ABOUT THIS APPLICATION FORM

This form is for the purpose of making an application for a Waste Water Discharge Licence under the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) or for the review of an existing Waste Water Discharge licence.

The Application Form must be completed in accordance with the instructions and guidance provided in the Waste Water Discharge Licensing Application Guidance Note. The Guidance Note gives an overview of Waste Water Licensing, outlines the licence application process (including the number of copies required) and specifies the information to be submitted as part of the application. The Guidance Note and application form are available to download from the Licensing page of the EPA’s website at www.epa.ie.

A valid application for a Waste Water Discharge Licence must contain the information prescribed in the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007). Regulation 16 of the Regulations sets out the statutory requirements for information to accompany a licence application. The application form is designed in such a way as to set out these questions in a structured manner and not necessarily in the order presented in the Regulations. In order to ensure a legally valid application in respect of Regulation 16 requirements, please complete the Regulation 16 Checklist provided in Annex 2.

PROCEDURES

The procedure for making and processing of applications for waste water discharge licences, and for the processing of reviews of such licences, appear in the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) and is summarised below. The application fees that shall accompany an application are listed in the Third Schedule to the Regulations.

Prior to submitting an application the applicant must publish (within the two weeks prior to date of application) in a newspaper circulating in the area, and erect at the point nearest to the waste water treatment plant concerned or, if no such plant exists, at a location nearest the primary discharge point, a notice of intention to apply. An applicant, not being the local authority in whose functional area the relevant waste water discharge, or discharges, to which the relevant application relates, takes place or is to take place, must also notify the relevant Local Authority, in writing, of their intention to apply.

An application for a licence must be submitted on the appropriate form (available from the Agency) with the correct fee, and should contain relevant supporting documentation as attachments. The application should be based on responses to the form and include supporting written text and the appropriate use of tables and drawings. Where point source emissions occur, a system of unique reference numbers should be used to denote each discharge point. These should be simple, logical, and traceable throughout the application.

The application form is divided into a number of sections of related information. The purpose of these divisions is to facilitate both the applicant and the Agency in the provision of the information and its assessment. Please adhere to the format as set out in the application form and clearly number each section and associated attachment, if applicable, accordingly. Attachments should be clearly numbered, titled and paginated and must contain the required information as set out in the application form. All questions should be answered. Where information is requested in the application form, which is not relevant to the particular application, the words “not applicable” should be clearly written on the form. The abbreviation “N/A” should not be used.

Additional information may need to be submitted beyond that which is explicitly requested on this form. Any references made should be supported by a bibliography. The Agency may request further information if it considers that its provision is material to the assessment of the application. Advice should be sought from the Agency where there is doubt about the type of information required or the level of detail.

Information supplied in this application, including supporting documentation will be put on public display and be open to inspection by any person.

Applicants should be aware that a contravention of the conditions of a waste water discharge licence is an offence under the Waste Water Discharge (Authorisation) Regulations, 2007.

The provision of information in an application for a waste water discharge licence which is false or misleading is an offence under Regulation 35 of the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007).

Note: Drawings. The following guidelines are included to assist applicants:

• All drawings submitted should be titled and dated. • All drawings should have a unique reference number and should be signed by a clearly identifiable person. • All drawings should indicate a scale and the direction of north. • All drawings should, generally, be to a scale of between 1:20 to 1:500, depending upon the degree of detail needed to be shown and the size of the facility. Drawings delineating the boundary can be to a smaller scale of between 1:1000 to 1:10560, but must clearly and accurately present the required level of detail. Drawings showing the waste water treatment plant location, if such a plant exists, can be to a scale of between 1:50 000 to 1:126 720. All drawings should, however, be A3 or less and of an appropriate scale such that they are clearly legible. Provide legends on all drawings and maps as appropriate. • In exceptional circumstances, where A3 is considered inadequate, a larger size may be requested by the Agency.

It should be noted that it will not be possible to process or determine the application until the required documents have been provided in sufficient detail and to a satisfactory standard.

SECTION A: NON-TECHNICAL SUMMARY

SECTION C: INFRASTRUCTURE & OPERATION Advice on completing this section is provided in the accompanying Guidance Note.

C.1 Operational Information Requirements Provide a description of the plant, process and design capacity for the areas of the waste water works where discharges occur, to include a copy of such plans, drawings or maps, (site plans and location maps, process flow diagrams), and such other particulars, reports and supporting documentation as are necessary to describe all aspects of the area of the waste water works discharging to the aquatic environment. Maps and drawings must be no larger than A3 size.

