PRESIDENT’S MESSAGE Bernie Guerreaz PS, 2015 ISPLS President

Fellow Members of ISPLS: June 2015 appears beginning as one of the best we as a profession in Indiana have had for several years. Job opportunity posions on the ISPLS Job Board are up and indicaons through speaking with colleagues over the past 8 months or so indicate land surveyors in general are sing on quite a bit of backlog. Cheers to a lile relief and keep up the good work. Maybe this will be a good me to take an opportunity to step out and connue to edu‐ cate other professionals in your community of the necessity of our professional services. Al‐ so don’t forget to read up on HB 1050 with respect to land surveyor’s statute of repose and noficaon requirements to bring the benefit of the Bill to you individually. As June arrives ISPLS has been able to move into our new normal. As you know the Board of Directors has entered into a contract with Banning Engineering, P.C. to provide administra‐ ve management services for ISPLS potenally to June 30, 2016. Jason Coyle will remain our Execuve Director as an employee of Banning Engineering and his assistant Ms. Andrea Wade will be working directly with Jason to address your general email, telephone and membership queries, among other tasks, on a daily basis. Welcome Home Jason, (albeit you never really le)! And Welcome Aboard Andrea! In par‐ cular Andrea has worked with Banning Engineering on a part‐me basis and now will concentrate efforts on ISPLS. Kudos to Andrea as she is climbing that learning curve very quickly and has hit the ground running.

Note to members, our first Board of Directors meeng at our new headquarters located at 853 Columbia Road, #101, Plainfield, IN 46168 will be on June 27, 2015 at 9:00 am. In the meanme Board Members are planning on moving those items out of the current office that do not sell in the online aucon Jason informed you of late last week. Speak‐ ing of which, please klook bac through your email dated May 28, 2015. Jason and Andrea have compiled an outstanding list of furniture and equipment for sale as well as items out of our library for free. All of which are in outstanding condi‐ on. Another item that is notable to share is an effort by Chuck Coyle of the Indiana Professional Land Surveyors Foun‐ daon to formulate agreements with individual chapters to seed endowments to the Foundaon. Queries to this effect should be directed to Chuck via email at [email protected]. I also request you seek out the meeng mes of your respecve Chapter Meengs. Call the ISPLS office at 317‐888‐4400 and ask Andrea or simply send an email to her at [email protected]. She will be happy to assist you with your quesons on dates, locaons and who within YOUR Chapter to contact.

Finally, don’t forget to renew your memberships. Work on the convenon which spans January 13 thru January 15, 2015 at the Marrio on 21st Street in Indianapolis is underway and it will be here before you know it. The program is coming together and your renewals will keep you abreast of noces, emails, and items of interest having to do with the Convenon and other events within the society. Membership, among other things, provides cost discounts on the con‐ venon, access to legislave lobbyists and legislave safeguards, and access to legislave outreach on a naonal level via NSPS. Without ISPLS and the work of individuals within the organizaon such as Jason Copperwaite, PS, House Bill 1050 would likely not have been realized.

So with that, I leave you with one last thought: “Stop Look and Listen”. Lessons of Operaon Safety in the Railroad In‐ dustry ring true in our profession too. Pay aenon and be safe.

ISPLS BOARD OF DIRECTORS MEETING HIGHLIGHTS By Andrea Wade, ISPLS Administrave Assistant

March 14, 2015

The ISPLS Board of Directors met on Saturday, March 14, 2015 at ISPLS Headquarters, Indianapolis, Indiana. President Bernie Guerreaz called the meeng to order at 8:59 am EST. All board members were in aendance with the excepon of Perry Cloyd. Others in aendance were Marc Cady, Dave Cro, Doug Herendeen, and Randy Miller.

Don West read the ISPLS Mission Statement and Rich Hudson read the Vision Statement. Both statements were also printed in the agenda. Adjustments had been made to the meeng agenda. HB 1163, dealing with land splits, had been removed. Jason Coyle submied a leer of resignaon as Execuve Director. A moon was made by Todd Bauer and seconded by Jim Tibbe to accept the agenda as adjusted. The moon passed by a voice vote.

The minutes from the January 14, 2015 Board meeng were reviewed and accepted. A moon was made by Don West and seconded by Don Williams to accept the Board of Directors’ meeng minutes as amended. The moon passed by a voice vote. The minutes from the January 14, 2015 Board of Directors Reorganizaon meeng were also reviewed and accepted. A moon was made by Eric Banschbach and seconded by Don Williams to accept the minutes as amended to clarify the financial report. The moon passed by a voice vote.

The Treasurer’s Reports were reviewed and narrated by Dennis Grumpp. The wrien financial reports dated February 28, 2015 were presented, and assets totaled $280,017.83. Dennis also covered the income and expense report, (Connued on page 7)

There was board discussion regarding other state sociees collecng NSPS dues from Indiana residents, the water bill, credit card fees, and the budget spreadsheet. A moon to accept the Financial Reports was made by Don Williams and secondedd by Tod Bauer. The moon passed by a voice vote.

The Board heard and reviewed the Execuve Director’s report. Execuve Director Coyle presented a wrien report and discussed highlights with the board. Aenon was drawn to the membership increase from last year. Dues had been paid to the chapters and NSPS, and tax filings have been made for the chapters. Our website created through YourMembership is being updated, and the chapter pages need some eding and updang. There are 24 job openings on the website. There was not a Central Indiana Damage Council meeng (Indiana 811), the next meeng will be held in April. The CST exam, LTAP Stormwater conference and Board of Registraon were noted, and the PS exam review had six signed up for the next weekend. The Central Indiana Chapter is planning for connuing educaon before this year’s golf oung. The Hoosier Surveyor should be out in the next week or two weeks. The “JCC – Job Creaon Commiee” meeng minutes have numerous errors, and a leer will be sent to them. The JCC had concerns about the required work experience and educaon. ILTA is sending a leer of support for connuing registraon requirements for surveyors and Jason is working with NSPS, ALTA and others to get their support. HB 1030, Registry of Cerfied Professions was discussed. Jason has submied a leer of resignaon, effecve May 1st. There were no Board moons.

