    PREFACE The Right to Information Act 2005 is a historic legislation in the annals of democracy in India. One of the major objective of this Act is to promote transparency and accountability in the working of every public authority by enabling citizens to access information held by or under the control of public authorities. In pursuance of this Act, the RTI Cell of National Archives of India had brought out the first version of the Handbook in 2006 with a view to provide information about the National Archives of India on the basis of the guidelines issued by DOPT. In the process of investigation, the fundamental rights of an arrested person are subjected to certain ‘reasonable restrictions.’ In order to ensure that the investigating agency does not abuse its powers, certain safeguards are provided under the Code of Criminal Procedure, 1973 (CrPC) as also certain evidentiary rules enacted into the Indian Evidence Act, 1872 (Evidence Act) which bar custodial confessions made in Police Custody. Self-inculpatory statements made by arrested persons in the custody of agencies like Customs including the Directorate of Revenue Intelligence (DRI), Directorate of Enforcement (ED) which perform the work of enforcing revenue and anti-money laundering laws, are admissible in evidence and it has been held in a catena of judgments that Customs officers are not Police officers for the purpose of section 25 of the Evidence Act (which makes confessions made to a Police officer inadmissible in evidence), often on the ground that Customs officers do not maintain law and order. Agencies like the DRI which collect intelligence also perform tasks of investigation and prosecution of offences under the Customs Act, 1962. The ED investigates and prosecutes for offences under the Prevention of Money Laundering Act, 2002 (PMLA). These agencies are exempted from disclosing information under Section 24 of the Right to Information Act, 2005 (RTI), which is meant to exempt ‘intelligence and security’ agencies.

It is the implementation of freedom of information in India on a national level "to provide for setting out the practical regime of right to information for citizens." The Act applies to all States and Union Territories of India, except the State of Jammu and Kashmir - which is covered under a State-level law. Certain facts 53% of public authorities do not share any information at all. 37% departments published about subsidies and beneficiaries. Only 23% listed the projects they undertake. Need For RTI Act? Promote Transparency of Information Promote openness in administration Promote Accountability in the working of every public authority Empowerment of Citizens. Building capacity of government officials as information providers Democracy requires an informed citizen Preservation of confidentiality of sensitive Information. RTI ACT--- Important sections Section 2(j) a right to (i) inspection of work, documents, records, (ii) taking notes, extracts or certified copies of documents or records, (iii) taking separate samples of material, (iv) obtaining information in the form of Disk, floppies, video cassettes. Section 4 duty of public authorities to maintain records for easy access and to publish within 120 days the name of the officers who should give information. Section 6(2) talks that an applicant cannot be questioned why he is asking for information. • Sec. 7 request to be disposed of within 30 days provided that where information sought for concerns the life or liberty of a person, the same shall be provided within 48 hours.