ATTACHMENT A1 - NON-TECHNICAL SUMMARY

Introduction Limerick County Council, County Hall, Dooradoyle, County Limerick is making an application to the Environmental Protection Agency (the Agency), in accordance with the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) for a Waste Water Discharge Licence, authorising the waste water discharges from the Athea Waste Water Treatment Works, serving the agglomeration of Athea, County Limerick. This application relates to the wastewater works consisting of the Athea Waste Water Treatment Plant located in Athea, County Limerick (Grid Ref: 112478E, 135553N) which provides primary treatment to sewage from the Athea area and its environs. The Primary Discharge Point is located in the townland of Templeathea West, approximately 0.5km downstream of Athea Bridge on the R524 Regional Road at Athea, County Limerick at Grid Ref: 112392E, 135549N and discharges to the Galey River. The Athea Agglomeration currently serves a population equivalent of 735 PE with a projected loading of 1,191 PE for the year 2029.

Waste Water Works and the Activities Carried Out Therein

Waste Water Treatment Plant Location The existing waste water treatment plant is located on the banks of the Galey River to the north of Athea village on the R524 road to Glin. The site area is rectangular measuring approximately 65m x 35m.

Collection System The collection system is characterised as a partially combined gravity system. The original system was constructed in the 1953, serving the centre of Athea along Main Street with the sewage being collected by gravity sewers to an ejector station (pumping station) located upstream of the Athea Bridge on the R524 road to Glin.

The collection system has been extended in 1987 to cater for new developments along the R253 road to Listowel and the R254 road to . The original system is constructed of 225-300 mm diameter concrete pipework and manholes. The recent extensions are constructed of 100-150mm diameter PVC pipework and concrete manholes. There is a 150mm diameter emergency storm overflow pipe on the collection system, which discharges sewage and surface water to the River Galey.

Process Description The waste water from Athea is collected at the pumping station described above. The pumping station delivers waste water to the rectangular Imhoff type sedimentation tank by a single 100mm internal diameter rising main. The Imhoff tank is a “two storey” type septic tank. The two-storey type tank prevents the solids once removed from the sewage from again being mixed with it whilst still providing for decomposition of the solids within the unit. The Imhoff tank removes the influent organic and inorganic settleable solids by sedimentation. The clarified supernatant overflows to an outlet channel and onwards to a 150mm internal diameter discharge pipe to the river. The outlet channel is fitted with a scum board to reduce solids carryover in the effluent.

Plant Condition The plant was originally constructed in the 1940’s and comprises a primary sedimentation tank, sludge drying beds and an outfall discharge pipe. The existing primary sedimentation tank is in poor condition and there are some cracks appearing in the sidewalls of the tanks. The settling chamber and outlet channel operate satisfactorily. It is likely that the apparent poor operation of the primary sedimentation tank is a result of hydraulic overloading of the WWTP resulting in inadequate residence times within the primary sedimentation tank. Settled sludge is drawn off to the sludge drying beds, where the sludge is dried prior to disposal.

Capacity The Imhoff tank provides sedimentation and sludge digestion in one unit and can produce a primary effluent with a suspended solids removal of 40 to 60 per cent and a BOD reduction of 25 to 35 per cent. The sedimentation tank has a side length of 4.5m, a surface area of 10.2m2, and a volume of 28.0m3. Based on a surface area of 10.2m2 and a dry weather flow of 180 litres/person/day, the tank can provide primary settlement for a design population of 263 PE with storm flows being diverted prior to being delivered to the Imhoff tank.

Historic Laboratory Analysis Results A summary of the results obtained from Limerick County Council for the quality of effluent from the existing waste water treatment plant is summarised in the Table below. For Athea, the date range for analysis of the effluent is from 13 April 2004 to 24 March 2009.

Athea Historic WWTP Effluent Analysis

Sources of Emissions from the Waste Water Works The effluent Primary Discharge Point from the waste water treatment plant is located in the townland of Templeathea West, approximately 0.5km downstream of Athea Bridge on the R524 Regional Road at Athea, at Grid Reference: 112392E, 135549N and discharges to the Galey River. A Storm Overflow from the collection system is located in the townland of Templeathea West, approximately 35m downstream of Athea Bridge on R523 road to Listowel at Athea, at Grid Reference: 112575E, 135132N and discharges to the Galey River. The existing pollution and hydraulic loads at Athea WWTP are 70% domestic in nature with 30% commercial load principally from office, retail, pubs and restaurants. There are two Section 16 Licences issued to a takeaway and a hotel/restaurant establishment. There is no sludge imported to the WWTP and no industrial loads.

