K.Ramakrishna Reddy R/o Karimnagar District, has filed 2nd appeal dated 07-06-2017 which was received by this Commission on 08-06-2017 for not getting the information sought by him from the PIO / 1)The Dy. Tahsildar, O/o The Tahsildar, Jammikunta Mandal, Karimnagar District, Pin:505122,(2)The Dy. Tahsildar, O/o The Tahsildar, Ellandakunta Mandal, Karimnagar District, Pin:505001. and 1st Appellate Authority / O/o The Revenue Divisional Officer, Huzurabad Division, Karimnagar District.505468. 2. The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 05-11-2016 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application: 3. The Public Information Officer has furnished the information to the appellant on 13-12-2016 Illanthakunta(M). 4. Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 18-02-2017 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005. 5. The 1st Appellate Authority has not furnished the information to the Appellant. 6. As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005. The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 29-01-2019. The Case is called on 29-01-2019. The PIO is present. The appellant is present. The PIO has submitted that the information has been furnished to the appellant on 13.12.2016 and 05.12.2016. The appellant has submitted that the pahani in Sy.No.454/A has been signed by the Tahsildar in the year 2010 though he has worked in the capacity of Tahsildar from 2012 onwards for which a petition has been submitted to the RDO, Huzurabad Division. The PIO has submitted that the enquiry is going on and will be completed at the earliest. The PIO & Dy. Tahsildar, Jammikunta Mandal has further submitted that the matter is now pending with Tahsildar, Ellanthakunta Mandal. The Commission directs to issue fresh notice to the PIO, O/o the Tahsildar, Ellantakunta Mandal. The case is adjourned. The case is called on 29-01-2019. The appellant is present. The Public Information Officer, Dy. Tahsildar, O/o the Tahsildar, Ellandukunta is absent. The Sr. Assistant, O/o the Tahsildar, Ellandukunta is present. The appellant submitted that he did not receive the sought information from the PIO. The Public Information Officer did not furnish manual verified copy of pahani. The Sr. Asst. appearing on behalf of the Public Information Officer submitted that available information was furnished to the appellant through letters dated 13.12.2016 and 06.02.2017. He submitted that the concerned file is not available . He will verify the records and furnish the sought information. He further submitted that there is a case pending in the High Court. Heard the parties and perused the records. The Commission observed that the Public Information Officer, O/o the Tahsildar did not seek leave of absence and the Sr. Assistant appeared before this Commission without any authorization. The Sr. Asst., came unprepared and is not aware of the facts of the case. The case is adjourned. Issue fresh notice to the parties. The Case is called on 24-04-2019. The appellant is present. The Public Information Officer, Deputy Tahsildar, Ellandukunta Mandal is absent. The Senior Assistant, O/o the Deputy Tahsildar is present. The appellant submitted that he did not receive the sought information from the PIO. The Senior Assistant filed affidavit of the Public Information Officer, Deputy Tahsildar wherein the Public Information Officer submitted that the sought information was furnished to the appellant through letters dated 13.12.2016 and 06.02.2017. The Senior Asst., further submitted that the manual records pertaining to the information sought by the appellant are not available and pahanies pertaining to the year 2010 onwards as available was furnished to the appellant. He further submitted that two cases are pending in the Civil Court and Hon’ble High Court in the matter. The appellant submitted that he wants information prior to the year 2010. The Commission directs the PIO to furnish available information prior to the year 2010 to the appellant within one week from the date of receipt of this order and submit compliance report to the Commission. With the above direction, the appeal is closed.
