Subject Environmental Services Report Month June 2021

RECREATION SERVICES Parks The new Windermere Beach playground has been installed and the beach is open for the season.

Crossroads Ballpark has been open for a few weeks now with Minor Ball practicing twice a week. Adult Slo-pitch is awaiting the green light for the resumption of adult sports. Tie Lake and Elk Valley Regional parks opened on May 1st. Larry Poch and Janette Auchterlonie have returned to Elk Valley Park for another season of maintenance. A student will maintain Tie Lake Park (and all other parks in Electoral Areas B, C and E).

INVASIVE PLANT PROGRAM Invasive plant management plans (as required/requested in letters sent in April) have been trickling in and follow up warning letters for non-compliant sites (sites that have not responded with management plans) have been issued. Neighbourhood Invasive Plant Program applications have been received and the Weed Control Officer has started site visits/inspections.

MOSQUITO CONTROL Morrow BioScience is in the last year of their five-year contract and has started monitoring sites for active larvae. The mosquito control Pesticide Use Notice has been received from the province as renewed for another five years and will be added to the RDEK’s Pesticide Management Plan.

SOLID WASTE Koocanusa seasonal bins were placed on Friday, May 21st.

Columbia Valley Fire

There has been an increase in Motor Vehicle Incidents within , some very serious. The incidents are resulting in traffic being backed up through Hwy 93/95.

New recruit training is nearing completion, with good results from the candidates. We have three more requests from individuals in Fairmont showing interest in joining the department.

Elk Valley South Country Fire

Training remains mainly face to face, with some virtual training when it is suitable.

Jaffray Fire Department has responded to a number of set fires at the Tie Lake Transfer Station. These fires are concerning due to the potential for injury to the public, injury to a firefighter, or the fire progressing into uncontrolled wildfire.

Generally, incident numbers for our area continue to be low due to a variety of contributing factors: COVID-19 protocols, good travel conditions, limited back country recreation, and less than ideal burning conditions.

Jaffray has one new recruit firefighter to report. Staffing levels remain a concern.

East Kootenay Emergency Management Program (EKEMP)

Regional Emergency Operations Center (REOC) The REOC is activated at Level 2 in support of Fairmont Hot Springs, due to debris flooding on Coldspring and Fairmont Creeks. A major rain event on May 24 resulted in the accumulation of debris in the creek systems, prompting an Evacuation Alert for 229 addresses. The Alert remains in effect due to the reduced capacity in the debris traps.

Freshet Current snowpack levels are slightly below normal, but could change depending on weather between now and early July. Sandbag supplies are staged and available across the region, with sandbag stations set up for preparedness purposes.

COVID-19 Cases are declining across BC and over 65% of adults in BC have received their first dose of the vaccine. Anyone aged 12 and older may now register to receive a vaccine. BC has issued a new 4 Step Restart Plan - currently in Step 1 – and we are starting to see some of the restrictions being relaxed.

Emergency Support Services (ESS) Program Delivery As we progress through the transition, existing ESS volunteers continue to sign on with the Canadian Red Cross (CRC) renewing their commitment to the ESS program. Additionally, we have a number new recruits registering to be ESS volunteers with the CRC. Recruitment drives are planned for the Fall.

Emergency Management Training The EKEMP hosted an EMBC Finance and Claims Process review session on May 20, 2021 that was virtually attended by CFOs and finance staff from across the region.

Evacuation Route Planning A project partners meeting was held on May 20, 2021 to discuss scope and deliverables for the Evacuation Route Planning project. The Request for Proposals will be issued at the end of May.

FireSmart The RDEK Fire Smart program is led by the temporary Wildfire Resiliency Supervisor position. Staff have awarded two service contracts for Local Fire Smart Representative services and are actively re-engaging with communities. A Communications Plan has been prepared and initiated; staff anticipate an increase in neighborhood Fire Smart activity due to the added advertising of our program. The RDEK continues to collaborate with the province to see Fuel Reduction projects completed adjacent to at- risk communities across the East Kootenay region.

REQUEST Consider prepayment of part of the grant approved for Angel Flight East Kootenay (Angel Flight).