Based on Effluent (Primary Discharge Point) Analysis presented on Tables D.1(i)(b) & D.1(i)(c), it is concluded that three substances listed in Annex X of the Water Framework Directive (2000/60/EC) or any of the Relevant Pollutants listed in Annex VIII of the Water Framework Directive (2000/60/EC) are being discharged from the waste water works, at concentrations above the standards set in the Water Quality (Dangerous Substances) Regulations, 2001 (S.I. 12 of 2001). The values for Copper (concentration 20.9µg/l, standard 5µg/l), Cyanide (concentration 16.0µg/l standard 10µg/l) and Fluoride (concentration 1500µg/l, standard 500µg/l) exceed the standards set. Based on the analysis of water upstream and downstream of the Primary Discharge Point (Tables F.1(i)(a) & F.1(i)(b)), none of the substances listed in Annex X of the Water Framework Directive (2000/60/EC) or any of the Relevant Pollutants listed in Annex VIII of the Water Framework Directive (2000/60/EC) are seen to be present in the receiving water environment downstream of a discharge from the works, at concentrations above the standards set in the Water Quality (Dangerous Substances) Regulations, 2001 (S.I. 12 of 2001).

The closest EPA station upstream of the agglomeration has a most recent Q-Value rating of Q4 (= unpolluted) as does the closest EPA station downstream of the agglomeration. This is an indication that the effluent discharges from the Athea Agglomeration are not having a major negative impact on the River Galey. It is therefore concluded the risk of a ‘significant environmental pollution’ is very low. Thus the Scheme is considered in compliance with Council Directives. A programme of improvements and the capital investment programme for the Athea agglomeration is discussed below.

Proposed Technology and Other Techniques for Preventing or Reducing Emissions from the Waste Water Works

WWTP Upgrade Proposals The level of treatment provided by the existing waste water treatment plant is not adequate in terms of capacity or quality to meet the current or projected requirements of Athea. The existing WWTP site is not suitable to accommodate the new WWTP. A treated effluent standard of 5mg/l BOD concentration, 5mg/l suspended solids concentration, 2mg/l total Ammonia, 0.5mg/l ortho-P and 10mg/l nitrates is considered necessary prior to discharging to the Galey River. A Preliminary Report prepared jointly by Barry & Partners and White Young Green Consulting Engineers in March 2008 recommends that a new 1,500 PE WWTP be constructed on an identified site local to the village. The new treatment plant should comprise inlet works, activated sludge plant, sludge thickening and storage, final effluent flow measurement and sampling, plant building, access roads, fencing and landscaping. A new terminal pumping station, rising mains and underground storage tank should be constructed at the location of the existing pumping station to deliver waste water flows to the new WWTP.

Recent Planning Consent for Private Waste Water Treatment Plant The Limerick County Council planning For database inspection purposes shows only. planning permission was granted to a Consent of copyright owner required for any other use. private individual, Mr Diarmuid Leonard, c/o Murnane Consulting Engineers, Main Street, , on 9 December 2008 for: a) The construction of a new waste water treatment plant with associated tanks, chambers, pumping station and final effluent outfall (to the Galey River), including new access road, new entrance, internal site roads and all ancillary works; b) Construction of new storm water holding tank; and c) Upgrading of existing pumping station at Athea Upper and Templeathea West Athea. Works on the construction of this plant have not commenced.

Limerick County Council Water Services Investment Programme With reference to the Limerick County Council Water Services Investment Programme Assessment of Needs Report (Draft Report), dated August 2006 (downloaded from LCC website), Section 8.1 states “The schemes which have already been assigned construction start dates will involve investment of the order of €60M and approximately €20-25M will have to be met from Council’s own resources. Included within these projects are sewerage schemes at , , , , , Athea, and Glin along with upgrades of major water treatment plants at Clareville (Limerick City Council) and Shannon

Estuary…..These schemes are all listed in Water Services Investment Program 2005 - 2007 shown in Appendix 4 attached (Circular L7/05).” It is noted that works at Athea were not commenced during this period.

DEHLG Water Services Investment Programme The Department of the Environment, Heritage and Local Government (DEHLG) Water Services Investment Programme is published on the DEHLG website. This states “The Water Services Investment Programme is the largest component of the Water Services Programme and relates to the provision of major water and sewerage schemes to meet the strategic objectives for investment in water services infrastructure. Within this general framework, the Department periodically asks County and City Councils to identify specific prioritised schemes in their areas that the Councils feel should be undertaken. The most recent assessment carried out by local authorities was undertaken in 2006 and the key criteria in selecting projects for possible inclusion in the Water Services Investment Programme may be seen in the Department’s Circular L2/06. In order to optimise delivery of the Programme, a rolling 3 year programme approach to investment was adopted in 2000, and most recently rolled forward on the 17th of September 2007 in relation to the period 2007-2009. The Minister announced the publication of the Water Services Investment Programme 2007 – 2009 at a Press Conference on 17 September 2007. The Programme is made up of 955 projects that have an overall capital value of €5.8 billion.” The published list of works for the Limerick County Council Water Services Investment Programme 2007 - 2009 is included in Attachment B.10 of this application. This identifies Athea as a scheme to start in 2009.

