Minutes of 255 th SEAC Meeting Date 15/01/2016

The 255 th meeting of SEAC was held in Directorate of Environment, U.P. on 15/01/2016. Following members were present in the meeting along with Secretary, SEAC:

The Chairman welcomed the members to the 255 th SEAC meeting.

The Members of SEAC unanimously taken following decisions on the agenda points discussed: • It has observed that in previous meeting the conditional E.C. was recommended subject to submission of some quires before preparation of the minutes but it was Miss Interpreted. As such in the light of above facts the SEAC took the decision that such quires raised by the SEAC if submitted before the end of the meeting and marked by the chairman and dully endorsed by the Secretary SEAC will be registered in the office record, these only considered in the meeting minutes only. If any quires submitted after that the objection/quires raised will be retained and considered in the coming SEAC agenda as per chronology.

File N0. 15 / Ent-OSD(T) The project proponent neither appeared in the meeting nor made any request to consider the matter in next meeting . The committee discussed and deliberated that project fie should be closed and should be considered in chronology after recipt of the request from the project proponent. The file shall not be treated as pending at SEIAA/SEAC.

A presentation was made by Dinesh Kumar, project proponent alongwith their consultant M/s Cognizanace Research India Private Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:- 1. During the presentation the project Proponent submitted the original letterNo. 679/kha. Li./2015, dated 22/12/2015 issued by the Mining officers, Bagpat Office of D M Bagapat that there is no other mining lease/permit is sanctioned within 500 mt of the proposed sites. 7. During the presentation the project Proponent informed the committee that (A) The distance of Mine to Mine is 340 mt. (B) The Distance of Mine to Brick Klin is 1 km.. (C) The leanth of haulage road is 1km. (D) The Total cost of the project is 30 lakh. (E) Number of Workers is 30. 8. The proposed method of mining is Opencast Manual method. 9. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006. 10. Regarding the project no litigation is pending in any court. 11. The project proposal falls under category 1(a) of EIA Notification, 2006 (as amended). 12. During the presentation the project proponent informed as follows- The applicant also submitted undertaking dated 31/08/2015 signed by project proponent and consultant that all the information/data submitted with regards to application for environmental clearance is correct and true to best of their knowledge. The committee discussed the matter and recommended grant of environmental clearance to the project proposals along with general and specific conditions as attached at annexure-1 of these minutes. The committee also stipulated following conditions : The CSR plan for Rs. 3.5 Lacks, executable work at phase wise with photographs should be prepared and detail of works to be executed with an affidavit as above is to be submitted to Directorate as well as to the District magistrate / Chief Development officers. 1. 2 number of toilets (1 gents & 1 ladies), 1 hand pump to be provided before start of mining. 2. Approach road 1.60 km katchha to be made motorable. 3. The capacity of trucks for loading purpose will be in tonnes as per PWD and Transport Department applicable norms and standard fixed by the Government. 4. Haul road shall be made motorable. 5. Li./2015, dated 22/12/2015 issued by the Mining officers, Bagpat Office of D M Bagapat that there is no other mining lease/permit is sanctioned within 500 mt of the proposed sites. 7. During the presentation the project Proponent informed the committee that (A) The longest distance of Mine to Mine is 230 mt. (B) The Distance of Mine to Brick Klin is 1.5 km. (C) The Total cost of the project is 30 lakh. (E) Number of Workers is 30. 8. The proposed method of mining is Opencast Manual method. 9. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006. 10. During the presentation the project Proponent informed the committee that (A) The Total cost of the project is 47 lakh. (b) The length of haulage road is 0.45 km. 8. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006. 9. Regarding the project no litigation is pending in any court. 10. The project proposal falls under category 1(a) of EIA Notification, 2006 (as amended). 11. During the presentation the project proponent informed as follows- The committee discussed the matter and recommended grant of environmental clearance to the project proposals along with general and specific conditions as attached at annexure-1 of these minutes. The committee also stipulated following conditions : 1. The CSR plan for Rs. 2.35 Lacks, executable work at phase wise with photographs should be prepared and detail of works to be executed with an affidavit as above is to be submitted to Directorate as well as to the District magistrate / Chief Development officers. 2. 2 number of toilets (1 gents & 1 ladies), 1 hand pump to be provided before start of mining 3. The capacity of trucks for loading purpose will be in tonnes as per PWD and Transport Department applicable norms and standard fixed by the Government. 4. Haul road shall be made motorable. 5. Green belt shall be developed around the mining site and along the haul road to mitigate noise pollution.

