County Council Minutes SUSSEX COUNTY COUNCIL-GEORGETOWN, DELAWARE-MARCH 12, 1974 Call to The regular meeting of the Sussex County Council was held Order on Tuesday, March 12, 1974 at 10:00 A. M. with the follow­ ing members present: Oliver E. Hill President Ralph E. Benson Vice President John T. Cannon, Sr. Member William B. Chandler, Jr. Member Richard L. Timmons Member The meeting was opened with the repeating of the Lord's Prayer and the Pledge of Allegiance to the flag. M 108 74 A Motion was made by Mr. Cannon, seconded by Mr. Benson, to Minutes approve the minutes of the previous meeting as presented. Approved Motion Adopted by Voice Vote. Corre­ The following correspondence was read by Mr. Betts, County spondence Solicitor: Department of Transportation, United States Coast Guard. Re: Public Notice on an application from the Delaware Depart­ ment of Highways and Transportation for approval of plans to replace an existing fixed bridge with a new one in the same location across Slaughter Neck Ditch near Slaughter Beach, Sussex County, Delaware. Department of Transportation, United States Coast Guard. Re: Public Notice on an application from the Delaware Depart­ ment of Highways and Transportation for approval of plans to widen an existing bridge across Indian River Inlet between Rehoboth Beach and Bethany Beach, Delaware. Delaware River Basin Commission. Re: Public Hearing on proposed amendments of its Administra­ tive Manual - Basin Regulations to establish a system of water supply charges to be held on March 26, 1974 in the auditorium of the Moore College of Art, Southeast corner of 20th and Race Streets in Philadelphia at 1:30 P. M. Department of the Army, Philadelphia District, Corps of En­ gineers. Re: Application by Gene Turulski, 20 Iowa Road, Wilmington, Delaware for Department of the Army approval of plans of an existing bulkhead and for a Department of the Army permit to construct a pier and to fill an area in the Back Creek portion of the Chesapeake and Delaware Canal along Randalia Road, Pandalia, Cecil County, Maryland -1- March 12, 1974 Corre­ Department of the Army, Philadelphia District, Corps of En­ spondence gineers. Re: Application by Delaware Department of Natural Resources and Environmental Control, Division of Soil and Water Con­ servation for a Department of the Army permit to dredge an area and to place beach fill in the Delaware Bay at Broad­ kill Beach, Sussex County, Delaware. Call Mr. Sherwin, Civil Defense Director, reported that the Call Board Board, now, has a standard procedure which should give faster service. Generator Mr. Sherwin, Civil Defense Director, reported that the new generator that has been received has no starter. He will get the cost of a starter and report back to the Council. Generator Mr. Sherwin, Civil Defense Director, reported that a new generator has been ordered for the Blades Fire Company. Disaster Mr. Sherwin, Civil Defense Director, reported that he has Setup been working with the U. S. Army Corp of Engineers on Emer­ gency regarding a d~saster setup for the Coastal Area. Emergency Mr. Sherwin, Civil Defense Director, reported that he has been working with the On Site Assistance Team regarding a plan to be used in case of emergency. Blades Mrs. Dix, Finance and Property Specialist, reported on the Sanitary Public Hearing for the formation of a Sanitary Sewer Dis­ Sewer trict in the Town of Blades held on March 7, 1974. As one District landowner objected to being included in the District the Town of Blades and the Department of Natural Resources have been contacted for their opinion on the District boundary lines being changed to omit this particular landowner. After receiving their replys the Council will receive a report on same. Rail Mrs. Dix, Finance and Property Specialist, reported that Spur the County has received an offer for a grant in the amount of $100,000.00 for the Rail Spur at the Industrial Airpark. R 004 74 The following Resolution was read by Mr. Betts, County Soli­ citor: -2- March 12, 1974 R 004 74 WHEREAS, Sussex County Council herein called the Cont. "Applicant", after thorough consideration of the various aspects of construction of 6,270 feet of Railroad Spur Lines, Main Line Turnout, Spur Switch, Bumpers, Ditch Crossings and associated drainage at the Sussex County Industrial Park, did authorize William C. Henry as Appli­ cant's Representative to apply to the Economic Develop­ ment Administration for a direct grant in the amount of $100,000.00 on 20 December 1973; and WHEREAS, on 6 March 1974, the Economic Development Administration did offer a grant not to exceed the amount of $100,000.00; NOW, THEREFORE, BE IT RESOLVED by Sussex County Council that Oliver E. Hill, President of Sussex County Council is hereby authorized to accept the aforementioned grant offer. R 005 74 The following Resolution was read by Mr. Betts, County Soli­ citor: -3- March 12, 1974 R 005 74 RESOLUTION INDICATING INTENT TO JOIN WITH OTHER GENERAL Cont. PURPOSE UNITS OF LOCAL GOVERNMENT IN THE SUSSEX COUNTY COASTAL AREA TO DEVELOP AND IMPLEMENT A PLAN RESULTING IN A COORDINATED WASTE TREATMENT MANAGEMENT SYSTEM FOR THE AREA. WHEREAS, pursuant to Section 208 of the Federal Water Pollution Control Act Amendments of 1972, P.L. 92-500 (here­ inafter called "the Act"), the Administrator of the United States Environmental Protection Agency has by regulation published guidelines for the identification of those areas which, as a result of urban-industrial concentrations or other factors, have substantial water quality control pro­ blems (40 CFR Part 126); and WHEREAS, the Sussex County Coastal area (hereinafter called "the Area"), satisfies the criteria contained in the Act and guidelines and designation of the area pursuant to Section 208 and those guidelines is desirable; and WHEREAS, Section 126.10 of the guidelines requires, among other things, that the affected general purpose units of local government within the problem area must show their intent, through formally adopted resolutions, to join to­ gether in the planning process to develop and implement a plan which will result in a coordinated waste treatment management system for the area; and WHEREAS, such planning process and waste treatment management system is a necessary and significant measure to control present point and non-point sources of water pollution and to guide and regulate future development and growth in the area which may affect water quality, in order to prevent, abate and solve existing and potential substan­ tial water quality control problems; NOW, THEREFORE, IT IS RESOLVED THAT the County of Sussex, State of Delaware, recognizing that the Sussex County Coastal area has substantial water quality control problems, supports designation of the Area pursuant to Section 208 and the EPA guidelines. IT IS FURTHER RESOLVED THAT the County of Sussex, State of Delaware, intends to join with other affected general purpose units of local government within the boundaries of the area to develop and implement a plan which will result in a coordinated waste treatment management system for the area. -4- March 12, 1974 R 005 74 IT IS FURTHER RESOLVED THAT all proposals for grants Cont. for construction of publicly owned treatment works within the boundaries of the designated area will be consistent with the approved plan and will be made only by the desig­ nated management agency. Laurel Richard Banks, representing the Laurel Little League, appeared Little before the Council and requested funds in the amount of League $5,000.00. No action was taken on this request at this time. Industrial Mr. Sidwell, Finance Director, reported that in response to Airpark our advertising of the Industrial Airpark we are receiving requests for information at the rate of approximately two per day. Industrial Mr. Conaway, County Administrator, reported that he will Airpark get the information necessary to prepare a synopsis of the effect of our advertising of the Industrial Airpark. Blue Cross Mr. Sidwell, Finance Director, reported on the increased & Blue rate for Blue Cross and Blue Shield. He will determine Shield what the increase will be for the 80% and the difference between the 80% and the 100% and report to Council at a later date.