Further Measures Planned to Comply with the General Principle of the Basic Obligations of the Operator i.e. that No Significant Pollution is Caused A stormwater holding tank will be provided as part of the proposed wastewater treatment plant upgrade works to ensure compliance with the “Urban Waste Water Treatment Directive Procedures and Criteria in relation to Storm Water Overflows”. Measures Planned to Monitor Emissions into the Environment A robust operation and maintenance schedule will be established for the proposed waste water treatment plant. This will include regular monitoring and sampling of final effluent emissions from the plant and the production of status reports for higher-level review. For the last number of years, Limerick County Council have carried out quarterly monitoring of the influent and effluent at the waste water treatment plant. This sampling includes analysis for Ammonia, BOD, COD, Suspended Solids, Nitrate, Phosphate, Total Nitrogen and Total Phosphorus. In the interim period prior to upgrading of the waste water treatment plant, sampling and analysis of the final effluent emissions from the plant will be increased to a minimum two- monthly interval.

Hours During Which the Waste Water Works is Supervised or Manned The Athea WWTP is unmanned. The plant caretaker makes daily visits to the plant, seven days per week.

CAPITAL INVESTMENT PROGRAMME – ATHEA SEWERAGE SCHEME

WWTP Upgrade Proposals The level of treatment provided by the existing waste water treatment plant is not adequate in terms of capacity or quality to meet the current or projected requirements of Athea. The existing WWTP site is not suitable to accommodate the new WWTP. A treated effluent standard of 5mg/l BOD concentration, 5mg/l suspended solids concentration, 2mg/l total Ammonia, 0.5mg/l ortho-P and 10mg/l nitrates is considered necessary prior to discharging to the Galey River. A Preliminary Report prepared jointly by Barry & Partners and White Young Green Consulting Engineers in March 2008 recommends that a new 1,500 PE WWTP be constructed on an identified site local to the village. The new treatment plant should comprise inlet works, activated sludge plant, sludge thickening and storage, final effluent flow measurement and sampling, plant building, access roads, fencing and landscaping. A new terminal pumping station, rising mains and underground storage tank should be constructed at the location of the existing pumping station to deliver waste water flows to the new WWTP.

Recent Planning Consent for Private Waste Water Treatment Plant The Limerick County Council planning database shows planning permission was granted to a private individual, Mr Diarmuid Leonard, c/o Murnane Consulting Engineers, Main Street, Bruree, on 9 December 2008 for: a) The construction of a new waste water treatment plant with associated tanks, chambers, pumping station and final effluent outfall (to the Galey River), including new access road, new entrance, internal site roads and all ancillary works; b) Construction of new storm water holding tank; and c) Upgrading of existing pumping station at Athea Upper and Templeathea West Athea. Limerick County Council Water Services Investment Programme With reference to the Limerick County Council Water Services Investment Programme Assessment of Needs Report (Draft Report), dated August 2006 (downloaded from LCC website), Section 8.1 states “The schemes which have already been assigned construction start dates will involve investment of the order of €60M and approximately €20-25M will have to be met from Council’s own resources. DEHLG Water Services Investment Programme The Department of the Environment, Heritage and Local Government (DEHLG) Water Services Investment Programme is published on the DEHLG website. This states “The Water Services Investment Programme is the largest component of the Water Services Programme and relates to the provision of major water and sewerage schemes to meet the strategic objectives for investment in water services infrastructure. Within this general framework, the Department periodically asks County and City Councils to identify specific prioritised schemes in their areas that the Councils feel should be undertaken. The most recent assessment carried out by local authorities was undertaken in 2006 and the key criteria in selecting projects for possible inclusion in the Water Services Investment Programme may be seen in the Department’s Circular L2/06. In order to optimise delivery of the Programme, a rolling 3 year programme approach to investment was adopted in 2000, and most recently rolled forward on the 17th of September 2007 in relation to the period 2007-2009. The Minister announced the publication of the Water Services Investment Programme 2007 – 2009 at a Press Conference on 17 September 2007. The Programme is made up of 955 projects that have an overall capital value of €5.8 billion.” The published list of works for the Limerick County Council Water Services Investment Programme 2007 - 2009 follows. Assessment of Needs

1. General

Local Authorities are generally required to update Assessment of Need for Water Services Capital Works in their area every 5 years. The last update was carried out in 2003 on foot of Circular L11/03. These assessments provide the basis for scheme scheduling and approval of successive Investment Programmes by the Department of Environment, Heritage and Local Government. However, it has been decided, under direction of Circular L2/06, that Sanitary Authorities need to carry out an earlier review of their needs given the scale and pattern of demographic and economic development within the state in recent years. A review at this time is appropriate also in order to provide input to the next National Development Plan covering period 2007- 2013. The review of Assessment of Need is necessary to optimize project selection in future phases of the Water Services Investment Program.

