DISTRICT MINERAL SURVEY REPORT OF

1.0 Introduction

The district Dharwad with an area of 4273 sq. km (427329Ha) lies in the northern part of state between 15’02’00’’to 15’48’00” north latitude and 740 43’ 30” to 750 33’25’’ east longitudes as depicted in Fig.1. Eastern region fall under Malaprabha river (Krishna basin 87%) sub-basin and the “Kali”river (west-flowing river) basin in the west, the rivers are ephemeral. The Bennihalla river (Krishna basin) and the Bedthi nadi & Shalmala Nadi (west flowing rivers) are main watersheds in the district.The district is well connected by national (NH-4), state highways and the rail. The Dharwad-Hubli, the twincity is a major city, Dharwad is the home to the Karnataka University and the University of Agricultural Sciences .The district comprises five taluks, 5 municipalities and 127-gram panchayats comprising 372 villages. The population of the district is 1604253; include about 685191 work forces with 16.65% growth of population (census-2001). Agriculture is the main occupation in the district using both surface water and groundwater resources practicing flood irrigation method. The major crops grown are Jower, paddy, wheat and maize.

1.1 ACCESSIBILITY

Dharwad district is situated in the western sector of northern half of Karnataka state. The district encompasses an area of 4263 square kilometers lying between the latitudinal parallels of 15.15 North and 15.35 South and longitudes 75.00 East and 75. 20 West. The district is surrounded by Belguam district in the North, Gadag district in the East, Haveri district in the South and Uttar Kannada district in the West.

1.2 ADMINISTRATIVE DIVISIONS

The influence of the climate is very remarkable on human economic activities particularly on agriculture and allied secondary and tertiaiy activities. It also affects the mode of life and economic pursuits. belongs to the tropical monsoon climate, which however has spatial and temporal variations. The climate of the area on the whole is agreeable and healthy. The western belt has a more pleasant weather. The year is usually divided in to the four seasons. Summer starts during the second half of February and lasts till the end of May. The highest temperature recorded during the month of May is 33°C. This season is marked by hard Easter winds, rising temperature, whirl winds and occasional thunderstorms accompanied by a sharp shower. Southwest monsoon season starts during early June and lasts till the end of September. This is a period of cool and damp climate. The months of October and November constitute the post-monsoon or the northeast monsoon season and this period witness a gradual rise in day temperature and sustainable amount of rainfall as well. The highest rainfall is received during the month of July, August and September and lowest in month of January. The winter season covers the period from December to mid February. Dharwad district enjoys moderate weather and it is not subjected to extremes either during summer or winter

1.3 DRAINAGE:

The district is drained by two major rivers: Malaprabha and Tungabhadra, with the main tributaries such as Bennihalla, Varada and Kumudvati. BennihaUa drains about 240 square kilometers of area of northern portion of the district, which is one-half of the total area and joins the river Malaprabha. Varada and Dharma with number of small tributaries drain half of the region. The river kumudvati located in the far south of the region. All the chief rivers flow towards east to join the Bay of Bengal. Shalmala a small river drains a small portion in the north-west and flows through the taluk of kalaghatagi nd parts of Hubli-Dharwad taluks, runs towards west to join the Arabian sea.

1.4 IRRIGATION PRACTICES

In the district the irrigation takes place from surface water and ground water. The surface water irrigation is through canals, tanks and from medium and minor irrigation projects. Major irrigation dam has been constructed across the Karanja River and medium irrigation dam constructed across Chukkenala and Mullamari rivers. From ground water the irrigation is through dug wells, dug cum bore wells and bore wells.

1.5 LAND USE

The main occupation of the region is agriculture. Dharwad district is an agriculturally advanced district in Karnataka state served with moderate rainfall. The total geographical area of the district is 4.27 lakh hectors as computed by survey of . The total cultivated area in 1999-2000 was 3.31 lakh hectors. Some of the important crops grown in the district are jawar, wheat, groundnut, cotton etc.

1.5 Education

Education in Dharwad district had its beginning in Agraharas, which were centers of learning in ancient times. Dharwad district is known for education in north Karnataka. It is called a famous educational center, because all types of educational facilities are available in this region. 76 EDUCATIONAL INFRASTRUCTURE: The following data throw light on the sound educational base that the district can be proud of.

1.6 CROPPING PATTERN

GATION; The main problem of the district is the inadequacy of the irrigation. Navalagund and Hubli taluks are irrigated by the Malaprabha river project. The total irrigated area of the district was 0.44 lakh hectors in the year 1999-2000. 2.0 RAINFALLS AND CLIMATE

The average rainfall of the district as a whole is 722mm. Kalaghatagi taluk receives higher amount of rainfall 1076mm and taluk receives lower amount of rainfall 488mm.

2.1 Topography

2.2 Availability of Minerals

The minerals found in the area are Bauxite, Kaolin and Red ochre. A deposit of highly siliceous bauxite clay has been located about three kilometers south. Similar deposits are noticed near Alwal Villages of Dharwad taluk. A large deposit of Kaolin is located near Kamthana village. Red ochre deposits are found near Sirsi and Aurad Village.

2.3 Geomorphology and Soils The Semi-Malnad part of the region, lies in the western part of the district. The taluks coming under this region are Kalaghatagi and the western part of Hubli-Dharwad. The hills abruptly rise and move towards west. The much-eroded face especially on the west has a poor soil cover and natural vegetation. This region has given rise to many small streams, which are converted in small tanks for irrigation

1. Black Soils Major parts of the district are comprised of black soils and are derived from Deccan traps. These are deep black in colour and their texture varies from loam to clay. Lime concentration in this soil is high resulting in poor infiltration capacities. Their infiltration characteristics are poor to moderate. This type of soils covers mainly in areas lying below 610 m contour and along the valley portions.

2. Lateritric Soils A Latertic soil is confined to the central portion of the district. Latertic soils are pale to bright red in colour and clay to clayey loam in nature. This soil has moderate to good infiltration characteristics. This type of soils covers mainly in areas lying above 610 m contour.

GROUND WATER SCENARIO Hydrogeology The entire district is underlain by lava flows of the Deccan trap except small area covered with the laterites capping. Deccan trap consists of successive lava flows, almost horizontal in disposition. Individual flows show considerable variation in physical character, thickness, nature and extent of weathering etc. The basaltic lava flows are generally dark, grey, hard and compact. Each lava flows normally consists two units lower massive basalt and upper vesicular basalt. Secondary minerals like zeolites, quartz, calcite or some earthy or ferruginous material fill the vesicles. Well-developed columnar joints and spherical weathering are characteristic features of the massive basalt. The massive basalt and vesicular basalt are similar in term of compositionally and texturally. Ground water quality

Water quality observations are essential to know the changes in quality of ground water, which plays a prominent role in promoting both the standards of agricultural production and human health. To evaluate the quality of ground water, ground water samples have been collected from observation wells of National Hydrograph Stations and Exploratory bore wells. The ground water quality of the district has been analysed from the point of view of drinking and irrigation purposes.

Occurrence of Groundwater Basalt: In general ground water occurs under water table conditions in shallow aquifer and semi-confined to confined conditions in deeper aquifer. The fractured jointed vesicular basalt and massive basalt when overlain by red bole bed of considerable thickness develops semiconfined to confined conditions. Hence the red bole bed acts as a confining layer. The red bole bed being of clayey in nature also acts as a ground barrier for downward movement. The weathered and jointed zone of massive basaltic unit and vesicular basaltic unit constitute the unconfined aquifer, which are being tapped by dug wells. The semi-confined to confined aquifers are being tapped by dug cum bore wells and bore wells. The presence of columnar joint in massive basalt also helps in the occurrence and movements of ground. Laterite: Laterite occupied a small area in southern parts of the district. Laterite mainly occurring above 610m contours generally varies in thickness from 10 to 30 m. On high ground 1 to 2 m of laterite is very hard, ferruginous, iron black in colour, grading downwards into soft greyish or reddish coloured laterite, more clayey and aluminous in character at some places. The maximum thickness of 45 m is noticed near Dharwad fort. The laterites are more or less a porous rock and acts as a recharge source to the underlying rocks. During monsoon the rock gets saturated quickly. However, de-saturation is also equally quick, once the monsoon is over.