Doug Herendeen and Jason Coyle gave a report concerning the 2015 Annual Convenon. ISPLS made a profit of $37,736.95, and the chapters had a profit of $6,659.46. The inial plan for the 2016 convenon was presented.

ISPLS Commi ee reports: Commiee Chairs and charges were presented for consideraon. Ron Wharry and Brent Friend are now on the Membership Commiee/New Member reviews. Ryan Swingley and Todd Bauer are now part of the Public Informaon and Markeng Commiee, which had a brief discussion about marke ng. Geodec Control has gained Eric Banschbach and Ma Badger.

Jason Coyle, the Board of Registraon Liaison, was not present at the last meeng, but 18 applicaons were approved. Also, a connuing educaon audit was performed for 1% of registrants. Dave Gaston, the County Surveyors Liaison gave a brief report on Road School, and is planning to communicate with Indiana Counes. NSPS Director Tony Gregory re‐ ported the spring meeng will be in April. Eric Banschbach with the Geodec Control Workgroup stated “Height Mod” observaons have been completed in the Vincennes District. The Legislave Commiee provided that HB 1050 Statute of Repose is in the Senate subcommiee, HB 1303 Cerfied Professions does not apply to surveying, SB 225 Indiana 811/ Dig Law‐purpose may be addressed by IURC policy, and HB 1163 Dividing Land is dead.

Ausn Yake with the Educaon Commiee reported that the PS Review is coming up. Luke Jahn gave a report for the Scholarship commiee stang that forms are available and they will be due April 3rd. There was also a board discussion about having interviews at the schools or at the office. The board consensus was to leave the interview locaons up to the commiee.

Rich Hudson reporng for the By‐Laws Commiee stated that e‐vong parcipaon could always improve. ISPLS saved money as only 22 ballots were mailed out (by request or for members without e‐mail), and 6 of the ballots were re‐ turned. Dennis Grumpp, Chair of the Finance and Planning Commiee, is planning a meeng of that group immediately aer the board meeng. Frank Walsko, Chair of the Young Professionals Commiee, has received informaon from NSPS. The Facilies Advisory Commiee (and with board direcon by e‐mail), are concentrang on the Castleton Park building 10, unit 103. Aer discussion a moon wasm made by Ji Tibbe and seconded by Rich Hudson to make a coun‐ teroffer per Jason’s e‐mail. Aer later discussion, a moon to rescind that moon was made by Jim Tibbe and seconded by Rich Hudson, both moons passed by voice vote. A moon to disconnue the telephone line service for the fax ma‐ chine was made by Jim Tibbe and seconded by Todd Bauer which passed by voice vote. (Connued on page 9)

Eric Banschbach, IPLS Foundaon Liaison, gave a verbal report. Perry Cloyd is the new president; Dan Kovert will be the new liaison. At the February meeng they discussed widening the scholarship and grant availability. There have been discussions with the Indiana Historical Society about reenacng and travel relatede to th 2016 Indiana Bicentennial, fundraising and partnerships, display informaon, memoranda of understanding with chapters and the raffle.

Chapter Reports: The Northwest Chapter met at Crown Brewery, and will have a baseball oung June 2nd, and a golf oung July 10th. The Wabash Valley Chapter announced their new officers, Marc Cady is the new President, Randy Mil‐ ler is Vice President, Barry Bunnell is Treasurer, and Don Wimmer is secretary. Trig Star is in process and they are plan‐ ning a scholarship golf oung. The Central Indiana Chapter will have their next meeng March 19th, and the Southwest Chapter’s next meeng will be held at Vincennes University on March 19th for a cookout. The Northwest Chapter is working on the 2016 Convenon planning. Jim Swi presented a one hour Stone Hunter connuing educaon program on February 16th. Inial Point Chapter has a joint meeng with the KAPS chapter in the near future. The Greenville Trea‐ ty Chapter meeng is March 26th in Osgood, and the Hoosier Hill Chapter met on February 24th and had elected new officers.

Unfinished Business: There was a discussion about the destrucon of records from the Sullivan County Surveyor’s office, and a discussion about the response from the Job Creaon Commiee.

New Business: The Board of Directors meeng was temporarily recessed to hold an execuve session concerning the replacement of the current Execuve Director, Jason Coyle.

Chuck Coyle presented a wrien report on the PLSO convenon, and Jim Tibbe noted that the Illinois conference was offering connuing educaon credits for mulple states.

The meeng adjourned at 3:24pm.

April 18, 2015

The ISPLS Board of Directors met on Saturday, April 18, 2015 at ISPLS Headquarters, Indianapolis, Indiana. President Bernie Guerreaz called the meeng to order at 9:02am EST. All board members were in aendance with the excep‐ on of Todd Bauer. Others in aendance were Ed Sweetland who joined the meeng at 10:04am.

Don Williams read the ISPLS Mission Statement and Eric Banschbach read the Vision Statement. Printed copies of the agenda were provided. The members of the board of directors were asked to consider task assignments currently per‐ formed by the Execuve Director. The agenda was accepted by consent. The minutes from the March 14, 2015 meeng were reviewed, and they were accepted by consent.

The Treasurer’s Reports were reviewed and narrated by Dennis Grumpp. The wrien financial reports dated March 31, 2015 were presented and ISPLS assets totaled $389,912.83. Dennis also covered the income and expense report, in‐ vestment report, budget, and the profit and loss budget versus actuals report, and the 2014/2015 budget spreadsheet. A moon to accept/receive the financial reports was made by Perry Cloyd and seconded by Jim Tibbe. The moon passed by a voice vote.

