Richard, 28 has been involved in competetive athletics for many years, he talks to the Messenger about his experiences...

How much training do you do?

I train 6 days a week with one rest day. This will generally consist of two gym sessions, two track sessions, one hill run - ning session and one technical session. I will generally train in the evenings and at weekends. The evening sessions allow me to work during the day and then concentrate on my training in the evening. I am aware of the fact that most of my competitors do not even work part time which may place me at a disadvantage but I have taken the decision to balance the two as there is not much money in athletics and athletes need to have something in place for when they stop competing. I feel that the balance is ok as long as I get enough sleep and recover well after my heavy training ses - sions with the correct nutrition and rest.

How does your training and competitions impact on your working life as a sports lawyer?

My firm, Farleys Solicitors, are very flexible with me when I need time off for races abroad. I realise that I am very lucky in this respect as I do not think some of the other law firms would be so willing to allow me to do this. I work under Daniel Draper, the Partner who heads up our Sports Law and Commercial Disputes Department and he has been great in allowing me the flexibility to compete at such a high How did you become involved in running? level. What is a law firm audit all about?

It is easy to buy-in to the idea of an audit without first appreciating what an effective audit is designed to achieve. It should integrate with your risk management framework and assist you in identifying the key issues your firm needs to tackle as a priority. Investing in an independent expert report not only gives the benefit of a fresh pair of eyes, it also acts as currency for COLPs/COFAs and risk managers who need to gather support from within the business for risk management initiatives.

What does an audit typically cover?

There is no magical formula used to produce the perfect audit since no two law firms are the same. Because I spent the early part of my career pursuing and then defending negligence claims against professionals, I have hands-on experience of the range of issues that make lawyers vulnerable. This translates to our audit: as well as covering the traditional favourites e.g. compliance with the SRA Code plus Authorisation and Framework rules, my team pays particular attention to uncovering the behaviours we associate with the average law firm’s Achilles heel.

How does an audit help firms get to grips with the cost of risk and compliance?

I asked a number of COLPs and COFAs how long they spent on risk and compliance, bearing in mind many compliance officers wear multiple hats e.g. MLRO, complaints/conflicts partner, and found that on an av - erage they could easily spend 10 hours a week fire fighting. For those firms who do not have the luxury of full-time compliance support (and even those who have), very few have the necessary management infor - mation to understand the true cost of compliance. An audit should empower a firm to decide where it wants to focus its limited resources and it can also be used to generate a risk management submission for issuing to insurers come renewal time.
