GOVERNMENT OF INDIA SOCIAL JUSTICE AND EMPOWERMENT LOK SABHA UNSTARRED QUESTION NO:1529 ANSWERED ON:07.03.2001 INCLUSION OF BHAR CASTE IN SC LIST BABBAN RAJBHAR Will the Minister of SOCIAL JUSTICE AND EMPOWERMENT be pleased to state: (a) whether the Government of Uttar Pradesh had submitted a proposal to the Union Government to include the `Bhar` caste in the list of the scheduled castes on May 26, 1982; (b) if so, the present status thereof; (c) whether a fresh report has been called from the government of Uttar Pradesh in this regard; (d) if so, the reasons therefor; and (e) the time by which the final decision is likely to be taken by the Government thereon? Answer MINISTER OF STATE OF THE MINISTRY OF SOCIAL JUSTICE AND EMPOWERMENT (SMT. MANEKA GANDHI) (a) Yes Sir. (b)to(d) The Government has decided modalities for inclusion in, exclusion from and other modifications in the list of Scheduled Castes and Scheduled Tribes on 15.06.1999. As per these modalities, such claims are decided in consultation with the concerned State Government, Registrar General of India and National Commission forS cheduled Castes and Scheduled Tribes. The Registrar General of India, in the context of inclusion of `Bhar` in the Scheduled Caste list of Uttar Pradesh, haso bserved that the available ethnographic information on this community is not adequate to show beyond doubt that this community suffers from social disabilities arising out from the practice of untouchability. In view of observations of the Registrar General of India, the Uttar PradeshG overnment has been requested on 8.11.2000, 12.12.2000 and 19.1.2001 to furnish detailed information in respect of their justification for inclusion of `Bhar` community in the Scheduled Caste list of Uttar Pradesh. This is awaited from two State Government. (e) No time frame can be assigned, as it requires consultation with various agencies. .

Even in the case of Schoduled Castes, Scheduled Tribes and Backward Class'es the figures of each oaste were not separately extracted; only the group totals f were ascertain€d. The Backward Classes Commission require the figures of population of each individual caste~ In order to assist them an estimate of popul~tion of each, caste in 1951 has been made on the basis of the figures of the previous censuses. 2. The figuros hnve been presented in three tables - (1) Scheduled Castes, Hindus only (ii) Scheduled Tr1bos, nnd (iii) Other Gastes, Hindus and· Muslims separately. 3. No castewiso figures arc available for 1941 census. The tables of 1941 census give figuros for only a few solectod cpstes and these also for a few selec ted distric ts. 4. Commission came into existence from 9th January, 2015. 2. The Commission led by me made extensive visits, visited 20 states, held meetings with 15 State Governments, met nearly 123 communities in their locations and saw their living conditions and received nearly 834 grievances/representations from the community people, leaders and associations. 3. These visits and the grievances have given a new vision to us and views of the people, especially the down-trodden people who are yet to see the ray of hope. The publication of the document “Voices of the Denotified, Nomadic & Semi-Nomadic Tribes” is a very big effort towards achieving the objectives of the Commission.

    1 AS INTRODUCED IN LOK SABHA Bill No. 117 of 2015 THE CONSTITUTION (SCHEDULED CASTES) ORDER (AMENDMENT) BILL, 2015 By SHRI HARI NARAYAN RAJBHAR, M.P. A BILL further to amend the Constitution (Scheduled Castes) Order, 1950 BE it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows:— 1. This Act may be called the Constitution (Scheduled Castes) Order (Amendment) Short title. Act, 2015. C.O. 19 of 2. In the schedule to the Constitution (Scheduled Castes) Order, 1950, in Part XVIII. - Definitions. 1950. 5 Uttar Pradesh, — (i) for entry 18, the following entry shall be substituted, namely,— "18. Beldar, Bind"; 2 (ii) for entry 36, the following entry shall be substituted, namely,— "36. Gond, Goud, Godiya, Kahar, Kashyap, Batham"; (iii) for entry 53, the following entry shall be substituted, namely,— "53. Majhwar, Kewat, Mallah, Nishad"; (iv) for entry 59, the following entry shall be substituted, namely,— 5 "59. A large number of people belonging to castes like Bind, Bhar, Rajbhar, Gaud, Kashyap, Kabar, Godiya, Batham, Bheevar, Dheemar, Mallah, Kewat, Nishad, Kumhar, Prajapati and Turha reside in the State.

    NCBC, Annual Report-2012-13 Chapter-I Introduction Reservation and the task of listing of castes/communities has had a long history, which started from the early period of our history with Manu. Medieval chronicles contained a description of communities located in various parts of the country. Listings in the colonial period were undertaken on an extensive scale, after 1806. The process gathered momentum in course of the censuses from 1881 to 1941. The Backward Classes movement first gathered momentum in South India particularly in Tamil Nadu where reservation was introduced much before Independence. Reservation in favour of Backward Classes (BCs) was introduced even many years before Independence in most of the area comprising the Presidencies and Princely States south of the Vindhyas. In view of Article 16(4) of the Constitution and in response to demands for reservation and other benefits for Backward Classes in other parts of India and in the Centre, the Govt. of India appointed a Backward Classes Commission under Article 340 of the Constitution on 29th January 1953. The Commission, popularly known as the Kaka Kalelkar Commission, was required "to investigate the conditions of socially and educationally backward classes within the territory of India and the difficulties under which they labour and to make recommendations as to the steps that should be taken by the Union or any State to remove difficulties and to improve their conditions." The Commission submitted its report on 30th March 1955. It was considered by the Government over the next half-decade but was rejected in 1961. The Backward Classes had to wait for nearly two more decades for the next step at the Central level.
