This is being done on behalf of The Association for Diplomatic Studies. I am Charles Stuart Kennedy. J.D. and I are old friends. We are going to include your biographic sketch that you included at the beginning, which is really quite full and it will be very useful. I have a couple of questions to begin. While you were in high school, what was your interest in foreign affairs per se? I know you were talking politics with Mr. Frank Humphrey, Senator Hubert Humphrey's brother, at the Humphrey Drugstore in Huron, South Dakota, and all that, but how about foreign affairs? BINDENAGEL: I grew up in Huron, South Dakota and foreign affairs in South Dakota really focused on our home town politician Senator and Vice President Hubert H. Humphrey. Frank, Hubert Humphrey's brother, was our connection to Washington, DC, and the center of American politics. We followed Hubert's every move as Senator and Vice President; he of course was very active in foreign policy, and the issues that concerned South Dakota's farmers were important to us. Most of farmers' interests were in their wheat sales, and when we discussed what was happening with wheat you always had to talk about the Russians, who were buying South Dakota wheat.

PUBLIC LAW Constitutional Drift: Toward the End of Federal Shop- Closing (Ladenschluss) Regulation By Craig T. Smith* A. Introduction Germany’s Federal Constitutional Court held on June 9, 2004, that the weekend and holiday closing requirements of the federal Shop-Closing Act (Ladenschlussgesetz) are compatible with the Basic Law.1 At the same time, however, the Court’s deci- sion in this Weekend Shop-Closing Case situated the Act’s Saturday closing require- ment – and by implication its weekday closing requirements too – perilously close to the brink of unconstitutionality. The Court’s First Senate accomplished this through three distinct rulings. First, it unanimously upheld the Sunday and holiday shop-closing requirements. Second, the First Senate – likewise unanimously – clarified that, under a 1994 amendment to the Basic Law, power to regulate retail shop-opening hours shifted from the federal government to the Länder. Finally, an evenly divided First Senate upheld the Act’s Saturday closing requirement, but only by virtue of the deadlock.

Abstract We study the effect of a deregulation in shop opening hours on employment in food retailing. Our identification relies on changes in restrictions of business hours across German states that allow for a difference-in-differences approach. Using data on the universe of German establishments, we find that lifting restrictions on business hours increases total employment modestly. This effect is driven by an increase in part-time employment while full-time employment is not affected.     12.2 Baden-Württemberg 12.2.1 Gesetz über die Ladenöffnung in Baden-Württemberg (LadÖG) Vom 14.02.2007 (GBl. BW, S. 135), zuletzt geändert durch Gesetz vom 10.11.2009 (GBl. BW, S. 628) § 1 Anwendungsbereich Dieses Gesetz gilt für die Öffnung von Verkaufsstellen und das gewerbliche Feilhalten von Waren. § 2 Begriffsbestimmungen (...) (3) Feiertage im Sinne dieses Gesetzes sind die gesetzlichen Feiertage. (...) § 3 Ladenöffnungszeiten (1) Verkaufsstellen dürfen geöffnet sein, soweit nicht Regelungen dieses Gesetzes entgegenstehen. (2) Verkaufsstellen müssen für den geschäftlichen Verkehr mit Kunden geschlossen sein 1. an Sonn- und Feiertagen, 2. am 24. Dezember, wenn dieser Tag auf einen Werktag fällt, ab 14 Uhr. (3) Während der Ladenschlusszeiten nach Absatz 2 ist auch das gewerbliche Feilhalten von Waren zum Verkauf an jedermann außerhalb von Verkaufsstellen verboten. Soweit für Verkaufsstellen nach diesem Gesetz oder den hierauf gestützten Vorschriften Abweichungen von den Ladenschlusszeiten nach Absatz 2 zugelassen sind, gelten diese Abweichungen unter denselben Voraussetzungen und Bedingungen auch für das gewerbliche Feilhalten. (4) Die beim Ladenschluss anwesenden Kunden dürfen noch bedient werden. (5) Absatz 2 gilt nicht für Volksfeste, die den Vorschriften des Titels III der Gewerbeordnung unterliegen und von der zuständigen Behörde genehmigt worden sind. § 3a Verkauf alkoholischer Getränke (1) In Verkaufsstellen dürfen alkoholische Getränke in der Zeit von 22 Uhr bis 5 Uhr nicht verkauft werden. Hofläden sowie Verkaufsstellen von landwirtschaftlichen Genossenschaften, von landwirtschaftlichen Betrieben und auf Verkehrsflughäfen innerhalb der Terminals dürfen alkoholische Getränke abweichend von Satz 1 verkaufen. (2) § 3 Abs. 4 gilt entsprechend. (3) Auf Antrag der Gemeinden können die Regierungspräsidien örtlich und zeitlich beschränkte Ausnahmen vom Verbot nach Absatz 1 zulassen, wenn dabei die mit dem Gesetz verfolgten öffentlichen Belange gewahrt bleiben.

Since then, substantial deregulation of shopping hours has occurred in all states except Bavaria and Saarland. Such deregulation could support economic growth, but it has been argued to hurt small businesses. Therefore, this thesis examines different store size categories to find possible effects of deregulation in Germany. Past studies have focused on the employment effects of deregulation, whereas this investigation employs a difference-in-difference approach with OLS regression on the number of stores in each size category.
