Preface The project, ‘Promoting and Supporting Good Governance in the European Football Agents Industry’ received financial support from the EU’s Erasmus+ Programme (Collaborative Partnerships). The project commenced in January 2018 and concluded in December 2019. We are grateful for the support provided by the Erasmus+ Programme. The purpose of this Final Report is to present findings regarding the operation of the 2015 FIFA Regulations on Working with Intermediaries (RWWI), particularly in relation to the implementation of the regulations at National Association level across the territory of the EU. In this regard, this Final Report presents a comprehensive picture of how intermediary regulations have historically developed and how the 2015 RWWI have operated across the territory of the EU, encompassing 31 National Associations. Our study supports key private stakeholders and public policymakers by providing evidence- based options and recommendations in terms of future regulatory initiatives in the sector informed by principles of good governance. In that regard, the scheduling of our work was adjusted to complement the work of the FIFA Transfer System Task Force that was established in order to consider reforming the RWWI. Therefore, this Final Report is, in large measure, an aggregated account of our Interim Report and Thematic Conclusions published throughout the duration of the project. The content of this Report has been informed by primary research undertaken by the research team, a national expert questionnaire, a stakeholder survey and discussions held in a series of stakeholder workshops held throughout Europe, known as Multiple Sports Events – MSEs. In order to improve the readability of this Report, we only provide a summary of the content of our National Reports which details the intermediary regulations in the 31 national football associations surveyed. Introduction The project, ‘Promoting and Supporting Good Governance in the European Football Agents Industry’ received financial support from the EU’s Erasmus+ Programme (Collaborative Partnerships). The project commenced in January 2018 and concluded in December 2019. The project is led by Edge Hill University in the UK (represented by Professor Richard Parrish and Dr Andrea Cattaneo) and the project partners are the University of Umeå in Sweden (Professor Johan Lindholm), the German Sport University of Cologne (Professor Jürgen Mittag), the Universidad Carlos III de Madrid (Professor Carmen Perez-Gonzalez) and the University of Rijeka, Faculty of Law in Croatia (Assistant Professor Vanja Smokvina). We are grateful to Maximilian Seltman from the German Sport University for his assistance. The focus of the project is to undertake evidence-based research in order to promote and support good governance in the context of the regulation of football players’ agents (referred to as ‘intermediaries’ in the 2015 FIFA Regulations on Working with Intermediaries - RWWI) in the EU. Our research has informed how private actors (the football stakeholders) and public actors (national and EU level policymakers) approach the issue of players’ agents regulation. By extension, our research will benefit other sports wanting to learn from the experience of football. A football agent is a natural or legal person who, for a fee or free of charge, represents players and/or clubs in negotiations with a view to concluding an employment contract or represents clubs in negotiations with a view to concluding a transfer agreement. One might therefore observe that an agent is merely an intermediary ensuring that the supply and demand for labour within football is met. However, many agents offer related services, such as scouting, managing the career of the player and any other service the parties agree to. Not only can an agent help secure a player or a club a better ‘deal’ in contract or transfer negotiations, particularly if the player is at a disadvantage in terms of equality of negotiating arms with a club, but an agent can also help a player focus on his or her primary task of playing football by assisting with ‘off-the-field’ issues. Agents have been a part of the football industry for many years, but their activity is currently at its height. Two reasons for this are the increase in the international migration of football players following the liberalisation of the European player market following the European Court’s judgment in Bosman1 in 1995 and the decision of FIFA in 2015 to reform the players’ agents regulations, which resulted in an increase in their activity. The work of some agents has attracted criticism. In particular, it has been observed that standards of professionalism within the sector can be poor.     5 Sport and EU competition law In applying EU competition law to sport, the Directorate General for Competition Policy (herein referred to as the Commission) has been caught between three powerful forces. First, the Commission has a constitutional commitment to promote and protect the free market principles on which much of the Treaty of Rome is based. In this capacity it shares a close rela- tionship with the ECJ. The ECJ’s rulings in Walrave, Donà and Bosman have played an important role in placing sport on the EU’s systemic agenda in a regulatory form. The Commission has a constitutional obligation to follow the ECJ’s line of reasoning on sport, given its role in enforcing ECJ rulings. As such, sport has passed on to the EU’s institutional agenda through the regulatory venue, the prevailing definition stressing sports commercial sig- nificance over and above its social, cultural and educational dimensions. The second major influence on Commission jurisprudence in the sports sector is administrative. Although primary and secondary legislation has equipped the Commission with the necessary legal powers to execute this commitment, it lacks the necessary administrative means to carry out formal investigations into abuses in all sectors of the economy. In the face of a large and growing caseload, the Commission has had to adopt creative means in order to turn over cases. In particular, the Commission has resorted to the use of informal procedures to settle cases rather than adopting formal deci- sions. For some time it has been felt by Commission officials that the proce- dures for applying competition law are in need of reform.

