In the beginning of the 148th meeting of SEAC, which was held on 24.10.2017 at 11:30 hrs. at the Conference Room, Paribesh Bhawan, Bidhan Nagar, the Secretary, SEAC welcome all the members. After introductory session, seven cases were discussed under Reconsideration section. Ten applicants were requested to make their presentation before the committee. All the ten applicants appeared before the SEAC for technical presentation on their respective project proposal.

SESSION I

A. Reconsideration Section:­

1. Proposed Paschim Dangapara Sand Mine Project by M/s. Sudipta Bose at Vill – Hatiagachh, PO & PS – Chopra, Dist – Uttar Dinajpur , .

Activity:

This is a proposal for river bed sand mining from the river bed of River Mahananda.

Chronology of the event: The unit presented their proposal before SEAC on 146th SEAC meeting held on 26.08.2017. The SEAC, West Bengal, made the following recommendations in the 148th SEAC meeting and subsequent response submitted on 11.10.2017 from the unit is given below :­

2. Proposed Chittal Ghata Sand Mine Project by Md. Sefiul at Vill – Nalbari, PO – Sonpurhat, PS – Chopra, Dist – Uttar Dinajpur, West Bengal.

Activity:

3. Proposed expansion of residential cum commercial complex by M/s. Riya Manbhari Projects LLP at Howrah Amta Road, PS – Domjur, Dist. – Howrah, West Bengal.

Activity:

This is a proposal for construction of a residential complex comprising of ­ Residential Blocks : 1 to 5 & Block :7 – G+7 , Block :6 – G+9, Blocks : 8,9,10,11, 12,13 ­ G+9 ; Commercial Block : B+G+5, Club Block : G+1 with Community hall, Gym, Swimming pool etc.. Total no. of flats will be 838 nos.

Chronology of the event: The SEAC recommended stipulated conditions for Environmental Clearance for the project in the 140th SEAC meeting held on 22.04.2017 and forwarded the proposal before the SEIAA on 29.05.2017. SEIAA issued stipulated conditions for environmental clearance vide No. 1314/EN/T­II­1/063/2016 dated 26.06.2017. The proponent submitted on the copy of the Master Plan and building plans sanctioned by Howrah Municipal Corporation on 21.08.2017. The case was put up for reconsideration in the 148th SEAC meeting held on 24.10.2017. After careful consideration of the documents submitted by the unit, SEAC recommended environmental clearance for the proposed project.

4. Proposed Building and construction project “The 101” by M/s. PS Vinayak Complex LLP at Mouza – Hanspukuria, JL No. – 20, Mouza – Sarmestarchak, JL No. – 17, Mouza – Daulatpur, JL No. – 79, PO – Pailan Hat, PS – Bishnupur, within Kulerdari Gram Panchayet, Dist. – South 24 Parganas, West Bengal.

Activity:

This was a proposal for construction of residential complex comprising of 10 blocks of B+G+16 storied 01 block of B+G+12 storied buildings. Total no. of dwelling units will be 1216 nos. Total land area is 30,473.48 sqm and total built up area will be 1,49,577.66 sqm.

Chronology of the event: The SEAC recommended stipulated conditions for Environmental Clearance for the project in the 141st SEAC meeting held on 13.05.2017 and forwarded the proposal before the SEIAA on 23.06.2017. SEIAA issued stipulated conditions for environmental clearance vide No. 1504/EN/T­II­1/013/2017 dated 19.07.2017. The proponent submitted the copy of the Master Plan and building plans sanctioned by Howrah Municipal Corporation on 12.10.2017. The case was put up for reconsideration in the 148th SEAC meeting held on 24.10.2017. After careful consideration of the documents submitted by the unit, SEAC recommended environmental clearance for the proposed project.

5. Proposed Residential Complex by M/s. DSK Real Estates Ltd. at 34, D. H. Road, Kolkata – 700 027, West Bengal.

Activity:

This is a proposal for construction of residential complex comprising of 1 No. of Block ­ B+G+42 and Club. Total number of residential flats will be 179 nos.