OPTIONS 1. THAT the five-year, $500,000 grant to Angel Flight East Kootenay be paid on the following schedule: 2021 - $300,000 2022 - $50,000 2023 - $50,000 2024 - $50,000 2025 - $50,000

2. THAT the request from Angel Flight East Kootenay to accelerate payment of their approved grant to include a $300,000 payment in 2021 be denied.

BACKGROUND/ANALYSIS Attached is a request from Angel Flight to receive the majority of their approved $500,000 grant in 2021 to enable the purchase of an aircraft. The grant of $100,000 per year for five years was approved by the Board to enable the purchase of a pressurized aircraft certified to fly in icing conditions, with the expectation that Angel Flight would be able to finance the purchase and make payments with the revenue stream from the RDEK. Angel Flight has been unable to obtain the required financing, and is now requesting that $300,000 of the funds be paid in 2021 to complete the purchase without borrowing.

SPECIFIC CONSIDERATIONS Financial - Taxation In order to maintain the taxation as $100,000 each year, the payment could be treated as a pre-payment of the future years’ grants. While this is not a common practice, a similar approach was used for grants for the purchase of Lot 48 in Fairmont, to enable a one-time contribution that was then funded through taxation over a number of years. Risk Management If funding is being contributed up-front rather than over a longer period of the service, it will be all the more important to apply due diligence in ensuring the funds are used for the continued provision of the Angel Flight services. As such, the funding agreement would include terms requiring adequate insurance and providing security that funds would be returned to the RDEK if the aircraft is sold or Angel Flight services are discontinued. We have been trying to finance the purchase of a suitable aircraft using the RDEK plan of $100,000 a year.

The bank we spoke to would not finance the total purchase price and would not lend money to pay the taxes.

Our five year financial plan revealed that having covered all cost associated with the purchase and allowing for the annual fixed costs to run the aircraft we could only support and pay off a loan that was not enough to cover purchasing an aircraft this year. We then tried to raise extra capital and have had some success with Teck and CBT (still to be confirmed) A further complication is that CBT and the bank will only advance funds after we have a confirmed deal on a specific aircraft and this results in a lag of several weeks before we can pay for the aircraft which may prove to be a problem.

Therefore we are asking for a restructuring in the RDEK grant to $300,000 this year and $50,000 in the remaining 4 years. This will allow us to go ahead with the purchase of the aircraft this year and being operational this winter. It also means we will not require a bank loan and a considerable saving in interest to the bank which can now be used to support the operation.

Further, we are planning on opening a separate account for the RDEK money to be paid into and a very clear and simple way to track and see were that money has gone. If we could limit the required audit to that account we could also make a considerable saving in audit costs over the period.

Those favouring person to person cited the importance of the in person dynamics and the sense of meeting as a commission which is diminished in the Zoom venu has I prefer in person although the members were split on this. one member has great difficulry with 5 zoom because of poor internet service in the area.

RECOMMENDATION Option 1

BACKGROUND/ANALYSIS This year, 125 proposals were submitted to the Columbia Basin Trust Community Initiatives and Affected Areas Programs. Each proposal was reviewed to ensure it was complete and met the Program qualifications. Two proposals were withdrawn and two proposals did not meet the eligibility requirements leaving 121 proposals in total. District of Elkford, Electoral Area G, Village of Radium Hot Springs and Village of Canal Flats were undersubscribed.

The community involvement meetings did not take place again this year due to the COVID- 19 pandemic and concerns for public safety. Although the public meetings were not held an electronic engagement website for the public to comment on submitted proposals was created. The engagement site provided an opportunity for the public to review the proposals and provide comments to specific areas. There were over 3,100 unique visits to the engagement site between March 1 and 23, 2021. The 2021 survey received a 136% increase in respondents over the 2020 survey with 1,146 comments compared to 2020’s 486. All comments were forwarded to the areas to assist with their adjudication of the proposals.

