Development Permit
The attached quarry allocation notice authorises a share of riverine quarry material under the Water Act 2000, but does not authorise the physical removal of the quarry material from the watercourse.
The physical removal ofthis quarry material allocation has been authorised under Development Permit No 181438 given at this office, dated 11 the March 2005. This permit lapses on 15 February 2010 and was issued through Integrated Development Assessment System (IDAS) under the Integrated Planning Act 1997 (IP A).
The removal is subject to the continuation of your existing approvals by the Environmental Protection Agency and the Local Authority.
If you are dissatisfied, you may apply for a review of the decision. This application must be in accordance with sections 851, 861 to 864, 877 and 878 ofthe Water Act 2000. Copies of these sections of the Act are enclosed. The applicationRelease form must be supported by enough information to enable the reviewer to decide the application. An application for an internal review must be received at this office within 30 business days from the date you receive this notice. DL

History
QMAN 100740 was transferred in error from Readymix Pty Ltd to Rinker Australia Pty Ltd due to the change of ownership on Lot 4 on RP891 065.
There are no provisions under the Water Act 2000 to allow the chief executive to transfer a QMAN due to the effect of a holderRelease ceasing to be an owner of land. The allocation notice holder has not been advised of the transfer.
Section 288 of the Water Act 2000DL allows for the holder of an allocation notice to apply to transfer all or part of the allocation to another person. Application for renewalRTI of QMAN 100740 was received in this office 26 February 2007 in the name of Rinker Australia Pty Ltd.
Section 289 of the Water Act 2000 states that the allocation notice holder may apply to renew the allocation notice. ActionDNRM To rectify a request in writing needs to be made to Readymix Pty Ltd asking that they transfer the allocation notice into the company's new name Rinker Australia Pty Ltd.
The reasons for the transfer should be so that for the application for renewal to be properly made the allocation notice must be held in the name of Rinker Australia Pty Ltd.

Allocation Notice 100740 will expire on 28 February 2007. If you intend to continue to take quarry material after this date, you should apply for the renewal of this Allocation Notice before the expiry date. The form on which to apply for renewal is attached. An application for renewal may be considered only to the extent of the volume and rate of extraction authorised under the existing Allocation Notice. Hi Bob,
Quarry material allocation notices 100740 and 1007 41 were historically granted to Readymix Holdings Pty Ltd. These allocations were mistakenly transferred to Rinker Holdings Pty Ltd due to a land dealing that had occurred.
The department has no authority to transfer OMAN on land dealings under the Water Act 2000 and no application to transfer has been received.