Depth to Water Level: The Central Ground Water Board has established 45 hydrograph stations. These hydrograph stations are measured four times a year, each year i.e. in January, May, August and November. Sri. Rajashekargouda S Patil, has a Quarry license vide Q. L. No. 651(R-1) in part of Sy ( No. 181/7(Previously181/5), Chabbi Village, Hubli Taluk, Dharwad District, Karnataka for extraction of Building stone in a total extent of 1-00 Acre. He has got Environmental clearance from State Level Environment Impact Assessment Authority - Karnataka (SEIAA) vide file no. SEIAA-89-MIN-2015 dated 30-05-2015. Now the proponent is going for expansion from 9,061 TPA to 20,020 TPA. For the same the proponent is intended to get modified environmental clearance, hence this modified Quarry Plan has been prepared.

Presently, as per the orders of the Hon'ble Supreme court, it is mandatory for all quarry lessees to produce Environmental clearance along with quarry plan. Hence this quarry plan is prepared.

( 3. GEOLOGY & EXPLORATION

( a) Briefly describe the topography and General Geology and local mine Geology of the mineral deposit including drainage pattern:

i) Topography:

A view at a Topo sheet No. 48 M/3 and 48 M/ 4 following topographic features can

( be observed. • The applied area is located in Patta land. It is a waste land.

• The terrain is Undulated terrain sloping towards south- west.

• No roads pass through the applied area.

• No human settlements within or in the vicinity of the applied area. The nearest village is at 0.75 Km distance.

• A Seasonal Nalla has been found in the Southern direction flowing to West which joins nearby Lake.

• The highest elevation at North East comer and lowest elevation at quarry workings and its values in the area are 643 mts and 636 mts respectively, having an elevation difference of 7 mts.

• For survey purposes, a temporary bench mark (TBM) with 641.2 mts RL is considered at North-West comer of the area and the same is shown in the Plate. No.3 & 4 (Surface & Geological plan).

( Greywackes constitute a major lithology in a younger greenstone belt in Dharwar ( craton. The Chitradurga Granite is an elongate, lenticular body of late to post-tectonic

( granite, about 60 km long and 15 km wide. The granite is cl(!'afly intrusive into the Jogimaradi lavas of the Bababudan Group as well as into the TIG basement.

The Chitradurga is biotite granite grading into granodiorite and quartz monzonite.

( Chadwick et al. (2007) dated the granite using Pb-Pb and Rb-Sr isochrons yielding an

( age of- 2.6 Ga, as well as SIMS U-Pb zircon age of- 2610 Ma. The Jampalnaikankote Granite is a -2.6 Ga (Rb-Sr) roughly oval shaped pluton that intrudes the ( Chitradurga schist belt. The Arsikere and Banavara Granites are thought to be from a single pluton that is connected at depth. The Arsikere graniticbatholith is approximately 75 km2 and oval in shape. The intrusion is primarily a potassic biotite granite that yielded an Rb-Sr age of - 2.6 Ga, and a SIMS U-Pb zircon age of - 2615 Ma. The Chamundi Granite is another potassic pluton, with associated radial and parallel dykes, that intrudes the peninsular gneiss. The granite has been dated via Rb-Sr at - 800 Ma.

Around Dharwad, greywackes are fine grained and show the effect of metamorphism and rude schistocity can be observed with pocket lens. Occurrence of BIF' s within greywackes is not seen, on the other hand, platformal fades is seen in the North of Dharwad

As per the field studies carried out the sanctioned quarry license area is belonging to "Middle Dharwarian Group."

The major rock types noticed in the area are as follows.

1) Soil cover

2) Phyllites

3) Greywackes.

Soil cover:

A part of the area is covered with top soil up to a depth of 0.8 to 1.0 mtrs at top as ( observed in the drill hole details carried out in the license area, which is Black cotton ( soil, suitable for agriculture.

( Greywackes: The greywackes occurring in the area are covered over a length of about 66 mtrs with a width of 67 mtrs in the entire license area as observed in the drillhole data. The general trend of the formation is N 15° W to S 150 E. Greywackes

( are medium to fine grained fresh & show intercalations of phyllites at places mafic flows occur up to the thickness of 20 to 30 mtrs as observed in the adjacent license areas. These are grey to pale grey in color, exhibits typical greasy luster & it is soft.

The study area has strong potentialities for yielding superior quality Building material. Which has value added processed products in domestic market. Promise for occurrence of ( workable deposits exposed below the surface has favored massive operations & higher levels of production, which favors economic feasibility of the deposit. Copy of the photographs is as follows.

(i) The Topographic plan of the applied area is prepared in 1:50,000 RF with 2 mts contour interval. For survey purpose, a temporary bench mark (TBM) with an elevation of 641.2 mts RL is considered in the area and the same is used as base for the preparation of surface and geological plan and shown in Plate. No. 3 & 4.

(ii) Details of exploration already carried out:

Exploration of Building stone was done in the previous years.

c) Geological cross sections are drawn at an interval of 10 mts on a scale of 1:1000 RF. All the exposures are marked on each section and enclosed as Plate. No.5. d) Future programme of exploration:

Exploration will be carried out till the reserves get exhausted.

e) Method of Estimation of Reserves:

The reserves estimation has been made based on potential zone marked on the geological plan and cross sections. The norms of Reserve estimation are of counting squares of sectional areas marked on the cross sections. About 4,49,114 Tonnes of 'Geological Reserves' are estimated. In order to meet the various statutory requirement some part of the license area cannot be excavated i.e 7.5 mtrs safety zone

Considering the facts that the Building Stone (Granite) requires blasting for its

( extraction and that class II explosives are to be used, the powder factor can be

( estimated to be 6 tons per Kg. of explosives.

( The explosive required per annum at a powder factor of 6 tons/ kg will be

( 20,429/6t/kg = 3,405 Kgs (say). It is proposed to use slurry explosive. The charge per hole is 500 gms; charging will be by safety fuse with the combination of Ordinary ( detonators and slurry explosive; handling - tie up with the explosive suppliers (sale, ( possesses and use of explosives); system of initiation - ordinary detonators. ( In addition, we require about 9,606 m of safety fuse and 6,404 Nos of ordinary detonators for initiation purpose. As only few holes (max 10 / round) will be blasted at one time, no significant air blast or vibrations will be envisaged. However, since the area is surrounded by an agricultural land, if required, sand bags/ mud bags will be kept on holes and will be muffled in order to prevent the flying rocks.

In case of boulders bigger than half a cubic meter, are broken after an initial blasting. 25 mm x 200 mm cartridges of 140 gms shall be used for such secondary blasting.

e) Storage of Explosive:

Explosive will not be stored in the mine since the entire Handling and blasting operations will be carried out by a licensed contractor who sell, possess and use of explosives having a magazine with license. Blasting operations will be carried out where ever it is permitted in the quarry license. Otherwise the extraction is by heating and cracking process.

However, if it becomes necessary, applicant will take necessary permission from the Competent Authority for using and storage of explosives. Explosive magazine of 25kg will be installed with the permission to use 10 kg ammonium nitrate/ day.

7. STACKING OF MINERAL REJCETS AND DISPOSAL OF WASTE:

( There is topsoil to be produced in the area. It is proposed to handle about 2,043 tonnes of waste, and will be used for haul road and approach road.

8. USE OF MINERAL:

a) The granite from this quarry will be used as building stone.

9. OTHERS:

a) Site services:

Since Hubli is at a distance of 14.5 Kms (N), most of the repairs of equipment will be undertaken there and hence, no workshop will be maintained at mine head. Office, stores, first-aid station, rest shelter, latrines and urinals is constructed and maintained outside in the license area.

