DEFINITIONS

CLOSED SEASON: The period when it is unlawful to fish for, take, catch, k ill, ordestroy any fish.

OPEN SEASON: The period when fish may be taken as specified and limited by law; it includes the first and last day thereof.

FLY: FLY means a single-pointed hook dressed with feathers, hair, thread, tinsel, or any similar material to which no additional weights, hook,spinner, spoon, orsimilardevice is added.

FLY FISHING: To cast upon water and retrieve in the usual and ordinary manner, an unbaited, unweighted, artificial fly attached toa line to which no extra weight has been added. Except as otherwise provided, it shall be unlawful to troll a fly in waters restricted to fly fishing only.

JIGGING: The use of any fishing tackle or device in an attempt to snag or snare fish. When fishing for Atlantic salmon in coastal rivers, "jigging" shall mean fishing with hook or hooks so as to pierce and hook a fish in any part of the body other than the mouth. Jigging is prohibited in Maine waters.

TRANSPORT: Includes to offer or to receive for transportation.

ALIENS: Aliens shall be classified as nonresidents, except that any alien who has resided in Maine continuously for 1 year and in addition thereto is assessed and pays taxes on real estate in the municipality in which he resides, or any alien who has resided in Maine continuously for 5 years, may purchase any resident license issued under Chapters 301 to 335.

RESIDENT: A citizen of the United States who is domiciled in Maine with the intention of remaining and who has resided in this state during the 3 months next prior to date of application for license. (All employees of the Veterans Administration facility residing in Maine and employed by the Togus facility are classified as residents for the purpose of obtaining fishing licenses.) NONRESIDENT: A person not coming within the definition of resident; includes aliens as defined above.

2 TRIBUTARY: A brook or stream flowing directly or indirectly into a lake, pond or another stream. A lake or great pond (over 10 acres) shall not be considered to mean tributary. The tributary to a great pond shall not be considered a tributary to the outlet of that great pond.

WATER THOROUGHFARE: A waterway without flowage, connecting 2 bodies of water.

POSSESSION LIM IT: Whenever any waters have a special bag limit, no person shall have in his possession more than 1 day's bag limit taken from those waters.

BAG LIM IT: The maximum limit, in number or amount of fish, which may lawfully be taken by any one person during one day.

INLAND WATERS: All waters within the state above the rise and fall of the tide.

CHAPTER 79

2251. Dumping litter

No person shall put or place, cause to be put or placed, deposit or throw upon any square, lane, alley, public bathing place, public park, the approaches thereto, or any other place, or into any inland or ti\ waters, or on the ice over such waters, or on the banks adjacent there o any bottles, glass, crockery, cans, scrap metal, junk, paper, garbage, rubbish, old automobiles or parts thereof, or similar refuse, except in proper containers placed for rubbish or garbage collection or removal or except in a public dump. Any person who violates this section shall be punished by a fine of not more than $100. Nothing contained in this section shall be construed as affecting authorized collections of such articles as garbage or refuse, nor shall anything be construed to prevent the proper use of the rights-of-way for highway purposes. If the throwing, placing or depositing was done from a motor vehicle, it shall be prima facie evidence that the throwing, placing or depositing was done by the driver of such motor vehicle. GENERAL OPEN SEASONS All dates are inclusive and apply to waters or portions of waters naturally free of ice, for all fish except black bass.______GENERAL MAJOR WATERS SEASON EXCEPTIONS 1 .Lakes & ponds April 1 -Sep. 30 Many reclaimed ponds (trout ponds) open the last Saturday in April. A good many waters are open in October; see county listings. 2. Brooks & streams April 1 - Aug. 15 Aroostook County opens May 1. Atlantic salmon closes 3. Nonresident licenses may be bought from any of numerous agents in Maine and other states or from the Fish and Game Department, State Office Bldg., Augusta, Maine 04330. Residents must purchase licenses in municipality of residence (except 3-day license). The 3-day license isfor 3consecutivedaysonly. GUIDE LICENSES: Resident, $15.00; nonresident, $50.00 Both these licenses permit fishing and hunting. Guides who use motor boats must have a motorboat operators license. (LICENSE INFORMATION CONTINUES ON PAGE 6) 4 GENERAL LAW BAG AND POSSESSION LIMITS No person shall take, catch, kill, or have in possession during any one day of any open season— from any or all of the inland waters of the state-more than 8 fish (12 in Aroostook County) of the salmon, trout, togue or black bass species, except as provided for by rules and regulations of the Department, under Section 1960.