ADDITIONAL BUSINESS Discussion regarding of the Comprehensive Plan Ms. Cornwell advised the Commission that there will be a workshop on Friday July 17, 2017 at 10:00 am to finish up the Community Design Chapter and goals, objectives and strategies for the Transportation chapter. Opportunity for public comment regarding Comprehensive Plan Paul Reiger spoke that he has an issue with the holding the meetings with only 2 Commission members with unexpired term; that 3 of the members terms have expired in June; that Mr. Wheatley spoke that every Commissioner is appointed until and serves until a successor is appointed; that if the County Council does not appoint them in June, that doesn’t mean the Commissioner that are here are ineligible are to serve but just means they are serving without reappointment; that the County Council could decide to appoint somebody else or decide to reappoint them but they serve until a new person is appointed.

DelDOT Mr. Lawson reported that the County has been working with the Delaware MOU Department of Transportation (DelDOT) since 2019 to update the Update Memorandum of Understanding (MOU) for land development and coordination. The current MOU has been in place since 1988. Since the Consider- Public Hearing held in January 2020, staff has addressed the feedback ation received and worked with DelDOT on updating the document. In July 2020, an update was provided to Council and based on feedback, the County again worked with DelDOT in regard to changes and suggestions.

    Annual Report of the Chief Engineer State Highway Department 1933 Dover, Delaware January 1, 1934 To the Chairman and Members of the State Highway Department, Dover, Delaware. Sirs: Pursuant to the statute, I herein submit a report of the achYI· ties of the State Highway Department for the calendar year 1933. Included therein is a list of roads for which petitions have been received asking that they be taken over by the Department as State Highways. There are also several recommendations as to the future work of the Department. A greater number of contracts have been awarded than ever before in the history of the Department. The mileage of all types of highways under contract, including widening projects, has been almost double that of any previous year. This has been made possible by the construction during the year of 115.1 miles of low cost secondary roads and not to increased funds available. The larger number of contracts and the continuation of un­ settled employment and economic conditions have introduced new problems and adjustments, which have added much to the work of all divjsions of the Department, while the uncertaiuty of the amounts of both State and Federal Funds available during the first half of the year added to the pressure of work jn the sh" months just dosing. The meeting was called to order at 6:00 p.m. with Chairman Wheatley presiding. The following members of the Commission were present: Mr. Robert Wheatley, Ms. Kim Hoey-Stevenson, Mr. Doug Hudson, Mr. Keller Hopkins, Ms. Holly Wingate, with Mr. Vincent Robertson – Assistant County Attorney, Ms. Janelle Cornwell – Director of Planning & Zoning, Mr. Jamie Whitehouse – Planning & Zoning Manager, and Ms. Samantha Bulkilvish – Planner I. The property is lying on the east side of Old Landing Road, approximately 155 ft. north of Marina Drive, and on the north side of Marina Drive, approximately 450 ft. east of Old Landing Road.