2. Purpose of the Assessment

The purpose of the Assessment is to develop for County Limerick “ …an overall strategic investment plan for the medium to long term and to set out a programme of works to meet the identified water services needs”. The provision of new water and wastewater schemes or upgrading of existing systems will encourage and facilitate future housing and industry, thereby enhancing the development of County Limerick. With the implementation of the Urban Waste Water Directive, Drinking Water Quality Regulations and Water Framework Directive, various towns and villages will require improved treatment facilities in order to ensure compliance with the regulations and enhance surface water quality in the County at large. The circular requires the Council, as part of the Assessment of Need, to measure progress since the last assessment and to facilitate progressive phased advancement of the Investment Program. This draft report therefore includes the following information: -

♦ Summary of achievements of the Water Services investment program since 2003 ♦ An outline of the general approach to meeting identified needs 2007-2009 ♦ An examination of the strategic requirements in period 2010-2014 ♦ Details of program of Works ♦ Estimated cost of program of Works by Project ♦ Description of objectives in terms of outcomes sought and specific outputs required.

4. Factors to be considered in preparing the Assessment of Needs

It is noted from Circular L2/06 that a scheme already assigned a construction start date in the 2005-2007 Water Services Investment Program is not to be included in the Assessment of Need 2006. For this reason a number of schemes already within the planning phase but not as yet advanced to construction have not been included in the draft list. Projects in this category would include such wastewater schemes as Adare- Patrickswell SS, SS, Kilmallock SS, Foynes/Shanagolden SS, Askeaton SS, Glin SS and Athea SS. These schemes have been assigned construction start years and allocated budgets within the years 2006 and 2007. In addition to the above projects a number of Trunk Water Main projects are also included in this category such as Patrickswell-Adare Trunk Watermains, Croom Trunk Watermains Link, / WSS and link to as well as upgrade of the Shannon Estuary Water Treatment plant.

The preparation of the draft assessment is obliged to take account of the following documents, reports and strategies: - a) Relevant national and EU environmental, public health and drinking water quality statutory requirements and standards, b) The provisions of the County Development Plan or any draft Development Plans and any strategic regional planning guidelines that may be relevant, c) The National Spatial Strategy, d) Relevant reports and studies in the Water Services Sector such as National Water Study, National Urban Wastewater Study, Rural Water Strategies, Regional or County Sludge Management Plan and including any such reports/plans commissioned locally. e) Relevant reports produced by the EPA – ‘The Quality of Drinking Water in Ireland: A Report for the year 2004’, ‘Water Quality in Ireland 2001 – 2003’ and ‘Urban Wastewater Discharges in Ireland: A report for the years 2002/2003’. in particular, the requirement of Article 7 to provide “appropriate treatment” in the case of sub threshold agglomerations. g) The adequacy of existing collection networks and, in the case of anticipated development, the adequacy of existing treatment plants. h) Continued support for economic activity in in-fill and green-field sites through Serviced Land Initiative and the need to address infrastructural deficits in small rural towns. i) Any remaining non-compliant water schemes listed in Annex 12 of the EU Commission’s application to the European Court of Justice in respect of Ireland’s implementation of Directive 80/778/EEC (the Drinking Water Directive). j) Developments in River Basin management having regard to: - the ongoing monitoring and management regimes in place - the additional key works, not initially included in the existing River Basin District Management Projects, that came to light in the Characterisation Reports completed in 2005.

5. Review of Progress on Water Services Investment Programs since 2003

The most recent Assessment of Needs was prepared in 2003 on foot of Circular L11/03. Table 1 provides a summary of the levels of investment which were expected to meet the need for Water Services infrastructure within the County during the period 2004-2012. A full listing of projects with associated costs and current status is shown in Appendix 2 attached to this report.