BACKGROUND/ANALYSIS Attached is a request and budget from the Elk Valley Minor Hockey Association to reallocate a portion of their 2020/2021 Columbia Basin Trust Community Initiatives Program grant. The original application project budget included the purchase of two full sets of jerseys for the girls hockey team. They purchased one set of jerseys and were then awarded funding to purchase a second set of jerseys through the McAdams program that became available after they applied to the CBT program. The request includes an extension to the project completion date of August 30, 2021. Any unused funds will be returned to the CBT program. The Elk Valley Minor Hockey Association was awarded $5,922.50 from the districts of Elkford and Sparwood, City of Fernie and Electoral Area A.

Hi Nikki Our original project was Elk Valley Minor Hockey - female team jerseys Our intake year was 2020 We were able to purchase 1 set of jerseys, it was brought to our attention after we had applied that we were able to apply through the McAdams program to get a second set of jerseys at no cost to the association so we applied for that as well. and were successful. This left us with remaining funds from RDEK/CBT We are hoping to use these funds to purchase goalie gear for our female program. REQUEST Consider the letter received from the Ktunaxa Nation Council (KNC).

OPTIONS 1. THAT a report be prepared outlining the process necessary to enact a vessel operation restriction regulation for consideration in relation to future project priorities.

2. THAT the Ktunaxa Nation Council be advised that the RDEK is not prepared to undertake a vessel operation restriction regulation application at this time.

RECOMMENDATION Option 1. Because the issue of boating regulations is occasionally raised in relation to local lakes and rivers, a full understanding of the process to apply for such a regulation and the responsibilities associated with sponsoring such a regulation will help the Board determine how to deal with present and future requests.

BACKGROUND/ANALYSIS Since 2019, the RDEK has periodically heard from area residents and others about their desire for vessel operation restrictions on the St. Mary River. Such a regulation is enacted by the federal government under the Canada Shipping Act. Only certain entities, such as local or provincial governments, can apply to have such a regulation enacted, and then become responsible for certain aspects of its implementation, including regulatory signage. Much upfront work is required before a regulation can even be applied for. Last summer, it was my understanding that a group of concerned local residents had formed and were preparing a detailed plan to undertake the work necessary to apply for such a regulation, and that this plan was going to be presented to the Board along with their request to have the RDEK sponsor the regulation. The recent letter from the KNC raises the issue of if the RDEK would undertake and lead such an application process, or sponsor a community group who would undertake the work to make such an application, or does not wish to be involved at this time.

Topic: Maintenance Funding for Disaster Mitigation Infrastructure in Communities with Low Population Density. Cabinet Minister: Honourable Mike Farnworth Minister of Public Safety and Solicitor General Background Information: Disaster mitigation infrastructure is capitalized through a variety of grants and funding streams and borrowing tools, however the ability to fund the maintenance of the infrastructure in areas with low populations can be cost prohibitive for the residential tax payer despite the fact that the area requiring the protection and ongoing maintenance is a significant and popular tourism destination attracting visitors from all over the world and contributing towards the provincial economy annually. We know that when we report a state of local emergency and news stations pick up the story the area directly impacted may be small but tourism throughout the entire Columbia Valley is impacted. We also know that 70 – 80% of new residents and investors are visitors to our area first (src. Kootenay Rockies Tourism) which suggests an even greater economic dependence on tourism and the safety of visitors. There are two areas: 1. Fairmont Flood and Landslide: This year Director Consent was required to increase service area funding by over 300%, which fortunately was less than it would have been without the Adaptation & Resilience Disaster Mitigation Program (Invest in Canada Infrastructure Program) funding. 2. Windermere Creek: we know there is a disaster in waiting based upon hydrology reports dating back to 2012 however with less than 50 residential properties potentially directly impacted we are unable to create a service area. To fund the maintenance of the recommended mitigation infrastructure it will be cost prohibitive for the residential tax payer in the area. Lives and property could be lost and a local economy damaged due to our lack of maintenance funding mechanisms. And instead EMBC will fund the clean up of events to the tune of $500,000/event which would more than cover the cost of several years of maintenance. Request: Provide a revenue source for local government to fund ongoing maintenance of critical public safety and disaster mitigation infrastructure through Emergency Management BC as preventative funding instead of response funding. Topic: Tourism Infrastructure Funding for Electoral Area A Cabinet Minister: Honourable Melanie Mark Minister of Tourism, Arts, Culture and Sport Background Information: The Elk Valley is an outstanding four-season area where high volumes of adventure seekers, mountain enthusiasts, and outdoor recreationists of all kinds come to experience the natural surroundings and range of outdoor activities. Resort municipalities receive funding to support basic infrastructure within their communities, whereas the electoral areas have no funding source. Typically, the