No person shall take, catch, or kill in any one day, or have in possession at any time, more than TA pounds in the aggregate of the above-mentioned species unless the last fish caught increases the combined weight to more than VA pounds. The daily bag lim it from any body of water is also the possession limit from that water at any one time.______SPECIES BAG & POSSESSION LIMIT 1. Salmon Trout Togue (lake trout) See above two paragraphs. Black bass (see No. 4 below) 2. Chain pickerel 10 fish (except no limit in Washington Countv). 3. White perch No size or bag limit except 25 fish daily bag lim it in Kennebec and Somerset counties. See county listings for a few other exceptions. 4. Black bass June 1— June 20 inclusive: daily limit 3 (See also No. 4 fis h ; fish may be taken only on on page 4.) single-pointed-hooked artificial lures; possession limit 3 fish. Bass may be taken under the general law from June 21 through the remainder of the season. In all waters where the size and bag limits have been removed on bass, the season and the method of taking shall be the same as for trout and salmon. 5. Atlantic salmon April 1 is opening date on salmon rivers except the Dennys (May 1). Two fish limit. See salmon regulations on pages 38-39, as they vary from river to river.

MINIMUM LENGTHS Bass, 10 inches; trout, 6 inches (no length limit on trout taken from brooks and streams); lake trout (togue) 14 inches; salmon, 14 inches (except 12 inches in Aroostook County). Some other exceptions in certain watersare listed by county.

5 FISHING LICENSES

See fee schedule on page 4. No license is required for resident or members of his immediate family on land where they are domiciled and which is used exclusively for agricultural purposes. Indians, over 16 years on the tribal lists of the Penobscot and Passamaquoddy tribes of I ndians, upon certification by the commissioner of I ndian affairs, may procure free license.

