The Authorized Uses, listed in Section 9 of the license, are wide ranging and describe the variety of services involving radioactive material that ES is qualified to perform. This license has been held for many years, based at various ES office/administrative locations. This license was most recently re-issued to support some administrative changes on December 28, 2016. This license is noted to expire on November 30, 2021. This license is historically utilized on several occasions each year at a variety of temporary job sites, for periods that range from a single day to many months. ES does not maintain any site or facility at which radioactive material is possessed under this license. Upon each use of this license, all radioactive material is either shipped to another licensed facility and/or returned to the possession of the holder of a permanent license for the site/facility. These actions are completed before demobilizing from the temporary ES location and terminating that temporary license use. Each use of this license since 2016 has happened to occur in an Agreement State, under the reciprocity process specified by that given state. Since that time, no uses of this license have occurred in states with NRC jurisdiction for activities involving handling of radioactive material. During a routine inspection oflicense records in August of this year, an NRC inspector noted that despite continuing, periodic use of the license under reciprocity in Agreement States, the ES mobile license had not been used in an NRC jurisdiction since mid-2016. The inspector stated that this situation would be considered to meet the condition stated in item (3) on Page 3 of RIS 2015-19, Rev 1 ("no principal activities under the license have been conducted for a period of 24 months"). 250 Berryhill Road, Suite 400 Columbia, South Carolina 29210 803-256-0450 • www.energysolutions.com October 12, 2018 DD-RR-2018-001 Page 2 of2 The inspector also advised that, given the usage history summarized above, ES should either terminate the license or obtain a license extension to keep the license active past January 1, 2019. The inspector stated that the use of the NRC Materials License to obtain reciprocity in Agreement States does not constitute "a principal activity" as defined in the regulations. While we disagree with this interpretation of the regulations, in order to support the continuing business need for this Material License, ES has completed the attached NRC Form 313 for renewal oflicense 39-35044-01. No programmatic changes to the license program and procedures are associated with this renewal. Please advise how to proceed with this renewal request. Thank you for your assistance in this matter.
