21. Minutes

Resolved: That the minutes of the meeting of the Joint Transportation Board held on 3 December 2019 be agreed and signed by the Chairman, as a correct record.

23. Matters Arising/Update (Including Actions from Previous Meetings)

The matters arising and actions were noted. It was queried whether, there was any progress with voting rights for Parish/Town representatives on the Board.

25. Requ est for 20 mile per hour restrictions outside St John's Primary School and Sevenoaks Primary School

The Chairman invited the Lead Petitioner, Katy Winkworth to address the Board.

The KCC Schemes Project Manager set out the report which summarised the outcome of an investigation by Officers into the feasibility of introducing 20mh speed limits in Bayham Road/Quakers Hall Lane, Sevenoaks, and Bradbourne Road/Bradbourne Park Road, Sevenoaks, and Brittains Lane, Sevenoaks. The Local

KCC Member supported the proposals and if the Board agreed to the proposals the next steps would include identifying a funding source to implement the scheme (the local KCC Member would assist with the funding from her Member Highways fund) and commence Traffic Regulation Order (TRO) consultation process.

Resolved: That

a) based on the survey results 20mph speed limits in the vicinity of the school be introduced in:

i) Bayham Road/Quakers Hall Lane, Sevenoaks between the boundary of number 14 Quakers Hall Lane and Serpentine Road and to include the entire length of Kennedy Gardens;

ii) The entire length of Bradbourne Park Road, Sevenoaks between Hitchen Hatch Lane and Bradbourne Road. Bradbourne Road, Sevenoaks between Sackville Close and Amherst Road and

b) 20mph speed limits not be introduced in Brittains Lane.

c) a funding source to implement the scheme, be identified

d) the TRO consultation process be commenced and

e) the scheme be introduced by March 2021, subject to consultation responses.

26. Request for new parking restrictions for Station Road , Otford and change to waiting times on High Street Otford

Members considered a report detailing the outcome of an investigation by Officers into the feasibility of introducing new waiting restrictions within Station Road and High Street, Otford. Officers had concluded that the measures did not meet the criteria for relieving congestion nor were considered safety critical. It was therefore not recommended that the restrictions be introduced presently.

Members discussed the report and expressed their support for a scheme to be implemented and requested that the proposal be revisited.

Resolved: That KCC Officers revisit proposals as set out in the summary of the report in consultation with the local SDC and KCC Councillors and arrange a site visit.

27. Highways Works Programme 2019/20

The Board considered a report which updated them on the identified schemes approved for construction in 2019/20 with the Sevenoaks District Manager giving

Action 1: The Sevenoaks District Manager (KCC) to follow up and report back to the local member on the safety issue for pavements in Otford.

28. Electrical Vehicle Charging in Sevenoaks

Members considered a report which set out the current and proposed future Electric Vehicle charging in Sevenoaks.

Members were advised that there were grants available for installing home charging points. Bradbourne car park had 8 charging points and if there was a demand, these could be increased. Cables were not allowed to run across public footpaths for charging vehicles. Members discussed alternative ways for charging vehicles if a property did not have a private driveway.

Resolved: That the report be noted.

29. Application for Disabled Persons (Blue Badge) Parking Bay

The Parking Engineer presented the report which detailed a proposed disabled persons (blue badge) parking bay within the District, which met KCC’s assessment criteria and had been the subject of an informal consultation with neighbours, together with Officers’ comments.

Shoreham Road, Shoreham – Request for Reduction of National Speed Limit to 40MPH

Summary: This report summarises the outcome of an investigation by Officers into the feasibility of reducing the existing National Speed Limit along Shoreham Road to 40mph. It is concluded that the location and existing speed vehicles do not meet the criteria to install an enforceable 40mph limit. As such, the current proposals are not considered for installation by KCC. For Information

1.0.1 Introduction and Background

1.1 Kent County Council has received a report from Shoreham Parish Council requesting a reduction in the existing National Speed Limit along Shoreham Road to 40mph. The report details the local communities’ concerns with road safety at this location and requests numerous highway improvements to be carried out.

2.0 Investigations

2.1 The A225 is in a unlit rural location and caters to a high volume of a variety of road users. There are few properties along Shoreham Road which are set back away from the carriageway with no existing footways.

