Call to The regular meeting of the Sussex County Council was held Order on Tuesday, March 12, 1974 at 10:00 A. M. with the follow­ ing members present:

Call Mr. Sherwin, Civil Defense Director, reported that the Call Board Board, now, has a standard procedure which should give faster service.

Generator Mr. Sherwin, Civil Defense Director, reported that the new generator that has been received has no starter. He will get the cost of a starter and report back to the Council.

Generator Mr. Sherwin, Civil Defense Director, reported that a new generator has been ordered for the Blades Fire Company.

Disaster Mr. Sherwin, Civil Defense Director, reported that he has Setup been working with the U. S. Army Corp of Engineers on Emer­ gency regarding a d~saster setup for the Coastal Area.

Emergency Mr. Sherwin, Civil Defense Director, reported that he has been working with the On Site Assistance Team regarding a plan to be used in case of emergency.

Blades Mrs. Dix, Finance and Property Specialist, reported on the Sanitary Public Hearing for the formation of a Sanitary Sewer Dis­ Sewer trict in the Town of Blades held on March 7, 1974. As one District landowner objected to being included in the District the Town of Blades and the Department of Natural Resources have been contacted for their opinion on the District boundary lines being changed to omit this particular landowner. After receiving their replys the Council will receive a report on same.

Rail Mrs. Dix, Finance and Property Specialist, reported that Spur the County has received an offer for a grant in the amount of $100,000.00 for the Rail Spur at the Industrial Airpark.

R 004 74 The following Resolution was read by Mr. Betts, County Soli­ citor:

R 004 74 WHEREAS, Sussex County Council herein called the Cont. "Applicant", after thorough consideration of the various aspects of construction of 6,270 feet of Railroad Spur Lines, Main Line Turnout, Spur Switch, Bumpers, Ditch Crossings and associated drainage at the Sussex County Industrial Park, did authorize William C. Henry as Appli­ cant's Representative to apply to the Economic Develop­ ment Administration for a direct grant in the amount of $100,000.00 on 20 December 1973; and

WHEREAS, on 6 March 1974, the Economic Development Administration did offer a grant not to exceed the amount of $100,000.00;

NOW, THEREFORE,

BE IT RESOLVED by Sussex County Council that Oliver E. Hill, President of Sussex County Council is hereby authorized to accept the aforementioned grant offer.

R 005 74 RESOLUTION INDICATING INTENT TO JOIN WITH OTHER GENERAL Cont. PURPOSE UNITS OF LOCAL GOVERNMENT IN THE SUSSEX COUNTY COASTAL AREA TO DEVELOP AND IMPLEMENT A PLAN RESULTING IN A COORDINATED WASTE TREATMENT MANAGEMENT SYSTEM FOR THE AREA.

WHEREAS, pursuant to Section 208 of the Federal Water Pollution Control Act Amendments of 1972, P.L. 92-500 (here­ inafter called "the Act"), the Administrator of the United States Environmental Protection Agency has by regulation published guidelines for the identification of those areas which, as a result of urban-industrial concentrations or other factors, have substantial water quality control pro­ blems (40 CFR Part 126); and

WHEREAS, the Sussex County Coastal area (hereinafter called "the Area"), satisfies the criteria contained in the Act and guidelines and designation of the area pursuant to Section 208 and those guidelines is desirable; and

WHEREAS, Section 126.10 of the guidelines requires, among other things, that the affected general purpose units of local government within the problem area must show their intent, through formally adopted resolutions, to join to­ gether in the planning process to develop and implement a plan which will result in a coordinated waste treatment management system for the area; and

WHEREAS, such planning process and waste treatment management system is a necessary and significant measure to control present point and non-point sources of water pollution and to guide and regulate future development and growth in the area which may affect water quality, in order to prevent, abate and solve existing and potential substan­ tial water quality control problems;

NOW, THEREFORE, IT IS RESOLVED THAT the County of Sussex, State of Delaware, recognizing that the Sussex County Coastal area has substantial water quality control problems, supports designation of the Area pursuant to Section 208 and the EPA guidelines.

IT IS FURTHER RESOLVED THAT the County of Sussex, State of Delaware, intends to join with other affected general purpose units of local government within the boundaries of the area to develop and implement a plan which will result in a coordinated waste treatment management system for the area.

Industrial Mr. Sidwell, Finance Director, reported that in response to Airpark our advertising of the Industrial Airpark we are receiving requests for information at the rate of approximately two per day.

Industrial Mr. Conaway, County Administrator, reported that he will Airpark get the information necessary to prepare a synopsis of the effect of our advertising of the Industrial Airpark.

Blue Cross Mr. Sidwell, Finance Director, reported on the increased & Blue rate for Blue Cross and Blue Shield. He will determine Shield what the increase will be for the 80% and the difference between the 80% and the 100% and report to Council at a later date.

Curtains Mr. Conaway, County Administrator, was instructed to proceed in Court to have the curtains in the Court House cleaned at Nanticoke House Cleaners at a cost of $140.00 and these are to be done with a guarantee that the curtains will not shrink.

O.E.D. Mr. Conaway, County Administrator, reported on the O.E.D. Committee Committee meeting that was held on February 27, 1974.