Potable Drinking water will be supplied to the persons working in the quarry by disinfected and cleaned water tank/ cans. No colony is maintained within the quarry as the workers come from the adjoining villages.

b) Employment Potential

In all, there will be about 7 face workers for the Building Stone(Granite) production of 20,429 tons (saleable production of 20,020 tons)@ 10 tons face OMS, each worker contribute 300 man shifts per annum, it requires 20,429/300/10 6+ 1(15%leave/ absent) workers. All others required are shown in manpower chart. l

11. ENVIRONMENTAL MANAGEMENT PLAN:

i) Base line information: a) Existing Land use pattern : The extent of the license block to be granted is 1-00 Acre. ( About 0-20 land will be used for quarrying in the plan period. The present land use pattern are given bellow. Statutory buildings will be away from the license area.

The surrounding area is dry land, where some seasonal crops like cotton, jawar and sunflower are grown.

The water table is about 80 m generally below the ground level. The drainage pattern is dendritic to sub-dendritic in nature.

iii) Flora and Fauna: The area is completely barren and devoid of any vegetation. Only few thorny bushes are seen.

( iv) Quality of air, ambient noise level and water: ( So far, the study on quality of air, ambient noise level and water is not carried out in the specific area. However, the area around the applied area is devoid of any

a) Air Quality: ( In general the SPM, 502 and Nox concentration in the region may be within the permissible limits, as it is a small scale quarrying.

b) Ambient noise level: The noise levels are very low in this vicinity.

c) Water quality: The quality of ground water is fairly good. There is no liquid waste discharge from mining activity, which is likely to pollute water.

v) Climatic Conditions: The area has tropical climate with semi-arid conditions and receives moderate rainfall. The rainfall in the area occurs from southwest monsoon extends from June to September and ranges from 998.2 to 594.30 mm. An average of 59 rainy days, with the rainfall contribution of about 64.9 % from SW monsoon and by NE monsoon 35.1 %. The yearly average rainfall is 772.00mm.

vi) Human Settlement: There is no habitation in the area. No villages are situated within the area. Workmen and staff come from the nearby villages. So, there is no displacement involved. The villages falling within the buffer zone of 5 kms from the license boundary are given in key plan (Plate No. 1).

( vii) Public buildings, places and monuments: No public buildings, places, monument etc., exist within the applied area or in the vicinity. b) Environment Impact assessment statement: (

( 1) Landscape: The area forms an undulated terrain.

2) Soil and Land use pattern: There is topsoil in the applied area.

About 0-20 acres land will be used for quarrying building stone in the License period. Statutory buildings will be away from the license area.

3) Agriculture: Due to quarrying agriculture will not be affected around the license area. Only seasonal rainfed crops are grown such as jawar, sunflower, cotton, etc.

4) Forest: As there is no forest area in the vicinity, and hence, there can be no effect on the forest area

5) Vegetation: The area is barren and devoid of any vegetation.

ii) Air quality: Only pollution in the air is due to dust which gets airborne due to the vehicular movement and while loading granite, etc. Therefore, the SPM count in the air will increase to a very small extent.

( iii) Water Quality:

( Since it is rocky terrain, no ground water is found. However rain water is the source for surface water. There is no toxic or poisonous discharge in to the drains from mining operations. So, quality of water shall not be affected. But, in the surface ( water some suspended silt particles may find their way during rainy season

iv) Noise Levels Since it is a small scale quarrying, drilling and blasting are proposed, the back ground noise levels will be slightly high at the site while drilling and blasting. The area is away from roads where frequent traffic is encountered. General noise levels are expected to be less than 80 dBa in working of the mine.

v) Vibration levels (due to blasting) Only 6,404 jack hammer holes/ annum of 1.5 mts depth will be drilled and blasted. As, only few holes will be blasted at one time, not more than 10 holes/ round, no significant air blast or vibrations will take place. The blasting will be done during the lunch interval of the workers, or before or after the working hours.

vi) Water Regime: 1) Surface Water:

Here, surface water is the rain water. The chemical analysis of the granite does not show any hazardous parameters. Therefore, the rain water passing from the mine working does not affect water quality. l

vii) Socio/ Economic:

1) Socio and demographic profile: ( There are 9 villages including hamlets within the buffer zone (5km) and they all depend on agriculture and related activities. Since the quarrying is on medium scale, no health problems are anticipated as well as safety due to quarrying operations.

2) Occupational health and safety: Some quantity of dust will be generated during drilling operations and the movement of trucks etc. As the quarrying is on a small scale, no appreciable impact due to generation of small quantity of dust will be there. Regarding safety all the precautions such as proper benches, use of safety belts, etc., will be maintained. All the eligible workers will be provided with safety shoes and helmets.

viii) Public buildings, places and monuments:

The impact of the proposed quarrying is nil as there are no public buildings, places and monuments in the vicinity.

c) Environmental Management plan:

i) Storage and preservation of the top soil: There is topsoil to be produced in the area.

ii) Proposals for reclamation of land affected by abandoned quarries and other mining activities during first five years. There is no vegetation in the area. Therefore, it is not likely that there will be a loss of vegetation in the area due to quarrying operation.

viii) Protective measures for ground vibrations/ air blast caused by blasting. Vibration due to blasting shall be kept to the minimum as explained in para 5.0 on blasting.

ix) Measures for protecting historical monuments and for rehabilitation of human settlement, likely to be disturbed due to quarrying activity: There is no habitation in the area. No villages are situated within the area. Work­ men and staff come from the nearby villages. So, there is no displacement of men involved.

x) Socio-Economic benefits arising out of mining: \ People residing in the near-by villages are benefited by the direct and indirect employment opportunity created by the quarrying activity, vocational training etc.

( 4.1 Mined-Out land: r Describe the proposals to be implemented for reclamation and rehabilitation of mined-out land including the manner in which the actual site of the pit will be restored for future use. ( restoration/reclamation/ rehabilitation: At the end of the life of the Quarry, depth of Quarry will be more. So back filling is neither warranted nor feasible. Since one side of the Quarry area is surrounded by the agricultural lands, this pit may be utilized as Irrigation pond or Fish pond by providing proper outlet for excess rain water. Proper bunding will be made around the license area.

If there is potential of Acid Mine Drainage the treatment method should be given: No surface & ground water bodies are available in the license area. Hence, no protection or control of erosion, siltation, water treatment, diversion of water courses is required.

4.3 Air Quality Management: Describe the existing air Quality status. The corrective measures to be taken for prevention of pollution of air should be described: Only pollution in the air due to dust which gets airborne due to the vehicular movement, drilling etc. therefore, the SPM count in the air will increase to a very small extent. NOx, 502 and CO values are expected to be within the permissible limits due to proposed small scale Quarrying. Effect of the small scale Quarrying is minimal. There is not much fuel burn during mining except during transportation of Building Stone and waste by vehicles plying and compressor used for drilling the JH-holes. However, corrective measures will be taken.

If no utilization of waste material is proposed, the manner in which the ( waste material will be stabilized should be described. The protective measures to be taken for prevention of siltation, corrosion and dust generation from these waste material should also be described. If toxic and hazardous elements present in the waste material the protective measures to be taken for prevention of their dispersal in the air environment, leaching in the surface and ground water etc should be described: There is top soil as over burden but in the buffer area only. There is 2,043 tons (2%) of waste to be produced which will be used for haul road and approach road.

4.5 Topsoil Management: Top soil will be available in the quarry as the Granite is exposed on the surface as an out crop. Any negligible quantity of top soil, will be used for bund on which plantation can be made.

4.6 Tailing Dam Management: The steps to be taken for protection and stabilihj of tailing dam, stabilization of tailing material and its utilization, periodic distillation measures to prevent water pollution from tailings etc, arrangement for surplus water overflow along with detail design, structural stability studies, the embankment seepage loss into the receiving environment and ground water contaminant if any should be described : Not applicable as there can be no tailing dam.

