1 INTRODUCTION

1.1 Overview and Background of the Project

1. The Project aims to electrify the missing 145.1 kilometers (km) of non-electrified track linking major cities in the populous Fergana Valley with Tashkent. This will facilitate direct and efficient operation of both freight and passenger train services, and thereby promotes economic and social development of the Fergana Valley.1

2. The Project will be aligned with the following impacts: (i) stimulated economic growth in the Fergana Valley, and (ii) increased regional trade along CAREC Corridor 2. The outcome will be the level of passenger and freight service on the Pap-Namangan-Andijan railway line improved.

3. The Project will produce two outputs. First, railway infrastructure along the Pap-Namangan- Andijan railway line will be upgraded. This includes electrification of 145.1 km of the main railway line to 27.5 kilovolts alternating current (including the 3.5 km line from Blok Post 136.1 to Uchkurgan), construction of 2 traction substations and dispatcher points, modernization of the locomotive depot in Andijan for it to be able to handle electric locomotives, purchase of maintenance equipment and machinery, modernization of signaling and communications facilities, and construction of external power supply facilities which will transmit electricity from the main grid to the traction substations. 6.7 kilometers of the railway line will be realigned to bypass a section of the line that currently traverses the territory of the Kyrgyz Republic to be also electrified under the Project. Second, safety of railway operations will be improved.

4. The Project includes the following components: 1) Electrification of the main track (145.1 km) between Pap Station and Andijan 1 station, and including the 3.5 km line from Blok Post 136.1 to Uchkurgan- Voltage of transmission lines will be 27.5 kV 2) Electrification of the new alignment (6.7 km)-Voltage of transmission lines will be 27.5 kV 3) Construction of two new traction substations in Namangan (Raustan) and Khakulabad, including the access roads 4) External power supply transmission line (TL) of 52km to transmit electricity to two new substations to be constructed as follows: • 110 kV TL for Khakulabad (40 km) • 220 kV TL for Namangan/Raustan (12 km) 5) Construction of Blok post new passing loop at km137 which includes: • Automobile road for passing loop (780m) • Building of Uychi Blok post • Borrow pit for construction (120m)

5. The implementation-ready Land Acquisition and Resettlement Plan (LARP) 2.1 was prepared for one of the components of the Project: External Power Supply Transmission Line (220 kV Namangan/Raustan 12km), which assessed the land acquisition and resettlement impacts of the Project based on the final design (hereinafter: LARP 2.1). The LARP complies with requirements of relevant Uzbek laws and regulations and ADB’s Safeguards Policy Statement (SPS) of 2009

and is based on the detailed measurement survey (DMS) and Census data which allowed assessing the Project’s actual impact. Figure 1 presents the Project components with applied social safeguard due diligence approach for each Project component. The LARP 2.1 was approved by ADB on 14.10.2019 and has been disclosed on ADB’s and UTY’s websites2.

6. According to the LARP 2.1, requirements of ADB’s SPS 2009 and established operational practice, the condition for the start of physical civil works is the full implementation of the final LARP 2.1 (full compensation/rehabilitation delivery) to be vouched by a compliance (completion) report prepared by UTY and acceptable to ADB. This LARP 2.1 Implementation Completion Report (CR) is covering the full implementation of LARP with demonstration of its compliance with approved LARP, as well as clear indication of issues emerged during the implementation process, including the GRM. Thus, the approval and disclosure of this CR by ADB will serve as a basis for the commencement of civil works in the concerned sections (component) of the Project.

1.2 Summary of impacts defined by approved LARP 2.1

7. The impact of the Project component in terms of land acquisition is limited to Turakurgan and Namangan districts and Namangan city. The Project component has permanent and temporary impacts in terms of land acquisition. Permanent land acquisition includes loss of trees as well as permanent impacts on agricultural land within the permanent area for installation of suspension and anchor angular towers, while temporary land acquisition includes loss of land required for construction of reinforced concrete and suspension and anchor angular towers and installation of external power supply cable which will cause of loss of trees and agricultural land due to the construction. In total 36.28 ha (1.16 ha permanent and 35.12 ha temporary) area is permanently and temporary affected due to the Project, of which 0.99 ha permanent and 27.96 ha temporary affected agricultural cultivated land and 0.16ha permanent and 6.45 ha temporary affected orchard/garden land. The number affected land users due to loss of permanent and temporary land acquisition are 50 AHs with 317 APs (AH members). The expected duration for temporary use of land plots is 1 month starting from the commencement date of civil works scheduled at the beginning of April 2021.