In addition to the schemes that the Council is itself advancing, it is also involved in partnership with a number of other Authorities in advancing several other projects in the Water Services sector. The foremost of these is with the Limerick City Council affecting facilities and networks servicing the City, its Environs and hinterland. These projects to a lesser extent involve Clare County Council also. Though Limerick County Council does not directly drive the projects nonetheless they involve major financial commitment from the Council in order to provide adequate systems for sustainable development within the region. Projects of this nature include Limerick Main Drainage, Limerick City and County Trunk Mains, Clareville Water Treatment Plant Upgrade and Sludge Management.

The County Council is also working in co-operation with Limerick City Council in advancing a number of other projects which are integral elements of the Limerick Environs and Shannon Estuary WSS Trunk Mains system. The following watermain projects are being led by Limerick City Council on behalf of both authorities and For inspection purposes only. (i) Monaleen Road (ii) Rosbrien – Dock Road, (ii) Dock Road – Cahirdavin and (iii) Caherdavin – Cratloe Road/Coonagh.

Another major project advanced by Limerick County Council during the relevant period has been the Limerick County Water Conservation project. The first phase of this project has now been completed culminating in the establishment of leakage management team and ongoing commitment to network control. The next phase will involve the completion of development of District Metering Areas (DMAs) which will facilitate more comprehensive network management.

A number of other schemes were included in the order of major priority in the 2003 Assessment (Period 2007-2012) but have not as yet been approved to enter planning. Some progress has been effected on these projects largely through the Council’s Small Towns and Villages Initiative whereby the Council has entered into negotiations, and in some cases completed contracts with developers, for the upgrade of treatment plants in certain areas. Certain projects are also being advanced under Serviced Land

Initiative Schemes and a number of those are being pursued particularly in the hinterland of the city but also in areas such as , Croom and Newcastle West.

One project from the list, Feenagh Sewerage Scheme (No. 45) is about to proceed to tender under the Small Towns and Villages Initiative. Preliminary discussions have been held in respect of a number of projects on the list i.e. Adare WSS (No. 36), Sewerage Scheme (No. 43) – treatment plant upgrade, Sewerage Scheme (No. 54) – treatment plant upgrade and Loghill Sewerage Scheme (No. 56) – treatment plant upgrade. Similar discussions are in progress in other areas in which need had not been identified but arose due to unexpected surge in development potential.

Very little progress has been achieved on the longer term priority list (2007 -2012) schemes listed Nos. 35-57. It is in this area that the Council’s Small Towns and Villages Initiative (STVI) is particularly important and vital to sustainable development of small towns and villages. Many of these areas have some development potential and environmental need but due to the criteria on economic justification for major capital schemes are unlikely to obtain such grant aid. In any case, the lead in time to construction for such projects is so long, currently 5-7 years, that it is not possible to achieve cost effective solutions in a reasonable time-frame for such locations and avail of development opportunities as they arise. It was for this reason that the STVI was conceived, formalized and implemented with much success in a relatively short period of time.

A full summary of the status of schemes included in the 2003 Assessment of Needs is included in Appendix 2 attached to this report.

6. Approach to meeting the identified Water Services Needs (Period 2007-2014)

The potential for growth has in the past been concentrated in the City Environs and in the scheduled towns such as Newcastle West, Abbeyfeale, Kilmallock and . In recent years the potential of many smaller towns and villages has been considered with the result that water services networks in many areas have been put under severe pressure. The surface waters of Limerick County have also been identified in the past as subject to severe threat from nutrients discharged from agricultural and wastewater activity. The issue of “appropriate treatment” as required by the European Union Urban Waste Water Treatment Regulations is a major consideration for wastewater discharges in County Limerick.

Many small towns and villages do not have receiving waters in close proximity with adequate assimilative capacity in terms of dilution and nutrient dissolution. One of the concerns in any consideration of water services infrastructure in the county is the number of small settlements which are dispersed throughout County Limerick. This is particularly critical in terms of wastewater given the poor assimilative capacity of streams in many areas and distance from settlements to rivers of significant flows. The situation is further exacerbated by the background levels of nutrients in many

watercourses requiring higher level of treatment to meet more exacting effluent standards thereby requiring greater levels of investment.

In preparing the prioritized list of water services needs within the County for the coming period (2007-2014) a number of primary factors were taken into account in preparing the list of priorities: - a) Adequacy of existing systems- treatment plants, pumping stations and networks; b) Integrity of existing systems – infiltration of storm water (sewers) and leakage (water mains); c) Population statistics; d) Development growth and potential – residential, commercial and industrial, e) Capacity of receiving waters in terms of assimilative capacity and proximity (wastewater); f) Economic justification (unit costs); g) Environmental protection; h) Sustainability – planning guidelines and i) Strategic issues in terms of lead in time to construction, local impacts during construction, long-term management of schemes – operational and financial characteristics.