4.7. Infrastructures: The existing infrastructural facilities available such as roads aerial ropeways, conveyer belts, railways, power lines, building and structures, water treatment plant, transport, water supply sources in the area etc. And their fuhtre utilization should be evaluated on case-tocase basis. If retained, the measures to be taken for their physical stability and maintenances slwuld be described. 4.10 Disaster Management and Risk Assessment: I1zis should deal with action plan for high risk accidents like landslides, subsidence flood, and inundation in underground mines, fire, seismic activities, tailing dam failure etc. and emergency plan proposed for quick evacuation, ameliorative measures to tlze taken etc. I1ie capability of lessee to meet such eventualities and tlze assistance to be required from tlze local authority should also be described: Since it is hard rock Quarrying, high risk accidents are very rare in these type of Quarrying, as the area is free from earthquake zone and also major water body. Even if there is any such event, the lessee is quite capable to meet such high risk accidents.

4.11 Care and maintenance during temporary discontinuance: For every five yearly review (as given is tire mining Sclzeme), an emergency plan for tlze situation of temporan1 discontinuance or incomplete programme due to court order or due to statuton1 requirements or any otlier unforeseen circumstances, should include a plan indicating measures of care, maintenance and monitoring of status of unplanned discontinued mining operations expected to re-open in near future. They should detail item wise status monitoring and maintenance with periodicity and objective: During temporary discontinuance proper bund will be made not to allow any rain water to fill the pit. Also proper fencing will be erected around the pit as a safety measure to enable the pit to re-open immediately in shortest possible time.

Economic repercussions of closure of mine and manpower retrenchments: Manpower retrenchment, compensation to be given, socio-economic repercussions and remedial measures consequent to the closure of mines should be described, specifically stating the following: There will be limited socio-economic repercussions due to closure of the Quarry activities as it is a small quarry. Since, the labours are from surrounding areas who are basically agricultural labours, in case of closure, they will go back to their family occupation. They will get compensation as per the Govt. rules.

5.1 Number of local residents employed in the mine, status of the continuation family occupation and scope of joining the occupation back: Around 15 local persons will be used as labours. Most of the labours will be from the surrounding areas who are basically agricultural laborers. In case of closure, they will go back to their family occupation.

5.2 Compensation given or to be given to the employees connecting with sustenance of himself and their family members: As they are daily wages employees, they will get compensation as per the Government rules.

5.5 Envisaged repercussions on the expectation of the society around due to closure of Quarry: There cannot be any repercussion on the expectation of the society around due to closure of the Quarry as it is a very small Quarry and is well away from habitations

Liberty and powers for or in connections with any of the purposes mentioned in this part to quarry and get, ordinary building stone and gravel and other building and road materials (except that of specified minor minerals) and ordinary clay and to use and employ the same and to manufacture such ordinary clay into bricks or tiles and to use such bricks or tiles but not to sell any such material, bricks or tiles on payment of royalties prescribed in the said rules.

Liberty and power for or in connection with any of the purposes mentioned in this part but subject to the rights of any existing or future lessee/ licensee and with the written permission ...... (any officer authorised by the State Government in that behalf) to appropriate use of water from any streams, water- courses, springs or other sources in or upon the said lands and divert, step up or dam any such stream or water-course and collect or impound any such water and to make, construct and maintain any water course, culverts, drains or reservoirs but not as to deprive any cultivated lands, villages, buildings, or watering places for livestock of a reasonable supply or water as before accustomed nor in any way to foul or pollute any stream or springs. 9. To clear brush-wood and to feJI and utilise trees, etc., ( Liberty and power for or in connection with any of the purpose mentioned in this part to feJI and use any timber or trees or brush wood now standing or which

( hereafter may be standing upon the reserved forest land, included within the said lands, provided that not more than 1,.00 square meters or such reserved forest land shall be cleared in any one year nor the same place of tender than once in every year and, provided that, the previous permission in writing from the Forest Department under Forest Department is obtained which permission shall be granted by the Forest Department from time to time for an area, not exceeding 1-00 acres at a time on written application of the lessees/licensees to the effect that the lessees/licensees requires/require the additional area for bonafide and immediate extension of quarrying operation under this lease/license and provided also that the exercise of the liberty and power expressed in this clause shall be subject to the observance of the terms and condition contained in the other part of this schedule.

PART III

Restrictions and conditions as to the exercise of the liberties, Powers and privileges in Part II.

1. No building etc. upon certain places.

No building or thing shall be erected, set up, placed and no surface operations shall be carried on in or upon any public pleasure ground, burning or burial ground or place held sacred by any class of persons or any house or village site, public road or other place which the State Government may determine as public ground nor in such manner as to injure or prejudicially affect any building, work, property or rights of other persons and no land shall be used for surface operations which is already occupied by persons other than the Government for works or purposes not included in this lease/license. They shall not also interfere with any right of way, well or tank.

2. Permission for surface operations in a land not already in use.

Before using for surface operations any land which has not already been used for such operations the lessee/ licensee shall give to the Competent Authority, sixty days previous notice in writing specifying the name or other designation of the situation and the extent of the land proposed to be so used and the purpose for which the same is required and the said land shall not be so used if objection is issued by the Competent Authority within one month after the receipt by him of such notice unless the objections so stated shall on reference to the State Government be annulled or waived.

3. To cut trees in unreserved lands.

l (a) The lessee/licensee shall not cut or injure any tree in the leased/licensed areas without the previous sanction in writing of the Competent Authority. 4. Permission for surface operations in a land not already in use.

Save as Provided in clause 9 PART II of this Schedule, the lessees/licensees shall not without the previous sanction from the Forest Department cut down or injure any timber or trees on the said lands but, may, without such sanction Clear away any brush-wood or under-growth which interferes with any operations authotised by these presents and notwithstanding anything contained in this schedule shall not enter upon any reserved forest included in the said lands without seven days previous notice in writing to the Forest Department or the officer authorised by the Forest Department.

5. No mining operations within SO meters of public works etc., ( The lessee/licensee shall not work or carry on or allow to be worked or carried on any quarrying operations at or to any point within a distance of 50 meters if .:io blasting is involved from the boundary of any railway line except with the previous written pefmission of the Railway Administration con,cemed or from the boundaries of reservoir, canal, high tension electric line or other public works or bujldings or inhabited site except with the previous permission of Government or any other officer authorised by the Government in this behalf and otherwise than in accordance with such instructions, restrictions and conditions and either general or special which may be attached to such permission. The said distances of 50 meters or 200 meters shall be measured in the case of railway, reservoir or canal horizontally from the outer toe f lh bank of the outer edge of the cutting as the case may be and of building horizontally from the plinth there f. · 6. Facilities for adjoining Government licenses and leases. The lessee/licensee shall allow existing and future holders of Goverrunent licenses or leases over any land which is comprised in or adjoins or is reached by the land held by the land held by the lessee/licensee reasonable facilities of access thereto. Provided that no substantial hindrance or interference shall be caused by such holder of licenses or leases to the operations of the lessee/licensee under these presents and the lessee/licensee shall be entitled to compensation as may be mutually agreed upcm between the lessee/licensee and such holders and in the event of disagreement such fair compensation may be determined by the Competent Authority or any other officer authorised by the State Government in respect of all loss or d·amage sustained by the lessee/licensee by reason of or the exercise of this liberty.

7. If the said lands or part thereof are forest lands, the lessees/licensees shall take all steps to ease the sJopes and restore top soil in lands worked out, exploited or mined and it shall be open to the Government to afforest such lands even during existence of the lease.

2. To make railways and roads.

r Liberty and power to the State Government or Central Government to construct ( any road, railway or canal reservoir or to carry electric or telephone lines in or over the lands under the lease/license is reserved: ( Provided that before such liberty or power is exercised a notiCe of not less than thirty days shall be given to the lessee/licensee and the area utilised by the Government for any of the aforesaid purpose shall be excluded frotn the area under the lease/license and lessee/licensee will not be entitled to claim any compensation for such exclusion.

