LAWYERS AND REVOLUTION: LEGAL ETHOS IN THE HISTORY OF THE JURIDICAL COUNCIL IN 1917 E. D. NEVEROV* The following article considers the history of the Ju- ridical Council of the Provisional Government from a biographical methodological perspective. The Juridical Council was established in March 1917 after the February Revolution in the system of the Provisional Government as a governmental body of legal expertise. The paper provides a summary of biographical information about lawyers of the Juridical Council (Vasily Maklakov, Fy- odor Kokoshkin, Nikolay Lazarevsky, Vladimir Nabokov, Moisey Adzhemov and Baron Boris Nolde), their origin, education, political career, professional and academic interests. Most of lawyers in the Council were descen- dants of noble Moscow and St. Petersburg families and belonged to big city intelligentsia circles. They gradu- ated from Moscow University and St. Petersburg Univer- Evgeniy D. Neverov, assistant, National Research University sity in 1890s during golden era of Russian legal university Higher School of Economics, education and their views concerning law, government, Russia liberalism, parliamentarism and public role of legal pro- fession were formed under a great influence of liberal professorate and in the atmosphere, when a university seemed to be the most liberal institute of the conservative era. The analysis of biographical information leads to a con- clusion that lawyers of the Council developed a new legal ethos, the characteristic feature of which was the adherence to the ideology of rule of law and civil society. Большинство юристов совещания были представителями знатных московских и петербургских фамилий, принадлежали к кругам столичной интел- лигенции. Они получили университетское юридическое образование в 1890-х гг., в период расцвета русской юридической школы. Взгляды юристов совещания на парламентский строй, права и свободы личности, независимость судебной власти и бессословную правовую систему, а также воззрения на общественную роль юри- дической профессии сформировались под влиянием либеральной профессуры, в период, когда университет был пространством наибольшего свободомыслия на фоне консервативной эпохи. Анализ биографий юристов совещания позволяет сде- лать вывод, что они были носителями нового правового этоса, т. е. специфической системы воззрений о праве, государственном управлении и месте юристов в обще- стве. Его характерной чертой являлась приверженность идее верховенства права, идеологии правового государства и гражданского общества. In the 20th century a new methodological approach to analysis of social processes appeared. The methodology was based on the idea that professional groups have their own unique moral identities. The theory that professional communities have specific moral recognition and collective consciousness was first proposed by French sociologist and philosopher Emil Durkheim in his “The Division of Labor in Society”: “functional diversity entails a moral diversity that nothing can prevent, and it is inevitable that the one should grow at the same time as the other”1. In 1960s this idea had gained influence in different fields of social knowl- edge2. In the sphere of Russian historical science and legal history the concept of specific moral identity of professional communities was introduced by American historian Richard Wortman in “The Development of Russian Legal Conscious- ness”, first published in 19763. This study focuses on the preconditions for the Great Reforms of Alexander II. R. Wortman makes an emphasis on the legal con- sciousness of top bureaucracy, which elaborated the strategy of the Reforms and conducted them. The author concludes that the real foundation for the Great Re- forms was a unique legal ethos, i. e. specific views concerning law, government and place of profession in society, which was cultivated among leading officials of key ministries. A cradle for this ethos was the Imperial School of Jurisprudence (Uchilishche Pravovedeniia), which was the most prestigious school for boys in St. Petersburg and the best start for an excellent career in public service at the time. Lawyers who studied there in 1830s — 1840s absorbed special beliefs on how law and state should be organized: ideas of civil equity and freedoms, division of powers and independent judiciary, trial by jury and due process, etc. In the late 1850s these lawyers obtained senior positions in the administrative 1 Durkheim E. Wortman was a turning point in understanding of the Great Reforms and theory of legal reforms in general. The idea of specific professional identities in legal culture studies has proved its applicability to various epochs and historical conditions4. Nancy Kollmann analyzes legal culture and professional legal consciousness in early modern Russia5. David Wartenweiler studies the legal consciousness of liberal professorate in the early 20th century and concludes that in this social group the ideas of human rights and civil liberties were predominant6. William Pomeranz argues that a breakthrough in the level of trial defense and emergence of great Russian trial lawyers was related to the development of professional ethos in advokatura community7. Analyzing peasant legal culture and post-reform development of judicial system, Jane Burbank proves that the legal culture of lawyers, bureaucracy and elite was very separated from peasants’ legal beliefs8. Burbank argues that ideas of non-estate court, unified citizenship and rule of law (pravovoe gosudarstvo) for all parts of empire prospered among lawyers and officials, while generally were not accepted in other social groups9. This lead to subcultural nature of legal consciousness in late-imperial Russia. Peter Holquist in his work, devoted to a prominent Russian lawyer Baron Boris Nolde (1876–1948), argues that in the early 20th century legal ethos and moral identity of lawyers under certain circumstances could be stronger than political self-determination. Holquist claims that “in Nolde’s case, I mean the homology that is often constructed between his outlook and the supposed lib- eralism (or, better, ‘liberalisms’) of the Constitutional Democratic Party. I do not mean to argue that party identity was irrelevant. But party affiliation is better understood as an instrument actors’ identity formation than as a clear-cut diag- nostic tool for divining what people believed”10. Maxim Vinaver and the First Russian State Duma The name, Maxim Vinaver, became associated with the First Russian State Duma. He wrote two books on the subject, Conflicts in the First Duma (Konflikty v pervoi Dume) (1907) and The History of the Vyborg Ap- peal [Memoirs] (Istoriia vyborgskogo vozzvaniia [vospominaniia]) (written in 1910 and published in 1913). In this essay I discuss the content of Vinaver’s memoirs while trying to reconstruct the political context in which they were written. My goal is not to provide an exhaustive description of Vinaver’s activities in the Duma or to provide a full description of the memoirs’ content. Rather, I outline Vinaver’s perception of the First Duma and illuminate the politi- cal goals contained in these two books. Lawyer, politician, and memoirist, Maxim Vinaver was born to a middle-class Jewish family in 1862, in Warsaw. After graduating with a degree in law from the University of Warsaw, he settled in St. Petersburg, where he was active both as a trial lawyer and editor of and contributor to the most prestigious legal journals in Russia, including Iuridicheskii vestnik and Vestnik prava.