The above criteria apply to consideration of all the schemes identified within this Assessment of Need, the full list of which can be seen in Appendix 3 attached to this report. The schemes to be advanced in the period 2007-2009, are of vital importance in terms of meeting immediate need in order that the Council can meet its corporate objectives in terms of: - i) Compliance with statutory regulations for drinking water and urban wastewater treatment; ii) Availability of resources, local and national as the needs identified will require not alone commitment of significant grant aid from central government but a level of matching funds from Council’s own resources; For inspection purposes only. iii) Value for moneyConsent and efficiencyof copyright owner as required the Council for any other has use. to prepare for greater spread

of resources to meet the increasing financial demands of more sophisticated and higher standard of treatment plant and regulatory standards; iv) Strategic linkage with other Local Authorities, Community Groups, Private development.

The necessity of meeting objectives within a reasonable and realistic timeframe must also be taken into account.

Table 2 provides a summary of the investment required to meet the Water Services Needs of the county from Water Services Investment Program in the period 2007- 2014. A full prioritized list of the schemes for this period is shown in Appendix 3 attached to this Report. In addition to all of those projects the Council has a current work program which is shown in Appendix 4 with an estimated cost of approximately €60M approximately €18M-€20M will have to be provided from local financial resources (see Table 3).

It is evident from the summary that a huge commitment is required in terms not alone of financial resources but also project management to achieve the aims of the program.

Consequently the Council with the approval of Department of Environment, Heritage and Local Government, is in the process of establishing a project office to push forward with the extensive list of projects. This should greatly assist in maximizing progress by allowing allocated staff to concentrate fully on advancing the program

7. Strategic perspective for Water Services Investment in period 2010-2014.

Consideration of investment needs in the Water Services area for the period 2010 - 2014 is governed to a large extent by the primary factors, a-i, as outlined in Section 6. Compilation of the priority list as identified in Appendix 3 has taken account of the timescale within which these projects will proceed towards construction which has a horizon of between 10 and 20 years. Account has also been taken of the fact that interim measures have been or are in the process of being put in place such as the installation of treatment plant upgrade and that upgrade of sewer networks must follow in due course for new trunk sewers, storm water separation, elimination of combined storm overflows, etc. Cognizance has also been taken of the need in some instances for water and wastewater upgrades to be carried out in conjunction with each other.

A number of schemes have been included in the priority list (2010-2014) that may or may not be able to meet the criteria for inclusion in DEHLG Water Services For inspection purposes only. these projects or certain elements thereof may have to be driven by local development objectives or interest. In this case funding of the projects may be derived from Small Towns and Villages Initiative, Serviced Land Initiatives, Small Capital Schemes or direct developer investment in certain areas. The need in certain cases is derived from an environmental perspective and it may be that the County Council may have to pursue some of these objectives directly. This to a certain extent will depend on the various River Basin Management objectives being pursued in the area.

8. Program of Works for Major Capital Schemes( > €635,000)

There are a number of major capital schemes currently with the Department of the Environment, Heritage and Local Government at various stages of approval as indicated in the attached appendix with an additional number currently being prepared for submission. The list of schemes outlined in Appendix 3 has been prepared in accordance with the criteria outlined earlier in the report. The list prioritizes the water and sewerage schemes estimated to cost greater than €635,000, that are required throughout the County at this time to meet the various objectives of the Council including regulatory compliance and environmental protection. than €635,000 will form part of the Small Capital Schemes program which is reviewed on an annual basis.

8.1 Estimate of the Overall Cost of the Program of Works

The priority list for the period 2007-2009 (see Appendix 3) consists of 20 major water and wastewater capital schemes which it is estimated will cost in the order of €110.56M It is anticipated that in order to progress this selection of projects the County Council will be required to provide about €37.5M from its own resources or non-domestic sector in line with Government’s Water Pricing Policy. A number of these schemes are already being advanced under the Investment Program but have not as yet been assigned Construction start dates on the Program. The first 3 projects on the Assessment of Needs have already been approved to enter the planning stage. The total cost of these schemes is of the order of €14.36M. The schemes which have already been assigned construction start dates will involve investment of the order of €60M and approximately €20-25M will have to be met from Council’s own resources. Included within these projects are sewerage schemes at Patrickswell, Adare, Kilmallock, Foynes, Askeaton, Athea, and Glin along with upgrades of major water treatment plants at Clareville (Limerick City Council) and Shannon Estuary. In addition there are trunk water main projects to Croom, East Limerick and City Environs. These schemes are all listed in Water Services Investment Program 2005 - 2007 shown in Appendix 4 attached (Circular L7/05).