Currently the RDEK is working in partnership with Tourism Fernie on a Sustainable Tourism Study that will assess the impact of the tourism in the Electoral Area A of the Elk Valley. The study will be finalized by September 2021 and will identify the need for sustainable funding to support degrading and heavily used basic infrastructure and include anticipated financials. Topic: Financial Assistance for Emergency Response Costs (EMBC) Ministry Staff: Emergency Management BC Background Information: The implementation of the draft Financial Assistance for Emergency Response Costs September 2020, a Guide for First Nations and Local Authorities will have profound, long-lasting, operational and financial impacts on the RDEK and other local governments across BC. The RDEK has serious concerns with many changes proposed in this document that do not support local government nor seem to align with current legislation. Given that the Emergency Program Act (Act) is currently under review and modernization, consideration that the Act not be drafted to fit the Financial Assistance Guidelines, but rather the Financial Assistance Guidelines should work with and complement the modernized Act. Request: The RDEK requests that due to the lack of local government involvement during the development of the new Financial Assistance for Emergency Response Costs – A Guide for First Nations and Local Authorities, that the draft guidelines be set aside and a truly collaborative process with UBCM, local governments, and EMBC be initiated to develop a new and equitable guideline for both EMBC and local governments, aligned with a modernized Emergency Program Act. Topic: BC Hydro Pole Rental Sales Ministry Staff: Honourable Lisa Beare Minister of Citizens' Services Background Information: Rural local governments are constantly working towards supporting the long-term growth of our communities. A key enabler to achieve this goal is the ability to connect government and social service offices, businesses and homes in our regions to high- speed broadband networks. As such, access to wireless infrastructure is critical for our region to engage in numerous aspects of the digital economy. Deploying broadband networks to rural and remote areas is a massive undertaking, and often relies on the availability and costs of access to utility poles. Internet service providers usually work with BC Hydro as the owner of the poles in order to extend their broadband networks. The rental rates to access the poles is often excessive and can stop a broadband provider from being able to provide service to an area. Request: The RDEK requests that a collaborative approach with BC Hydro is needed to develop a fair distribution of costs, which would help to support viable business models for private investment in broadband infrastructure. Topic: BC Ambulance Rural Service Ministry Staff: Honourable Adrian Dix Minister of Health and Minister responsible for Francophone Affairs Background Information: It has been a long standing concern that rural BC is under serious paramedic shortage and it is worrisome considering the valuable and critical services provided by BC Ambulance. Rural ambulance service stations typically rely on one regional paid manager and on-call volunteers, unlike that of urban stations with full time paid paramedics. This model is not viable in our rural communities as there is no longer adequate availability of paramedics. AKBLG has previously endorsed resolutions related to the BC Ambulance service but none have requested the province for a full service review of the current model. Without a consistent and sustainable funding model, there will always be a risk that the rural ambulance service will have insufficient funding to provide the critical emergency response services needed every year. . Request: The RDEK requests that the province engage in a full service review of the current funding model. RECOMMENDATION Option 1.

BACKGROUND/ANALYSIS The current partnership agreement for the operation and maintenance of the Yaqakxaqⱡamki Boat Launch expires July 1, 2021. Staff have pursued the Licence of Occupation, (as per December 4, 2020 Board Resolution 49479 ‘THAT the RDEK apply for a Licence of Occupation through the Province’s Community Institutional Program for operations and maintenance of the boat launch’) and recent correspondence with the Province indicated the Province will proceed with the Licence of Occupation for operations and maintenance of the Boat Launch. However, the province is unable to have the document ready for Board approval until later this year/early next year. In the interim, they have provided the attached agreement amendment to extend the term of the existing partnership agreement.