Execuve Director Coyle gave the Board his wrien Execuve Director’s report. The report included the following high‐ lights: The membership roster will be updated by the end of the month. Jason will plan on working on the Business en‐ ty reports that need to be fidle for the chapters. The House has concurred with changes made in the Senate to House Bill 1050, Statute of Repose, and it has been sent on to the Governor’s Office. The ISPLS lobbyist, Mike O’Brien, will send a leer to the Governor supporng this. The PS Exam review was held on March 21st. Seven individuals paid for

(Connued from page 9) the course and six aended. The Winter Hoosier Surveyor has gone out. Jason has been organizing and packing the library materials and had suggesons for items to be removed from the collecon. There were no board moons.

Doug Herendeen and Jason Coyle discussed the 2015 Convenon Report and Update. Revenues were up and expenses were down at this year’s conference.

ISPLS Commiee reports: Ron Wharry and Brent Friend as part of the Membership Commiee/New Member reviews reported that upon peon, a moon to grant life membership to David B.H. Best was made by Brent Friend and se‐ conded by Perry Cloyd. The moon passed by voice vote.

The Board of Registraon Liaison, Jason Coyle, will connue aending meengs if possible, and Perry Cloyd will help as needed. The next meeng is scheduled for April 17, and will include two disciplinary hearings. The County Surveyors Liaison, Dave Gaston, discussed that he is waing to receive more informaon from the County Surveyor’s Associaon regarding Sullivan County before deciding how to proceed with that maer. The NSPS Director, Tony Gregory, aended the Spring NSPS mee. ng Luke Jahn with the Scholarship Commiee noted that the Purdue interviews were held Fri‐ day, April 17, and the Vincennes interviews will be held the following Friday. Dennis Grumpp with Finance and Planning reported that the preliminary budget has been posted to Dropbox. The Past President’s Council is working on an up‐ date of acvies. Don West and Jason Coyle reporng from the Facilies Advisory Commiee discussed that a lease cancellaon noce has been sent informing Castleton Park that ISPLS will not be moving forward with space there at this me.

Eric Banschbach, IPLS Foundaon Liaison, gave a verbal report that the Foundaon will meet next Monday.

Rich Hudson with the Northwest Chapter reported that the baseball oung will be June 12, and the golf oung will be July 10.

Unfinished Business: A leer had been sent out to the Job Creaon Commiee.

The Board discussed the following items under new business: The announcement that ISPLS is seeking an Execuve Di‐ rector has been sent to or posted with: ISAE (Indiana Society of Associaon Execuves), the Kelley School of Business, Purdue, Ball State, the Hoosier Surveyor and the ISPLS membership by email. Leslie Murphy, president of Raybourn Group Internaonal, spoke to the execuve commiee last Saturday about what services an associaon management company could offer. The discussion of that meeng was also reviewed. There was discussion about the merits of hold‐ ing a goal‐seng meeng to determine long‐range goals for ISPLS.

Banning Engineering has submied a leer of interest in providing associaon management services to ISPLS. A moon to ask Banning to submit a proposal for associaon management services was made by Perry Cloyd and seconded by Brent Friend. The moon passed by voice vote. A moon to have Stephen Ingram facilitate a Board of Directors goal‐ seng session was made by Jim Tibbe and seconded by Perry Cloyd. The moon passed by voice vote. A moon to approve the transfer/disposal of library items idenfied by Jason Coyle was made by Bryan Catlin and seconded by Eric Banschbach. The moon passed by voice vote. Dennis Grumpp will invesgate bonding.

A moon to require two signatures on checks, the Treasurer and another account signatory, to be effecve July, 1, 2015, was made by Dennis Grumpp and seconded by Jim Tibbe. The moon passed by voice vote. A moon to have the Execuve Commiee (President Bernie Guerreaz, Vice‐President Perry Cloyd, Treasurer Dennis Grumpp, Secretary Bryan Catlin, Past‐President Don West and President‐Elect Rich Hudson) and Execuve Director Jason Coyle be named as signatories for the checking account was made by Perry Cloyd and seconded by Dennis Grumpp. The moon passed by voice vote with Jim Tibbe vong no. There was a general discussion about ISPLS obtaining a post office box.

BOARD OF REGISTRATION FOR LAND SURVEYORS MEETING HIGHLIGHTS ‐ APRIL 17, 2015 By Robert “Jason” Coyle, PS, Execuve Director

The Board of Registraon for Professional Surveyors (Board) met Friday, April 17, 2015, at 9:00 am EDT. The meeng was held at Indiana Government Center South, 402 W. Washington Street, Room W064, Indianapolis, Indiana. Aer a few addions under discussion item, a moon was made by Doug Lechner and seconded by Ross Holloway to adopt the amended agenda. The moon passed with a voice vote. A moon was made by Gary Kent and seconded by John Stephens to adopt the minutes from the January 30, 2015 meeng. The moon passed with a voice vote.

