Irvine, 26 February 2001 - At a Meeting of the Planning and Regulatory Sub-Committee of Council at 10.00 a.m.

Present David Munn, Samuel Gooding, Robert Reilly, Jack Carson, David Gallagher, James Jennings, Elizabeth McLardy, David O'Neill, Robert Rae, and John Sillars.

1. Arran Local Plan Area

In terms of Standing Orders Councillor Munn declared an interest in 1.1 and 1.2 below and withdrew from the meeting. Councillor Gooding assumed the Chair for these items.

1.1 Blackwaterfoot: Land at South Feorline Shore

West of Water, West of Scotland Science Park, Acre Road, Glasgow have made a screening request for the Council's opinion on whether a planning application for a waste water treatment plant on land at South Feorline Shore, Blackwaterfoot, Arran, will require to be accompanied by an Environmental Statement.

The Sub-Committee agreed that (a) the planning application need not be accompanied by an Environmental Statement, but that it will require to be accompanied by additional information including details of landscape and visual impact, odour, noise, dust, archaeology and traffic, together with mitigation measures; and (b) the applicants be advised that the preferred access route is the track running north east from the site direct to the A841.

1.2 Brodick: Market Road

West of Scotland Water, West of Scotland Science Park, Acre Road, Glasgow have made a screening request for the Council's opinion on whether a planning application for a waste water treatment plant at Market Road, Brodick, Arran, would require to be accompanied by an Environmental Statement.

The Sub-Committee agreed that the planning application need not be accompanied by an Environmental Statement, but that it will require to be accompanied by additional information including details of landscape and visual impact, geology (including possible presence of contaminated land), odour, noise, dust, archaeology and traffic, together with mitigation measures.

Page 1 2. Garnock Valley Local Plan Area

2.1 N/00/00404/PP: Beith: Sunnyside of Threepwood

Ms E Hutchison, Sunnyside of Threepwood, Beith has applied for a Change of use of a domestic outbuilding and grounds to form a private corporate entertainment venue at that address. Objections have been received from C. M. Scott, Whitestones Farm, Gateside, Mr and Mrs John Lamont, Shutterflat Farm, and J. R. Kerr, Brownhill of Shutterflat farm, all Beith.

The Sub-Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions:-

(1) That the activities to be carried out on the site shall be limited to those listed in the Business Plan submitted with the application and shall not be amended or augmented unless approved in writing by North Ayrshire Council as Planning Authority.

(2) That prior to the private corporate entertainment venue hereby approved coming into use, four vehicular passing places shall be constructed and available for use on Bigholm Road as specified by the Roads Service and to the satisfaction of North Ayrshire Council as Planning Authority.

(3) That no more than 60 customers shall be allowed on the site at any one time to the satisfaction of North Ayrshire Council as Planning Authority.

(4) That prior to the corporate entertainment facility hereby approved coming into use, a report shall be submitted to, and approved in writing by, North Ayrshire Council which demonstrates that the effluent disposal arrangements will comply with the current code of practice BS6297:1983, all to the satisfaction of North Ayrshire Council as planning authority.

(5) That the clay pigeon shooting, quad biking and off-road driving activities shall only be carried out between the hours of 0800 to 1800 on any day; and that outwith these times these activities shall cease, all to the satisfaction of North Ayrshire Council as Planning Authority.

(6) That no music, pre-recorded or live, shall be played in the open air and the playing of all music shall be restricted to inside the buildings on the site to the satisfaction of North Ayrshire Council as Planning Authority.

(7) That the clay pigeon shooting hereby approved shall be carried out using laser operated guns only, and firearms using live ammunition shall not be operated at the site without the express written permission of North Ayrshire Council as Planning Authority.

2.2 N/00/00718/PP: Beith: Wilson Street: Criffel

Mr J Wilson, Criffel, Wilson Street, Beith, has applied for planning permission to erect 3 houses at that address. An objection has been received from N. McCulloch, Dunlop Cottage, 63 Wilson Street, Beith.

The Sub-Committee, having considered the terms of the objections, agreed to grant the application subject to the following conditions:-

(1) That the boundary walls indicated in green on the application plans shall be retained to the satisfaction of North Ayrshire Council as Planning Authority.

(2) That prior to the occupation of any of the dwellinghouses hereby approved, the new and amended vehicular accesses shall be constructed as shown on the approved drawings, to the standards of the Roads Authority and be available for use, all to the satisfaction of North Ayrshire Council as Planning Authority.

