Together, they are a representative sampling of the range of manuscript collections at HSP, but scholars are urged to pursue fruitful lines of inquiry to locate and use the scores of additional materials in each area that is surveyed here. There are numerous helpful unprinted guides at HSP that index or describe large collections. Some of these are listed below, especially when they point in numerous directions for research. In addition, the HSP has a printed Guide to the Manuscript Collections of the Historical Society of Pennsylvania (HSP: Philadelphia, 1991), which includes an index of proper names; it is not especially helpful for searching specific topics, item names, of subject areas. In addition, entries in the Guide are frequently too brief to explain the richness of many collections. Finally, although the on-line guide to the manuscript collections is generally a reproduction of the Guide, it is at present being updated, corrected, and expanded. This survey does not contain a separate section on land acquisition, surveying, usage, conveyance, or disputes, but there is much information about these subjects in the individual collections reviewed below. -

Devaney Washington, D.C. 2010 The Bill of Rights and Federalism: An Interpretation in Light of the Unwritten Constitution Joseph S. Devaney, Ph.D. Director: Claes G. Ryn, Ph.D. According to conventional understanding, the primary purpose behind the framing and ratification of the Constitution was to preserve liberty through a form of government that provided for a highly structured system of federalism and separation of powers. The primary purpose behind the framing and ratification of the Bill of Rights was to allay Anti-Federalist fears that the Constitution did not sufficiently secure individual rights. For that reason, the original Constitution is frequently contrasted with the Bill of Rights. Yet distinguishing between the Constitution and the Bill of Rights obscures more about the nature of the Bill of Rights than it discloses. It is agreed that one of the primary Anti-Federalist objections to the Constitution was the absence of a bill of rights. A close examination of the debate over the absence of a bill of rights reveals that the first ten amendments to the Constitution occupy a much more complex place in the constitutional scheme than is commonly assumed. While individual rights did constitute an important theme during the ensuing debate concerning the importance of a bill of rights, they were not the only theme or even the prevailing theme. -

