1. The detaineeworkedas a security guardfor the governorof Jalalabadcarryinga Kalashnikovrifle.

2. In2000 the detainee moved to Mazar - E - Sharifwhere he was a member of a 10-12 -man team who provided security to the Governor.

3. The detaineeservedas the actinggovernorinMazar- E -Shariffor 8 or9 monthsprior to hiscapture.

b . Connections / Associations

The detaineetraveledto Kabulto serve a security guard fora Talibanofficial.

4. The following primary factors favor release or transfer:

1. The detainee testified : " I neededto survive, so I didwork with the government, which was at the time the Taliban government andI work with them and that's the only mistake I made ifyouwant to call itthat, or that's the only thing I did.

b . Exculpatory

1. detaineeemphasized this was merely a civilianpositionand hadno realpolitical responsibilitieswithintheTaliban. Additionally, he hadnointeractionwith the leadersinthe Taliban .

2. Thedetaineeadmittedhis allegiancewiththe Talibanas hewas fearfulof standing againstthe currentgoverningbodyinAfghanistan.

3. The detainee does notknowany ofthe al Qaeda members detained at Guantanamo. He cannotinteract withthe Arabs as he not speak their language.

5. Youwillbe affordeda meaningfulopportunityto be heardandto presentinformationto the Board; includesan opportunitytobe physicallypresentat the proceeding.
