Concordia University In 1922, a group of eastern European Jewish immigrants joined together to form the Jewish Community council of Montreal (Vaad Ha’ir) to coordinate and organize the growing Jewish population‘s communal needs. Merging Orthodox and secular elements, the Vaad Ha‘ir of Montreal was founded to manage the basics of Jewish life in Canada: reliable kosher food, Jewish education, communal cooperation, and mutual aid. Beset by struggle, competition, recalcitrant butchers, wayward kosher slaughterers, and conniving wholesalers, the Vaad‘s history has been an active one. Centering this study on the archives of the Vaad Ha‘ir of Montreal in the 1950s and 60s, I have identified the challenges faced by voluntary Jewish communal bodies in North America. Although the archives are mostly limited to the mid-century period, the analysis takes us beyond that point into the twenty-first century to examine how these changes have affected Orthodoxy in the long term. Questions of ethnic identity, Orthodox adaptability, and communal boundaries are reflected within the records of this community, and form the basis of my analysis. Although the Vaad Ha‘ir aspired to recreate a European-style communal council that would dictate virtually every aspect of Jewish life, as was the case in Europe, the new North American reality would not permit such authority. Faced with new social and legal circumstances, the history of the Vaad Ha‘ir illuminates the struggle of traditional iii Jewish communities in North America to address the challenges of voluntary societies and personal freedom. By the end of the century, the agenda of the Vaad Ha‘ir of Montreal was decidedly narrower than previously. The collection contains some thirteen linear metres of textual records, of which approximately four metres (about twelve banker‘s boxes) contain ledgers and financial records exclusively. The balance are filled with reports, minutes, and correspondence. I examined every box with the exception of those containing uniquely financial information. Not only were the finances of the organization not of germane interest to this work, a forensic audit merits a large-scale project of its own, beyond the skills of this author. The archives are on permanent loan from the Jewish Public Library of Montreal to the Canadian Jewish Congress Charities Committee National Archives, where I consulted them. In about 1995-96, these documents were discarded by the Jewish Community Council of Montreal and through the help of Ira Robinson, Claire Stern, Beverley and Eiran Harris, of the Jewish Public Library in Montreal, and Janice Rosen and Hélène Vallée of Canadian Jewish Congress National Archives, the documents were salvaged and catalogued and made available to researchers. The initial haphazard treatment of these important documents resulted in incomplete files and a truncated time line. While some documentation remained from the early period in the 1930s (treated in ―The Vaad Early Years‖), the bulk of the collection

    eSharp Issue 20: New Horizons A Fresh Perspective on the History of Hasidic Judaism Eva van Loenen (University of Southampton) Introduction In this article, I shall examine the history of Hasidic Judaism, a mystical,1 ultra-orthodox2 branch of Judaism, which values joyfully worshipping God’s presence in nature as highly as the strict observance of the laws of Torah3 and Talmud.4 In spite of being understudied, the history of Hasidic Judaism has divided historians until today. Indeed, Hasidic Jewish history is not one monolithic, clear-cut, straightforward chronicle. Rather, each scholar has created his own narrative and each one is as different as its author. While a brief introduction such as this cannot enter into all the myriad divergences and similarities between these stories, what I will attempt to do here is to incorporate and compare an array of different views in order to summarise the history of Hasidism and provide a more objective analysis, which has not yet been undertaken. Furthermore, my historical introduction in Hasidic Judaism will exemplify how mystical branches of mainstream religions might develop and shed light on an under-researched division of Judaism. The main focus of 1 Mystical movements strive for a personal experience of God or of his presence and values intuitive, spiritual insight or revelationary knowledge. The knowledge gained is generally ‘esoteric’ (‘within’ or hidden), leading to the term ‘esotericism’ as opposed to exoteric, based on the external reality which can be attested by anyone. 2 Ultra-orthodox Jews adhere most strictly to Jewish law as the holy word of God, delivered perfectly and completely to Moses on Mount Sinai.

    239 Setting the Record Straight: Was the Chasam Sofer Inconsistent? A Review Essay By: NOSSON DOVID RABINOWICH In this essay we will discuss claims made in two recent articles, published by two leading scholars, to the effect that the Chasam Sofer was inconsistent and contradicted himself. I will attempt to show that those supposed “contradictions and inconsistencies” are either simply nonexistent or can be properly explained by careful and deliberate analysis of the actual sources and the issues involved. While my respect for Rabbi Moshe Sofer, the late “Chasam Sofer,” of blessed memory, is not merely that reserved for a great rabbi and outstanding scholar, I have endeavored to maintain a balanced and critical approach throughout. Nevertheless I feel it appropriate to note that from my perspective, Rabbi Sofer was a holy rabbi, a saint if you wish, whose towering scholarship in so many areas of Jewish studies was unmatched by his peers or by any rabbi from any subsequent generation. I do not hesitate to apply to him this popular saying: “From R. Moshe [Ben-Maimon; Maimonidies] until [R.] Moshe [Sofer] there was no one of the stature of R. Moshe [Sofer].”1 1 As the halakhic authority of his generation, he was probably more prolific than any other rabbi going back six hundred years, since the leading halakhic authority of the Golden Age in Spain, Rabbi Shlomo ben Aderet. Of R.     Keele Law Review, Volume 2 (2021), 45-62 45 ISSN 2732-5679 ‘Hidden’ Regulations and the Rule of Law: A Look at the First decade of Israel Gal Amir* Abstract This article reviews the history of issuing regulations without due promulgation in the first decade of Israel. ‘Covert’ secondary legislation was widely used in two contexts – the ‘austerity policy’ and ‘security’ issues, both contexts intersecting in the state's attitude toward the Palestinian minority, at the time living under military rule. This article will demonstrate that, although analytically the state’s branches were committed to upholding the ‘Rule of Law’, the state used methods of covert legislation, that were in contrast to this principle. I. Introduction Regimes and states like to be associated with the term ‘Rule of Law’, as it is often associated with such terms as ‘democracy’ and ‘human rights’.1 Israel’s Declaration of Independence speaks of a state that will be democratic, egalitarian, and aspiring to the rule of law. Although the term ‘Rule of Law’ in itself is not mentioned in Israel’s Declaration of Independence, the declaration speaks of ‘… the establishment of the elected, regular authorities of the State in accordance with the Constitution which shall be adopted by the Elected Constituent Assembly not later than the 1st October 1948.’2 Even when it became clear, in the early 1950s, that a constitution would not be drafted in the foreseeable future, courts and legislators still spoke of ‘Rule of Law’ as an ideal.