The remaining schemes for the period 2007-2009 will cost in the region of €96.20M. It is therefore evident that in order to meet the identified water services infrastructure need in County Limerick about €60M will have to be provided locally to meet the objectives of this program.

A further 20 schemes are prioritised for the period 2010 – 2014 (Appendix 3) which will cost in the order of €34M and require an investment of €10.21M from the Council’s own resources. such as Serviced Land Initiative, Small Capital Schemes, Small Towns and Villages Initiative or direct Council or developer investment.

The final priority list of 20 schemes (Appendix 3) has an estimated cost of about €11.15M but which will require direct investment in the order of €11.15M to complete. The need for these schemes in terms of environmental protection, local growth and sustainability and ‘expectations of our customers’ (Corporate Plan) is extremely critical. Table 3 below outlines the Total Investment required between now and 2014 at approximately €221M of which an estimated €86M will have to be found from local resources including commitments to projects being advanced by other authorities. This demand on resources is unprecedented and will present a major challenge to the Council and developers. Further demands may emerge from the various River Basin Management projects to ensure compliance with the requirements of the Water Framework Directive.

Affordability of Schemes Proposed for Inclusion in the Water Services Investment Programme: In prioritising schemes for inclusion in the Water Services Investment Programme sanitary authorities should: • be satisfied that proposals represent good value for money, and

In relation to value for money, the level of grant available to group water schemes and the cost of proprietary single house sewage treatment systems are useful guides to determining the cost effectiveness of proposals to serve existing individual houses by way of new public water or wastewater infrastructure.

Under Water Services Pricing Policy, services for future development, including new residential development, are regarded as non-domestic and the associated marginal capital costs are not funded by the Department. In the case of future residential development, the funding arrangements under the Serviced Land Initiative may apply.

In drawing up proposals sanitary authorities should, therefore, concentrate on providing infrastructure to serve the core areas of towns and villages. More outlying areas may, more appropriately, be dealt with under the Small Schemes Measure of the Rural Water Programme.

undertaken in 2003, • An outline of the general approach to meeting the identified water services needs over the period 2007 to 2009, • An examination, from a strategic perspective, of the main requirements for water services investment over the period 2010 - 2014, • Details of the programme of works - projects costing greater than €635,000 ­ required to meet the identified water services needs, • An estimate of the overall cost of the programme of works, broken down by project where this is possible, and •A description of the objectives of the investment in terms of outcomes sought and specific outputs required.

EPA Export 26-07-2013:15:08:32 Internal and Public Consultation: When completed, the appropriate Strategic Policy Committee within the local authority should consider the draft assessment of needs. The sanitary authority should also have regard to the views of the public and should allow at least one month for public consultation, based on a published draft document, before submitting the assessment to the Department. An account of comments received on the published draft and, where appropriate, the authority's response to the comments made should also be sent to the Department.

Administrative Areas: The Assessment of Needs should be carried out by city councils and county councils only. County councils should incorporate the requirements of borough and town councils as an integral part of the assessment for the county. A lead authority may undertake an assessment, in agreement with the other authorities concerned, in relation to a region e.g. Dublin, . In such cases, prior notification of this arrangement should be given to the Department by all the authorities involved.

Guidelines for Completion of Assessment: As indicated above, the Assessment of Needs should be structured to identify schemes for inclusion in Water Services Investment Programmes in the period up to the end of 2009 and in the longer term. The assessment:

• Should provide a single county/city list, in order of priority, incorporating water, wastewater and sludge management schemes, with an outline description and cost estimate for each scheme. In the case of water schemes, the outline description should identify any scheme cited in Annex 12 of the EU Commission's application to the European Court of Justice in respect of Ireland's implementation of Directive 80/778/EEC (the Drinking Water Directive), • Should not identify, as a new requirement, any scheme already assigned a construction start date in the Water Services Investment Programme 2005 ­ 2007. Where a local authority wishes to bring forward the commencement of any such scheme to an earlier date, such a proposal should be identified separately, and

Future Needs: Sanitary authorities will be aware that, when publishing the Water Services Investment Programme 2005 - 2007 in December 2005, the Minister indicated that, while progressing schemes designed to implement national and EU requirements in relation to water and wastewater treatment would remain as an important ongoing objective, the progress that had been achieved in these areas would facilitate a shift in the focus of investment in the years ahead to the management and improvement of existing infrastructure and to issues emerging from the Water Framework Directive.

In the context of the Assessments of Needs now required from authorities, it is accepted that these emerging issues will not yet have matured to an extent that they can be identified as specific projects for inclusion in the Water Services Investment Programme at this time.