    THE FEBRUARY REVOLUTION: A WIDER PERSPECTIVE INTRODUCTION Neither the revolutionaries nor the Tsarist authorities expected that the almost daily signs of unrest in January and February 1917 – industrial strikes, street protests, mutinous soldiers and sailors – would escalate into a full-scale revolution capable of overthrowing the regime [NOTE: Russia at that time like most Eastern Orthodox countries still used the Old Style Julian Calendar while the rest of the world had adopted the Gregorian Calendar which was 13 days ahead. As a result some Western historians refer to the March Revolution of 1917]. Lenin, in exile in Zurich, told a meeting of young socialists a month before that “we of the older generation may not live to see the decisive battles of this coming revolution.” He was 46 years-old at the time. Nikolai Sukhanov, a pro-Menshevik journalist said “Not one party was prepared for the great overturn”. On 18 February, workers at the Putilov steel works, the largest producer of military armaments within the Empire, went on strike for higher wages because of the rising cost of living. The strike continued for five days and other workers joined in the protest. Then, on 23 February, 7000 women textile workers came out on the streets demanding ‘More Bread!’. By the afternoon the protesters had grown to nearly 100 000 and some were breaking into food shops to ‘liberate’ the food. Even so, neither the authorities nor the Mensheviks and Bolsheviks believed that these events were particularly significant. On that day, for example, the Tsar was content to leave his Imperial residence at Tsarkoïe-Selo, just south of the capital, and travel by train to the Military Headquarters at Mogilev 650 km from Petrograd.

The Kshesinskaia mansion, a founding work of the Art Nouveau in Russia, was originally a St. Petersburg socialite’s salon. Through 1917, it became the center of one of the most famous lawsuits in the country and the headquarters of the Bolsheviks as well. In the aftermath of the Revolution, the house was dedicated to a number of social service causes and as of the 1930s became what it is today, a museum dedicated to the revolutionary past. This saga of this building, with its extraordinary links to the central players of the Russian Revolution, thus allows us a rare stage on which to see the revolutionary era unfold. This dissertation therefore speaks to the Russian Revolution and in particular, Russia’s experience with modernity. While historians have tended to trace Russia’s steps to 1917 through the eyes of particular groups, in this work, I show that “modern society” was a vision multiple groups embraced, although they understood that term differently.

Ultimately they would climax in the successful overthrow of the Tsarist regime in February 1917, followed by the Bolshevik revolution in October of the same year. At the very same time the Rebbe Rashab was deeply invested in the fight for Torah true yiddishkeit on a national level. He was an activist par excellence, and whenever he saw a need would mobilize rabbis and philanthropists across the Empire to lobby the government and / or to raise necessary funds. His battles on behalf of Yiddishkeit took him right into the heart of the struggle for Russia’s future. He was not a spectator to history but a participant in the making of history, and in the making of the Jewish future. The three essays collected here were first published on Chabad.org as unconnected articles under different titles. They are collected and published here in honor of the marriage of my sister, Zeldy Rubin, to Mendy Schwei. May they build an everlasting edifice on the foundation of Torah and Mitzvot as illuminated by the teachings and examples of the successive rebbes of Chabad.

Grigori Yefimovich Rasputin (Russian: Григорий Ефимович Taksen/sandbox/2 Распутин, IPA: [ɡrʲɪˈɡorʲɪj (j)ɪˈfʲiməvʲɪtɕ rɐˈsputʲɪn];[1] 21 January [O.S. 9 January] 1869 – 30 December [O.S. 17 December] 1916[2]) was a Russian peasant, an experienced traveler,[3] a mystical faith healer, and trusted friend of the family of Nicholas II, the last Tsar of the Russian Empire. He became an influential figure in Saint Petersburg, especially after August 1915 when Nicholas took command of the army fighting in World War I. Advising his wife, Alexandra Feodorovna, in countless spiritual and political issues, Rasputin became an easy scapegoat for Russian nationalists, aristocrats and liberals. There is uncertainty over much of Rasputin's life and the degree of influence that he exerted over the extremely shy Tsar and the strong-willed Tsarina.[4] Accounts are often based on dubious memoirs, hearsay, and legend.[note 1] While his influence and position may have been exaggerated by society gossip and his own drunken boasting[8] his presence played a significant role in the increasing unpopularity of the Imperial couple.[9] Rasputin was Born 21 January 1869 murdered by monarchists who hoped to save Tsarism by ending Pokrovskoe, Siberia, his sway over the royal family.