2.2 Traffic surveys were carried out at four sites along the Shoreham Road to ascertain existing vehicle speeds. Data from the speed surveys have been provided to Shoreham Parish Council with a summary of the findings.

2.3 The key factors considered when making decisions on setting local speed limits are existing speed, collision history, road environment, road users and purpose. Most of Kent’s rural network is subject to a National Speed Limit. The posted limit is an absolute maximum and drivers are encouraged to respond in accordance to the environment and the geometric characteristics of the road. National Speed Limits are set with terminal signs placed at the start of the restrictions with no additional repeater signage required. With any reduction in the speed limit it will be necessary to install additional signage to remind drivers throughout the route of the set limit. There is a risk a driver may believe that it is safe to consistently drive at the new stated speed limit throughout the route which is likely to be inappropriate when negotiating hazards such as bends.

2.4 Within the report the Parish Council have expressed concerns with pedestrian safety and requested the installation of pedestrian refuge islands between the bus stops at Shoreham Railway Station and the Public Rights of Way. Further investigations would be required to establish the demand in pedestrians crossing within the vicinity, without the presences of existing footways in would be difficult to install the islands. It would also be necessary to identify funding for the investigations.

3.0 Recommendations

3.1 The data retrieved from the traffic survey did not support the reduction to 40mph without the use of engineering measures. To implement a successful self-enforcing 40 limit along Shoreham Road it would be necessary to change its environment, so the driver understands the need to reduce speeds.

3.2 The proposed 40mph speed limit does not receive support from Kent County Council following investigations and the existing traffic speeds, we do not feel it would be appropriate to install at 40mph knowing compliance of the limit is unlikely which could itself lead to future safety concerns:

3.3 If the Parish Council would like to discuss in further detail their concerns at this location and would like to explore the possibility of exploring other types of highway improvements a meeting can be arranged with a the Schemes, Planning and Delivery Team however this work may be delayed until 2021, due to SPD’s priority work on the Emergency Active Travel Fund.

4.0 Conclusion

4.1 Kent County Council are not able to support the proposals to lower the speed limit to 40mph. A meeting may be required with the Schemes, Planning and Delivery Team and the Parish Council to discuss other available improvements that will aid in alleviating their concerns with road safety.

Recommendations to Sevenoaks Joint Transportation Board:

That the Board

(a) notes the applications for parking bays for disabled persons (blue badge)

i) which did not meet Kent County Council’s assessment criteria, and will proceed no further, which are set out in Appendix 1 of this report;

ii) which met Kent County Council’s assessment criteria and has been the subject of an informal consultation with neighbours, together with Officers’ comments, which are set out in Appendix 2 of this report; and

(b) considers the proposed actions set out in Appendix 2(ii).

The disabled persons (blue badge) parking bay scheme is aimed at providing better management of the public highway, in line with current legislation and the Highway Code

Introduction

1 Kent County Council (KCC) has the power to provide on-street parking places on roads within its area for which it is the traffic authority for the purpose of relieving or preventing congestion on the public highway.

2 This power is frequently exercised to establish disabled persons’ (blue badge) parking bays (DPPBs) close to the homes of disabled persons who would otherwise have difficulty parking near to their homes.

3 An application process exists, through which a person can request that a DPPB is established close to their home.

4 The District Council administers local requests for DPPBs on behalf of KCC, and manages and funds their provision.

5 KCC has produced an application form and guidance notes for requests for DPPBs, which is available for applicants to download from the District Council’s website.

6 KCC has also produced personal and locational assessment criteria for the District Council to use when considering applications.

7 If an application satisfies KCC’s assessment criteria, neighbours who may be affected by the provision of a DPPB are then informally consulted, and any feedback received is reported to the Joint Transportation Board, together with Officers’ comments and proposals.

8 If representations are received during the informal consultation, and these are upheld, the application will proceed no further.

9 In cases where there have been no representations or the representations received are overruled, a DPPB can be installed.

10 An interim DPPB is usually introduced in the first instance in residential areas on an “informal” basis, and without a traffic regulation order (TRO). This means that the DPPB can be marked on the road shortly after the application has been approved, but has no legal status and cannot be enforced.

