Minister’s foreword

I am delighted to introduce the Treasure Act Annual Report 2014, which provides a report on the operation of the Treasure Act 1996 this year.

The Treasure Act 1996 is a continuing success, ensuring that museums are able to acquire the most important archaeological discoveries for the benefit of all. 2014 saw 1,011 potential Treasure finds reported in , and Northern Ireland. Of these items, 373 have been (or are to be) acquired by museums.

Many museum acquisitions have been made possible only through the kind assistance of funding bodies, particularly the Art Fund, Headley Trust, Heritage Lottery Fund, National Heritage Memorial Fund and the V&A Purchase Grant Fund. I am grateful to these organisations for their recognition of the importance of archaeological finds and their support of museums’ efforts to acquire them. I also applaud the large number of interested parties waiving their right to a reward for Treasure cases, with individuals foregoing their share in 77 cases this year. These donations have allowed museums to acquire finds that may otherwise have not been available to for the public enjoy and experts to study.

There are many bodies and people who deserve praise for the ongoing success of the Treasure Act, in particular the Portable Antiquities Scheme (PAS) and its local network of 38 Finds Liaison Officers (FLOs) across England and Wales, to whom almost all finds of Treasure are reported. The Scheme is fundamental to the operation of the Act, and on behalf of the Government I would like to thank the British Museum and its local partners for their commitment to the success of the PAS. The role of the FLOs role is vital in disseminating information about the Act and archaeological best practice to finders of treasure and landowners. They are indispensable in facilitating the administration of Treasure cases and providing the logistical means for the Act to function. Together with curators, scientists and conservators at the national museums of England, Wales and Northern Ireland, they also provide expert reports on Treasure finds for Coroners, who, along with their staff, are also owed thanks for their diligence in holding Treasure inquests. The British Museum, which manages the PAS, also supports coroners in England and serves as the secretariat for the Treasure Valuation Committee and I am grateful for their continued excellent work. In order to ensure the long-term success of the Act, and that it reflects current practice and works as efficiently as possible, the Government is continuing a process to conduct a Review of the Treasure Act Code of Practice. This will also consider the definition of Treasure, and whether that should be amended.

Finally I would like to acknowledge the invaluable contribution of the Treasure Valuation Committee, chaired by Lord Renfrew of Kaimsthorn. I am grateful for the services of all of the Committee members, who voluntarily provide their time and expertise.

Introduction

Under the Treasure Act 1996, finders have a legal obligation to report all finds of potential Treasure. For a summary see finds.org.uk/treasure or the leaflet Advice for Finders of Archaeological Objects, Including Treasure.

The Act allows a national or local museum to acquire Treasure finds for public benefit. If this happens, a reward is paid, which is (normally) shared equally between the finder and landowner, though the interested parties may wish to waive their rights to a reward, enabling museums to acquire such finds at no or reduced cost. Rewards are fixed at the full market value of the find, determined by the Secretary of State on the advice of an independent panel of experts known as the Treasure Valuation Committee.

Although Treasure finds account for a relatively small proportion of archaeological items found in England and Wales by the public, finders are encouraged to record all archaeological items with the Portable Antiquities Scheme: this data is published on the online database at finds.org.uk. The Scheme and its network of local archaeologists – experts in recording small finds, known as Finds Liaison Officers – play an increasingly important role in the operation of the Treasure Act, advising finders of their legal obligations, providing advice on the process and writing reports on potential Treasure finds for local coroners.

Organisation The administration of the Treasure Act is undertaken by the British Museum, which employs a Treasure Registrar and four Assistant Treasure Registrars, one of whom is part-time. This work involves the preparation of Treasure cases for inquest (at a Coroner’s Court), the handling of disclaimed cases, acting as the secretariat of the Treasure Valuation Committee, and the payment of rewards to finders/landowners.

Treasure Valuation Committee The Committee’s terms of reference are detailed in the Treasure Act 1996 Code of Practice. In short, it is tasked to recommend to the Secretary of State the value of Treasure finds, to recommend abatements of rewards in the case of misbehaviour on the part of the interested parties, and to recommend an apportionment of the reward when there is a disagreement among the parties. The Committee is made up of independent experts appointed for their knowledge of the antiquities trade; its membership also includes someone to represent the interests of finders, a museums’ representative, and an expert in cultural property law.

Treasure cases 2014

Number of Treasure cases and geographic distribution The number of Treasure cases reported in 2014 was 1,011 (Table A). This is more than five times the number of cases reported in the first full year of the Act (1998).

The high level of the reporting of Treasure reflects a wider understanding on the part of finders of their obligations under the Treasure Act, through the education and outreach work of the Portable Antiquities Scheme and its Finds Liaison Officers.