3. Liberty and power to the State Government to determine, at any time by giving to the lessee/licensee a notice in writing the lease/license if the area for which the lease/license has been granted or any part thereof is required by the State Government for any public purpose and a declaration under the signature of the Director that the area, or as the case may be, the part of the area is so required shall, as between the lessee/licensee and the Government, be conclusive.

On the determination of the lease/license under this power the area under the lease/license shall be resumed by the Government and the lessee/licensee shall be paid such compensation as may be determined by an officer appointed by the Government for the purpose and in assessing the amount of compensation, the officer so appointed shall be guided by the principles laid down in the Acquisition Act 1894, for such assessment. PARTV

Rent and Royalties reserved by this lease

1. Rate of mode of payment of Dead Rent.

As from the day of J 6-01-2012 during the subsistence of Iease/licc:nsc. the lessee/licensee shall pay the dead renl 1[ c v r. yt:;Jr at the rate specified in schedule I which may be modified from time to time] in accordance with rules.

2. Rate of mode of payment of royalty.

The lessee/licensee shall, pay royalty in advance to Government in respect of minor minerals removed or consumed by him or his agent, manager, employee, contractor or buyer al the rates prescribed in Schedule 2 2[which may be modified from timl! to time] in accordance \Vilh the Rules.

4. Penalty. f

Subject to the provision of clause (3) of this part, any lessee/licensee or his agents, ( managers, employees, contractors, consumers or buyers contravening the above clause and ( transport mineral without valid Permit, such persons will be liable for penalty at 5 times of royalty. If any lessee/licensee or his agent, etc., or buyers continue to indulge in such offence ( he Competent Authority may order for determination of the lease/license with the prior approval of the Controlling Authority.

PART VI

Provisions Relating to the Rents and Royalties

1. Rent and royalties to be free from deduction etc., ( The rents and royalties in PART V of this Schedule shall be paid free from any deductions to the State Government at District -Sub Treasury at Dharwad and in such manner as the Competent Authority may prescribe. (

2. Mode of computation of royalty.

For the purpose of computing the said royalties the lessee/licensee shall keep a correct account of the mineral/ minerals actually produced from the quarries/mines, lands and dispatched from the quarry and maintained stock, in the form pi-escribed by Government/Competent Authority. The lessee/licensee shall also keep a correct account of the number of persons employed therein and shall also maintained a complete set of plans and cross sections of the quarry and furnish to the Competent Authority concerned such information, reports and returns as required from time to time under these Rules together with representative samples of minerals and processed materials from the same obtained during the operations. The accounts as well as quantity (in volume or in weight as the case may be) of the mineral/minerals in stock or in the process of dispatch from the quarry may .be checked by any officer authorised by the State Government and or by the Competent Authority.

3. Course of action if rents and royalties are not paid in time.

Should the royalty and/or rent reserved and made payable by the lessee/licensee is l not paid within thirty days after the date fixed in lease/license for the payment of the same, State Government may enter upon the premises and restrain all or any of the l_ mineral or beneficiated /processed or movable property there and may order the sale of the property to restrained or so much of it as will suffice of the satisfaction of the rent and royalties G due, and all cost and expenses occasioned by the non-payment thereof. l J 1 (3A. Any rent, royalty tax fees, penalty or other sums due to Government under said Rules of under this lease/license shall be recovered as arrears of land revenue on the basis of certificate ( issued by the Competent Authority. ( PART VII ( The Covenants of the Lessees/Licensee

1. Lessees to pay rents, royalties. r l. The lessee/licensee shaJI pay the rents and royalties reserved by this lease/license at such times and in the manner provided in PART V and VI of these presents and also may ( and discharge all taxes, cesses, rates assessments and impositions whatsoever being in the nature of public demands which shall from time to time be charged, assessed or ( imposed by the authority of the State Government upon or in respect of the premises and works of the lessee/Jessee in common with other premises and works of alike nature except demands for land revenues.

2. To maintain and keep boundary marks in good order.

The lessee/licensee shall at his own expenses erect and at all times maintain and keep in repair boundary marks and pillars according to the demarcation to be shown in the plan annexed to this lease/license. Such marks order and pillars shall be sufficiently clear of the shrubs and other obstructions as to allow easy identifications.

3. To commence operations within a year and work in a workman-like manner.

Unless the Competent Authority for good cause permits otherwise the lessee/licensee shall commence operation within a year from the date of execution of the lease/license and shall thereafter at all times during the continuance of this lease /license search for, win, work and develop the said minerals without voluntary intermission in proper skilful and workmanlike manner without doing or permitting to be done any unnecessary or avoidable damage the surface of the said lands or the crops, buildings or other property thereon. The lessee/licensee shall prevent waste by removal of over burden, careful storage of waste, drainage and removal of valuable minerals. For the purpose of this clause quarrying operations shall include the erection of machinery, lying of a tramway or construction of a road in connection with the quarry. The lessee/licensee shall not dwnp the overburden or waste rock or mineral on the workable deposit. If lessee/licensee does not find suitable place to dump the waste material generated from the quarry within the leased/licensed area he may dump in nearly Government land obtaining prior approval from Competent Authority in writing.

4. To indemnify Government against all claims. The lessee/licensee shall make and pay such reasonable compensation as may be assessed by lawful authority in accordance with the law in force on the subject for all damage, injury or disturbance which may be done by him in exercise of the powers granted by this lease/license and shall indemnify and keep indemnified fully and completely State Government against all claims which may be made by any person or persons in respect of any such damage. injury or di sturbance and all costs ::111d expenses in connection therewith. ~ )} ~ :'.') ~';' ' , :. ,,,,...... -... ~- :~ 1 / ..,; ,,... ---.,_ \ ~ , ~ ' I' I \ ' ( )- ' I)__ ·.'":.- j . (a) height. and widths of trenches in open quarries are properly maintained to ra ·ili lale easy removal of the mineral and the muck, (b) the working faces are always kept clean, ( (c) the mi neral an d or bencfi ·iat1.:·d , processed dressed products there from won are ( stacked in suitable dimensions and each such stock is numbered or marked in a manner prescribed by the Competent Authority, ( (d) the proper sanitation of the area leased/licensed to him maintained. 6. To strengthen and support the quarry to necessary extent. ( The lessee/licensee shall strengthen and support -to the satisfaction of the Railway administration concerned or the State Government or any other Competent Authority controlling the provisions or any law for the time being in force relating to the working of quarries and matters affecting safety health and labour matter as the case may be any part of the quarry which in its opinion requires such strengthening or support for the safety of any rail way, reservoirs, canal road high tension electric line and other public works or structures.

7. (1) The lessee/licensee shall submit from time to time or when required, progress reports to the Director of Mines and Geology, along with analysis and representative samples of the minerals collected during the quarrying operations as also the periodical returns prescribed in the said Rules or in the manner prescribed by him from time to time.

(2) The lessee/licensee shall submit to the Director of Mines and Geology, the Competent Authority and any other officer as may be sp cified b y the Director of Mines and Geology in this behalf, quarterly returns in FORM-Q and ann ual returns in FORM -Y appended to the said Rules, for each financial year ending 31st March, before the 31st April of the succeeding year, and to allow inspection of working.

8. To allow inspection of working. The lessee/licensee shall allow any officer authorised by the Central Government or the State Government or the Competent Authority or the Director of Mines and Geology under the said rules in that behalf to enter upon the premises including any building excavation or land comprised in the lease/license for the purpose of inspecting, examining, surveying and making plans thereof, sampling and collecting any data and the lessee/licensee shall with proper person employed by the lessee/licensee and acquainted v.:ith the mine/quarry and works effectively assist such officers, agents servants and workmen in conducting every such inspection and shall afford them all facilities, information connected with the working of the quarry which they may reasonably require. ( 10. To report discovery of other minerals.