BOYS' AND GIRLS' CAMPS, to fish in lake or pond adjacent to camp: a blanket license (children not over 16 years of age) an enrollment of less than 50 campers $30.00 an enrollment of not less than 50 and not more than 75 campers 50.00 an enrollment of more than 75 campers 75.00 CAMP TRIP LEADER'S PERMIT (for resident camps) 5.00 (for nonresident camps) 10.00 REPLACEMENT: Duplicate licenses issued at main office, Augusta, $1.00. REVOCATION: Licenses may be revoked for violation of law. ARMED FORCES: A license to hunt or fish shall be issued, at the resident license fee, to any member of the armed forces of the United States of America who is a citizen of the United States or Canada, and stationed at some military or naval post, station or base within Maine, or his or her spouse or minor child who is at least 16 years of age. Said member of the armed forces desiring a hunting or fishing license, must present certification from the commander of said post, station or base,orhisdesignated agent,that the person mentioned in the certification is stationed at or attached to said post, station or base. Licenses may be issued by the clerk or agent in the town in which said military or naval post, station or base is situated. Also a license to hunt or fish shall be issued at the resident license fee, to any civilian employee and immediate family, residing on any military or naval post, station or base within the state. Said civilian employee and immediate family, desiring a hunting or fishing license, must present certification from the commander of said base, or his designated agent, that the person mentioned in the certification is such a civilian employee and immediate family, residing on said base for a period of 3 months. PATIENTS AT VETERANS ADMINISTRATION CENTER authorized to fish without license. The commissioner is authorized to permit inpatients at the Veterans Administration Hospital at Togus to fish without a license in the inland waters within a 25 mile radius of Togus. Patients not under the direct supervision of hospital staff or volunteer supervisors shall have in their possession while fishing a valid pass issued by the Veterans Administration Hospital. MISCELLANEOUS AND GENERAL PROVISIONS FISHING TACKLE: It shall be unlawful to angle or fish other than by the use 6 of the single-baited hook and line, artificial flies, artificial minnows, artificial insects, spoon hooks, and spinners. Noperson shall fish with more than two lines at any onetime. The possession of fishing tackle in the fields, forests, or on the watersor ice of the state, by any person without license, shall be prima facie evidence of fishing in violation of law. All pools of state fish hatcheries and rearing stations and all waterswithin 200 feet of such pools shall be closed to all fishing. (Exception: Grand Lake Stream.) CLOSED SEASON: During the period of the respective closed season, it is unlawful for any person to fish for, take,catch, kill, or have in possession any fish of any kind from such closed waters. PROHIBITED IN TAKING FISH: Explosive, poisonous, or stupefying I substances; fish spawn, grapnel, spear (see SUCKERS, below), spear gun, I trawl, weir, gaff, seine, gill net, trap or set lines; electronic, sonic, or battery powered devices. It shall be unlawful for any person to use or have in possession a gill net on any of the inland waters of Maine. FISHWAYS: No person shall fish within 150 feet of any dam in which a fishway is located, except as follows: A. This limit is 50 feet at Upper Dam in Richardsontown (T.4,R.1) at the outlet of (Oxford County), at Middle Dam in Twp. C at the outlet of lower Richardson Lake(Oxford County),and at East Outletdam inSapling (T.1 ,R.7 ,Somerset County) and Big Squaw Mountain (Piscataquis County). B. This lim it is 75 feet from the mouth of the fishways in the Woodland dam and Grand Falls powerhouse dam in the St. Croix River in Baileyville (Washington County) and East Grand Lake dam in T.9,R.4 (Spednic Lake dam, Washington County). C. The limit does not apply at the Bath Tub, so called, in (Franklin County). This section shall not preclude the taking of alewives and smelts in the manner provided under the laws regulating sea and shore fisheries. PONDS FORMED BY BROOKS,STREAMS, AND RIVERS: Ponds 10acres or less, formed on brooks, streams, or rivers, shall be governed by the same law regu lating f ish ing that appl ies to the brook, stream, or river on wh ich they are situated, whether said pond be natural or artificial. THOROUGHFARES AND BOGS: The general laws governing lakes and ponds also apply to thoroughfares and bogs. SMELTS: Above tide waters, smelts may be taken with a dip net except in waters prohibited by rule and regulation of the commissioner. No person shall take, kill, catch, or have in possession more than 4quarts of smelts in any one day. (See next page for exceptions.) SUCKERS, EELS, HORNPOUT, ALEWIVES AND YELLOW PERCH may be taken for market by permit. It shall be lawful to take suckers in all rivers) brooks and streams which are open to fishing between April 1st and June 30th of each calendar year by the use of a hand spear by persons licensed or otherwise entitled to fish in Maine waters. EELS: Trappers may procure permit to take 20 pounds. 7 TRANSPORTATION OF FISH Licensed persons may ship to residence one day's bag limit once in 10 days. Exceptions: once a year from Rangefey Lake, Mooselookmeguntic Lake, Cupsuptic Lake, R ichardson Lake, Upper and Lower. Heads and tails, oreither, may not be detached from salmon, trout, togue, and black bass, unless the fish are being prepared for immediate cooking. For •the purpose of this section, the smoking of fish shall not constitute cooking. Trout, salmon, togue, and black bass kept in any sporting camp, hotel, or public lodging place must have name and address of person catching same attached thereto. Aircraft are required to have a permit for transportation of fish, game, or fur-bearing animals; fee, $2.00. SALMON** tV 6 u*T,**TOGUE* * B*LACK* * BASS, WHITE PERCH* OR PICKEREL FROM INLAND WATERS: No owner, keeper, or employee thereof or any other person shall have in his possession any salmon, trout, togue, black bass, white perch, or pickerel from the inland waters of the state for the purpose of serving or consuming the same in any camp, house, or other building used partly or wholly in lumbering operations, log driving, or construction of any kind. Exception, pickerel in Washington County. LIVE BAIT FOR FISHING; DEALERS LICENSED: It shall be unlawful to sell, use, or have in possession, either dead or alive, fo,r use as bait for fishing in the inland waters of this state any pickerel, goldfish, yellow perch, white perch, bass,sunfish, crappie, hornpout, carp, or any spiny-finned fish. It shall be lawful to take minnows usually used asbaitforfishing in all the inland waters of the state during the period that such waters are open for fishing. The commissioner may grant permits to take minnows for bait purposes from certain waters at any time. All persons dealing in live bait shall be licensed to do so by the commissioner, and the fee therefor shall be $10.00 for each calendar year. The license shall authorize the person holding the same to use the ordinary commercial type minnow seine, not to exceed 8 feet in depth by 150feet in length, in the taking of minnows and other unprotected fish commonly used for bait purposes. Persons having a bait dealer's license under this section may take smelts in accordance with sections 2704 and 2552, and a licensed bait dealer may possess more than 4 quarts of bait at any time providing the taking was legal. §2558-A, Live smelts for bait; dealers licensed. All persons dealing in live smelts for resale as bait shall be licensed to do so by the commissioner. The fee for such live smelt bait dealer's license shall be $50 for each calendar year. Persons having a live smelt bait dealer's license under this section may take, from waters designated by the commissioner, smelts for resale. Said smelts may be taken at any time with a dip net, drop net or hook and line. The daily limit for dealers licensed under this section shall be 8 quarts and they may possess more than 8 quarts provided the taking was legal. No live fish, to be used as bait for fishing within this state, shall be imported from without the state. 8 HELLGRAMITES: Transportation out of state is prohibited.