At 9:04 am, the Board held an Administrave Hearing concerning Bre R. Miller, LS20300059, regarding an Administra‐ ve Complaint, Cause No. SBRLS 14‐08. Board Member, Gary Kent, recused himself from the hearing since he was in‐ volved with the Selement Conference. A complaint had been dfile against Mr. Miller for using his Professional Sur‐ veyors License to stamp and cerfy work outside of the pracce of surveying – namely preparing design plans for pro‐ jects outside of a subdivision. Prior to the complaint, Mr. Miller felt he was acng in accordance with the law and was under the impression that he could design sewers as long as they were not under pressure. Mr. Miller has since changed his business pracce and hired a Professional Engineer. Another key discussion point during the hearing was the fact that other Professional Surveyors and/or Professional Engineerst did no try to educate or mentor Mr. Miller prior to filing a complaint against him. At the conclusion of the hearing, Ross Holloway made a moon to accept the terms of the Selement. The moon was seconded by Doug Lechner and passed with a voice vote. eTh Board further stressed that Professional Surveyors should aempt to educate / mentor fellow Professional Surveyors not following the law and/or rules before filing a complaint against them. At 9:25 am, the Board held an Administrave Hearing concerning Jerry D. Wiggins, LS8088002, regarding an Adminis‐ trave Complaint, Cause No. SBRLS 14‐09. Natalie Sdd, Deputy Aorney General, provided the following facts per‐ taining to the hearing. Mr. Wiggins has had a suspended Professional Surveyors license since August 29, 2006. Mr. Wiggins has also not paid the $6,000 civil penalty ordered by the Board on August 29, 2006. In January 2010, Mr. Wig‐ gins had submied two invoices to Philip and Erica Jackson for works related to a replat of Lots 745 and 746 of Foxcliff Estates South Secon 35, Morgan County, Indiana. Aer a short break, the Board connued with an Administrave Hearing in the Maer of the Applicaon for Neal A. Ballah at 10:58 am EDT. The hearing was in regards to a Peon of Review for Denial of Applicaon, Cause Number SBRLS 15‐02. The Board had reviewed Mr. Ballah’s applicaon for Professional Surveyor and denied it based upon his work experience. Mr. Ballah had the required number of years of experience, but failed to properly convey on his ap‐ plicaon that he had obtained at least 60% of his land surveying experience with those acvies listed within Indiana Code 25‐21.5‐1‐7(b)(4) through IC 25‐21.5‐1‐7(b)(7). Mr. Ballah presented addion informaon and evidence concern‐ ing his work experience during the hearing. Upon conclusion of the hearing and further Board discussion, a moon was made by Gary Kent and seconded by Mike Deboy to approve Mr. Ballah’s applicaon and allow him to sit for the exam. The moon passed with a voice vote.

At 11:08, the Board held an Administrave Hearing in the Maer of the Applicaon for John A. Campbell at 10:58 am EDT. The hearing was in regards to a Peon of Review for Denial of Applicaon, Cause Number SBRLS 15‐04. The Board had reviewed Mr. Campbell’s applicaon for Professional Surveyor by Comity and denied it based upon his ob‐ tained educaon. Mr. Campbell explained that he was first licensed as a “Property Line Surveyor” in the State of Mary‐ land in 1984. In 1996, Mr. Campbell was licensed as a Professional Surveyor in Maryland. The State of Maryland has two license types: 1) a Property Line Surveyor; and 2) a Professional Surveyor. Mr. Campbell noted that in Maryland a Property Line Surveyor can perform all the same tasks as a Professional Surveyor with the excepon of road design, storm water design, and storm water management. Aer some discussion, it was suggested that the Board could use the date of Mr. Campbell’s fi, rst license Property Line Surveyor license in 1984, for determining what requirements had to be met. Upon conclusion of the hearing, a moon was made by Gary Kent and seconded by John Stephens to ap‐ prove Mr. Campbell’s applicaon based upon the abovemenoned suggeson and allow him to sit for the exam. The Boardn co nued with an Administrave Hearing in the Maer of the Applicaon for Patrick Finn. The hearing was in regards to a Peon of Review for Denial of Applicaon, Cause Number SBRLS 15‐03. The Board had reviewed Mr. Finn’s applicaon for Professional Surveyor by Comity and denied it based upon his obtained educaon. Mr. Finn ex‐ plained his case and noted that his first Professional Surveyor’s license was received in the Spring of 1988 in the State of Ohio. The State of Indiana first required the educaon component for licensure ine th Summer of 1988. Thence, Mr. Finn fell under Indiana requirements which required for no educaon. Upon conclusion of the hearing and further Board discussion, a moon was made by Gary Kent and seconded by Rich Hudson to approve Mr. Finn’s applicaon and allow him to site for th exam. The moon passed with a voice vote.

The Board next had a discussion with Richard Vermillion, PS, Knox County Surveyor. Mr. Vermillion expressed a con‐ cern that County Surveyor’s Offices across the State had a difficult me of hiring qualified individuals. This is due to the fact that the individual would have a tough me gaining the boundary experience needed to be able to sit for the Pro‐ fessional Surveyors exam. (Connued on page 15)

The Board connued with Probaonary Reports for J. Bernard Feeney, Michael Sadlon, Ronald Morrison, and Stephen Williams. There was substanally nothing to report concerning these individuals since they had not prepared any sur‐ veys.

The Board discussed the applicaons that were reviewed and reported as to whether they were approved or denied. The following applicaons were approved: 1. Mark H. Kamin – Professional Surveyor ‐ Approved 2. Byron D. Howell – Professional Surveyor by Comity – Tabled – Requesng more detail on work experience.

The Board then turned their aenon to the discussion items eon th agenda. The Board approved to send Amy Hall, Board Director, and Doug Lechner to represent the Board of Registraon for Professional Surveyors at the NCEES Na‐ onal Meeng. The second round of connuing educaon audits was conducted on 2 licensed professional surveyors. One slls need to submit and the other was found not in compliance. Addional the Board had a brief discussion con‐ cerning Carlos Pedrazza, LS80040274, based upon tesmony and facts presented earlier in the meeng. Ross Holloway made a moon to have the Indiana Professional Licensing Agency file a complaint against Mr. Pedrazza. The moon was seconded by Doug Lechner and passed with a voice vote.

INDIANA PROFESSIONAL LAND SURVEYORS FOUNDATION, INC. Report from Perry Cloyd to the ISPLS Membership ‐ June 1, 2015

Since the March 24, 2015 Report, the IPLS Foundaon BOD has met on two occasions [April 20th and May 11th] and there are several items that the Board has taken up:

1) Scholarships: The foundaon has finalized the applicaon for an “Open” Scholarship to any student that is enrolled or intending to enroll in an approved surveying or sur‐ vey related program. This would be open to high school students or exisng survey‐ ing students that will be enrolled for classes in the fall of 2016. The recipient must be an Indiana resident, but not necessarily aending an Indiana school. The amount has not yet been determined, but we are working on the amount, interview process and payment schedule to put the finishing touches on the project.

There has been no change related to the applicaons for the Peggy Archer Award (Vincennes), the John G. McEntyre Award (Purdue), as well as the P.U.‐ Scholarships. April 1st was the deadline for applicaon; We understand that there are approximately 50 surveying students statewide that can apply for these scholarships, and the process is moving forward.

