September 14, 2016 JOINT LEGISLATIVE AUDIT AND REVIEW COMMITTEE REGULAR COMMITTEE MEETING MINUTES COMMITTEE BUSINESS • Representative Orcutt, JLARC Secretary, served as Chair on behalf of Senator Braun who was absent. Representative Orcutt called the meeting to order at 10:18 a.m. • Representative Orcutt introduced a proposed rule from the Executive Committee for adopting Committee comments on JLARC staff reports. The proposed rule would require two sponsors in order to bring a comment for adoption by the full Committee, one from each of the two major political parties. Representative Orcutt and Senator Mullet explained the intent of the rule was to demonstrate there was bipartisan support for any proposed comment. The rule would also provide more time in the schedule for members to propose and consider comments. Members voiced their opinions about the proposed rule. Representative Orcutt noted the Executive Committee will take this discussion into consideration as they consider next steps for the comment process. Representative Orcutt asked members to submit to the Executive Committee any alternative language they would prefer for the rule. (See TVW recording at 00:36) REPORTS, PRESENTATIONS, DISCUSSIONS Unaccompanied Homeless Youth – Preliminary Report Legislative Auditor’s Conclusion: Homeless youth programs need specific performance measures. Ability to evaluate outcomes hindered by state limits on collecting personal data. Rebecca Connolly and Suzanna Pratt from the JLARC staff presented the preliminary report. In 2015, the Legislature transferred one outreach and two residential programs for unaccompanied homeless youth from DSHS to Commerce. Commerce has issued grant agreements to providers who operate these programs, established a data reporting system, and begun developing performance measures. State limits on collecting personal data will impedeDraft the ability to evaluate how well these programs assist youth, and current grant agreements do not incorporate performance elements. The Legislative Auditor recommends that Commerce inform legislators about the potential impact of consent laws on data collection and analysis, and develop program-specific performance measures that can be incorporated into grant agreements. The Legislative Auditor also recommends that Commerce and OSPI issue joint guidance to counties and school districts to clarify how they can work together to improve estimates of the unaccompanied homeless youth population. Representative Orcutt invited representatives from the Department of Commerce to respond to the report. Kim Justice, Executive Director of the Office of Homeless Youth, responded to questions. (See TVW recording at 01:09:55). Alternative Process for UW Medical Facility Construction Projects: Sunset Review – Preliminary Report Legislative Auditor’s Conclusion: The Legislature should reauthorize the UW alternative process for contractor selection because timeliness and contractor performance have improved. Stephanie Hoffman from the JLARC staff presented the preliminary report. The 2010 Legislature created an alternative process that allows the University of Washington (UW) to pre-qualify contractors for certain medical facility construction projects. The alternative process ends June 30, 2017, unless the Legislature reauthorizes it. This process is intended to improve the speed of contractor selection. The Legislative Auditor recommends that the Legislature reauthorize the alternative process because timeliness and contractor performance have improved. The Legislative Auditor also recommends that UW establish timeliness goals for selecting a contractor and beginning construction, and annually monitor its progress in meeting its goals. Additionally, the UW should work with the Office of Minority and Women Business Enterprises (OMWBE) to identify the barriers it believes impede its use of certified minority and woman owned contractors and suggest remedies to those barriers. (See TVW recording at 01:13:06). Representative Orcutt invited representatives from the UW and the OMWBE to respond to the report. Amy Engal, UW Director of Special Projects, and Lawrence Coleman and Teresa Berntsen, OMWBE, responded to questions. (See TVW recording at 01:34:51).