5. M/s Narendra Singh, Vill: Barauli Basdevpur, Syana, Bulandshahar Sri Narendra Singh S/o Shri Nepal Singh, Resd: Vanjarpur, Sadar, Gautam Buddha Nagar. File N0. Ent./128/AD(H) The committee noted that the matter was earlier discussed in SEAC meeting dated 08/12/2015 and directed the project proponent to submit following information: a. Cluster certificate of 500 meters should be submitted with exhibiting dispatch number on it. b. Affidavit regarding compliance of MoEF Om dated 24/06/2013 should commensurate to actual production. A revised certificate should be submitted ink this regards. c. Letter of intent District Magistrate. The committee also directed the project proponent to submit the information for the above which shall be heard in the next meeting. However, affidavit regarding compliance of MoEF OM dated 24/06/2013, commensurating to the actual production of 37411 cum was submitted by the project proponent during the meeting dated 08/12/2015. Cluster certificate of 500 m exhibiting dispatch no it and letter of intent from the District Magistrate was submitted on 09/12/2015 by the project proponent. The case was put up in SEAC meeting dated 19/12/2015 for discussion, the committee noted that the document, copy of certificate issued by District Mining Officer, Bulandshar which clearly state about existing operating mining areas within 500 m of the project site of “Soil Excavation” at Gata No.- 744, 777, 743 and 776, Village-Baraauli Basdevpur, Tehsil-Syana, District-Bulandshahar, U.P. on this the committee deliberated that the submitted Cluster certificate is not in order, not clear and it is vague. Revised, corrected 500 mt. cluster certificate should be submitted in this regard. The matter shall be discussed after submission of information as above. The matter was again discussed in SEAC meeting

The proponent, through the documents submitted and the presentation made, informed the committee that:- 1. The Environmental Clearance is sought for soil /clay earth excavation at Gata no. 744, 777, 741, 776, Vill: Barauli Basdevpur, Syana, Bulandshahar, (Leased Area 3.938 Ha), M/s New Priya Ent Udyog. 2. As per Form-1 and presentation; 37411.00 cum/annum of soil excavation is proposed. 3. The ultimate depth of mining will be restricted to 01 meter as proposed in PFR. 4. The water requirement will be limited to 1.5 KLD & will be supplied from water tankers. 5. During operation the maximum no. of workers will 10. 6. An affidavit dated 09/12/2015 has been submitted by the proponent regarding compliance of provisions given in MoEF OM dated 24/06/2013. 7. Mining Officer, Bulandshahar through letter no. 850/khanan lipik dated 10/6/2015 it has been informed that there is no existing operating mine within 500 m from the periphery of the proposed site. 8. The mining will be opencast type and carried out Semi mechanized as proposed in PFR. 9. This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006. 10. The project proposal falls under category 1(a) of EIA Notification, 2006 (as amended). 11. Regarding the project no litigation is pending in any court. The committee discussed the matter and recommended grant of environmental clearance for the project proposals alongwith general and specific conditions: General condition: 1. Any excavation work shall only be undertaken after obtaining permission of District Administration under related rules. 2. No change is mining technology and scope of working shall be made without approval of Authority. 3. Personnel working in dusty areas shall be provided with protective respiratory devices and they shall also be imparted adequate training and information on safety and health aspects. 4. The Authority reserves the right to revoke the clearance if conditions stipulated are not implemented. The Authority will also be entitled to impose additional environmental conditions or modify the existing ones, if necessary. 5. In case of any deviation or alteration in the project proposed from those submitted to this Authority for clearance, a fresh reference should be made to the Authority to assess the adequacy of the condition(s) imposed and to add additional environmental protection Measures required, if any. 6. Concealing factual data or submission of false/fabricated data and failure to comply with any of the conditions mentioned above may result in withdrawal of this clearance and attract action under the provisions of Environment (Protection) Act, 1986. Specific Conditions: 1. This environmental clearance does not create or verify any claim of applicant on the proposed site/activity. 2. The Environmental clearance will be co-terminus with the mining lease period. 3. This environmental clearance shall be subject to valid lease in favour of project proponent for the proposed mining proposals. In case, the project proponent does not have a valid lease, this environmental clearance shall automatically become null and void. 4. The mining work will be open-cast and JCB shall be used for excavation work as proposed. 5. Top soil should be adequately preserved and should be used for landscaping. 6. Excavated soil should be properly stored in a manner not to increase surrounding SPM level. 7. Water sprinkling should be exercised during excavation and storage of soil for suppression of fugitive dust. 8. Excavated area should be properly reclaimed and ensured that no open bore hole is left. 9. Safety measures for the people working at the site shall be duly taken care of as per law. Page 6 of 78