2) Financial Partnering and Fund Raising Ideas: The foundaon board has researched opportunies such as the Flower and Pao Show, Indianapolis Home Show, Honor Flight and Wish for our Heroes as a way to make the services of the surveyor beer known to the general public. Please “stand by” as we connue to solicit such opportunies.

3) Grants: The deadline for Grant Applicaons was also April 1st. We have reviewed grants for the Indiana Map to support operaons as well as a grant from Parke County to purchase a large format scanner. I am happy to say the foundaon was able to support both requests. We have commied to supporng the Indiana Map for the next 3 years and funded 40% of the scanner project. In addion, we have discussed suggested grants relat‐ ed to the Indiana Surveyor’s Historical Society, a secon corner soware program, a standard contract book and a court case book. While none of these have been officially submied, the foundaon rounely discusses issues such as these to gain understanding of potenal opportunies. Grant applicaons can be obtained on the ISPLS Website under the Foundaon tab.

4) The IPLSF Raffle: The Foundaon provided a survey to determine if the membership preferred the individual “bucket” format used at the last conference or the “all in one” format that was previously used. While no final decision has been made at this me, the membership has indicated it prefers to be in the running for every prize and wants the “all in one” format to return. The foundaon is already considering prizes for next year… so if you have some special ideas please pass them along to a Foundaon Board member.

5) IPLSF / Chapter MOU’s: The Foundaon now has the Foundaon/Chapter MOU agreement in a form that we are able to present this program to the Chapters for their consideraon. If your chapter would like to have a MOU presentaon made just let an IPLSF Board member know.

6) Budget: The foundaon will finalize the 2015/2016 budget at the Junee me ng.

Randy Corn vs. Junior P. Corn, Bonnie C. Corn and Benjamin Corn, Indiana Court of Appeals Case No. 85A02‐1405‐PL‐323, January 12, 2015

Here the Wabash Circuit Court was asked to determine ownership and other rights concerning a thirty foot lane which had been established when an eighty acre parcel was split up in 1897 or before. Briefly, through several transacons, both ownership and rights for ingress and egress were transferred to the owner of the northern 53 acre parcel. Since 1977 that owner has been Randy Corn. Junior Corn bought the balance of the acreage which is split by the lane in 1984. The southern line of the southern tract runs along a county road. Junior and Randy used the lane to gain ac‐ cess to the road, apparently peacefully. Eventually Junior sold a porone of th property along the county road to his son Benjamin who built a house and used the lane to gain access to his driveway. During construcon on the home in 1999, Randy objected to Junior’s use of the lane. In 2011, the Corns filed a complaint to quiet tle against Randy. They alleged that they held fee simple tle by an 1899 deed or alternavely, they held tle by adverse possession.

Aer counterclaims, a bench trial was held in which the court was apparently concerned about the differing language in the deeds from the 1890’s and eventually decided that Randy Corn and the Corns were tenants in common of the lane. Randy Corn filed a moon to correct error which was denied and this appeal ensued.

On appeal, the court found that the plain language of the earlier transacons transferred fee tle as well as ingress‐ egress rights to Randy Corn’s predecessor in tle. The appeals court also denied an argument that clauses contradict each other in the prior deeds. As to the claim of adverse possession, the court found that it failed due to the issue of control since Randy used the tlane to ge to his house from the county road daily. The case was remanded back to the trial court with a finding that Randy Corn owned fee simple tle but that the trial court must now consider whether the Corns have established a prescripve easement over some poron of the lane as well as Randy’s request for perma‐ nent injuncve relief. Both are issues the trial court did not address once it found Randy and Junior as tenants in com‐ mon.

LBLHA, LLC, Margaret L. West and Don H. Gunderson vs. Town of Long Beach, Indiana, Alliance for the Great Lakes and Save the Dunes, Long Beach Community Alliance, Patrick Cannon, Roger Gansauer, David Oei, Bernard Rab‐ inowitz, and Joan Smith, Indiana Court of Appeals Case No. 46A05‐1404‐PL‐146 March 26, 2015

This case from the LaPorte Circuit Court may eventually define where the boundary between private and public owner‐ ship lies along the Lake Michigan shoreline. In 2012, relying on Indiana Department of Natural Resources informaon, Long Beach enacted a resoluon to not enforce private property rights below the ordinary high water (OHW) mark. A group of lakefront property owners sued eth town. The town argued that the State of Indiana should have been the party any lawsuit was directed at as it is the limit of state ownership that is in queson. Eventually summary judgment was granted to the town on all counts and this appeal was made.

The appeals court reversed those rulings and held that the State of Indiana or appropriate state officials as individuals in their official capacity should be added as a party or pares so the issues could be decided. In addion, one of the counts was decided aer the appeals court had authority by court rules.

This case has the potenal to determine if the limit of public ownership in Indiana is the OHW line, the undisturbed lake edge, the locaon the GLO survey found, or something else enrely.

County of Lake and the Lake County Plan Commission vs. Alan J. Pahl and Roderick Pahl, Indiana Court of Appeals Case No. 45A03‐1406‐PL‐214, March 31, 2015

The Pahls purchased Lot 5 in Westerhoff Acres, containing 10.08 acres in unincorporated Lake County, in 2006. At that me the land had been used for growing crops. The subdivision had been rezoned from A‐ 1 (agriculture) to R‐1 (single family residenal) in 1995 to allow development of the subdivision under the Comprehensive Plan and Zoning Ordi‐ nance. The Realtor’s lisng indicated the property was zoned “Ag‐Res” and the Pahls checked the Assessor’s website which indicated the “Parcel Type” as “101 AG – Cash Grain/General Farm”, but the Pahls did not check the zoning clas‐ sificaon at the Plan Commission. The Pahls built a home and around May 2008 brought alpacas onto the property. Eventually there were approximately 28 alpacas, 2 riding horses, 4 miniature horses, two dozen chickens, about a doz‐ en ducks and 4 pygmy goats, along with temporary shelters, fencing and wheelless semi‐trailers used for storage on the lot. In addion the Pahls operated a business selling ducklings, using the goats for recreaonal and commercial uses and raising alpacas for fiber and manure.

