and to add additional environmental protection Measures required, if any. 5. Concealing factual data or submission of false/fabricated data and failure to comply with any of the conditions mentioned above may result in withdrawal of this clearance and attract action under the provisions of Environment (Protection) Act, 1986. Specific Conditions: 1. The mining work will be open-cast and carried out manually. 2. Top soil should be adequately preserved and should be used for landscaping. 3. Excavated soil should be properly stored in a manner not to increase surrounding SPM level. 4. Water sprinkling should be exercised during excavation and storage of soil for suppression of fugitive dust. 5. Excavated area should be properly reclaimed and ensured that no open bore hole is left. 6. Safety measures for the people working at the site shall be duly taken care of as per law. 7. The excavation work shall be done in day time only. 8. The project boundary shall be properly covered to restrict dust dispersion. 9. Precautionary measures during soil excavation for conservation and protection of rare and endangered flora and fauna found in the study area. 10. Equivalent Level of Noise level shall be maintained as per standards for both day and night. 11. The route map for soil transportation from excavation plots to work site should be firmed up and necessary permissions shall be sought from District Administration. 12. Vehicles hired for the transportation should be in good condition and should have Pollution Check Certificate and should conform to applicable air and noise emission standards. 13. Approach road will be maintained periodically.

14. Personnel exposure monitoring for respirable mineral dust shall be carried out for the workers and records maintained including health records of the workers. Awareness program for workers on impact of mining on their health and precautionary measures like use of personal protective equipments etc. shall be carried out periodically. First aid facilities and adequate sanitary facility in the form of temporary toilets/septic tanks. 15. Solid waste material viz gutkha rappers, plastic bags, glasses etc. to be generated during project activity will be separately stored in bins and managed as per Solid Waste Management Rules. 16. Project proponent should maintain daily register for information of (a) collection of soil/clay, (b) manpower & (c) transportation purpose. 17. A CSR Plan (Corporate Social Responsibility Plan) with minimum Rs. 1.5 Lac/annum should be drawn up and submitted.

The project proponent is also required to comply with following stipulations as per MoEF, GOI OM No. 11011/47/2011-IA.II(M) dated 24/06/2013:

1. The borrowing/excavation activity shall be restricted to a maximum depth of 2 m. below general ground level at the site. 2. The borrowing/excavation activity shall be restricted to 2 m. above the ground water table at the site. 3. The borrowing/excavation activity shall not alter the natural drainage pattern of the area. 4. The borrowed/excavated pit shall be restored by the project proponent for useful purpose(s). 5. Appropriate fencing all around the borrowed/excavated pit shall be made to prevent any mishap. 6. Measures shall be taken to prevent dust emission by covering of borrowed/excavated earth during transportation. 7. Safeguards shall be adopted against health risks on account of breeding of vectors in the water bodies created due to borrowing/excavation of earth. 8. Workers/labourers shall be provided with facilities for drinking water and sanitation. 9. A berm shall be left from the boundary of adjoining field having a width equal to at least half the depth of proposed excavation. 10. A minimum distance of 15 m from any civil structure shall be kept from the periphery of any excavation area.