8. A total of 1764 numbers of fruit trees are affected due to permanent and temporary acquisition. All affected trees were evaluated by independent appraisal company while the annual harvest evaluated by agriculture department of local khokimiyats. There is a temporary impact on 1 unregistered movable greenhouse which will be dismantled and removed temporary during the construction period of 2-3 weeks in that section. No business and employment is impacted by the Project.

9. In total 50 AHs with total number of 317 APs are identified. According to impact assessment, there are no severely AHs due to permanent land acquisition, as well as no vulnerable AH affected by the Project. The summary details on various impacts defined by approved LARP are shown in Table 1 below.

1.3 Legal Framework and Entitlements for Compensation

10. The legal and policy framework of the Project is based on national laws and legislations related to land acquisition and compensation policy in Uzbekistan, and ADB’s Safeguard Policy Statement 2009 (SPS). Based on the analysis of applicable laws and policies and ADB’s Policy requirements, Project related land acquisition and resettlement (LAR) principles have been adopted. APs entitled for compensation or at least assistance provisions under the Project are (i) All APs losing land either covered by legal title/traditional land rights, legalizable, or without legal status; (ii) Tenants and sharecroppers whether registered or not; (iii) Owners of buildings (as and when applicable), crops, plants, or other objects attached to the land; and (iv) APs losing business, income, and salaries.

11. Compensation eligibility is limited by a cut-off- date which is the start of final AP Census during the detailed measurement survey, following the detailed design. The cut-off-date has been communicated to APs by the UTY prior to the start of final AP census survey. APs who settle in the affected areas after the cut-off date are not be eligible for compensation. The Entitlement matrix of the LARP is attached in Annex 2.

2 MONITORING OF LARP 2.1 IMPLEMENTATION

2.1 Monitoring objective and scope

12. LARP implementation is routinely be monitored internally by the UTY (PIU) with outcomes reported to ADB in relevant Completion Reports (CR), as well as in Semi-annual social monitoring reports (SSMR). The key objective is to ascertain the compliance of full LARP implementation, including the delivery of compensation and allowances, consultation and grievance redress. The CR contains: (i) accomplishment to-date, (ii) proof of compensation, (iii) problems encountered, grievances received and addressed, consultations carried out during the implementation.

13. An international consulting firm (Italferr) has been engaged by the PIU as a Project Management and Supervision Consultant (CSC). The scope of CSC services is extended with involvement of international and national resettlement specialists (IRS and NRS) who will provide overall assistance to PIU in managing and implementing the Project and ensuring safeguards compliance with the Project implementation plan, the loan agreement, and the Project agreement(s) in terms of social safeguards and resettlement, particularly in implementation and monitoring of LARPs, including the preparation of LARP implementation Compliance Reports (CR), Semi-annual Social Monitoring Reports (SSMR) and other required progress reports under the Project.

2.2 Internal Monitoring Methodology

14. Fulfillment of the LARP policy and targets in the implementation process has been monitored through setting up indicators. The vital indicators monitored include the contents of the activities and entitlement matrix. The LARP contains indicators for achievement of the objectives under the resettlement program. The indicators for achieving the proposed objectives during the implementation of the LARP are of two types: (i) Process Indicators (indicating Project inputs, expenditure, staff deployment, etc.) and (ii) Output Indicators (indicating results in terms of numbers of APs compensated, and assistances provided. The monitoring indicators applied for the monitoring of LARP implementation are presented in Table 2 below.

15. Internal monitoring data has been collected through the following methods: (i) Desk review and verification of census and entitlement data for the APs during and as a result of implementation; (ii) Desk review and verification of delivery of compensation to all AHs in payment orders with the amount defined in the LARP (iii) Consultation and informal interviews with APs; (iv) The grievance redress register; (v) Desk review of other related documents; and (vi) Direct field observations.

3 LARP 2.1 IMPLEMENTATION PROCEDURES AND RESULTS

3.1 LARP Implementation Preparatory activities

16. LARP implementation has actually started at the end of August 2019 and completed by the end of January 2021. Prior the LARP implementation, the following preparatory activities were carried out by the UTY (PIU) within the LARP implementation:

(i) Disclosure of approved LARP on Project’s (UTY’s) website3.