In October 2009 the Plan Commission sent the Pahls a leer informing them they were in violaon of the zoning ordi‐ nance. The Pahls later filed for two peons for variance which were withdrawn and filed a permit for a barn which was denied. On August 28, 2012 Lake County filed a complaint for injuncve relief against the Pahls. At a bench trial before the Lake Superior Court one of the arguments was that the use was an agricultural nonconforming use under Indiana Code 36‐7‐4‐616. Eventually the trial court found for the Pahls and this appeal followed.

The appeals court noted why the restricons of the zoning ordinance sll apply since even a nonconforming use must sll be in compliance with the requirements for a conforming agricultural use which the Pahls were not. Therefore the trial court decision was reversed and eth case was remanded with instrucons to grant Lake County’s peon.

Berthal O. Williams and Patricia Williams vs. The Indiana Rail Road Company, Indiana Court of Appeals Case No. 77A04‐1311‐CC‐580, March 31, 2015

Here the Sullivan Circuit Court was asked to decide if an indenture from 1901 bound the current owner of the railroad to maintain a dam which was originally constructed to supply water for steam locomoves. In 1899 a perpetual right‐ of‐way was granted to the Southern Indiana Railway Company (Southern) and in 1901 Southern entered into an inden‐ ture which gavee it th “right to construct and maintain” a dam in their right‐of‐way and to use the water it impounded while agreeing that the water would be not less than fourteen feet or more than twenty feet deep at it deepest point. The property owners also had rights to fish, use water for farm purposes, harvest ice, boat, picnic and hold public gath‐ erings at the pond. The indenture was recorded in 1945. In May 2006 the Indiana Rail Road (IRR) acquired the railroad right‐of‐way but did not use water from the pond. In 2008 and 2010 Berthal sent leers to IRR complaining that there was a sinkhole near the dam which IRR was now responsible for maintaining. On June 4, 2012 the Williamses filed a complaint maintaining that IRR refused to maintain the dam and asking for a judgment that IRR must repair the dam as well as damages to compensate them for their loss.

IRR filed a moon for summary judgment arguing the covenant did not run with the land, that even if it did, the terms did not impose a duty to maintain a specified depth and even if it did, the breach occurred before the Williamses pur‐ chased the land in 2005, causing the covenant to cease running with the land. Aer a hearing the trial court granted IRR’s moon for summary judgment and the Williamses appealed.

The appeals court in part determined that the covenant does run with the land and that the argument “that the cove‐ nant ceased running with the land upon a possible breach prior to the Williamses’ purchase‐and its supporng citaons do not hold water”. (Evidently Judge Pyle has ae sens of humor.)

This case was reversed and remanded for further proceedings by a 2‐1 margin. Judge Mathias dissented, nong that the railroad had a right to construct and maintain a dam, but not a duty or obligaon to do so.

The court’s website includes many “Memorandum Decisions” which are not published in West’s Northeastern Reporter and, in general, are not to be used as precedent or cited before any court. However, they sll show a court’s reasoning and may be of interest. This column looks at some such decisions related to surveying.

Timothy McNamara, Tamara Goodfellow, and Teresa Melton vs. Zollman Farms, Inc., Testamentary Trust of Jack D. Roller, and Thomas Michael Carr, Indiana Court of Appeals Case No. 36A05‐1404‐PL‐180, January 13, 2015 ‐ MEMO‐ RANDUM DECISION ‐ not regarded as precedent

This is a case from the Jackson Superior Court where McNamara, Goodfellow andn Melto own a landlocked 40 acre parcel. They went to court requesng that a path from a county road to their property be declared a county road since it had been used, mainly as a walking path, for over twenty years before the relevant statute changed in 1988. The trial court agreed that the path had been used for over twenty years before 1988 but concluded that the existence of a pub‐ lic road by use had not been established. On appeal McNamara et al. agreed with the findings of the trial court but not its conclusion. The appeals court agreed, reversed the trial court and remanded the case for further proceedings.

Celebraon Worship Center, Inc., vs. Patrick Tucker and Carolyn P. Tucker a/k/a Pay Tucker, Indiana Court of Ap‐ peals Case No. 22A01‐1405‐PL‐229, January 14, 2015 ‐ MEMORANDUM DECISION ‐ not regarded as precedent

Here Celebraon Worship Center (CWC), the owner of lot 3 in Plat 349 and the Tuckers, the owners of lot 4, were hav‐ ing a land dispute. CWC filed a complaint June 30, 2011 in the Floyd Circuit Court seeking a judgment against the Tuck‐ ers who argued they had either acquired ownership by adverse possession or a prescripve easement. The Tuckers claimed their predecessor‐in‐interest had used the land in queson for primary access to an old garage for over twenty years before the Tuckers tore down the old garage in 2003 or 2004. They then built a new garage which did not need access from the land in queson as it had direct access from a public road, and the Tuckers no longer used the land for access to the garage. The trial court granted summary judgment in favor of the Tuckers on both the adverse posses‐ sion and prescripve easement claims.

CWC appealed, contending the trial court shouldn’t have granted summary judgment. The appeals court noted that summary judgment is appropriate when there are no issues of material fact and the moving party is entled to sum‐ mary judgment as a maer of law. Here, cing Fraley v. Minger, the court observed that the Tuckers had only paid tax‐ es on lot four so there is an issue of fact that does not meet the requirements of Fraley. In addion the court specified that abandonment can prevent an easement from ripening and the Tuckers had voluntarily abandoned using the dis‐ puted land when the new garage was built in 2003 or 2004. The court cited case law on abandonment having an “element of intent as well as mere nonuse”. The appeals court found that CWC, not the Tuckers, dwas entle to sum‐ mary judgment on both claims, reversed the judgment and remanded the case to the trial court with instrucons to enter summary judgment in favor of CWC on both claims.