11 A DPPB can be used by any vehicle displaying a current disabled persons’ blue badge, and is not for the sole use of any person or vehicle.

12 Where there is a known pressure on parking, or a DPPB is abused by non- blue badge holders after its introduction, a TRO would be made, thereby making it enforceable.

13 The purpose of this report is to advise the Board on the locations of the latest applications for a DPPB received from individuals that have been evaluated in accordance with the highway authority, Kent County Council’s (KCC’s) assessment criteria.

14 For those applications that satisfied the assessment criteria, the Board is requested to consider any feedback received to the informal consultation with the occupiers of neighbouring addresses, together with Officers’ comments and proposals.

15 Appendix 1 of this report contains details of the latest applications for a DPPB, which did not meet KCC’s assessment criteria and will proceed no further. These applications relate to the following locations:

– London Road (section fronting nos. 178-184)  – Claremont Road (2 applications – section fronting nos. 1-27)

16 Appendix 2 of this report contains details of latest applications for DPPBs, which met KCC’s assessment criteria and have already been the subject of an informal consultation with neighbours. These applications relate to the following locations:

Financial

The costs incurred in administering local requests for disabled persons (blue badge) parking bays on behalf of Kent County Council and in managing their provision and ongoing maintenance are met by the District Council from its on-street parking account operated under the Agency Agreement with the County Council.

Legal Implications and Risk Assessment Statement

There is no legal requirement to undertake an informal consultation, and there are no legal implications to installing an interim disabled persons (blue badge) parking bay on the public highway.

However, a traffic regulation order (TRO) must be made under the Road Traffic Regulation Act 1984 and a sign installed before the parking bay can be enforced, and to do this, a formal (statutory) consultation procedure must be followed in accordance with The Local Authorities’ Traffic Orders (Procedure) ( and Wales) Regulations 1996. Any formal objections received during this statutory consultation would be reported to a future meeting of the Sevenoaks Joint Transportation Board.

Equality Assessment

The recommendation of this report has a remote or low relevance to the substance of the Equality Act. There is no perceived impact on end users.

Safeguarding Children and Vulnerable Adults

The report deals with the assessment of applications for disabled persons’ (blue badge) parking bays, in line with KCC’s policy and assessment criteria.

INFORMAL CONSULTATION FEEDBACK

1. I live very close to this property and I am aware of the need. This particular row of houses is always congested with vehicles (like everywhere) and this is I suspect brought about by convenience and proximity to front doors. Every property in Claremont Road has off road parking and a garage (or space) so space for 2 vehicles generally. I would support this application, given my comments above, and the access to garage and parking spaces they have behind their properties. (Cllr D Kitchener)

2. I have no objections to a disabled bay here. (County Cllr M Horwood) 3. I am writing as the applicant’s Power of Attorney. The applicant has had the use of a blue badge for a number of years and has medical complications which have resulted in constant pain and restricted mobility. The applicant’s car provides independence for day to day living and social interaction, and a lifeline to the outside world.

As indicated on the application, the applicant owns and has use of a garage which is located in a separate area behind their property with access from a side road. This area is shared with a number of other households. The applicant has been unable to use this facility due to their medical condition, and therefore has to park outside the front of her property in the road, providing relatively easy access to and from their vehicle - particularly important when carrying shopping and other items. On many occasions, however, due to neighbours with multi-car households and visitors also parking on the road, the applicant has been unable to park in close proximity to their house, and the arrival of new neighbours with three vehicles has now compounded an already difficult parking environment, thereby causing much distress and anxiety. The applicant is extremely worried that if they go out in their car they may not be able to park outside their house to the point where they are seriously considering stopping driving. If this happens, the overall impact on both their independence and general wellbeing will be devastating. There is no doubt that the situation is having a detrimental effect on their health. I very much hope that having considered the applicant’s personal circumstances you will be able to make a favourable decision regarding their application in order for them to continue to lead a fulfilling and independent life as their medical condition allows.

