Report on the Committee's Proposals for a Northern Ireland Public Committee for the Office of the First Minister and deputy First Minister Report on the Committee’s Proposals for a Northern Ireland Public Services Ombudsman Bill Volume One Together with the Minutes of Proceedings, Minutes of Evidence and Written Submissions relating to the Report Ordered by the Committee for the Office of the First Minister and deputy First Minister to be printed 27 June 2013 Report: NIA 120/11-15 (Committee for the Office of the First Minister and deputy First Minister) REPORT EMBARGOED UNTIL COMMENCEMENT OF THE DEBATE IN PLENARY Mandate 2011/15 Seventh Report Membership and Powers Membership and Powers Powers The Committee for the Office of the First Minister and deputy First Minister is a Statutory Committee established in accordance with paragraphs 8 and 9 of the Belfast Agreement, Section 29 of the Northern Ireland Act 1998 and under Assembly Standing Order 48. The Committee has a scrutiny, policy development and consultation role with respect to the Office of the First Minister and deputy First Minister and has a role in the initiation of legislation. The Committee has the power to; ■ consider and advise on Departmental Budgets and Annual Plans in the context of the overall budget allocation; ■ approve relevant secondary legislation and take the Committee stage of primary legislation; ■ call for persons and papers; ■ initiate inquiries and make reports; and ■ consider and advise on matters brought to the Committee by the First Minister and deputy First Minister. Membership The Committee has eleven members, including a Chairperson and Deputy Chairperson, and a quorum of five members. The proposals would also reform jurisdiction and powers and provide for appointment of the Northern Ireland Public Services Ombudsman (NIPSO) by Her Majesty on the nomination of the Assembly and for the NIPSO to report to the Assembly and Assembly Committees on a basis to be laid down in Standing Orders. Westminster legislation is likely to be required to enable the Assembly to confidently legislate on a small number of matters within the proposed Bill. Following consideration of this report the Committee will seek the assistance and consent of the Secretary of State in bringing forward relevant legislation. ■ The new office would be known as the Northern Ireland Public Services Ombudsman or NIPSO; ■ Appointment as NIPSO would be for a single, non-renewable, fixed term of seven years; ■ The mechanics of recruitment and selection of a suitable candidate would be under the auspices of the Assembly Commission; ■ Formal appointment would be by Her Majesty on the nomination of the Assembly and removal before expiry of the fixed term would reflect the appointment arrangements; ■ There would be restrictions on appointment and on leaving office aimed at avoiding actual or perceived conflicts of interest; ■ Temporary vacancies in office would be provided for by appointment of an acting NIPSO; ■ The NIPSO’s salary would be determined by the Assembly Commission subject to an upper limit; ■ Existing staff/secondees would have the opportunity to transfer to the NIPSO; ■ The NIPSO would have a similar relationship to the Assembly as the Comptroller and Auditor General; ■ Where the current legislation indicates a requirement for approval by or accountability to a NI Department this would transfer to the Assembly or its Committees as provided for in the Assembly’s Standing Orders; ■ In relation to budget and spending the NIPSO would be accountable to an Assembly Committee as provided for in Standing Orders; ■ The NIPSO’s remit would include schools, the Assembly Commission, the Northern Ireland Audit Office and further and higher education institutions, in addition to bodies currently within the Assembly Ombudsman/Commissioner for Complaints remit. ■ The NIPSO’s remit would not include public sector employment issues; ■ In relation to public procurement the NIPSO’s remit would be extended and complaints regarding professional judgment in social care would be dealt with on the same basis as complaints regarding clinical judgement in health care; ■ Complaints could be made orally (if reduced to writing and agreed within 20 working days) and the NIPSO would have discretion in relation to accepting different written forms of complaint; ■ Complaints could be made directly by the aggrieved person, by their Member of the Northern Ireland Legislative Assembly (MLA) or by the aggrieved person’s representative; 1 Report on the Committee’s Proposals for a Northern Ireland Public Services Ombudsman Bill - Volume One ■ Complaints could also be referred to the NIPSO for determination - by a public body which had sought unsuccessfully to resolve an issue; ■ The Northern Ireland residency requirement for complainants would be removed; ■ The time limit for making a complaint would be reduced from

