La présente publication est une recommandation élaborée par l'OFEFP en tant qu'autorité de surveil- lance. Elle s'adresse en premier lieu aux autorités d'exécution. Elle concrétise des notions juridiques in- déterminées provenant de lois et d'ordonnances et permet ainsi une application uniforme de la légis- lation. De telles recommandations (appelées aussi directives, instructions, manuels, guides, aides pra- tiques) paraissent dans la collection « L'environne- ment pratique / Vollzug Umwelt ». Ces recommandations garantissent l'égalité devant la loi ainsi que la sécurité du droit, tout en favorisant la recherche de solutions adaptées aux cas particuliers. Si l'autorité en tient compte, elle peut partir du prin- cipe que ses décisions seront conformes au droit fédé- ral. D'autres solutions ne sont pas exclues; selon la jurisprudence, il faut cependant prouver leur confor- mité avec le droit existant.

Remarques préliminaires

Suite à l’entrée en vigueur de l’ordonnance sur l’utilisation des organismes en mi- lieu confiné (ordonnance sur l’utilisation confinée, OUC), le Conseil fédéral a de- mandé à l’Office fédéral de l’environnement, des forêts et du paysage (OFEFP) d’établir les listes des organismes classés et des systèmes de sécurité biologique (art. 22 OUC). Ces listes facilitent l’application de l’OUC et de l’ordonnance sur la protection des travailleurs contre les risques liés aux microorganismes (OPTM). Elles permettent aussi d’harmoniser l’exécution.

C’est dans ce contexte qu’ont été élaborées des listes de classification des parasites pathogènes pour l’homme et pour les animaux, sur mandat de l’Office fédéral de la santé publique (OFSP).

En accord avec l'OFSP, l'OFEFP a ensuite soumis ces listes à l'Office vétérinaire fédéral (OVT), à l'Office fédéral de l'agriculture (OFAG), au Secrétariat d'Etat à l'économie (seco), à la Caisse nationale suisse d'assurance en cas d'accidents (suva), ainsi qu'à la Commission fédérale d'experts pour la sécurité biologique (CFSB) et à ERFA Bio (groupe de travail des services cantonaux compétents). C'est en accord avec tous les services fédéraux impliqués que l'OFEFP publie la présente liste. 4