John D. Jenkins Revocable Living Trust, John D. Jenkins, Trustee, vs. Peru Ulity Service Board, City of Peru and Peru Common Council, Indiana Court of Appeals Case No. 52A01‐1409‐PL‐387, February 13, 2015 ‐ MEMORANDUM DECI‐ SION ‐ not regarded as precedent

This is the second part of a case ttha was split into two parts by the Miami Superior Court. This case concerns an al‐ leged trespass by Peru Ulies. Here representaves of Hilltop Farms L.P. and Hilltop Farms Phase Two (Hilltop), a housing development, negoated with a representave of the trust (RLT) about construcon of a sewer line Hilltop would construct. Both Hilltop and RLT understood the sewer and easement would be turned over to Peru Ulies and Peru Ulies were “heavily involved in the planning process”. Construcon of the sewer began in late 2003 and was completed in January 2004. In April 2004 RLT granted an easement to Hilltop. In May 2004 Hilltop dedicated plaed easements and sanitary infrastructure to Peru Ulies. In September 2004 Hilltop assigned the easement to Peru Uli‐ es which accepted and recorded the assignment. The easement provided that RLT may grow crops and farm over the easement. RLT claimed Peru Ulies commied trespass by altering surface drainage. At a bench trial on May 22, 2014, RLT’s trespass claim focused on the presence of manholes in the field, specifically one manhole three feet above grade. eTh trial court found for Peru Ulies.

On appeal, RLT again argued that Peru Ulies failing to remove a manhole was a trespass. The court noted that for trespass a defendant would have to enter the land without right which RLT is not arguing. RLT doese refer to th Re‐ statement of Torts which provides liability for trespass if you fail to remove from the land a thing you are under a duty to remove. RLT also argued that the manhole should not be above ground since the easement allowed crops to be grown over the top of the easement. But the easement document does not require manholes to be buried and Jenkins had tesfied that he did not allow dirt to be brought in to level the ground around manholes and did not want dirt add‐ ed or the sewer system changed. RLT also argued that IDEM requires plans to confirm that at least three feet of dirt be placed over a sanitary sewer but didn’t convince the court this applied to manholes. The trial court decision was affirmed.

Shelley Bradford vs. Mike Lazo and Angela Lazo, Indiana Court of Appeals Case No. 45A03‐1404‐MF‐147, March 12, 2015 ‐ MEMORANDUM DECISION ‐ not regarded as precedent

This case concerns denial of access to shared common areas at a condominium. However, the Lake Superior Court dis‐ missed the case and the appeals court agreed since it is arguing the same facts as a prior case between the pares which was dismissed with prejudice.

Jack L. Yant III vs. Barry L. Payne, Indiana Court of Appeals Case No. 32A04‐1408‐PL‐385, March 27, 2015 ‐ MEMO‐ RANDUM DECISION ‐ not regarded as precedent

Payne bought 10.07 acres in 1963 and built a fence along the northern property line per a survey. Soon aer, Payne’s grandparents bought 2.00 acres north of the fence and built a house. A poron of the fence was removed for a com‐ mon driveway. In 1976, Jack L. Yant II purchased the 2.00 acre property. A second survey in 1982 confirmed the same boundary between the properes. Between 1983 and 1986, Payne built a barn near the northern boundary of his property near the fence. Payne has paid all assessments for the barn every year since it was built. In 2011, Payne de‐ cided to sell his property and had another survey completed. This survey showed the original boundary marked by the fence was incorrect and that the fence and a poron of the barn are on Yant’s real estate. The disputed property totals 0.02 acres. In October 2013, Yant deeded his property to his son, Jack III. On November 13, 2013, Payne filed a com‐ plaint to quiet tle on the disputed 0.02 acres by adverse possession. Payne filed a moon for summary judgment which was denied and Payne requested a hearing which was granted. The hearing by the Hendricks Superior Court took place on July 30, 2014, and on August 1, 2014 the trial court granted Payne’s moon for summary judgment. Yant appealed. (Connued on page 23)

Yant argued that Payne did not sasfy the elements of control, noce and payment of taxes. Here the appeals court relied on Fraley v. David R. Ulrich and Marcia K. Ulrich vs. Brad R. Minear and Miranda G. Minear, Indiana Court of Appeals Case No. 92A05‐1408‐PL‐363, March 30, 2015 ‐ MEMORANDUM DECISION ‐ not regarded as precedent

The Ulrichs own a house in North Park Subdivision in Columbia City subject to restricve covenants. One of the cove‐ nants is “Said real estate shall be used for residenal purposes only and shall not be used for any commercial, mercan‐ le or manufacturing purpose”. In November 2013, the Minears purchased a house in eth subdivision and placed a sign reading “Future home of Minear Real Estate”. The Ulrichs filed a complaint in the Whitley Superior Court to en‐ force the covenant menoned. The Minears answered claiming estoppel as several other commercial uses exist in the subdivision. The complaint was denied and the Ulrichs appealed.

The appeals court agreed with the trial court and also clarified why a prior complaint by the prior owners of the lot in queson against the Ulrichs to amend and modify the same covenant did not amount to res judicata (essenally li‐ gang something twice). In this case, because the prior acon was to amend or modify the covenant, while this acon was to enforce the covenant. In addion, since the Ulrichs did not offer evidence for why the prior complaint was dis‐ missed, the court cannot tell if anything was adjudicated in that case. The trial court decision was affirmed.

The Indiana‐Michigan Boundary Line Commission met Tuesday, Jan. 13, in the County Com‐ missioners Meeng Room on the seventh floor of the County City Building, 227 W. Jefferson Blvd., South Bend, Ind. Commission members present were John McNamara, chairman, Indi‐ ana; David Mostrom, vice‐chairman, Michigan; Anthony Hendricks, Rex Pranger and Michael Ruff, Indiana; and John Kamer and Chris Marbach, Michigan. Those not present were Brad Cramer, Indiana; and Michael Lodzinski and Edward Reed, Michigan. The Jan. 13 meeng agenda and the minutes from the Nov. 12 meeng were approved.