Analysis of Treasure finds by Geographical area Table B illustrates the geographic distribution of Treasure finds. The busiest county in 2014 was, as usual, Norfolk (119 cases), which comprised more than 10% of the total number from across the country. East Anglia in general sees the highest number of reported cases; Essex (80) and Suffolk (72) are the second and third busiest counties.

The number of Treasure cases reported from Wales (33) is the largest amount in a single year since the inception of the Treasure Act in 1997. The Vale of Glamorgan is the busiest county in Wales, with its 11 finds reported in 2014. Wales has a single full-time Portable Antiquities Scheme post (based in Cardiff), though finds- recording work is also undertaken by the Welsh Archaeological Trusts, and Finds Liaison Officers in the bordering areas of England. Northern Ireland, which is not covered by the Portable Antiquities Scheme has the lowest number of reported finds (3) of the three countries where the Treasure Act applies. This is explained by the fact that searching for antiquities with a metal detector is not permitted in Northern Ireland.

Analysis of Treasure finds by period and type Table C provides the dispositional outcome of Treasure cases according to period and type.

Casting our eye back to previous years’ reported, it is interesting to note the consistency in the disposition of Treasure cases over time. In 2008 we reported that 33% of Treasure cases from that year had been or were in the process of being acquiring by museums. That figure for subsequent years has been 34% in 2009, 34% in 2010, 36% in 2011, 37% in 2012, 37% in 2013 and is also 37% this year. Since the number of finds overall has increased from 803 in 2008 to 1,011 in 2014, this means that more material overall is finding a home in public collections.

In the climate of fiscal austerity, this is heartening to see. A steady rate of acquisition indicates that museums with restricted budgets are making effective use of the opportunities for fundraising available to them, from the national funding bodies listed above to local funders and by holding events to raise money. It also means that the generosity of those interested parties who waive their rewards is essential in ensuring that a high number of finds end up in public collections.

So far, of the cases acquired in 2014, 20.6% (77) have seen one or more interested parties waive their right to a reward. Many of these were for what would have been rewards of less than £100, but many were for more. David Huddlestone and Christine Hurst waived their reward for Bronze Age Hoard (case 2014 T205) from Rampside area, Cumbria, valued at £380, in order to allow it to be acquired by the Dock Museum. Dr JH and Mrs Baker declined a reward for a Roman gold finger-ring found on their land (2014 T38), worth £350, so that it could go to the Wiltshire Heritage Museum.

The DCMS maintains a policy of proactive encouragement of interested parties to consider waiving their right to a reward, which has borne dividends in recent years.

Slightly less than half (49%) of all Treasure cases are disclaimed by the Crown and returned to the finder or landowner, while another 9% are found to fall outside the definition of Treasure after they are reported. As with previous years, coin cases are acquired by museums at a higher rate than object cases, and as a general observation, the older an object or coin, the more likely it is to be acquired by museums. Object cases dating from the Post-Medieval make up about a third of all Treasure cases, but only 24.7% of these were acquired. This is an almost identical profile to the previous year.

Table D gives the method of discovery of finds reported as Treasure in 2014. Metal-detecting accounts for and even greater majority of Treasure cases reported in England, Wales and Northern Ireland this year (96.14%) than last (94.75%). Archaeological finds accounted for 2.08% of 2014 Treasure finds, a slight increase on the previous year. Chance finds, where the finder discovered Treasure on the surface of the ground or in the course of performing another activity like gardening, make up only 1% of all finds.

Table E lists all of the museums or museum services across the country acquiring Treasure reported in the years 2012, 2013 and 2014, along with the number of cases they have acquired. 114 institutions acquired or are in the process of acquiring finds from this year. The large majority are acquired by local museums, 334.5 of 371 cases in 2013, or 90%. In most instances, the national museum will act as a ‘backstop’ and acquire important finds only if the local museum is unable to.

Enforcement It is the aim of the Treasure Act to encourage people to report finds rather than pursue prosecutions. This is reflected in the fact that finders have 14 days to report Treasure from when they first know or have reason to believe the item they have found is potential Treasure. However, that is not to say finders who fail to report Treasure will not be prosecuted.

The British Museum works closely with relevant colleagues in local police forces, HM Revenue & Customs, and the Arts Council England (ACE) Export Licensing Unit, as well as the Metropolitan Police Service’s Art & Antiques Unit and the Alliance to Reduce Heritage Crime.

The British Museum continues to monitor eBay for items of potential Treasure, and questions vendors of such finds. In 2014, intelligence on 78 cases was logged and made available to the police.

Since September 2007, the Head of the Portable Antiquities Scheme has been an Expert Adviser for export licensing applications of metal-detected finds. In several cases exporters of unreported potential Treasure were asked to report these items in accordance with the Treasure Act.