Chronology of the event: The SEAC recommended stipulated conditions for Environmental Clearance for the project in the 144th SEAC meeting held on 22.07.2017 and forwarded the proposal before the SEIAA on 07.08.2017. SEIAA issued stipulated conditions for environmental clearance vide No. 1717/EN/T­II­1/038/2017 dated 10/08/2017. The proponent submitted the copy of the Master Plan and building plans sanctioned by Kolkata Municipal Corporation on 12.10.2017. The case was put up for reconsideration in the 148th SEAC meeting held on 24.10.2017. After careful consideration of the documents submitted by the unit, SEAC recommended environmental clearance for the proposed project.

6. Proposed housing complex by M/s. Kolkata Heights Pvt. Ltd. at Mouza – Madurdaha, Ward No. 108 of KMC, Kolkata – 700 099, Dist – 24 Parganas (North), West Bengal.

Activity:

This is a proposal for construction of a residential complex comprising of 2 residential blocks : Block 1: – G+XVIII & Block 2 ­ Tower 1 – G+XV, Tower 2 – G+XV & Tower 3 – G+XVI storied buildings. Total no. of flats will be 264 nos. Total land area is 13353.26 sqm and total built up area will be 40479.39 sqm.

Chronology of the event: The SEAC recommended stipulated conditions for Environmental Clearance for the proposed project in the 143rd meeting held on 03.07.2017 and forwarded the proposal before the SEIAA on19.07.2017. SEIAA considered the proposal in their meeting held on 09.08.2017 and examined the recommendations of SEAC and submission of the project proponent. SEIAA noted that the land documents submitted by the project proponent identify land character of project area as “” i.e. water body. The SEIAA forwarded the proposal back to SEAC for review. The letter of SEIAA dated 18.08.2017 was considered by the SEAC in the 146th meeting held on 26.08.2017 and the committee requested the project proponent to submit land conversion certificate from the competent authority for the proposed project. The case was referred to Hon’ble NGT. Hon’ble NGT directed SEAC to dispose off the application within six weeks of the date of application. While deciding, Hon’ble NGT directed the SEAC to take into consideration the judgement of the Hon’ble Calcutta High Court dated 20.05.2016 in No. M.A.T. No. 134 of 2016 and M.A.T. No. 22 of 2016. The case was placed for reconsideration in the 148th SEAC meeting held on 24.10.2017. the matter was reconsidered and SEAC recommended the case to SEIAA for issuance of stipulated conditions for Environmental Clearance.

7. Proposed expansion (Phase­2) of Residential Complex “Mani Casadona” by M/s. Magus Bengal Estates LLP at Plot No. IIF/04, Action Area – II, New Town, PS – Rajarhat, New Town, Kolkata Development Authority, Dist – 24 Parganas (North), West Bengal.

Activity:

This is a proposal for expansion of Phase 2 of Residential Complex “Mani Casadona” involving construction of one B+G+ 23 residential blocks. Total no. of flats in proposed expansion (Phase 2) is 176. Total Land area in Phase 2 is 1.32 acres. (In phase 1 total land area is 11.68 acres; total land area for phases 1 & 2 is 12.99 acres). Total built up area in phase 2 is 24877.40 sqm (Total built up area in phase 1 is167787.66 sqm; total built up area for phases 1 & 2 is 192665.06 sqm). Project profile of Phase 1 comprises of 2 Office Blocks ­ LB+UB+G+16 and UB+G+16 storied building. MLCP – UB+G+5 & Club – LG+UG+1 (Construction phase).

Chronology of the event: The project proponent presented their proposal for Terms of Reference presentation in the 129th SEAC meeting held on 13.09.2016 and the SEAC recommended the ToR vide letter dated 04.10.2016. The project proponent submitted the final EIA/EMP report on 03.04.2017. The project proponent presented their proposal for final EIA in the 140th SEAC meeting held on 22.04.2017. The SEAC recommended stipulated conditions for Environmental Clearance for the project in the 140th SEAC meeting held on 22.04.2017 and forwarded the proposal before the SEIAA on 25.05.2017. SEIAA issued stipulated conditions for environmental clearance vide No.1313/EN/T­II­1/055/2016 dated 26.06.2017. The proponent submitted the copy of the sanctioned Master Plan and building plans on 23.08.2017. The case was put up for reconsideration in the 148th SEAC meeting held on 24.10.2017. After careful consideration of the documents submitted by the unit, SEAC recommended environmental clearance for the proposed project.