(ii) Disclosure of final approved LARP in affected districts via khokimiyats: UTY sent an official letter to Namangan province khokimiyat by indicating the link to the webpage of disclosed final LARP 2.1 in two languages Russian and English for their information and dissemination in affected districts. (iii) Communication of the compensation data with khokimiyats: Official letters have been sent to khokimiyats with provision of data on compensation packages for each AH defined by LARP. (iv) Consultations with khokimiyats regarding the allocation of relevant budget and procedures for the compensation delivery, (v) Preparation of notification letters and face to face notification to each AH regarding the defined compensation amount. (vi) Preparation of information leaflets for the notifications to each AH.

3.2 Payment of Compensation

3.2.1 Payment of Compensation for Land Development Cost, Loss of Profit, Trees and Loss of Harvest from Trees

17. The LARP implementation cost estimate includes the following:

(i) Land development cost, which was calculated by Agricultural Department of Turakurgan and Namangan districts; (ii) Compensation for income loss (lost profit) from crop due to permanent and temporary land acquisition which was evaluated by agricultural department of local khokimiyats; (iii) Compensation for affected trees for permanent and temporary land acquisition which was evaluated by independent appraisal company; (iv) Compensation for affected trees harvest due to permanent and temporary land acquisition which was evaluated by agricultural department of local khokimiyats

18. The compensation for the land development cost amounts to 74,062,145 UZS and will be paid by UTY to the Government special account. As a result of LARP implementation, in total compensation of 718,451,703 UZS has been paid to all 454 AHs as defined by LARP, out of which 374,852,400 UZS compensation for loss of profit to 14 AHs, 107,724,803 UZS for trees and 235,874,500 UZS for loss of harvest from trees to 34 AHs. The breakdown of implementation results per type of losses are provided in table 3 below. The payment orders (proof of compensation payment) are provided in Annex 1 of this CR.

4 5 AHs of 50 AHs haven’t used the land plots, those are empty lands as of cut-off date, out of which 4 were temporary affected (rows 16, 42, 44, 47) and 1 was permanently (row 48) affected for which only land development cost was calculated. However, they were considered as AHs and were included in the LARP table. 9

* 17,188,400 UZS compensation for loss profit of this AH was missed in the LAR budget due to an absence of valuation data, but it was completed and paid during the implementation process.

19. In order to transfer the compensation directly to AHs the khokimiyat has obtained the existing bank accounts of AHs and approved list of APs/AHs with compensation size has been sent to the Bank for transfer.

20. The civil works will be started upon of approval of this completion report. It is scheduled to complete civil works on permanently affected land plot within 1 month. However, it should be noted that all AHs having an impact on temporary affected land plot were allowed to cultivate their land plot, i.e. sow them and gather the harvest during the whole 2020. At the end of the March 2021 UTY will inform to all temporary affected AHs through phone calls about commencement 11

date of civil works which are scheduled to be completed at the end of April 2021. The social safeguard specialist of CSC will support to UTY in monitoring of the whole process to ensure that all AHs are properly informed about the dates of temporary using and returning land plots to them by Contractor.

21. No land for land was provided taking into account the small scale of permanent impact of the Project: the minimum permanent impact is 0.01 % in from the total land holdings and maximum is 0.19% in Namangan city. During the public consultation, the farmers informed that they are not interested to be given a small part of lands as the cultivation of those small portions will not be economically viable for them in terms of mobilization of equipment and workforce.

4 PUBLIC CONSULTATIONS AND INFORMATION DISCLOSURE

22. Upon the completion of LARP implementation preparatory actions, consultation and assistance were given to each APs in all legal and organizational issues related to their entitlements, land allocation procedures, relocation and compensation payment. The notification letters to each AH regarding the defined compensation amount has been carried out by UTY.

23. Together with the notification letters, also the LARP Information brochure has been provided to each AP. Besides, the contacts of focal persons from UTY and Italferr (CSC) were distributed among APs to ensure a prompt communication.

5 GRIEVANCE REDRESS MECHANISM

24. The GRM has been established prior the start of LARP implementation. The details on GRM with contact details have been posted in khokimiyat’s administration offices and every train station office between Pap-Namangan-Andijan upon start of LARP implementation. There were no written or verbal complaints registered during and after completion of the LARP implementation.

6 CONCLUSIONS

25. The desk review and field visit suggest that in general, LARP 2.1 implementation is fully completed in accordance with provisions set in LARP and with satisfaction of APs.

26. The impacts have been fairly listed and compensated for affected assets. The compensation costs have been paid as per LARP eligibility. In total 50 AHs received 718,451,703 UZS compensation which were paid through bank transfers by the end of January 2021.