10. The excavation work shall be done in day time only. 11. The project boundary shall be properly covered to restrict dust dispersion. 12. Precautionary measures during soil excavation for conservation and protection of rare and endangered flora and fauna found in the study area. 13. Equivalent Level of Noise level shall be maintained as per standards for both day and night. 14. The route map for soil transportation from excavation plots to work site should be firmed up and necessary permissions shall be sought from District Administration. 15. Vehicles hired for the transportation should be in good condition and should have Pollution Check Certificate and should conform to applicable air and noise emission standards. 16. Approach road will be maintained periodically. 17. Personnel exposure monitoring for respirable mineral dust shall be carried out for the workers and records maintained including health records of the workers. Awareness program for workers on impact of mining on their health and precautionary measures like use of personal protective equipments etc. shall be carried out periodically. First aid facilities and adequate sanitary facility in the form of temporary toilets/septic tanks. 18. Solid waste material viz gutkha rappers, plastic bags, glasses etc. to be generated during project activity will be separately stored in bins and managed as per Solid Waste Management Rules. 19. Project proponent should maintain daily register for information of (a) collection of soil/clay, (b) manpower & (c) transportation purpose. 20. Norms of Transport Department/PWD shall be strictly followed during transportation of soil. 21. Green belt shall be developed around the mining site and along the haul road to mitigate noise pollution. 22. Kutchha Approach Road should be made motorable. 23. Corporate Social Responsibility (CSR) plan along with budgetary provision amounting to 2% of the total project cost shall be prepared and approved by Board of Directors of the company. A copy of resolution as above shall be submitted to the authority alongwith list of beneficiaries with their mobile nos./address. The project proponent is also required to comply with following stipulations as per MoEF, GOI OM No. 11011/47/2011-IA.II(M) dated 24/06/2013: 1. The borrowing/excavation activity shall be restricted to a maximum depth of 2 m below general ground level at the site. 2. The borrowing/excavation activity shall be restricted to 2 m. above the ground water table at the site. 3. The borrowing/excavation activity shall not alter the natural drainage pattern of the area. 4. The borrowed/excavated pit shall be restored by the project proponent for useful purpose(s). 5. Appropriate fencing all around the borrowed/excavated pit shall be made to prevent any mishap. 6. Measures shall be taken to prevent dust emission by covering of borrowed/excavated earth during transportation. 7. Safeguards shall be adopted against health risks on account of breeding of vectors in the water bodies created due to borrowing/excavation of earth. 8. Workers/labourers shall be provided with facilities for drinking water and sanitation. 9. A berm shall be left from the boundary of adjoining field having a width equal to at least half the depth of proposed excavation. 10. A minimum distance of 15 m from any civil structure shall be kept from the periphery of any excavation area.

The committee noted that the matter was earlier discussed in SEAC meeting dated 07/12/2015 wherein the project proponent was directed to submit following information: 1. Aerial distance among Mining sites and distance from mining sites to brick kiln. 2. Calculation of volume of proposed brick earth excavation on the basis of proposed brick production should be submitted (annual and total). 3. A details CSR plan of Rs. 2.05 Lakh to be submitted along with the details of beneficiary.