The Village of Canal Flat’s Loan Authorization Bylaw No. 233 is for $250,000. The amount of borrowing required for the Fall 2021 debenture is $250,000.

The Village of Canal Flat’s Loan Authorization Bylaw No. 234 is for $700,000. The amount of borrowing required for the Fall 2021 debenture is $700,000.

Debenture payments are the responsibility of the Village of Canal Flats.

The MFA withholds 1% of the amount of every debenture borrowing and puts the funds into a debt reserve. In the event a Municipality or Regional District defaults on repaying a debenture, the MFA can draw on the debt reserve to make the payments. Once a debenture is paid in full, the 1% debt reserve amount is refunded to the borrower. The debt reserve represents the joint and several guarantee that all MFA members are responsible in the event of default by any member. There has been no default by an MFA member since the inception of the MFA in 1970.

WHEREAS the Municipal Finance Authority of British Columbia (the "Authority") may provide financing of capital requirements for regional districts or for their member municipalities by the issue of debentures, or other evidence of indebtedness of the Authority and lending the proceeds therefrom to the regional district on whose request the financing is undertaken;

AND WHEREAS the Village of Canal Flats is a member municipality of the Regional District of East Kootenay (the "Regional District");

AND WHEREAS the Regional District will finance from time to time on behalf of and at the sole cost of its member municipalities, under the provisions of Section 410 of the Local Government Act, the works financed pursuant to the herein mentioned loan authorization bylaws;

AND WHEREAS under the provisions of Section 411 of the Local Government Act, the amount of borrowing authorized by each of the following loan authorization bylaws, the amount already borrowed under the authority thereof, the amount of authorization to borrow remaining thereunder, the amount being issued under the authority thereof by this bylaw, and the term of the debt are included in this bylaw;

AND WHEREAS the tables contained in this bylaw are to provide clarity and information for the purposes of this bylaw;

AND WHEREAS the Regional Board, by this bylaw, hereby requests such financing shall be undertaken through the Authority;

NOW THEREFORE the Regional Board of the Regional District of East Kootenay enacts as follows:

1. This Bylaw may be cited as "Regional District of East Kootenay – Security Issuing Bylaw No. 3066, 2021".

2. The Regional Board hereby consents to financing the debt of the Village of Canal Flats and further described in the Municipal Loan Authorization Bylaws table, in the amount of Seven Hundred Thousand Dollars ($700,000) in accordance with the following terms.

4. Upon completion by the Authority of financing undertaken pursuant hereto, the Chair and Chief Financial Officer of the Regional District, on behalf of the Regional District and under its seal shall, at such time or times as the Trustees of the Authority may request, enter into and deliver to the Authority one or more agreements, which said agreement or agreements shall be substantially in the form annexed hereto as Schedule A and made part of this bylaw (such Agreement or Agreements as may be entered into, delivered or substituted

hereinafter referred to as the "Agreement") providing for payment by the Regional District to the Authority of the amounts required to meet the obligations of the Authority with respect to its borrowings undertaken pursuant hereto, which Agreement shall rank as debenture debt of the Regional District.

The Agreement in the form of Schedule A shall be dated and payable in the principal amount or amounts of monies and in Canadian dollars or as the Authority shall determine and subject to the Local Government Act, in such currency or currencies as shall be borrowed by the Authority under Section 2 and shall set out the schedule of repayment of the principal amount together with interest on unpaid amounts as shall be determined by the Treasurer of the Authority.

6. The obligation incurred under the said Agreement shall bear interest from a date specified therein, which date shall be determined by the Treasurer of the Authority, and shall bear interest at a rate to be determined by the Treasurer of the Authority.

7. The Agreement shall be sealed with the seal of the Regional District and shall bear the signature of the Chair and the Chief Financial Officer of the Regional District.

8. The obligations incurred under the said Agreement as to both principal and interest shall be payable at the Head Office of the Authority in Saanich and at such time or times as shall be determined by the Treasurer of the Authority.