( Whenever the lessee/licensee shall find, in the said lands, any mineral other than the said mineral I minerals the lessee /licensee shall immediately report such discovery in writing to the Competent Authority with full particulars of the nature and position of each such find.

11. The lessee/licensee shall, at all times, during the said term keep or cause to be kept, at an officer to be situated upon or near the said lands, corr~_ct and intelligible books of accounts which shall contain accurate entries, showing from time to time.-

(1) Quantity and quality of the said mineral/minerals realised from the said lands; (2) Quantity of the various qualities of the said mineral/ minerals beneficiated, processed or converted; (3) Quantities of the various qualities of the said mineral/minerals sold at the quarry head or dispatched to any mineral processing units, granite cutting and polishing units within the country and quantity exported and the manner and purpose of such sale and disposal; (4) Details of royalty paid and PERMITS obtained; (5) The prices and all other particulars of all sale of the said mineral/minerals; (6) The number of persons employed in the mines or work or upon the said lands specifying nationality, qualifications and pay of the technical personnel; (7) Such other facts, particulars and circwnstances as the Competent Authority or the Director of Mines and Geology may from time to time require and shall also furnish of charge to such officers and at such times they may prescribe true and correct abstracts of all or any such books of accounts and shall at all reasonable times allow such officers or any other officers as the State Governments shall, in that behalf appoint, to enter into and have free access to, for the purpose of examining and inspecting the said books of accounts and to make copies thereof and to make extracts there from.

12. To maintain plans etc., The lessee/licensee shall at all times during the said term maintain at the quarry office correct, intelligible, up to-date and complete Contour and Geological plans and cross sections of the quarries in the said lands. They shall show all the operations, workings, and all the trenches, pits and drillings made by the lessee/licensee in the course of operations carried on by him/them under the lease/license. The lessee/licensee shall update such quarry planes and section at the end of each year or any period specified from time to time and the lessee/license shall furnish free of charge such plans, sections and mineral specimens, to the Competent Authority whenever these required. Accurate records of all trenches, pits and drillings shall show:- (a) the sub-soil and strata through which they pass. \._ (b) any other minerals encountered. (c) any other matter of interest and all data required by the State Government lhr. Competent Authority from time to time.

The lessee/licensee shall be bound by the provisions of To of any laws for the time being in force relating to ecology and environment, the working of ( the quarries (mines and minerals) and matters affecting safety, health and convenience of the lessee/licensee employees or the public. The lessee/licensee shall abide by the conditions laid down in the payment of wages Act 1936 (Central Act IV of 1936), the Mines Act1952 (Central Act XXXV of 1952), the Indian Explosives Act 1984 (Central Act of IV of 1884) and the Water and Air (prevention and control of pollution) Act 1974. (

14. The lessee/licensee shall respect all existing rights of way, water and other basements and ( shall not carry on mining/quarrying or other operations under the said lease/license in any way than as prescribed under the Rules.

( 15. Government indemnified from paying compensation for in-jury to third parties. ( The lessee/ licensee shall make and pay reasonable compensation for_ all damage, mJury disturbance to person or property which may be caused by or on the part of ( lessee/licensee in exercise of the liberties and power granted by these presents and shall at all times have harmless _and kept indemnified the State Government from and against all suits, claims and damages which may be brought or made by any person or persons in respect of any such damage, injury or disturbance.

16. Not to obstruct working of other minerals.

The lessee/licensee will exercise the liberties and powers hereby granted in such a matter as to offer no unnecessary or reasonable avoidable obstructions interruption to the development and working within the said lands of any minerals not included in this lease/license and shall at all times afford to the Central and State Government and to the holder quarrying lease, of quarrying license and prospecting license or mining lease in respect of any such minerals or any minerals within any land adjacent to the said lands as the case may be reasonable means of access and safe and convenient passage upon and across the said lands to such minerals for the purpose of getting working, developing and quarrying away the same provided that the lessee/licensee shall have receive reasonable compensation for any damage or injury which he may sustain by reason or in consequence of the use of such passage by such lessee/licensee or holders of prospecting licenses.

17. Lessee shall deposit any additional amount necessary equal to the security deposit.

Whenever the security deposit as provided in the 9(1) and 21 ( 1)of the said Rule or any part thereof or any further um hereafter deposited with the State Government in replenishment thereof shall be forfeited or applied by the Competent Authority pursuant to the power hereinafter declared in that behalf the lessee/licensee shall deposit with the State Government such further sum as may be sufficient with the un appropriated part thereof to bring the amount in deposit with the State Government up to the sum of equal to the said full security deposit amount.

(b) In the event of the existence of State or War or emergency (of which existence the President of India shall be th1~ sole judge and a notification to this effect in the Gazette of India shall be conclusive proof) the State Government with the consent of the Central Government shall from time to time and at all times during the said term have the right to be exercised by a notice in writing to the lessee/licensee shall forth with take possession and control of the works plant, machinery premises of the lesseenicensee on or in connection with the said lands or preparations under this lease/license and during such possession or control the lessee/licensee shall confirm and obey all directions giv1en by or on behalf of the Central or State Government regarding the use of employment of such works, plants, premises and minerals. PROVIDED THAT after compensation ·which shall be determined in default of agreement by the State Government shall be paid to the lessees/licensee or all loss or damage sustained by him/them y reason or in consequence of the exercise of the powers conferred by th.is clause and PROVIDED ALSO that the exercise of such powers shall not determine the said term hereby granted or affect the terms and provisions of these pre en ts f urthcr than may be necessary to give effect to the provisions of this clausie. The Government or the Competent Authority shall have the right to dispose of the minor mineral waste generated during tbe c urse of quarrying in accordance with the provision of Schedule-2.

20. Not to light fire in Forest Areas.

The lessee/licensee shall not light any fire upon the said lands if lying within the reserved forest except under such conditions as the Forest D!..!partmcnl may in wTllrn' specify and the lessee/licensee and his/their workmen and employees shall render prompt assistance in extinguishing any fire on the said lands or in their vicinity. (b) If any mineral/s not specified m the lease/license leased/licensed area he/they shall not win and dispose of such mrnera s \ 1Choll l obtaining lease/license therefore. If he fails/they fail to apply for such lease/license within three months from the discovery of the said mineral/minerals, the Competent Authority may grant a lease/license in respect of such mineral/minerals to any other person/persons in respect of such mineral/minerals to any other person/persons,

c) Without the prior permission of the Director of Mines and Geology the lessee/licensee shall not use the minor minerals quarried under these rules for a purpose which will classify them as major minerals.

( 22. The lessee/licensee shall make available to the Government of India beryl or any other "Substance prescribed" under Section 3(d) of the Atomic Energy Act (Act XXIX of 1948) if they are found to occur in the said lands. 23. The State Government shall be immune from the lessee/licensee claims for damage and account or any land having been included in this lease which may subsequently be discovered not have been available for the lease.

24. The lessee/licensee or his assignees shall not erect any building in contravention of the provisions of any law for the time being in force relating to the erection of buildings or in contravention of any order is issued by any officer or authority composed to issue such order any such law within whose jurisdiction the leased area is situated.

25. The lessee/licensee shall abide by such reasonable instructions and direction as may be issued by the Director of Mines and Geology from time to time regarding conservation and development of minerals.

26. The lessee/licensee shall minimise the air and water pollution keeping in view the local atmosphere/environment.

PART-VIII

The Covenants of the State Government

1. Lessee may hold and enjoy rights quietly.

1. Lessee/licensee paying the rents and royalties hereby reserved and observing and performing all the covenants and agreements herein contained and on the part of the lessee/licensee is Lu be observed and performed shall and may quietly hold and enjoy the rights and premises hereby demised for and during the tenn hereby granted without any unlawful interruption from or by the State Government, or any person rightfully claiming under it.

