CONCLUSION: THE LIMITS AND AMBIGUITIES OF VAGNER'S VISION ............ 1489 1993] WAGNER ACT 1381 ARTICLE THE POLITICAL ECONOMY OF THE WAGNER ACT: POWER, SYMBOL, AND WORKPLACE COOPERATION Mark Barenberg* To shed light on the legal debate over new forms of workplace collabo- ration, this Article reexamines the origins of the National Labor Relations Act of 1935. ProfessorBarenberg concludes that the Wagner Act scheme was profoundly cooperationist, not adversarialas is conventionally assumed. Re- visionist historiography shows that, contrary to the claims of public choice theorists, Senator Wagner's network of political entrepreneurs was the de- cisive force in the conception and enactment of the new labor policy, amidst interest group paralysis and popular unrest. Drawing on original archival materials and oral histories, ProfessorBarenberg reconstructs the progressive ideology of Wagner and his circle. That elite network understood, consonant with recent critical theories, that legal symbols could shape worker con- sciousness. Their goal, however, was not to pacify but rather to galvanize workers to seek the collective empowerment that alone could secure demo- cratic consent and cooperation in both the enterprise and in the polity in the era of mass production. Wagner rejected the leading interwar model of workplace cooperation - company unionism - because he believed it could not combine high-trust cooperation with protection of workers against in- strumental and symbolic "domination" by employers. Unlike recent legal- economic theorists who presume a world of self-interested, rational behavior, Wagner understood that workplace hierarchiesgenerate cultural contests over trust and resentment. Wagner's model is more akin to current theories that maintain that human interests and perceptions - including dispositions toward trusting cooperation - are constituted intersubjectively and self- reflexively. I. INTRODUCTION T HIS Article reexamines the political and intellectual origins of the Wagner Act in order to reconstruct the vision of political economy, ideology, and law that impelled Robert Wagner's crusade to build a cooperative social democracy. It draws on historical evidence to il- luminate two issues currently at the center of labor law: the substan- tive controversy over the appropriate legal policy toward innovations in workplace cooperation, and the methodological contest between * Associate Professor of Law, Columbia Law School. With varying degrees of explicitness, Robert Wagner's progressivism addressed both problems, and his "so- lutions" to them were tightly intertwined. He presaged, to a surprising degree, the more self-consciously theoretical views of several present approaches to labor relations specifically and to social conflict and coordination generally. These approaches hold that economic and political actors' desires, interests, perceptions, and identities are shaped endogenously and self-reflexively in the practices, discourses, and power relations of legal, political, and economic institutions.' In this light, this Article portrays Wagner as an exemplar of those "prac- titioners" of institutional ordering whose "programs often profoundly shape our [theoretical] reflections on problems of coordination in un- suspected ways. "2 The last decade brought with it a profusion of new and potentially contradictory analyses of the origins, impact, and desirable future of American labor law. By looking at state-wide policymaking in North Carolina and policy effects in the state’s black belt counties, this study shows why the civil rights movement was vital for shifting state policy in former Jim Crow states towards greater investment in human resources. By breaking down employment barriers to African Americans and opening up the South to new people and ideas, the civil rights movement fostered a new climate for economic policymaking, and a new ecosystem of organizations flourished to promote equitable growth.

When I came to the Oklahoma State University in 1967, I decided to expand my test of this model by examining the thirteen representatives from Oklahoma during the years 1901 through 1917. In testing the thesis for Oklahoma, I investigated the social, economic, and political characteristics of the members whom Oklahoma sent to the United States House of Representatives during those years, and scrutinized the role they played in the formulation of domestic policy. In addition, a geographical analysis of the various Congressional districts suggested the effects the characteristics of the constituents might have on the representatives.

Comparing 1935–80 with 1980–2013—that is, the Keynesian-inspired welfare regime and, later, neoliberal globalization—the average annual rate of GDP growth was more than halved and income inequality went from a postwar low in 1976 to a postwar high in 2012. How do we account for this double-sided phenomenon? The conventional explanations of secular stagnation and elevated inequality are inadequate, largely because mainstream (“neoclassical”) economics rejects the notion that the amassment and exercise of institutional power play a role in the normal functioning of markets and business. This analytical inadequacy has left important causal elements outside the purview of researchers, policymakers, and the public at large. Morris Southern Methodist University My purpose and concern in this chapter is to call attention to a criti- cal missing link in the U.S. system of industrial relations. That link is members-only minority-union collective bargaining, which is a natural preliminary stage in the development of mature, majority-based exclu- sivity bargaining. What follows is an abbreviated version of some of the key elements of that thesis, which is more fully developed in my recent book, The Blue Eagle at Work: Reclaiming Democratic Rights in the American Workplace.1 Minority-union bargaining was commonly prac- ticed immediately before and after enactment of the Wagner Act2 (the National Labor Relations Act) in 1935, and as I demonstrate in that book, it was not Congress’ intent to deny protection to such bargaining under that act. During the early years following its passage, such bargaining prevailed widely. The decisive provisions of the act, which were not af- fected by either the Taft-Hartley3 or Landrum-Griffin4 amendments, are still fully in effect today.

This idea goes back to the beginnings of modern democratic theory and to Jean-Jacques Rousseau’s Social Contract. It was adopted by different socialist thinkers, later on by trade unions and, in the 1960s and 70s, by political scientists such as Carole Pateman and other promoters of participatory democracy. According to this tradition, workplace democracy is considered to be necessary for the realization of democratic ideals like individual autonomy, freedom, voice and participation in all relevant questions influencing citizens’ lives. Parts of this normative idea were realized by trade union movements and laws, especially in Western European countries. Nevertheless, workplace democracy in the sense of the above-mentioned theories remained far from becoming reality.

    91 The Contract as Social Artifact Mark C. Suchman This article outlines a distinctive, albeit not entirely unprecedented, research agenda for the sociolegal study of contracts. In the past, law and society scholars have tended to examine contracts either through the intellectual history of contract doctrine ‘‘on the books’’ or through the empirical study of how real-world exchange relations are governed ‘‘in action.’’ Although both of these traditions have contributed greatly to our understanding of contract law, neither has devoted much attention to the most distinctive concrete product of contractual transactionsFcontract documents themselves. Without denying the value of studying either contract doctrine or relational governance, this article argues that contract documents are independently interesting social artifacts and that they should be studied as such. As social artifacts, contracts possess both technical and symbolic properties, and the sociolegal study of contract-as-artifact can profitably apply prevailing social scientific theories of technology and symbolism to understand both: (1) the microdynamics of why and how transacting parties craft individual contract devices, and (2) the macrodynamics of why and how larger social systems generate and sustain distinctive contract regimes. Seen in this light, the microdynamics of contract implicate ‘‘technical’’ theories of transaction cost engineering and private lawmaking, and ‘‘symbolic’’ theories of ceremony and gesture. In a parallel fashion, the macrodynamics of contract implicate ‘‘technical’’ theories of innovation diffusion, path dependence, and technology cycles, and ‘‘symbolic’’ theories of ideology, legitimacy, and communication. Together, these micro and macro explorations suggest that contract artifacts may best be understood as scripts and signalsFcollections of symbols designed to yield technically efficacious practical action when interpreted by culture-bearing social actors within the context of preexisting vocabularies and conventions.
