(OGC) (FBI)' (b)(6), (b)(7)(C), (b)(7)(E) per FBI Subject: Documents All, There have been a number of phone calls today and I wanted to send around a short note to ensure we are all operating under the same set of instructions and timeline: (1) By close of business tonight, FBI will forward to me (on the high side) any proposed redactions itmay have to the three sets of documents. a. Gang of 8 Document s: ODNI has the set of Gang of 8 documents with minimal redactionsthat sit in the reading room at DOJ. We are operating under the presumption thatthose redactions will remain. Any new proposed redactions should be made to that set of documents and should be done in redbox {not blacked out) so we can quickly identify them. b. 302s: ODNI has a clean set of these documents. Any proposed redactions should be done in redbox (not blacked out) so we can quickly identify them. c. FISA Applications: ODNI only has t he copies t hat were previously approved for public release in response to the FOIA request. To that end, we will need FBI to send us their proposed 0001 Document ID: 0.7.22184.1 2891 redactions to the original applications that reflect a new version that can be publicly released. Any proposed redactions should be done in redbox (not blacked out) so we can quickly identify them. (2) 0DNI will consolidate those redactions with any additional redactions we might propose tomorrow morning. (3) Once that is complete, we will send soft copies of the documents, as redacted, to the White House. Please let me know if you have any questions or concerns. Flynn's communications with Russian Ambassador Sergey Kislyak were interpreted by some senior U.S. officials as an inappropriate and potentially illegal signal to the Kremlin that it could expect a reprieve from sanctions that were being imposed by the Obama administration in late December to punish Russia for its alleged interference in the 2016 election. Flynn on Wednesday denied that he had discussed sanctions with Kislyak. Asked in an interview whether he had ever done so, he twice said, "No." On Thursday, Flynn, through his spokesman, backed away from the denial. The spokesman said Flynn "indicated that while he had no recollection of discussing sanctions, he couldn't be certain that the topic never came up." Officials said this week that the FBI is continuing to examine Flynn's communications with Kislyak. Several officials emphasized that while sanctions were discussed, they did not see evidence that Flynn had an intent to convey an explicit promise to take action after the inauguration. Flynn's contacts with the ambassador attracted attention within the Obama administration because of the timing.

Historically, government lawyering has swung between two poles: (1) dialogic lawyering, which stresses reasoned elaboration, respect for institutions, and continuity with unwritten norms embodied in past practice; and (2) insular lawyering, which entails opaque definitions, disregard of other institutions, and departures from unwritten norms.1 Because President Trump regularly signals his disdain for institutions, such as the intelligence community, and unwritten norms, such as prosecutorial independence,2 senior lawyers in the White House have added a new mode of legal representation that entails ad hoc adjustments to President Trump’s mercurial decisions and triage among the presidential decisions they will try to temper.

Begun in 1998, the White House Transition Project provides information about individual offices for staff coming into the White House to help streamline the process of transition from one administration to the next. A nonpartisan, nonprofit group, the WHTP brings together political science scholars who study the presidency and White House operations to write analytical pieces on relevant topics about presidential transitions, presidential appointments, and crisis management. Since its creation, it has participated in the 2001, 2005, 2009, 2013, 2017, and now the 2021. Among the many disturbing things you said, I was particularly troubled by your statement that if the president feels an investigation "is based on false allegations, the president does not have to sit there constitutionally and allow it to run its course. The president could terminate that proceeding and not have it be corrupt intent because he was being falsely accused." If this idea is how our nation is governed, we will no longer be the democracy Americans think we are. I understood from the memorandum you sent to Deputy Attorney General Rosenstein in June of 2018 that you subscribe to a philosophy in which the executive is exalted above the other co­ equal branches of government. But this was the first time I had heard you articulate, as Attorney General, this starkly extremist view. Such a statement, in my view - and I believe most Americans would agree - shows complete disregard for the carefully-designed system of checks and balances the Framers enshrined in our Constitution. If these views are truly your views, you do not deserve to be Attorney General.