2. To renew. ( 3. Liberty to surrender the Leas~/License.

The lesseenicensee shall be at liberty to surrender this lease /license by giving notice of not less than three months in writing to the Competent Authority and no fresh liability shall accrue to the lessee/licensee from the date of such surrender provided that ( all the Government dues on rents, royalties and taxes shall be cleared off arising upon the date of the surrender.

4. Refund of s·ecurity deposit.

On such date as the Competent Authority may within two months after the determination to this lease or of any renewal thereof, the amount of the security deposit paid in respect of this lease and then remaining in deposit with the State Government and not required to be applied to any of the purpose mentioned in this lease shall be refunded to the lessee/licensee. No interest shall run on the security deposit.

PART IX General Provision

1. 1[Breach of Conditions]

In case of breach of any of the conditions of the lease other than mentioned in clause (2) and (3) of this part, then the Competent Authority may require the lessee/ licensee or his/their assigns to pay penalty not exceeding an amount equivalent to twice the amount of the annual dead rent specified under clause (I), Part V.

2. Obstruction to inspection.

In case lessee/licensee or his/their assignees does/do not allow or obstruct entry or inspection, by the Officers authorised by the State Government, the Competent Authority may cancel the lease and forfeit the whole or part of the deposit made under Rule 9(1) and 21(1) of the said Rules.

3. In case the lessee/licensee or his/their assignees commit any breach of any of the conditions specifies in the clauses, sub-rule (1) to (2) of Rule 6 of the said Rules then and in any such case the Competent Authority shall give notice in writing to the lessee/licensee or his/their or assignees as the case may be, asking him/them to remedy the breach within Thirty days from the date of the notice and if the breach is not remedied within such period the Competent Authority under the said Rules may determine the lease provided that nothing therein contained shall debar the State Government from enforcing any other right or remedy that the State Government may have against the lessee/licensee or his/her assignees under any other provisions herein contained.

5. If the lessee/licensee ceases/cease to work the quarry for a continuous period of one year the lease/license shall liable to cancellation as per the rules: Provided that the lease/license r shall not be cancelled if the lessee/licensee are prevented from working the quarry owing to some reasonable cause or if the lessee/licensee ceases/cease to work with prior permission of the Competent Authority. (

6. Interpretation. (

If there is any dispute regarding their lease/license or any other matter or thing ( construction of a term or condition in the lease/license anything connected with the quarries or minor minerals specified in this lease/license or the working or non working of the quarry

operated under this lease/license, the amount of payment of royalty or dead rent or its mode ( of payment to the Competent Authority it shall be referred to the State Government whose decision shall be final and binding on the lessee/licensee

8. Lessee/Licensee to remove his properties on the expiry of lease.

The lessee/licensee having first paid and discharged the rents and royalties payable by virtue of these presents may at the expiration or sooner determination of the said terms or within three months thereafter (unless the leasenicense shall be determined under c.lause (1) and (2) of this Part and in that case at any time not less than three calendar months after such determination), take down and remove for his own benefit all or any engines, machinery plant, buildings, structures, tramways, railway, railways other works, erection and conveniences which may have been erected, set up or placed by the lessee/licensee in or upon the said lands and which the lessee/licensee is/are are bound to deliver to the State Government under clause ( 18) of Part VII of this Schedule and which the State Government shall not desire to purchase.

9. Forfeiture of property left more than six months after determination of lease.

If at the end of three months after the expiration or sooner determination of the said term or after the date from which after determination of lease any surrender by the lessee/licensee of part under the provisions contained in Clause (3) of Part VIII of this schedule become effective there shall remain or upon the said land or the surrendered part or parts thereof the case may be any engine, machinery, plant, building, structures, tram ways, railways and other work, erections and conveniences or other property which are not required by the lessee/licensee in connection with his/their operations in these parts of the said lands which he/they has/have surrendered or in any other lands held by him/them under quarrying lease the same shall not removed by the lessee/licensee within one calendar month after notice in writing requiring their removal has been to the lessee/licensee by the State Government be deemed to become the property of the State Govemment and may be sold or di sposed of in such manner as the State Government shall dcen~ 'vyi tb ou t liability to pay eo mp·"i1: ''.tion or to the lt!sst":'./licem:::c ~;-. re spcL· I thereof. / . ~ ;--~ · _..,

* * * * This has reference to your application dated 7th December 2014 addressed to SEIAA, Karnataka on the subject mentioned above. It has been noted that the proposal is for grant of Environmental Clearance under the provisions of ElA Notification, 2006, for quarrying of Building Stone. The total quarry lease area of the project is 1 Acre, which is a Patta Land. Out of 1 Acre of area, 0.65Acre area is for quarrying, 0.12 Acre area is for waste dumping, 0.02Acre area is for mineral storage, 0.01Acre area is for infrastructure, 0.02Acre area is for roads and 0.18Acre area is for green belt. Working will be opencast and semi mechanized method. The water requirement for the project is 3.5 KLD will be met from tankers. During the plan period about 4,069 Tons of waste rock will be handled. The Mines and Geology Department has approved quarrying plan on 28th November 2014. Capital cost of the project is about Rs .30 Lakhs. It is reported that the lease area do not attract General Conditions specified in the EIA notification, 2006 and the amendments made there on.

2. The State Expert Appraisal Committee (SEAC) appraised the project in its meeting held on 22m1 and 23rd April 2015 and recommended for issue of Environmental Clearance. SPECIFIC CONDITIONS: ( 1. Quarry plan approved by the Departmen~ of Mines and Geology shall be strictly implemented and shall not be operated beyond the validity period of ( the approved quarry plan. 2. Baseline data on health profile of each of the workers shall be maintained. ( 3. PAs should get the health checkup done for the quarry workers on quarterly ( basis and submit report periodically. 4. The SEIAA, Kamataka reserves the right to withdraw the environmental ( clearance subject to any change in the quarrying policy by the State r Goverrunent as may be applicable to this project. 5. This Envirorunental Clearance is co-terminus with the lease granted vide quarry lease under MM (D & R) Act 1957/K!v1MC RULES-1994. 6. Quarrying shall be undertaken strictly in accordance with provisions of MM (D&R) Act 1957 / KMMC RULES-1994. 7. All the conditions stipulated in the Consent for establishment issued (If applicable) by the Kamataka State Pollution Control Board should be effectively implemented, ( 8. The quarrying operations shall not intersect ground water table. Prior approval of the SEIAA / Ministry of Environment & Forests and Central Ground '\Nater Authority shall be obtained for quarrying below water table. 9. The topsoil if any should be stacked at earmarked site only and should not be kept unutilized for a period more than 3 years. The topsoil should be used for reclamation and plantation. 10. Waste rock shall be stacked at earmarked site (s) only. The maximum height of the stack should not exceed lOm duly providing suitable terraces. The overall slope of the dump shall not exceed 27°. A retention wall shall be built around the waste rock dump to prevent sliding. 11 . Catch drains and siltation ponds of appropriate size should be constructed to arrest silt and sediment flows from quarry working area and rock dumps. The water so collected should be utilized for watering the haulage area, roads, green belt development etc., the drains should be regularly de-silted particularly after monsoon and maintained properly. 12. Dimension of the retaining wall at the toe of dumps within the quarry to check run-off and siltation should be based on the rainfall data. 13. The project authority should implement suitable conservation measures to augment ground water resources in the area in consultation with the Regional Director, Central Ground Water Board within 3 months and report be submitted to the Authority. 14. Appropriate mitigation measures should be taken to prevent pollution of nearby water bodies in consultation with the State Pollution Control Board. 15. The project proponent shall submit commitment from the competent authority for drawl of requisite quantity of v<.'ater for the project before starting work on the project. 16. Vehicular emissions should be kept under control and regularly monitored. ( Measures shall be taken for maintenance of vehicles used in quarrying

