The Large Bank Protection Act: Raising the CFPB’s Enforcement and Supervision Asset Threshold Would Place American Consumers at Risk Christopher L. Peterson May 3, 2018 1620 Eye Street, NW, Suite 200 | Washington, DC 20006 | (202) 387-6121 | consumerfed.org Executive Summary Congress is currently considering raising the total asset threshold for Consumer Financial Protection Bureau (CFPB) supervision and enforcement of banks from $10 billion to $50 billion. This report analyzes the effect of this change on the number of banks subject to CFPB oversight. Furthermore, this report looks at the CFPB’s enforcement track record in cases against banks within the $10-to-$50-billion-range, and highlights examples of enforcement actions previously taken by the CFPB that would have been impossible if the asset threshold were set at $50 billion under the original Dodd-Frank Act. Raising the CFPB supervision and enforcement threshold from ten to fifty billion dollars would: • Cut the number of banks subject to CFPB supervision and enforcement by 65% from 124 to 43. Currently, 124 out of 5,679 banks are subject to CFPB enforcement. Raising the CFPB oversight threshold to fifty billion dollars would place 81 of the nation’s largest banks beyond the supervisory and enforcement jurisdiction of the CFPB. • Eliminate CFPB oversight of nearly 50 of the largest banks bailed out during the financial crisis. Forty-nine of 81 large banks in the $10 to $50 billion asset range took TARP funds during the Great Recession. After bailing out these banks with taxpayer money, Congress is now considering removing them from the supervision and enforcement authority of the agency designed to prevent some of the same behavior that caused the crisis.

ICBA PETITION IN SUPPORT OF THE ECONOMIC GROWTH, REGULATORY RELIEF, AND CONSUMER PROTECTION ACT (S. 2155) Petition to Enact Community Bank Regulatory Relief Immediately We, the undersigned community bankers, directors, employees and customers from across the nation, respectfully urge the U.S. House of Representatives to immediately pass legislation to provide community banks with regulatory relief. We are strongly encouraged by Senate passage of the Economic Growth, Regulatory Relief and Consumer Protection Act (S. 2155), a robust package of community bank regulatory relief measures that will strengthen economic growth, job creation, and consumer protection. The administration has noted that the president would sign S. 2155 into law if sent to him. Community bank regulatory relief has been debated exhaustively in each chamber over a period of years. Further delay or inaction could derail its current momentum. Without relief from costly and disproportionate regulatory burden, industry consolidation will continue apace and permanently change the financial services landscape to the detriment of consumers and small business borrowers. Regulatory relief for community banks will revitalize lending and investment in local economies across every congressional district. It will spur job creation and strengthen the economic recovery. We urge you to seize the moment that presents itself today and immediately pass community bank regulatory relief that can be signed into law by the president. September 26, 2017 The Honorable Mike Crapo The Honorable Sherrod Brown Chairman Ranking Member Committee on Banking, Housing, Committee on Banking, Housing, & Urban Affairs & Urban Affairs United States Senate United States Senate Washington, D.C. 20510 Washington, D.C. 20510 Dear Chairman Crapo and Ranking Member Brown: On behalf of the more than 5,700 community banks represented by ICBA, I write to urge you to put before the Committee needed regulatory relief legislation for community banks as outlined in ICBA’s Plan for Prosperity: The Community Bank Agenda for Economic Growth. More than 10,000 community bank employees and advocates from states across the country have signed a petition endorsing the Plan. (Petition attached.) The economic recovery has been painfully slow and has failed to reach many individuals and communities. We believe that expeditious enactment of meaningful regulatory relief for community banks will help jump start our sluggish economic recovery and spur more robust job creation. ICBA is encouraged by your recent and ongoing statements in support of community bank regulatory relief. At your Committee hearing in June, Chairman Crapo said: “Community financial institutions are critically important to the constituents in each of our states. That has been clearly demonstrated in the conversations I have had with members on both sides of the aisle who are committed to pursuing bipartisan reform measures.” The Chairman went on to cite a number of Plan provisions, including automatic “qualified mortgage” status for
