PROCEEDINGS OF 266th MEETING OF THE ERC-NCTE HELD ON 31st JANUARY, 2019

The 266th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 31st January, 2019 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 266th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Mr. Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

ATTENTION!

1. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

ER-266.2 [Court Case] Complaint received from Governer’s Secretariat against 39 Teacher Education Institutions running B.Ed Programme regarding non-compliance of the direction of the 1. 266.2 .1 Hon’ble Chancellor Raj Bhawan, Patna for ensuring transparent compliance of NCTE norms regarding.[File No.ERC/05-1361/2017] In reference to NCTE HQrs. letter No. NCTE-Reg.1011/11/2019-US(Regulation)-HQ dated 24.01.2019, the matter was placed before the Committee and decided in respect of following 39 recognised institutions under three Universities viz. Magadh University, Maulana Mazharul Haque Arabic & Persian University and Patliputra University that Show Cause Notice be issued on the following grounds for smooth functioning as per NCTE Regulations, 2014:-

a. Approved faculty list by the concerned affiliating body along with requisite documents. b. Approved building plan by the concerned competent Govt. Engineer/Authority. c. Approved building completion certificate by the concerned competent Govt. Engineer/Authority. d. FDRs towards Endowment fund and Reserve fund after conversion into joint operation mode as prescribed in the NCTE Regulations, 2014. e. Confirmation on website updates of the institutions with all details along with affidavit. f. Fire safety certificate issued from the competent Govt. Authority.

“Be that as it may, let NCTE consider refunding the said amount of Rs.1,50,000.00 by depositing of the petitioner’s representation, said to have been made on 10.01.2108, which has been brought on record by way of annexure-4 to the writ application; within two months from the date of receipt/producting of copy of this order”.

The Committee considered the order of the Hon’ble High Court of Patna and observed as under:

(i) ERC considered to apart by the Regulation 7(1) of NCTE Regulations, 2014 and has since the application is incomplete due to non-submission of NOC, the application fee is forfeited.

In view of the above, the Committee decided as under: A letter be issued to the institution in this regard.

(i) LOI u/c 7(13) issued on 16.01.2019 to the institution with a copy to Vinoba Bhave University as the affiliating body. (ii) The institution has submitted a representation dated 23.01.2019 along with a copy of Jharkhand Gazette Notification dated 23.03.2017 regarding territorial jurisdiction of newly established University i.e. Binod Bihari Mahto Koyalanchal University, Dhanbad and for change of its previous affiliating body.

In view of the above, the Committee decided as under: Request of the institution for change of new affiliating body is accepted. A letter be issued to the institution as well as new affiliating body for submission of reply of LOI.