NEW ASH GREEN: Penenden

INFORMAL CONSULTATION FEEDBACK

1. I have a few thoughts around this application as follows: Parking on Penenden, as most places, is at a premium at present. One reason being is that garages are not being used, as cars are much bigger now, they won’t fit it! Bushes have been removed next to the garage (of the applicant). Could this not be used for extra width on the driveway! It appears the residents have a 2nd car so they would have 1 car on the driveway and 1 car in the disabled bay. If allowed. Would this be fair? Residents have been asking for some time for extra parking spaces, however the Residents Society say this is not possible! In my opinion there are several spaces that could be used for parking. I have sympathy for the resident in question, however I believe another resident is disabled, would that mean if they parked on there would that cause a problem?

2. I would question that a reserved disabled bay is required as all the properties have a dedicated driveway attached to the rear of each house with gated access to the rear garden from the driveway. I would therefore like to register my view that the disabled bay application be rejected as parking on the road is always busy and spaces are always at a premium and the loss of space will cause inconvenience to many residents.

3. We are vehemently opposed to a blue badge bay as there is not a requirement for a disabled resident to have further parking. Each of the properties in the vicinity has its own parking bay in the form of a short driveway in front of their own garage. If the application is from a resident other than from numbers 124-132 & 79-84 then there are parking bays that do no cause an obstruction closer to those homes. From our own driveway a car parked in the position indicated would block our vision when pulling out and could cause an accident. One other possible consideration is the fact that a number of properties in Penenden are being rented and regularly change residents; if the application is from one such resident then in the future the space will be obsolete. Please do not grant this unnecessary application. 4. The Amenity Committee of New Ash Green Village Association has no objection to the provision of a disabled persons parking bay in Penenden, in the location shown. 5. The Penenden Residents Committee has no objections to the position of the proposed disabled bay. We have not contacted the residents in the area about the proposed bay, and are only confirming that the proposed position does not block any paths/access.

A parking bay is required on the public highway to provide for the applicant’s mobility and accessibility needs, as the applicant is currently unable to use their off-street parking due to their disability.

Parking already takes place in the location of the proposed parking bay, and hence the provision of a parking bay is unlikely to worsen visibility from adjoining driveways.

Adaptations are planned to the applicant’s hardstanding, which it is hoped will enable them to use their off-street parking. If the parking bay is no longer required once these adaptations have been completed, it can be removed.

PROPOSED ACTION

That, subject to any comments, the application be approved, and an interim disabled persons (blue badge) parking bay be marked.

The need for the parking bay will be reassessed, once the planned adaptations to the applicant’s hardstanding are completed.

These petitions were presented to the Sevenoaks Joint Transportation Board meeting on 3rd December 2019. The request related to concerns relating to congestion, pedestrian accessibility and anti-social parking.

1.2 At the March 11th 2020 Sevenoaks JTB, a paper was presented by KCC, with findings that no action to be undertaken at that time. The conclusion in the Paper received criticism from the JTB. It was agreed that KCC Officers would discuss the matter further with KCC Member Roger Gough. This Paper outlines the summary of the discussion held via video call, held 12th August 2020.

2.0 Discussion via Video Call, 12th August 2020

2.1 The Paper presented to the JTB Board in March 2020 was discussed.

2.2 At the end of the discussion it was agreed that Cllr Gough would gather further location details from Otford Parish Council, of where the Parish felt there were problematic hotspots caused by parking, impacting pedestrian access and creating congestion.

2.3 KCC’s Schemes Planning & Delivery Team is currently experiencing exceptional service demand. SPD Team must focus on the delivery of the Government’s recently announced Emergency Active Travel Fund and the securing of the second phase of a significant injection of funding for the highway network in Kent. agreed that upon receipt of the information from Otford Parish Council, KCC would review and reinvestigate the parking issues, but progress may be delayed, potentially until 2021, whilst work on the Emergency Active Travel Fund was prioritised.

2.4 It was also agreed that where possible, it was important to collect representative site data, outside of any further future Lockdowns (due to Covid19), school holidays, etc.

3.0 Reinvestigation

3.1 Parking reinvestigation in Otford will depend on the details to be provided by Otford Parish Council, but is likely to involve:

 Review of the specific location details to be provided by Otford Parish Council (ie. in relation to physical setting, road width, footway availability, proximity to key destinations like the school and the train station, proximity to formal crossing points, any existing parking restrictions).