1. Proposed Residential development by M/s. Lakshmi Group of Realty Pvt. Ltd. & Others at Mouza – Takdari, JL No. 19, PS – New Town, Mahishbathan under Bidhannagar Municipal Corporation Kolkata – 700 102, West Bengal.

Activity:

This is a proposal for construction of residential development project comprising of 10 blocks each G+20 storied & MLCP – G+6. Total number of dwelling units will be 969 nos.

Chronology of the event: The Name of the Environmental Consultant is M/s. Ghosh Bose & Associates Pvt. Ltd. The case was put up for consideration in the 148th SEAC meeting held on 24.10.2017. After carefully considering the submission by the project proponent and presentation, SEAC recommended stipulated conditions for environmental clearance for the proposed project.

2. Proposed Business Building Garment Park by M/s. West Bengal Industrial Development Corporation Ltd. at Budge Budge, Dist – 24 Parganas (South), West Bengal.

Activity:

This is a proposal for a Commercial Building comprising 4 nos. SDF = G+7 storied, 1 no. CFB = G+3 storied building. Total built up area is 67823.31 sqm. and Land area is 39087.27 sqm.

Chronology of the event :

Name of the Environmental Consultant is M/s. JB Enviro Consultants Pvt. Ltd. The case was put up for consideration in the 148th SEAC meeting held on 24.10.2017. SEAC scrutinized the documents and presentation made by the unit in the 148th SEAC meeting held on 24.10.2017. After careful consideration of the submission & detailed discussion, the committee recommended that the project proponent should submit the following: i. At least 2.5% of total project cost should be utilized on Enterprise Social Commitment programme as suggested in the meeting. Specific proposal in this regard should be provided accordingly. ii. Micro climatic study of the project area delineating the exclusive tree plantation area ensuring that the plantation area does not fall under the shadow zone. iii. Specific proposal for disposal of solid waste generated during demolition of existing structure as per the provisions of the Construction and Demolition Waste Rules, 2016. iv. CRZ Clearance from the Competent Authority. It has been decided that the case will be further considered only after submission of the necessary clarification/information/documents.

This is a proposal for construction of 10 blocks of B+G+16 storied residential project. Total no. of flats is 704 nos. Total Built up area is 100817.67 sqm. and Total land area is 27882.71 sqm.

Chronology of the event : Name of the Environmental Consultant is M/s. Ghosh, Bose & Associates Pvt. Ltd. The case was put up for consideration in the 148th SEAC meeting held on 24.10.2017. SEAC scrutinized the documents and presentation made by the unit in the 148th SEAC meeting held on 24.10.2017. After careful consideration of the submission & detailed discussion, the committee recommended that the project proponent should submit the following: i. Mutation certificate issued by the Competent Authority under section 50 of the WBLR Act, 1955 and permission for conversion of land issued by the Competent Authority under section 50 of the WBLR Act, 1955 ii. NOC from the Competent Authority under the Urban Land (Ceiling & Regulation) Act, 1976. iii. At least 2.5% of total project cost should be utilized on Enterprise Social Commitment programme as suggested in the meeting. Specific proposal in this regard should be provided accordingly. iv. Mechanism for disposal solid waste; including agreement with the Competent Authority. v. Drainage mechanism for disposal of waste water and storm water including agreement with the Competent Authority vi. Layout plan clearly demarcating location of STP, rain water harvesting facility and compost plant to be provided. vii. Micro climatic study of the project area delineating the exclusive tree plantation area ensuring that the plantation area does not fall under the shadow zone. It has been decided that the case will be further considered only after submission of the necessary clarification/information/documents.

4. Proposed expansion of the building complex “Atmosphere” by M/s. Forum Projects Pvt. Ltd. at Plot No. 1001/A, EM Bypass, Mouza – Purba Topsia, JL No. 7, PS – Tiljala, Kolkata­700 046, West Bengal. Activity: This is a proposal for expansion of residential project comprising of 2 blocks of B+G+37 storied building. Total built up is 49615.45 sqm. and Land area is 12139.93 sqm. Total No. of flats is 80 nos.