9. During the currency of the obligations incurred under the said Agreement to secure borrowings in respect of the Village of Canal Flats Loan Authorization Bylaw No. 234 there shall be requisitioned annually an amount sufficient to meet the annual payment of interest and the repayment of principal.

10. The Regional District shall provide and pay over to the Authority such sums as are required to discharge its obligations in accordance with the terms of the Agreement, provided, however, that if the sums provided for in the Agreement are not sufficient to meet the obligations of the Authority, any deficiency in meeting such obligations shall be a liability of the Regional District to the Authority and the Regional Board of the Regional District shall make due provision to discharge such liability.

11. The Regional District shall pay over to the Authority at such time or times as the Treasurer of the Authority so directs such sums as are required pursuant to Section 15 of the Municipal Finance Authority Act to be paid into the Debt Reserve Fund established by the Authority in connection with the financing undertaken by the Authority on behalf of the Regional District pursuant to the Agreement.

The Authority is hereby requested and authorized to finance from time to time the above noted undertakings, and further described in the Municipal Loan Authorization Bylaws table, at the sole cost and on behalf of the Village of Canal Flats up to, but not exceeding Two Hundred and Fifty Thousand Dollars ($250,000) in lawful money of Canada (provided that the Regional District may borrow all or part of such amount in such currency as the Trustees of the Authority shall determine but the aggregate amount in lawful money of Canada and in Canadian Dollar equivalents so borrowed shall not exceed $250,000 in Canadian Dollars) at such interest and with such discounts or premiums and expenses as the Authority may deem appropriate in consideration of the market and economic conditions pertaining.

4. Upon completion by the Authority of financing undertaken pursuant hereto, the Chair and Chief Financial Officer of the Regional District, on behalf of the Regional District and under its seal shall, at such time or times as the Trustees of the Authority may request, enter into and deliver to the Authority one or more agreements, which said agreement or agreements shall be substantially in the form annexed hereto as Schedule A and made part of this bylaw (such Agreement or Agreements as may be entered into, delivered or substituted

hereinafter referred to as the "Agreement") providing for payment by the Regional District to the Authority of the amounts required to meet the obligations of the Authority with respect to its borrowings undertaken pursuant hereto, which Agreement shall rank as debenture debt of the Regional District.

5. The Agreement in the form of Schedule A shall be dated and payable in the principal amount or amounts of monies and in Canadian dollars or as the Authority shall determine and subject to the Local Government Act, in such currency or currencies as shall be borrowed by the Authority under Section 2 and shall set out the schedule of repayment of the principal amount together with interest on unpaid amounts as shall be determined by the Treasurer of the Authority.

6. The obligation incurred under the said Agreement shall bear interest from a date specified therein, which date shall be determined by the Treasurer of the Authority, and shall bear interest at a rate to be determined by the Treasurer of the Authority.

7. The Agreement shall be sealed with the seal of the Regional District and shall bear the signature of the Chair and the Chief Financial Officer of the Regional District.

8. The obligations incurred under the said Agreement as to both principal and interest shall be payable at the Head Office of the Authority in Saanich and at such time or times as shall be determined by the Treasurer of the Authority.

9. During the currency of the obligations incurred under the said Agreement to secure borrowings in respect of the Village of Canal Flats Loan Authorization Bylaw No. 233 there shall be requisitioned annually an amount sufficient to meet the annual payment of interest and the repayment of principal.

10. The Regional District shall provide and pay over to the Authority such sums as are required to discharge its obligations in accordance with the terms of the Agreement, provided, however, that if the sums provided for in the Agreement are not sufficient to meet the obligations of the Authority, any deficiency in meeting such obligations shall be a liability of the Regional District to the Authority and the Regional Board of the Regional District shall make due provision to discharge such liability.

11. The Regional District shall pay over to the Authority at such time or times as the Treasurer of the Authority so directs such sums as are required pursuant to Section 15 of the Municipal Finance Authority Act to be paid into the Debt Reserve Fund established by the Authority in connection with the financing undertaken by the Authority on behalf of the Regional District pursuant to the Agreement.