Within, a total of 29 (23.2%) of the 125 Division-1 FBS universities responded to our request to provide institutional literature on their agent policies and Agent Days. Results from this request and analysis of documents show some effort to educate student-athletes about sport agents and to create an ethical environment but more could be done. Next, this work sought to review the realities/outcomes of unethical agent and student-athlete relationships and explain the policies and practices of the NCAA as well as federal and state laws regarding agent and student-athlete interaction. Finally, this work offers a variety of suggestions/recommendations to better protect student-athletes and institutions. According to the National Football League Players Association (NFLPA; 2006), there are more than 700 registered agents allowed to work for the National Football League (NFL). Bechta (2009) explained that after the final roster cuts nearly 400 of these agents will have no clients on an NFL roster and therefore no income to pay off their large expenses.

This paper mainly compares three aspects, the industry itself, athlete brokers, and relevant commercial events. From the perspective of the industry itself, the Chinese sports brokerage industry has relatively low requirements on the education qualifications of employees, training attaches importance to theory rather than practice, and the qualification certification mechanism is not yet complete. In terms of policies and laws, China has not yet made national unified legislation on sports brokerage. As for the scope of business, the business content only stays on some of the most basic and primitive brokerage forms and does not connect well with other industries. From the perspective of athlete brokerage, the transfer of Chinese players is still government-led and the market is less liquid. The professionalization of athletes under the national system is not complete. Athletes develop their own intangible assets through the brokerage industry, which often conflicts with the interests of the overall economic development of their units. From the perspective of commercial events, the current number of commercial events in China is increasing, and the events involved are more extensive, but the number of events operated through the domestic brokerage industry is still small.

One growing area of research on officials is officiating efficacy, or refficacy. Previous research includes a conceptualization of the construct and an operational definition that has been supported with respect to factor structure and other psychometric properties. However, the samples that have supported the validity and reliability of the scale have reflected a narrow conceptualization of officiating; samples have been dominated by interactor officials in invasion sports, such as football and basketball. The current study was designed to assess the psychometric properties of the REFS with a sample of monitor and reactor officials. A sample of 174 officials from monitor sports such as wrestling, tennis and figure skating completed the REFS. A Confirmatory Factor Analysis supported Myers et al [1] four-factor model. The data also showed strong internal consistency and gender differences that are consistent with other research on efficacy in sport. These results show that the REFS is a valid and reliable measure for a heterogeneous and widely representative sample of sport officials.

Koller* ABSTRACT Recent scandals involving national governing bodies for sport and allegations of athlete abuse have captured media attention. The most recent, focusing on the actions of USA Gymnastics, prompted Congress to propose legislation to require better protections for Olympic Movement athletes. Signed into law on February 14, 2018, the Protecting Young Victims from Sexual Abuse and Safe Sport Authorization Act of 2017 designates the United States Center for SafeSport (SafeSport) as the independent organization charged with exercising jurisdiction over the United States Olympic Committee (USOC) and sport national governing bodies to safeguard amateur athletes against all forms of abuse. Congress’s instincts in this regard are admirable, and the empowerment of SafeSport is critically important.

    Volume 5 2016 www.csscjournal.org ISSN 2167-1974 Special Section BREAKING THE RULES A Cavalier Approach to Public Relations: The Unconventional Image Restoration of LeBron James Kathleen Stansberry Cleveland State University Jessalynn Strauss Elon University Abstract In a widely panned 2010 television special, LeBron James announced that he would be leaving the Cleveland Cavaliers and “taking his talents to South Beach.” Criticized by many for exhibiting what was seen as uncouth and egotistical behavior, James and his personal and professional image were severely damaged by the fallout from the spectacle and subsequent posturing. After five years, however, LeBron’s image has recovered fully, and today he has the distinction of being one of the most popular athletes in the world. Using the theoretical lens of Benoit’s Image Restoration Theory, this case study examines how James bucked established strategic communication processes to rebuild his tarnished brand.
