1 ENGROSSED SENATE CONCURRENT 2 RESOLUTION NO. 41 By: Bingman of the Senate 3 and 4 Steele of the House 5 6 A Concurrent Resolution relating to legislative 7 procedures; establishing a legislative procedure schedule for the 54th Oklahoma Legislature. 8 9 10 BE IT RESOLVED BY THE SENATE OF THE 2ND SESSION OF THE 53RD OKLAHOMA 11 LEGISLATURE, THE HOUSE OF REPRESENTATIVES CONCURRING THEREIN: 12 THAT the First Regular Session of the 54th Oklahoma Legislature 13 shall adhere to the following procedure schedule: 14 1. The First Regular Session of the 54th Oklahoma Legislature 15 shall convene at twelve noon on January 8, 2013, for the purposes 16 only of performing the duties set forth in Section 5 of Article VI 17 of the Oklahoma Constitution and organizing pursuant to the 18 provisions of Article V of the Oklahoma Constitution, and shall 19 recess no later than five p.m. on that same day until February 4, 20 2013, beginning at twelve noon. 21 2. December 14, 2012, shall be the final date for requesting 22 the drafting of bills and joint resolutions in the Senate and House 23 24 ENGR. S. C. R. NO. 41 Page 1 1 of Representatives for introduction for consideration during the 2 First Regular Session. 3 3. January 17, 2013, no later than 4:00 p.m., shall be the 4 deadline for introduction of bills and joint resolutions in the 5 Senate and House of Representatives for consideration on the floor 6 of the Senate or House during the First Regular Session. Bills and 7 joint resolutions subsequently introduced, if reported from 8 Committee, shall not be placed on the Calendar for consideration in 9 said house until the first legislative day of the Second Regular 10 Session. 11 4. March 14, 2013, shall be the final legislative day for third 12 reading and final passage of a bill or joint resolution in the house 13 of origin. 14 5. April 25, 2013, shall be the final legislative day for third 15 reading and final passage of a bill or joint resolution in the house 16 opposite the house of origin. 17 6. The First Regular Session shall adjourn sine die not later 18 than five p.m. on May 31, 2013. 19 7. Upon a two-thirds (2/3) vote of the membership of both 20 chambers, a bill or joint resolution can be exempt from all deadline 21 dates in both chambers; provided, each chamber may adopt rules which 22 supersede the provisions of this paragraph. 23 THAT the Second Regular Session of the 54th Oklahoma Legislature 24 shall adhere to the following procedure schedule: ENGR. December 13, 2013, shall be the final date for requesting 2 the drafting of bills and joint resolutions in the Senate and House 3 of Representatives for introduction for consideration during the 4 Second Regular Session. 5 2. January 16, 2014, no later than 4:00 p.m., shall be the 6 deadline for introduction of bills and joint resolutions in the 7 Senate and House of Representatives for consideration on the floor 8 of the Senate or House during the Second Regular Session. 9 3. The Second Regular Session of the 54th Oklahoma Legislature 10 shall convene at twelve noon on February 3, 2014. 11 4. March 13, 2014, shall be the final legislative day for third 12 reading and final passage of a bill or joint resolution in the house 13 of origin. 14 5. April 24, 2014, shall be the final legislative day for third 15 reading and final passage of a bill or joint resolution in the house 16 opposite the house of origin. 17 6. The Second Regular Session shall adjourn sine die not later 18 than five p.m. on May 30, 2014. 19 7. Upon a two-thirds (2/3) vote of the membership of both 20 chambers, a bill or joint resolution can be exempt from all cutoff 21 dates in both chambers; provided, each chamber may adopt rules which 22 supersede the provisions of this paragraph. 23 24 ENGR. NO. 41 Page 3 1 THAT this schedule shall be inapplicable to any joint resolution 2 introduced for the purpose of disapproving or approving agency rules 3 pursuant to the provisions of the Administrative Procedures Act. 4 THAT this schedule shall be inapplicable to any bills introduced 5 for the purposes of incorporation and merging different versions of 6 a statute amended in more than one measure at the same or different 7 sessions of the Legislature as set forth in Section 23.1 of Title 75 8 of the Oklahoma Statutes. 9 THAT this schedule shall be inapplicable to any bill or joint 10 resolution introduced for the purpose of approving, disapproving, 11 repealing or modifying rules of the Ethics Commission pursuant to 12 the provisions of Section 3 of Article XXIX of the Oklahoma 13 Constitution. 14 THAT this schedule shall be inapplicable to any bill or joint 15 resolution which proposes a special or local law and for which 16 notice of intended introduction is published in a newspaper for four 17 consecutive weeks pursuant to the provisions of Section 32 of 18 Article V of the Oklahoma Constitution. 19 THAT the dates specified in this resolution for introduction of 20 bills or joint resolutions shall be inapplicable to any bill or 21 joint resolution which contains an "RB" number pursuant to the 22 provisions of the Oklahoma Pension Legislation Actuarial Analysis 23 Act. Such measures shall be submitted to the legislative actuary 24 ENGR. S. C. R. NO. 41 Page 4 1 not later than such dates, and may be introduced not later than the 2 first Monday in February following such submission. 3 THAT this schedule shall be inapplicable to any bill or joint 4 resolution authored by the chairs and vice-chairs of the Senate 5 Appropriations Committee and the House Appropriations and Budget 6 Committee which affects the receipt, expenditure or budgeting of 7 state funds or funds under the control of an entity created by state 8 law. 9 THAT this schedule shall be inapplicable to any bill or joint 10 resolution authored by the President Pro Tempore of the Senate and 11 the Speaker of the House of Representatives which is deemed by them 12 to be necessary for the preservation of public peace, health or 13 safety. 14 Adopted by the Senate the 18th day of May, 2012. 15 16 Presiding Officer of the Senate 17 18 Adopted by the House of Representatives the ____ day of _______, 19 2012. 20 21 Presiding Officer of the House 22 of Representatives 23 24 ENGR.