 Data collection via video capture, on different days / at different times, to better understand the extents and nature of any problematic parking.

 Discussions with Otford Parish Council.

 Discussions with the KCC Member

 Discussions with Sevenoaks District Council’s Parking Team.

3.2 This will allow Officers to consider the most suitable next steps, based on the information collected and discussions held.

4.0 Conclusion

4.1 A meeting was held with Cllr Gough and KCC Officers in August, to discuss the Otford parking issues raised at previous Sevenoaks JTBs. KCC Officers are to be provided with specific location information by Otford Parish Council, on where they feel there are particular problematic parking hotspots in Otford.

4.2 KCC Officers will reinvestigate this matter through collecting site data and discussions. This investigation may be delayed until 2021, due to SPD’s priority work on the Emergency Active Travel Fund, relating to the Covid19 pandemic. KCC Officers will continue to work with Cllr Gough on this matter, as the reinvestigation progresses.

1. Introduction

This report provides an update and summarises schemes that have been programmed for delivery in 2019/20.

Kent County Council has agreed a substantial increase in the budget for planned highway works over the next three years, and as a result we are still in the process of identifying and designing schemes for inclusion in our full Year One to Two (2019/20 and 2020/21) and Year Three to Five (2021/22 to 2023/24) programmes. Because of this, we have decided to publish an interim programme, and to publish the full programmes later this year. For some assets this interim programme covers approximately the first six months of 2019/20, whilst for others it includes most of the works planned for the whole year.

This programme is subject to regular review and may change for a number of reasons including budget allocation, contract rate changes, and to reflect KCC’s changing priorities. The programme and extent of individual sites within the programme may also be revised following engineering assessment during the design phase.

Local Growth Fund

Local Growth Fund programme update for Sevenoaks Borough

The Department for Transport (DfT) added £100m to the Local Growth Fund (LGF) pot in order to fund Local Sustainable Transport Fund Style schemes. KCC subsequently submitted four Local

Sustainable Transport Fund (LSTF) capital bids 1) East Kent – A network for Growth, 2) Kent Thameside – Integrated door-to-door journeys and 3) West Kent – Tackling Congestion. The fourth was for Tonbridge Town Centre Regeneration, which included a highway improvements scheme in the Lower High Street as well as additional LSTF style measures. The objective of all of the capital bids is to boost economic growth by decreasing carbon emissions and reducing congestion.

The Kent Thameside, West Kent and Tonbridge Town Centre Regeneration bids were all successful. The schemes aim to:

 improve access to employment and services  reduce the need to travel by the private car  enhance pedestrian, cycle and public transport facilities  improve sustainable transport connections

The following schemes have been submitted as part of the successful Kent Thameside LSTF this financial year.

Scheme Status Swanley Train Station - Forecourt The Swanley Station forecourt scheme includes the Improvements refurbishment of the station building, improvement to the forecourt on the South Side of the station to improve the walking route through the forecourt onto the overbridge, extension of the North Side entrance to create a more visible station entrance improved cycle storage, signage and implementation of a one-way system on Station Approach (TRO to be progressed). Resurfacing of Station Approach to be completed as part of scheme. New tenancy premises will be created as part of the increased ticket office and booking hall area. The Tender for construction was issued to a number of pre- qualified suppliers with a return date of 21st February 2020. These suppliers provided tender submissions for the project in mid-February and a period of review ensued including interviews with the short listed bidders. The evaluation process was nearing completion in early March when the Covid-19 pandemic started to materially impact general business activities. On this basis, SE asked all bidders to confirm they remain interested in competing for the scheme and if so, how their original submission is impacted by the current Covid-19 restrictions in a number of areas including: their proposed methodology, impact on their proposed programme and the resultant impact on costs. The revised submissions have been received and reviewed and recommendation report produced. Contract to be awarded in August for project mobilisation in late Summer. We are waiting on an updated programme. Planning permission has been granted. South Eastern to commission pre-scheme passenger surveys so monitoring data can be gathered pre-construction. South Eastern continuing to work on disabled access footbridge option with consultants, high level feasibility report issued (this will not be funded as part of the scheme). Monthly