Albert Gallatin: Champion of American Democracy Friendship Hill National Historic Site Education Guide Post-Visit Activities Post-Visit Activities Post-Visit Activity #1 – Comic Strip Directions: Have students look over several comic strips in the newspaper and look up the definition of the word cartoon. Have them draw or illustrate their own comic strip about Albert Gallatin. The students can base their comic strip on their visit to Friendship Hill, and what they have read and learned about Albert Gallatin. Post-Visit Activity #2 – Headline News Directions: After studying about the Lewis and Clark expedition and Albert Gallatin, have the students make up headlines about the event. Write several of the headlines on the classroom board. Have the students pick a headline and write a short newspaper account about it. The students may read their news articles to the class. Post-Visit Activity #3 – Whiskey Rebellion Flag Directions: The angry farmers in 1794 designed a Whiskey Rebellion flag with symbols that expressed their feelings. Have the students construct or draw their own flags with symbols, designs and logos that express their feelings. Display the flags in the classroom. Have the students examine each other’s flags and see if they can tell what the flags mean. Post-Visit Activity #4 – Artist Poster Directions: Have the students design a poster of young Albert Gallatin using the objects that symbolize his early involvement in Southwestern Pennsylvania and the United States government. Judicial Power, Political Fragmentation, and the Failed 1831 Repeal of Section 25 A ntebellum Americans anticipated contemporary political science when they complained about the tendency of embattled political elites to take refuge in the judiciary. Recent scholarship on comparative judicial politics suggests that judicial review is a means by which constitutional framers provided protection for certain class interests that may no longer be fully protected in legislative settings. Tom Ginsburg claims, "[I]f they foresee themselves losing in postconstitutional elections," the politicians responsible for the constitution "may seek to entrench judicial review as a form of political insurance." 1 Such a constitutional design ensures "[e]ven if they lose the election, they will be able to have some access to a forum in which to challenge the legislature."2 In 1801, Thomas Jefferson foreshadowed this strategy. He asserted that the defeated Federalist Party had "retired into the judiciary as a stronghold ...and from that battery all the works of republicanism are to be beaten down and erased.",3 More than a half century later, Chief Justice David S. *Professor of Law and Government, University of Maryland School of Law. Enumeration and Other Constitutional Strategies for Protecting Rights: the View from 1787/1791
ARTICLES ENUMERATION AND OTHER CONSTITUTIONAL STRATEGIES FOR PROTECTING RIGHTS: THE VIEW FROM 1787/1791 Mark A. Graber Constitutional designers employ many strategies for securing what they believe are fundamental rights and vital interests.' Specifying in the constitutional text the rights and interests to be protected is a common device. In a constitution that relies solely on enumeration as a rights-protective strategy, whether that constitution protects abortion rights depends on whether any provision in that constitu- tion is best interpreted as granting women a right to terminate their pregnancies. Enumerating the powers government officials may ex- ercise is a second rights-protective strategy. Government may not constitutionally ban partial-birth abortions, although no constitu- tional provision properly interpreted protects a right to reproductive choice, when no constitutional provision properly interpreted au- thorizes government officials to interfere with reproductive decisions. Structuring government institutions is a third rights-protective strat- egy, one that does not rely primarily on enumeration or interpreta- tion. Government officials do not ban abortion, even when at least some reasonable persons believe constitutional provisions are best in- terpreted as permitting legislative prohibitions, when the constitu- tional rules for staffing the government and passing laws consistently provide pro-choice advocates with the power necessary to prevent hostile proposals from becoming law. Equal protection is a fourth strategy for protecting fundamental rights. Elected officials are less inclined to ban abortion when they may not constitutionally confine that prohibition to certain social classes or racial groups. Five original letters written by nephews of G.W. Campbell were also deposited by descendants. The materials in this finding aid measures .42 linear feet. There are no restrictions on the materials. Single photocopies of unpublished writings in the George Washington Campbell Correspondence may be made for purposes of scholarly research. SCOPE AND CONTENT This collection is composed of correspondence (Photostats and five original letters) of George Washington Campbell for the dates 1793-1833. The bulk of the material falls in the period 1813-1822 when Campbell was United States Senator, Secretary of the Treasury, and Minister to Russia. The letters are especially concerned with national and diplomatic problems involving the purchase of East Florida from Spain, diplomatic relations with Great Britain during the period of Jackson’s execution of Ambrister and Arbuthnot, conditions in France after the Revolution, treaties with European Countries, and subjects of national concern. His correspondents included four presidents – Andrew Jackson, Thomas Jefferson, James Monroe, and James Madison. -

Seiken, M.A. * * * * * The Ohio State University 2007 Dissertation Committee: Approved by Professor John Guilmartin, Jr., Advisor Professor Margaret Newell _______________________ Professor Mark Grimsley Advisor History Graduate Program ABSTRACT In the 1780s, there was broad agreement among American revolutionaries like Thomas Jefferson, James Madison, and Alexander Hamilton about the need for a strong national navy. This consensus, however, collapsed as a result of the partisan strife of the 1790s. The Federalist Party embraced the strategic rationale laid out by naval boosters in the previous decade, namely that only a powerful, seagoing battle fleet offered a viable means of defending the nation's vulnerable ports and harbors. Federalists also believed a navy was necessary to protect America's burgeoning trade with overseas markets. Republicans did not dispute the desirability of the Federalist goals, but they disagreed sharply with their political opponents about the wisdom of depending on a navy to achieve these ends. In place of a navy, the Republicans with Jefferson and Madison at the lead championed an altogether different prescription for national security and commercial growth: economic coercion. The Federalists won most of the legislative confrontations of the 1790s. But their very success contributed to the party's decisive defeat in the election of 1800 and the abandonment of their plans to create a strong blue water navy.