BOUNDARY WATERS BETWEEN MAINE AND NEW BRUNSWICK IN AROOSTOOK COUNTY: St. Francis River, Glazier Lake, St. John River, Monument Brook, North Lake, The Thoroughfare between North and East Grand Lake, and East Grand Lake. IN WASHINGTON COUNTY: East Grand Lake, Mud Lake, St. Croix River, Spednic Lake, and Grand Falls flowage. Notwithstanding any other law to the contrary; 1. Open water. Open water fishing season shall be from April 15th to September 30th of each year. 2. Length limit. No person shall take or have in possession a landlocked salmon less than 14 inches in length, togue less than 14 inches in length, trout less than 6 inches in length, and bass less than 10 inches. 3. Daily bag and possession limit. No person shall take in any one day nor possess more than 15 fish in the aggregate or 7/4 pounds of landlocked salmon, togue, trout, and bass.

BOUNDARY WATERSBETWEEN MAINE AND IN YORK COUNTY: Balch Pond, Parsonsfield, Maine; Wakefield, New Hampshire. Great East Lake, Acton, Maine; Wakefield, New Hampshire. Horn Pond, Acton, Maine; Wakefield, New Hampshire. Lords Pond, Parsonsfield, Maine; Effingham, New Hampshire. Milton Three Ponds, Lebanon, Maine; Milton, New Hampshire. Province Lake,Parsonsfield,Maine; Effingham, Wakefield, New Hampshire ‘ , Acton, Berwick and South Berwick, Maine; Milton, Rochester, Somersworth and Rollinsford, New Hampshire. Spaulding Pond, Lebanon, Maine; Milton, New Hampshire. Live Bait for Fishing: It shall be unlawful to take, sell, use, or have in possession either dead or alive, for use as bait for fishing in the herein-named waters, any pickerel, goldfish, yellow perch, white perch, bass, sunfish, crappie, horned pout, carp or any spiny-finned fish. Open Water Season: Fishing through natural openings in the ice from April 1st to September 30th for all species. Closed to all fishing — October 1st to ice-in. Limits: Brook trout (includes rainbows and browns), lake trout, and salmon: limit, 8 fish or 714 pounds in aggregate. Brook trout: length limit, 6 inches. Lake trout and salmon: length limit, 14 inches. Bass: 5 fish; no length limit; no weight limit. Pickerel: 10 fish; no length limit; no weight limit. Bullhead (horned pout): no length limit; no weight limit; no creel limit. White perch and yellow perch: no length limit; no weight limit; no creel limit.