EDA Money Mr. Conaway, County Administrator, reported that he will for 1975 be meeting with Mr. Emerick of the Department of Community for County Affairs and Economic Development regarding a proposed plan for EDA money for 1975 for the County.

Manpower Mr. Conaway, County Administrator, reported on the Manpower meeting he attended on March 7, 1974.

I.C.C. Mr. Conaway, County Administrator, submitted to the Council Hearing copies of the statement he made to the I.C.C. Hearing held in Philadelphia on March 11, 1974 regarding the proposed rail shutdown.

Summer Mr. Conaway, County Administrator, submitted to the Council Recreation a list of the towns t hat have applied for funds for a summer Program recreation program, totaling $28,318.00, as of this date.

A 001 74 AMENDMENT NO. A 001 74 TO ORDINANCE NO. 1 to Ordinance Repeal: Article 5, Section 1, Paragraph 1.4, Sub-paragraph No. l 1 ( e) • "l(e). Not more than 2 mobile homes, provided such mobile homes are occupied by persons employed on the premises or im­ mediate members of the family owning or operating the farm, and provided the front setback is not less than 40 feet. The location of any such mobile home within 400 feet of a resi­ dential structure on property of other ownership, requires approval of site plan as provided in Article 15, Section 4, Paragraph l(g). A permit granted after approval of such site plan will expire at the end of seven (7) years. All on farm permits for mobile homes expire when a location ceases to be a part of a bona-fide agricultural enterprise."

Enact: Article 5, Section 1, Paragraph 1.4, Sub-paragraph 1 ( e) •

"l(e). A 002 74 AMENDMENT NO. A 002 74 TO ORDINANCE NO. 1 to Ordinance Amend Article 13; Section 4, Paragraph 4.1 by adding Sub­ No. 1 paragraph 3 (p) .

"More than one (1) mobile home may be permitted on a farm of more than five (5) acres pursuant to Article 5, Section 1, Paragraph 1.4 Sub-paragraph l(e) provided all mobile homes or dwellings on the property are the primary place of residence for the occupants by persons employed on the premises or immediate members of the family owning or operating the farm, and provided the granting of this exception will not adversely affect the values or uses of adjacent properties."

A 003 74 AMENDMENT NO. A 003 74 TO ORDINANCE NO. 1 to Ordinance Repeal: Article 10, Section 2, Paragraph 24, Item (c). No. 1 "(c). The minimum width and/or depth of the trailer park shall be 200 feet and minimum total area of the trailer park shall be five (5) acres, except that minimum area may be two (2) acres where the proposed park is to be located adjacent to an existing trailer park containing an area of five acres or more."

The minimum width and/or depth of the trailer park shall be 200 feet and minimum total area of trailer park shall be five acres, except that minimum area may be two (2) acres where the proposed park is to be located adjacent to an existing trailer park containing an area of five acres or more. A 004 74 "l. The following regulations shall apply to every to trailer and mobile home used as a dwelling except in a trailer Ordinance park or on a farm, except where permitted for seasonal or No. 1 temporary use: Cont. (a) It shall be designed exclusively for single­ farnily occupancy.

(b) The wheels and undercarriage shall be removed, if removable, and it shall be erected on a durable masonry foundation or columns, with solid footings. The space be­ tween the dwelling unit and grade level shall be fully en­ closed with skirting.

(c) It shall have a gross floor area, excluding any additions not a part of the original manufactured unit, not less than 450 square feet. Amend #0-001-71 by A-8 adopted 5/9/72

(d) It shall comply in all other respects with the requirements for dwellings in the district in which it is located.

(e) It shall be located on a lot of the same owner- ship."

Section 11. Special Regulations for Trailer and Mobile Hornes

"l. The following regulations shall apply to every trailer and mobile home except construction trailers:

(a) It shall be designated exclusively for single-family occupancy if used as a dwelling.

(b) The space between the unit and grade level shall be fully enclosed with skirting approved by the Director.

(c) It shall have a gross floor area, excluding a ny additions not a part of the original manufactured unit, not less than 450 square feet, except in mobile home parks where the minimum will be 400 square feet. Amend #0-001-71 by A-8 adopted 5/9/72

(d) It shall comply in all other respects with the requirements for dwellings in the district in which it is located.

M 120 74 A Motion was made by Mr. Cannon, seconded by Mr. Timmons, C/U #187 to concur with the recommendations of the Planning and Zoning Commission and approve with the stipulations that (1) 50 foot buffer on all sides; (2) no excavation is to be done less than 100 feet from Route 427; (3) slopes will be graded on a 3 to 1 basis; (4) provisions are to be made so there will be no stagnation of pond water after pit is exhausted; (5) depth will be limited to two (2) feet below water table or a maximum of 20 feet below average grade; (6) excavation not to be greater than 13.2 acres of land within a 30.887 acre tract; (7) slopes are to be seeded with grass such as Crown Vetch or Rye Grass; (8) permit owner to excavate in the buffer area between Road 427 and Pit site down to a grade level of 6 inches above the crown of Road 427; (9) final site plan to include a notation of conditions and be approved by the Com­ mission; C/U #187 - An application from Delmarva Land Company to consider the Conditional Use of land in an ARl Agricultural Residential District in Gumboro Hundred for a Borrow Pit to be located on the north side of Route 427, 1 mile west of Route 26.