    A Policy Trajectory Analysis of the National Strategy for Higher Education to 2030 in Ireland - An Institutes of Technology Perspective Ciarán P. Ó hAnnracháin A thesis submitted in partial fulfilment of the requirements for the degree of Doctor of Education School of Education University of Sheffield January 2018 Abstract The National Strategy for Higher Education to 2030 was commissioned by the Higher Education Authority and was published in 2011 under the chair of Colin Hunt. The National Strategy, along with policy implementation and review documents, makes some radical proposals for the reconfiguration of the HE landscape in Ireland with much of the focus on the restructuring of the non- university sector, particularly the fourteen Institutes of Technology (IoTs), while maintaining a “binary divide”. The reform agenda has provided many challenges to the Institutes of Technology sector, and a policy trajectory approach to policy analysis is adopted to investigate the proposed changes to the Institutes of Technology sector. The tensions and shift in power dynamics are key elements to the process of reform in what is a contested space. These tensions are explored from the perspective of the Institutes of Technology sector through a process of critical discourse analysis conducted in the policy document and semi-structured interviews with key policy stakeholders. A historical policy review of the evolution of the non-university sector in Ireland, alternative models in the European Higher Education Area and alternative proposals to the Hunt Report are used as counterpoints to frame the analysis. The analysis revealed that while the Report was initially broadly welcomed, the proposals and their implementation are far more complex and contentious, and there is less cohesion, particularly in the Institutes of Technology, on how the sector can ensure parity of esteem with, and a distinctive mission from, the traditional university sector.

    Changes in employment and services in the voluntary and community sector in Ireland, 2008-2012 by Brian Harvey 2012 1 2 Executive summary and key judgements This report is an examination of the cumulative impact of the cuts in spending on the voluntary and community sector in Ireland over 2008-12, specifically examining their effect on employment. The voluntary and community sector had, at the start of the financial crisis in 2008, a value of €6.5bn, received about €1.89bn in state funding and employed 53,098 people (full-time equivalents). From 2008-2012, government spending on current services fell -2.82%, our benchmark. Using the government’s own figures from the budgets of 2008- 2012, government funding for the voluntary and community sector has fallen by the following amounts: Health services, the largest funder - 4.5% to -29% Voluntary social housing, the next largest - 54% National supports -48% Local Community Development Programme - 35% Initiatives against drugs - 29% Family support projects - 17% Dormant accounts -87% In response, voluntary and community organisations have sharply reduced their spending, their last options being the dismissal of staff and the closure of services. Such a dramatic full in funding is estimated, based on a contraction in the order of 35%, to lead to a loss of employment in the voluntary and community sector of 11,150 jobs by end 2013 and that employment in the sector may be down to 36,638 by end 2015. The voluntary and community sector works alongside public services, whose numbers have also been sharply reduced and are scheduled to fall by 37,500; and by the closure of state agencies valued by and important for the functioning of an effective voluntary and community sector.

Northern Ireland is bottom of UK tables that measure employment rates and people with qualifications, according to UCU analysis. Just over two-thirds of people in Northern Ireland (69.7%) are employed, the worst percentage of the UK's 12 regions. The South East of England tops the table with over three-quarters of people (78.5%) employed. The average is 74%. Northern Ireland has the highest percentage of people without qualifications. One in five (21.8%) have no qualifications, which is a long way off the national average of 12.4%. Northern Ireland fares slightly better when it comes to the percentage of people with a degree though. Over a quarter of people (25.7%) have a degree, which puts Northern Ireland in the middle of the regions' table but still some way behind the average of 29%.