4. An original notarized affidavit from project proponent regarding compliance of provisions given in MoEF OM dated 24/06/2013. 5. A Revised certificate from Mining Officer/District Administration should be submitted regarding 500 m cluster situation. The project proponent submitted their replies through undated letter received on 01/01/2016. A presentation was made by Sri Ranjeet Singh, project proponent alongwith their consultant M/s ENV DAS India Pvt. Ltd. The proponent, through the documents submitted and the presentation made, informed the committee that:- 1. The Environmental Clearance is sought for Brick earth mining at Plot No. 53,171,137,334, Village - Bharwal, P.O. - Belipar, Tehsil Bansgaon, District - Gorakhpur, Uttar Pradesh.,(Leased area 2.66 Ha), M/s Asha Ent Udhyog 2. As per Form-1, presentation and documents submitted, 36708 cum soil excavation is proposed from the area 2.66ha. The project Proponent submitted the original letter No.113/2015, dated 16/10/2015 issued by the Tehsildaar, Basgoan, Gorakhpur that there is no other mining lease/permit is sanctioned within 500 mt of the proposed sites. 11. During the presentation the project Proponent informed the committee that (A) The Total cost of the project is 48 lakh. 12. The project proposal falls under category 1(a) of EIA Notification, 2006 (as amended). The committee discussed the matter and recommended grant of environmental clearance to the project proposals along with general and specific conditions as attached at annexure-1 of these minutes. The committee also stipulated following conditions: 1. The CSR plan for Rs. 2.05 Lacks, executable work at phase wise with photographs should be prepared and detail of works to be executed with an affidavit as above is to be submitted to Directorate as well as to the District magistrate / Chief Development officers. 2. 2 number of toilets (1 gents & 1 ladies), 1 hand pump to be provided before start of mining. 3. Calculation of volume of proposed brick earth excavation on the basis of proposed brick production should be submitted (annual and total). 5. An original affidavit from project proponent regarding compliance of provisions given in MoEF OM dated 24/06/2013. The committee also directed to submit the Undertaking from project proponent and consultant that all the information/data submitted with regards to application for environmental clearance is correct and true to best of their knowledge. A presentation was made by Sri Shiv Sahay Yadav, representative of the project proponent along with their consultant M/s Earthvision Envirotech Pvt. Ltd., Lucknow. The committee discussed the matter and nated that In the Khatuani the Gata no is mentioned as 194 kha but in 500 meter cluster certificate it is mentioned as 194 therefore SEAC directed the project proponent to submit the revised certificate from Mining Officer/District Administration. During the presentation the SEAC noted that the actual area of proposed gata no as per khatuani is 4.275 ha but in 500 meter cluster certificate issued by the mining officer bhadoi through letter dated 21/12/2015 the total area is mentioned as 3.48 ha which also proposed by the project proponent.

This project does not attract any of the general conditions applicable on mining projects specified in EIA Notification 14/09/2006. 6. Regarding the project no litigation is pending in any court. 7. An aunotarized affidavit dated 30/11/2015 has been submitted by the proponent regarding compliance of provisions given in MoEF OM dated 24/06/2013. 8. A letter dated 20/11/2015 from Mining Officer, Mirzapur/Bhadohi has been submitted which mentions that there is no other mining work being undertaken within 500 m of is proposed sites. 9. The project proposal falls under category 1(a) of EIA Notification, 2006 (as amended). 10. During the presentation the project Proponent informed the committee that the Maximum distance of Mine to Mine is 150 mt., Brick kiln to min 1.56 kilometer. The applicant also submitted undertaking signed by project proponent and consultant that all the information/data submitted with regards to application for environmental clearance is correct and true to best of their knowledge. The committee discussed the matter and recommended grant of environmental clearance to the project proposals along with general and specific conditions as attached at annexure-1 of these minutes. The committee also stipulated following conditions: 1. Total cost (Rs 30.00 Lakh) of the project and CSR plan for Rs. 1.50 Lakh, executable work at phase wise with photographs should be prepared and detail of works to be executed with an affidavit as above is to be submitted to Directorate as well as to the District magistrate / Chief Development officers. 2. 3 number of toilets (2 gents & 1 ladies), 1 hand pump to be provided before start of mining. 3. The capacity of trucks for loading purpose will be in tonnes as per PWD and Transport Department applicable norms and standard fixed by the Government. 4. Haul road 100 meter shall be made motorable. 5. Green belt shall be developed around the mining site and along the haul road to mitigate noise pollution.

