TERMS & CONDITIONS By using a ticket (the “Ticket”) to attend a show at The Burton Cummings Theatre for the Performing Arts, located at 364 Smith Street, Winnipeg, MB, the Ticket user, on their own behalf, on behalf of any person for which they are the parent/legal guardian and on behalf of the end use of the Ticket (collectively the “Attendee”) agrees to adhere to these terms and conditions, as well as the terms and conditions printed on the reverse side of each Ticket and any other terms and conditions TN Arena Limited Partnership by its General Partner TN Arena Inc. (“True North”) may implement for a show, which may be amended from time to time. If the original purchaser transfers a Ticket to any individual, the purchaser agrees to bring these terms and conditions to the attention of the transferee. Tickets must be purchased in groups that have been predetermined by True North (for example, two (2), four (4), six (6) seats, etcetera) (the “Ticket Group”). To ensure a safe environment at a show, the Ticket purchaser must purchase all the Tickets in a selected Ticket Group. The Attendee must follow all presented instructions while attending a show. An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By attending a show, the Attendee voluntarily assumes all risks related to exposure to COVID-19. In order to help ensure the health and safety of those attending a show, the Attendee must wear a face covering at all times when the Attendee is not seated with their Ticket Group. The Attendee hereby agrees not to attend a show if the Attendee: (i) is experiencing or has come into close contact with anyone with onset of a fever of 38⁰C or higher, cough, sore throat, shortness of breath/difficulty breathing, loss of taste or smell; (ii) is experiencing or has come into close contact with anyone with onset of 2 or more of the following symptoms: runny nose, muscle aches, fatigue, pink eye, headache, skin rash of unknown cause or nausea; (iii) is waiting for results of a laboratory test for COVID-19 or has been in contact with anyone who is confirmed to have COVID-19; (iv) has been in a setting in the last 14 days that has been identified by public health as a risk for acquiring COVID-19, such as on a flight, in a workplace with a cluster of cases, or at an event; and/or (v) has travelled outside of Manitoba in the last 14 days, excluding travel to Western Canada, the Territories or Ontario (West of Terrace Bay). While in attendance at a show, the Attendee will use best efforts to social distance from any and all individuals who are not members of their Ticket Group and to adhere to all COVID-19 related protocols implemented by True North and as amended by True North from time to time. The Ticket purchaser may only transfer the Ticket: (i) if all the Tickets purchased for a Ticket Group are transferred to another group; or (ii) if only some of the Tickets purchased are being transferred, the original purchaser uses the utmost discretion in inviting a new individual into the Ticket Group, keeping in mind risk of exposure. True North reserves the right to request and disclose the name of each Attendee using a Ticket to enter a show for contact tracing purposes only. The Attendee hereby: (i) accepts and voluntarily assumes sole responsibility for all risks and dangers of serious injury, including permanent disability, illness, disease, paralysis, death and/or the transmission of any communicable disease, including COVID-19, which may arise by the Attendee attending a show; (ii) understands and agrees that the risks and dangers mentioned above may be caused by the Attendee’s own actions or inactions, the actions or inactions of others attending or involved in a show, the condition in which a show takes place, and/or the negligence of the Releasees named below; (iii) irrevocably and unconditionally releases and forever discharges Winnipeg Jets Hockey Club Limited Partnership, Winnipeg Jets Hockey Club Inc., The True North Entertainment Complex Limited Partnership, True North Sports & Entertainment Limited, TN Arena Limited Partnership, TN Arena Inc., TN Hockey Limited Partnership, TN Hockey Inc., the show promoter, any other event organizer (iv) and their respective parents, subsidiaries, affiliates, directors, officers, shareholders, unitholders, employees and agents, other volunteers and attendees, any sponsors, advertisers, and each of their respective successors, administrators, assigns, heirs and legal personal representatives (collectively, the “Releasees”) of and from all injuries, liabilities, damages, actions, suits, obligations, duties, acts, omissions, misfeasance, malfeasance, losses, expenses, costs, rights of indemnity and all other claims and rights whatsoever (collectively, the “Liabilities”), whether or not known or anticipated and whether or not due to the negligence of the Releasees, which the Attendee ever had, now has or may in the future have against the Releasees for or by reason of the Attendee’s attendance at a show; and (v) covenants and agrees to waive any claim and not to institute legal proceedings against any Releasee for any of the Liabilities that have been released and discharged herein, and further agrees to defend and indemnify the Releasees from and against any and all legal proceedings that may be instituted on the Attendee’s behalf. Tickets are intended for personal use by the Attendee and are not intended for resale, whether commercial or otherwise. The Ticket may not be offered for resale in any manner which would violate any law or regulation. The Ticket may not be offered, sold or otherwise used in connection with any advertising or public promotion of any business (including by way of contests, sweepstakes, giveaways or otherwise). Tickets obtained from unauthorized sources may not be honoured. No ticket refunds or exchanges. Tickets cannot be replaced if lost, stolen or destroyed. The Ticket is a limited, revocable license to attend the specific show described thereon and may be withdrawn and admission refused at any time by True North in its sole discretion. The license granted by the Ticket will automatically terminate if any term is breached. The Attendee grants permission to True North and its respective agents, affiliates and licensees to utilize in perpetuity, without further authorization or compensation of any kind, the Attendee’s image, likeness, actions and statements in any live or recorded audio, video or photographic display or other transmission, exhibition, publication or reproduction made of, or at, a show (or activities carried on in connection therewith) in any medium or context for their respective marketing, advertising and/or promotional activities, and/or for exhibition incidental to any live or recorded video display, broadcast or other transmission or reproduction of a show in whole or in part. While attending the show, the Attendee agrees to: (a) abstain from using foul, obscene or abusive language or actions, or fighting; (b) abstain from engaging in unruly or careless behavior; (c) abstain from having a level of intoxication that creates a disruption to those around them; (d) abstain from engaging in indecent exposure; (e) abstain from wearing obscene or indecent clothing; (f) abstain from smoking (including vapourizers); and (g) adhere to all COVID-19 related protocols. Violators will be removed from the show and no refund of the Ticket price or any other compensation will be given. The Attendee consents to an examination of his/her person and any personal belongings (including through the use of a magnetometer) before entering a show to ensure compliance with the requirements outlined above. Refusal to submit to the search will result in denied entry to the show. .