( operations and in transportation of blocks. 18. Digital processing of the entire lease area using remote sensing technique should be done regularly once in three years for monitoring land use pattern and report submitted to SEIAA Kamataka, Department of Environment and r Ecology, Govt. of Karnataka and the APCCF, Regional Office, MoEF, Bengaluru. 19. This environmental clearance does not confer any right to the proponent on the land proposed for quarrying until and unless quarry lease and all other statutory clearance are obtained from the respective department/ agencies. 20. The project authorities should undertake sample survey to generate data on ( pre-project community health status within a radius of 1 km from proposed quarry. ( 21. Consent to operate if applicable shall be obtained from State Pollution Control Board prior to start of production from the quarry. 22. Proper sanitary facilities should be installed for the colony /work place. Domestic waste generated should be disposed in a scientific manner. Proper first aid facilities and health care facilities should be provided for the labourers. 23. The project proponent shall take all precautionary measures during quarrying operation for conservation and protection of endangered fauna spotted in the study area. Action plan for conservation of flora and fauna shall be prepared and implemented in consultation with the State Forest and Wildlife Department. The proponent shall contribute towards the cost of implementation of the plan and / or Regional Wildlife Management Plan for conservation of wild life. The amount so contributed shall be included in the project cost. A copy of the action plan may be submitted to the SEIAA, Department of Environment and Ecology, Govt. of Karnataka, the Regional Director (Environment), Department of Environment and Ecology, Government of Karnataka, Karwar and the APCCf, Regional Office, MoEF, Bengaluru within 3 months. 24. The project proponent shall delineate Quarry Closure Plan/ exit protocol to rehabilitate the quarried out land to match its surrounding land use including removal, storage and reuse of waste rock from quarry area to cover reclaimed area. Post Quarry Land Use Plan with rehabilitation of quarried out area (with Plan and Section) provided and submit to SEIAA. 25. Plantation monitoring progranunc during post project period for ensuring survival and growth rate of plantation in reclaimed area. 26. A Final Quarry Closure Plan along with details of Corpus Fund should be submitted to the SEIAA Karnataka, Department of Environment and Ecology, Govt. of Karnataka and the APCCF, Regional Office, MoEF, Bengaluru 5 years in advance of final quarry closure for approval. 27. Retention walls should be a minimum of 2.5 mtr height with base of 3 mtr. 28. Patil 30. The infrastructure of transport roads should be improved collectively by the quarry owners of the area. ( 31. Link road from quarry site to main road shall be maintained and black topped by the project proponent. 32. The quarry lease area to be properly demarcated using the lat-long ( coordinates and duly erecting 4 feet concrete/ granite pillars on the ground. 33. No quarrying shall be undertaken outside the lease area. ( 34. The project Authorities shall maintain a margin of 7.5 meters along the lease ( boundarv. 35. The project authorities shall also earmark at least 5 % of the total turnover of (

The project authority shall ensure that the quarry pits are well protected erecting a compound wall of stone masonry of appropriate height conforming to safety norms. 37. The project authority shall avoid stagnation of water in the quarry pits which would turn out to be mosquito breeding centers resulting in spreading of diseases such as malaria, dengue, etc. 38. Haulage approach road should not be through village till the main road is reached. 39. The Project Authority shall get the Quarry plan modified limiting the production to quantity specified in this letter. B. GENERAL CONDITIONS: 1. No change in quarrying technology and scope of -..vorking should be made without prior approval of the SEIAA Karnataka. 2. No change in the calendar plan including excavation, quantum of mineral and waste should be made. 3. It shall be ensured that the Ambient Air Quality parameters conform to the norms prescribed by the MoEF, Govt. of India, New Delhi. 4. Data on ambient air quality (PMlO, PM 2.5, S02, NQ'() should be regularly submitted to the SEIAA Karnataka, Department of Environment and Ecology, Govt. of Karnataka, the Regional Director (Environment), Department of Environment and Ecology, Government of Karnataka, Karwar and the APCCF, Regional Office, MoEF, Bengaluru and the State Pollution Control Board / Central Pollution Control Board once in six months. 5. Fugitive dust emission from all the sources should be controlled regularly. Water spray arrangement on haul roads, loading and unloading and at transfer points should be provided and properly maintained. 6. Measures should be taken for control of noise levels below 85 dBA in the work enviromnent. vVorkers engaged in operations of HEMM, etc should be provided with earplugs / muffs. 7. ·waste water from the quarry should be properly collected, treated so conform to the standards prescribed under GSR 422 (E) dated 19th m and 31st December, 1993 or as mendt'd from time J~ time. Personnel working in dusty areas should wear protective respiratory devices ( and they should also be provided with adequate training and information on safety and health aspects. ( Occupational health surveillance program of the workers should be undertaken periodically i.e. once in 3 months to observe any contractions due to exposure to dust and take corrective measures, if needed. Quarterly report in this regard should be submitted to the Department of Environment and Ecology, Govt. of Karnataka and the Kamataka State Pollution Control Board and the APCCF, Regional Office, MoEF, Bengaluru. 9. A separate environmental management cell with suitable qualified personnel shall be set-up under the control of a Senior Executive, who will report directly to the Head of the organization. The Environment management committee should be constituted with one of the member representing nearby village. ( 10. The funds earmarked for environmental protection measures should be kept in separate account and should not be diverted for other purpose. Year wise expenditure should be reported to the SEIAA Karnataka, the Department of Environment and Ecology, Govt. of Karnataka, the Regional Director (Environment), Department of Environment and Ecology, Government of Karnataka, Karwar and the APCCF, Regional Office, MoEF, Bengaluru. 11. The project authorities should inform the SEIAA Karnataka, Department of Environment and Ecology, Govt. of Kamataka, the Regional Director (Environment), Department of Environment and Ecology, Government of Karnataka, Karwar and the APCCF, Regional Office, MoEF, Bengaluru regarding date of financial closures and final approval of the project by the concerned authorities and the date of start of land development work. 12. The Regional Office of MoEF, Bengaluru; the Department of Environment and Ecology, Govt. of Karnataka, the Regional Director (Environment), Department of Environment and Ecology, Government of Karnataka, Kanvar and the Kamataka State Pollution Control Board shall monitor compliance of the stipulated conditions. The project authorities should extend full co-operation to the Officer (S) of these offices by furnishing the requisite data / information / monitoring reports. 13. The project proponent shall submit six monthly report on the status of the implementation of the stipulated environmental safeguards to the SEIAA Karnataka, Department of Environment and Ecology, Government of Karnataka, the Regional Director (Environment), Department of Environment and Ecology, Government of Karnataka, Karwar and the APCCF, Regional Office, MoEF, Bengaluru; the Central Pollution Control Board and the Karnataka State Pollution Control Board. 14. A copy of the clearance letter will be marked to the concerned Panchayat. Local NGO, if any, from whom suggestion / representation has been received while processing the proposal. 15. The project proponent should display the conditions prominently at the entrance of the project on a big panel board for the information of the public. 16. The project authorities should advertise at least in two local newspapers widely circulated, one of which shall be in the vernacular language of the ( locality concerned, '\vithin 7 days of the issue of the clearance letter ( informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution Control Board and also at website of the Authority at http://www.seiaa.kar.nic.in and a copy of the same should be forwarded to the Department of Environment and Ecology, Government of Karnataka, the Regional Director (Environment), Department of Environment and Ecology, Government of Karnataka, Karwar and the APCCF, Regional Office, MoEF, Bengaluru. 18. Concealing factual data or submission of false/ fabricated data and failure to ( comply with any of the conditions mentioned above may result in withdrawal of this clearance and attract action under the provisions of ( Environmental (Protection) Act, 1986. ( 19. Any appeal against this environmental clearance shall lie with the National Green Tribunal, if preferred, within a period of 30 days as prescribed under Section 16 of the National Green Tribunal Act, 2010. 20. The SEIAA or any other competent authority may alter / modify the above conditions or stipulate any further condition in the interest of environment protection. 21.