Annexure-1

General condition for Soil Mining Projects:

1. This environmental clearance does not create or verify any claim of applicant on the proposed site/activity. 2. Any mining activity shall be undertaken only after valid permission from Mining Department/District Administration and written agreement with land owner from where earth excavation is proposed. 3. No change is mining technology and scope of working shall be made without approval of Authority. 4. Personnel working in dusty areas shall be provided with protective respiratory devices and they shall also be imparted adequate training and information on safety and health aspects. 5. The Authority reserves the right to revoke the clearance if conditions stipulated are not implemented. The Authority will also be entitled to impose additional environmental conditions or modify the existing ones, if necessary. 6. In case of any deviation or alteration in the project proposed from those submitted to this Authority for clearance, a fresh reference should be made to the Authority to assess the adequacy of the condition(s) imposed and to add additional environmental protection Measures required, if any. 7. Concealing factual data or submission of false/fabricated data and failure to comply with any of the conditions mentioned above may result in withdrawal of this clearance and attract action under the provisions of Environment (Protection) Act, 1986.

Annexure-2 Specific Conditions for Soil Mining Projects: 1. Approach kaccha road should be made motorable and maintained periodically. 2. Transportation of soil should be undertaken in covered containers. 3. Rehabilitation plan with planting of trees to be submitted along with the closure plan. 4. Land to be levelled and handed over to the owners after completion of excavation work. 5. A valid NOC from State Pollution Control Board shall be obtained for the Brick kiln prior to operation as per law and all guidelines must be followed. 6. The mining operations shall be strictly limited to the proposed mining sites and proposed purpose. 7. Top soil should be adequately preserved and should be used for landscaping. 8. Excavated soil should be properly stored in a manner not to increase surrounding air pollution level. 9. Water sprinkling should be exercised during excavation and storage of soil for suppression of fugitive dust. 10. Excavated area should be properly reclaimed and ensured that no open bore hole is left. 11. Safety measures for the people working at the site shall be duly taken care of as per law. 12. The excavation work shall be done in day time only. 13. The project boundary shall be properly covered to restrict dust dispersion. 14. Precautionary measures during soil excavation for conservation and protection of rare and endangered flora and fauna found in the study area. 15. Noise level shall be maintained as per standards for both day and night. 16. The route map for soil transportation from excavation plots to work site should be firmed up and necessary permissions shall be sought from District Administration. 17. Vehicles hired for the transportation should be in good condition and should have Pollution Check Certificate and should conform to applicable air and noise emission standards. 18. Personnel exposure monitoring for respirable mineral dust shall be carried out for the workers and records maintained including health records of the workers. Awareness program for workers on impact of mining on their health and precautionary measures like use of personal protective equipments etc. shall be carried out periodically. First aid facilities and adequate sanitary facility in the form of temporary toilets/septic tanks. 19. Solid waste material viz gutkha rappers, plastic bags, glasses etc. to be generated during project activity will be separately stored in bins and managed as per Solid Waste Management Rules. 20. Project proponent should maintain daily register for information of (a) collection of soil/clay, (b) manpower & (c) transportation purpose. 21. Soil mining shall strictly be undertaken as per rules and regulations/permissions obtained from District Administration/Mining Department 22. 2% of project cost should be earmarked for CSR activities. Firm up plan should be submitted to District Administration and to SEIAA with proposed activities and time schedule. A copy of resolution as above shall be submitted to the authority alongwith list of beneficiaries with their mobile nos./address. The project proponent is also required to comply with following stipulations as per MoEF, GOI OM No. 11011/47/2011-IA.II(M) dated 24/06/2013: 1. The borrowing/excavation activity shall be restricted to a maximum depth of 2 m. below general ground level at the site. 2. The borrowing/excavation activity shall be restricted to 2 m. above the ground water table at the site. 3. The borrowing/excavation activity shall not alter the natural drainage pattern of the area. 4. The borrowed/excavated pit shall be restored by the project proponent for useful purpose(s). 5. Appropriate fencing all around the borrowed/excavated pit shall be made to prevent any mishap. 6. Measures shall be taken to prevent dust emission by covering of borrowed/excavated earth during transportation. 7. Safeguards shall be adopted against health risks on account of breeding of vectors in the water bodies created due to borrowing/excavation of earth. 8. Workers/labourers shall be provided with facilities for drinking water and sanitation. 9. A berm shall be left from the boundary of adjoining field having a width equal to at least half the depth of proposed excavation. 10. A minimum distance of 15 m from any civil structure shall be kept from the periphery of any excavation area. Page 78 of 78