9 •Exceptions — Salmon Falls River Brook trout season April 1st to September 15th; length limit: 6 inches; 8 fish or TA pounds in aggregate. IN OXFORD COUNTY: Lower Kimball Pond, Fryeburg, Maine; Chatham, New Hampshire. •, Upton, Maine; Cambridge and Errol, New Hampshire. •Exceptions Umbagog Lake Salmon or brook trout: 5 fish or 714 pounds perday in aggregate.

RULES AND REGULATIONS BY COUNTIES Fishing regulations are subject to annual changes. Familiarize yourself with the current regulations. When any variance occurs between the general laws and the following regulations, this summary supersedes. NOTE; Two abbreviations appear frequently in this booklet. NLFAB= "The use or possession of live fish as bait is prohibited." FFO= "Fly fishing only."

"The waters listed herein are those on which there are special regulations. All waters not listed herein are open to fishing under the general law (see pages 4 and 5). Special regulations mean that the water listed differs from the general law in the manner noted. In all cases wherein the daily bag lim it differs from the general law, the lim it of fish which may be legally taken by any one person in any one day is stated herein, either in numbers of fish or pounds. Bag and possession limits are defined on page 3 and listed on page 5. Where county lines divide a body of water, the more liberal bag limitshall apply. "Closed” means closed to all fishing. All dates are inclusive. The sale of game fish in prohibited. Auburn Lake Closed to all fishing is the area of approximately 340 acres beginning at the post set in the ground on the shore of about 2,500 feet westerly from the Auburn Water District intake; thence northerly about 300 feet to a point (buoy); thence northeasterly about 2,500feet to a point (buoy) about 3,300 feet northerly from the intake of the Auburn Water District; thence easterly about 2,500 feet to a point (buoy); thence southerly about 3,000 feet to a post on the shore of Lake Auburn and on the line between the Lake Grove lot and the Morrell farm, so-called; thence westerly by the shore of Lake Auburn to the point of beginning. ATLANTIC SALMON SPORT FISHING REGULATIONS General Provisions for Sport Fishing 2 fish per day limit and 14 inch minimum length in all waters of the state. Fishing by the ordinary mode of angling with hook and line in all waters of the state unless otherwise stated. Open season April 1 to September 15 in inland waters unless otherwise stated. Season in tidal waters April 1 through October 15. Special Provisions Dennys River-Season opens May 1. Between the lower dam site and The Narrows, fishing is restricted to use of artificial fly. That portion of the Dennys River between tidewater and two red posts at.The Narrows is open to fly fishing until October 15. -Artificial flies only in the area from Route 1 bridge downstream to head of tide. 38 Machias River— Artificial flies only in the area from Whitneyville dam downstream to Blaine Davis Mill. That portion of the Machias River from the Whitneyville dam to tidewater shall be open to fly fishing until October 15. Pleasant River (Washington County)— Fishing for Atlantic salmon restricted to use of unweighted fly hook and line, and such hook shall not be larger than No. 4. Narraguagus River— Atlantic salmon may be taken only with hook and line or artificial flies. Taking of fish prohibited except by use of a single hook on a line above Deblois bridge. Fly fishing only, below Deblois bridge. That portion of the river between tidewater and 100 feet below the ice control dam shall be open to fly fishing until October 15.

HIGHLIGHTS OF MAINE BOATING LAW Fishermen who use boats are cautioned to be sure their boats are properly registered, equipped and operated as required by the Maine boat law. Highlights of this law are stated below. For full details of the law, or to register your boat, contact the Bureau of Watercraft Registration and Safety, State House, Augusta, Maine 04330. 1. Maine's boat law is federally approved. Boats driven by machinery of over 10 horsepower must be registered and properly display assigned number on bow of craft. License is good for 3 year period. 2. Boats validly registered in other states having a federally approved law (except New Hampshire, Washington, and Alaska) can operate for 90 day period without licensing in Maine. 3. All watercraft except canoes must carry a Coast Guard approved lii saving device for each person aboard. All motor boats must display , lights and carry necessary safety equipment such as life preservers,' fire extinguishers, and other equipment in compliance with federal; laws and regulations, except that motorboats of less than 10j horsepower need display only a single white light, while operating! between sunset and sunrise. 4.