Commissioners reviewed and discussed informaonal materials on the Boundary Line Re‐ tracement and Remonumentaon project to be displayed at annual conferences of the Indi‐ ana Society of Professional Land Surveyors and the Michigan Society of Professional Surveyors. The display included poster boards highlighng work completed by surveyors beforee th commission was formed, as well as new material produced by Commissioner Anthony Hendricks. Chairman John McNamara and Hendricks said they planned to exhibit the items at the Indiana meeng Jan. 14‐16 and asked if the materials could be transported to the Michigan conference for display from Feb. 17‐20. Vice‐chairman David Mostrom said he would see that the items were taken to the Michi‐ gan event.

Chris Beland, director of the state of Michigan’s Office of Land Survey and Remonumentaon, said he had completed all but one of the changes to the dra request for service and esmated costs that the commission agreed upon at its Nov. 12 meeng. He said he could not remove a requirement that plats of survey be completed in compliance with 865 Indiana Administrave Code 1‐12‐13, a secon that deals with retracement and original survey plats. He said the spu‐ laon needed to stay in the document as a deliverable associated with the requirement that the commission adminis‐ ter a survey of the line.

Beland also said he would work with the procurement staff on the process for posng the request for service and costs, but he said the project would not be awarded unless funding existed to complete it. He also said that the commission may need to start considering alternate methods if it wanted to complete the project.

He asked if commissioners believed county perpetuaon funds from adjoining counes in both states could be used to complete the work at the county level. He said it would take longer to do it that way, but it would remove concerns about the overall cost. He added that if even if this was done — and if the commission connued its work — it would need to look at exisng laws and most likely amend them.

Following a discussion, Commissioner Chris Marbach asked if forms used in the request for service and costs would contain blanks where costs could be placed. Beland said he would dra a form to be part of the posted informaon that would idenfy how costs should be broken down and submied.

Commissioner Rex Pranger asked how noce of the request would be distributed when the posng took place, and Beland said vendors registered with Indiana and Michigan should receive noce of the posng through those states’ systems. He also said he would send noce to surveying sociees in both states.

Since McNamara said he could not aend the Feb. 10 meeng, commissioners decided to move its locaon from South Bend, the county seat of Indiana’s St. Joseph County, to Centreville, Mich., the county seat of Michigan’s St. Joseph County. The meeng was subsequently canceled, however.

Meengse wer also scheduled May 12 and Aug. 11, both in the County City Building in South Bend.

NSPS Spring 2015 Meengs Report By Tony Gregory

The NSPS Spring 2015 meengs were held at the Hilton Hotel in Arlington (Crystal City), Virginia from April 13th unl April 16th, 2015. The meengs were held in conjuncon with a joint conference of NSPS and MAPPS.

The Great Lakes Council met on Monday, April 13th. Discussion items included a series of moons to be brought forth to the Board of Governors/Board of Directors meeng. The moons and acon items that came forth from the discussion focused on the chang‐ es in the roles and responsibilies as the Board of Governors is eliminated, and most exisng Governors will become members of the Board of Directors. These items will be detailed within the secon of this report relave to the Board of Directors meeng.

On Wednesday, April 15th, more than 100 members of NSPS and MAPPS parcipated in Capitol Hill Day (formerly Lobby Day). Col‐ lecvely, the offices of more than 80 Senators, and many more Congressmen were visited. The offices of Senator , Sena‐ tor , and Congressman Pete Visclosky (of Indiana) were visited. The focus of the visits was to seek support for: the funding of the 3D Elevaon Program (3DEP); the Pipeline Safety and Community Empowerment Act; the Federal Land Asset Inven‐ tory Reform (FLAIR) Act; and legislaon calling for ulizaon of the private sector eto th maximum extent praccal for geospaal acvies.

A brief NSPS Membership Meeng was held early on Thursday, April 16th. The primary purpose of the meeng was to approve vari‐ ous revisions to the NSPS Bylaws that would allow such terms as Area Director and Board of Governors to be removed. Also, new officers were installed at the meeng.

A brief Board of Governors meeng followed, and aer some minor items of business, the meeng was adjourned. With this ac‐ on, the NSPS Board of Governors was formally dissolved.

The NSPS Board of Directors meeng was called to order aer the adjournment of the Board of Governors meeng. Some notable items presented during the reports, and moons passed included:

 Discussions took place relave to the responsibility of each NSPS Director to be the voice of NSPS at the state affiliate level, as Area Directors no longer exist. This would include the preparaon of and managing of NSPS booths at state conferences.  NSPS Execuve Director Report – Curt Sumner  NSPS now uses electronic vong via email.  ALTA/ACSM minimum standards to be revised. New version to be released in 2016. Title being changed to ALTA/ NSPS standards.  Treasurer’s Report – Brief report was presented, as Bob Miller (Pennsylvania) assumed the office of NSPS Treasurer at the be‐ ginning of this meeng, replacing John Fenn (Michigan). NSPS budget is healthy. $105,000 in the black at the me of the meeng.  Joint Government Affairs Report – John Matonich  Updates provided on 3DEP program; Davis‐Bacon Act; Digital Coastal Act; HUD in comment period with ALTA com‐ miee; COFPAES  John Matonich is stepping down from the NSPS Government Affairs Commiee, aer 23 years of service, 21 years as chair.  The following moons and acons were discussed and passed:  Necessary replacements and appointments were made to the NSPS Foundaon  Necessary reappointments and appointments were made to the Hydrographic Cerficaon Board  A moon was passed to connue NSPS membership in COFPAES (Council on Federal Procurement of Architectural and Engineering Services), considering the organizaon’s Reorganizaonal Proposal  A moon was passed to support the use of UAS’s (Unmanned Aerial System) across the country  A moon was passed to explore the availability of and use of alternave media for commiee meengs (i.e. web‐ based meeng sites)  A moon was passed that all BOD members be required to serve on at least one NSPS commiee