(3) That the first 2.0 metres of the accesses hereby approved, measured from the heel of the footway fronting the site, shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.

Page 2 (4) That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority a detailed specification and samples of the proposed external finishes.

(5) That visibility splays of 2.5 metres by 60 metres shall be provided towards the north from both accesses hereby approved and towards the south from the northern access hereby approved; and that a visibility splay of 2.0 metres by 60 metres shall be provided towards the south from the southern access hereby approved; all of which shall be maintained such that there is no obstruction to visibility above a height of 1.05 metres measured above the adjacent carriageway level to the satisfaction of North Ayrshire Council as Planning Authority.

(6) That prior to any of the dwellinghouses hereby approved being occupied, the vehicular turning areas shown on the approved drawings shall be constructed at both the new development hereby approved and for the two flatted dwellinghouses already existing on the application site to the satisfaction of North Ayrshire Council as Planning Authority.

(7) That no trees, other than those indicated on the approved plans, shall be felled, lopped or topped without the prior written approval of North Ayrshire Council as Planning Authority.

2.3 N/00/00831/PP: Dalry: Templand Road: site to East of 7 Templand Road

Mr and Mrs P Sherrie, 7 Templand Road, Dalry, have applied for planning permission for the erection of a dwellinghouse at that address. A representation has been received from D. Smith, 5A Templand Road, Dalry.

The Sub-Committee, having considered the terms of the representation, agreed to grant the application subject to the following conditions:-

(1) That prior to work commencing on site, a scheme to reduce the height of the existing boundary wall on the Templand Road frontage of the site to no more than 1.0 metre above carriageway level, shall be submitted to, and approved in writing by, North Ayrshire Council as Planning Authority.

(2) That prior to the dwellinghouse hereby approved being occupied, the boundary wall on the site frontage shall be reduced in height in accordance with the scheme approved under the terms of Condition 1 above.

(3) That the first 2.0 metres of the access, measured from the metalled portion of Templand Road fronting the site, shall be hard surfaced in order to prevent deleterious material being carried onto the carriageway and designed in such a way that no surface water shall issue from the access onto the carriageway.

(4) That the two trees indicated on the approved plans in green shall be protected during the course of construction works and shall not be lopped, topped or felled without the prior written approval of North Ayrshire Council as Planning Authority.

3. Irvine/ Local Plan Area

In terms of Standing Orders Councillor O'Neill declared an interest in the following item and took no part in the discussion.

N/00/00392/LBC: Irvine: Church Street: Ayrshire Metal Products Slipway

Mr J M Tildesley, Director of Scottish Maritime Museum, Laird Forge Buildings, Gottries Road, Irvine, has applied for planning permission for the demolition of the clipper ship "Carrick" - "City of Adelaide" located in a dry dock within the site of Ayrshire Metal Products, Church Street, Irvine. 119 representation (as detailed in Appendix P&R1) have been received together with a petition with 22 signatures from Turramurra, New South Wales, Australia. Representations have also been received from organisations involved in the history and preservation of ships ie. The Sub-Committee, having considered the terms of the objections and representations, agreed to refuse the application for the following reason:-

That the case for demolition has not been proven beyond reasonable doubt in that the ship, which, in terms of construction technology and historic interest is of international significance, is not in a dangerous condition and it has not been demonstrated that every effort has been exerted by all concerned to find practical ways of keeping the ship as is required by Section 2.10 of the Memorandum of Guidance on Listed Buildings and Conservation Areas (1998).

4. North Coast and Cumbraes Local Plan Area

N/00/00872/PP: Largs: 2 Mackerston Place

Mr and Mrs McCulloch, 2 Mackerston Place, Largs have applied for a Change of use of domestic basement to form a tea room with associated toilets and ramped access at that address. Objections have been received from Mr and Mrs J G Gardiner, Gogo Vale, 1A Burnlea Road, Largs (who also objects on behalf of Mr and Mrs E W McKenna, 1 Burnlea Road, Largs - resident in Florida), Mr V Venugopal, 1A Burnlea Road, Largs and the Benedictine Monastery, 5 Mackerston Place, Largs.

The Sub-Committee, have considered the terms of the objections, agreed to grant the application subject to the following conditions:-

(1) That no amplified music shall be played within the premises; and

(2) That the use hereby permitted shall not operate between the hours of 6.00 p.m. in any day and 11.00 a.m. the following day.