Chronology of the event : Name of the Environmental Consultant is M/s. Ghosh Bose & Associates Pvt. Ltd. The case was put up for consideration in the 148th SEAC meeting held on 24.10.2017. 5. Proposed expansion of Residential Complex “Ideal Aurum” by M/s. Exult Realty Pvt. Ltd. at Mouza – Kumrakhali, JL no. 48, PS – Sonarpur, Ward No. 27 of Rajpur­Sonarpur Municipality, Dist ­ South 24 Parganas, West Bengal Activity:

This is a proposal for expansion of Residential complex comprising of 5 nos. of Blocks of G+15 storied building. Earlier phase comprising built up area 45066.67 sqm. granted EC by SEIAA. Now the project proposing to consuming the maximum permissible FAR i.e. 2.2489 resulting total built up area increasing to 49776.90 sqm. and the building now becoming Wing 1 = G+14, Wing 2, 3, & 4 = G+15 (previously B+G+14), Wing 5 = G+15 (previously B+G+11) and Club House = B+G+2 (Previously G+2). Total Land area is 17186.997 sqm. Total no. of flats are 444.

Activity: This is a proposal for Office Building comprising of 1 block of 2B+G+8 storied building. Total Built up area is 36537.85 sqm. and total land area is 10117.63 sqm. Chronology of the event : Name of the Environmental Consultant is M/s. Ghosh Bose & Associates Pvt. Ltd. The case was put up for consideration in the 148th SEAC meeting held on 24.10.2017. SEAC scrutinized the documents and presentation made by the unit in the 148th SEAC meeting held on 24.10.2017. After careful consideration of the submission & detailed discussion, the committee recommended that the project proponent should submit the following: i. 7. Presentation of Terms of Reference for the proposed capacity expansion of Uluberia LPG Plant by M/s. Bharat Petroleum Corporation Ltd. at Birshibpur, West Bengal. Activity: This is a proposal for capacity expansion of Uluberia LPG Plant. Chronology of the event : The case was put up for consideration in the 148th SEAC meeting held on 24.10.2017. After carefully considering the submission by the project proponent and presentation, SEAC recommended ToR (Annexure – A) for preparing draft EIA/EMP reports.

8. Proposed Sand Mining project at river bed of Kangsabati River by Shri Bhim Midday at JL No. 136, Mouza Lohatikril, PO – , Paschim Midnapore, West Bengal. Activity: This is a proposal for sand mining project of Sand extraction of 50000 MT / annum in 15.0 acres of 6.07 Ha. Chronology of the event : Name of the Environmental Consultant is M/s. Cognizance Research Pvt. Ltd. The case was put up for consideration in the 148th SEAC meeting held on 24.10.2017. The environmental consultant for the project could not provide necessary documents of accreditation for functional area experts. Therefore, the presentation was not allowed by the SEAC.

9. Proposed Sand Mining Project by Sri Panchanan Kar at JL No. 137, Plot No. 211, 271(p), on Kangsabati River, Mouza – Jamsole, PS – Kotwali, Dist – Paschim Midnapore, West Bengal. Activity: This is a proposal for Sand Mining Project of capacity 1000000 CFT/annum in 10.55 acres or 4.26 Ha. of Land. Chronology of the event : Name of the Environmental Consultant is M/s. Cognizance Research India Pvt. Ltd. The case was put up for consideration in the 148th SEAC meeting held on 24.10.2017. As the mining lease area is less than 5 Ha., therefore, does not fall under the purview of the SEAC.

10. Proposed Monipur Clay Mine project by Sri Nepal Chandra Das, M/s. Monipur Clay Mines at Mouza – Monipur JL No. 1, PS – Taldangra, Dist , West Bengal. Activity: This is a proposal for Clay Mine project of capacity 5670 MT/year and the Lease Area is 7.80 Ha.

SEAC scrutinized the documents and presentation made by the unit in the 148th SEAC meeting held on 24.10.2017. After careful consideration of the submission & detailed discussion, the committee recommended that the project proponent should submit the following: i. Copy of the latest mining plan approved by the Competent Authority. ii. Total water requirement for the entire project and its availability and the provisional source approved by the Competent Authority. iii. Detailed mine closure plan approved by the Competent Authority. iv. EMP to be resubmitted, specifically detailing afforestation programme and green development as per the statute, proper waste management including mine spoils and overburden, mine backfill programme etc.. v. The no. of ambient air quality monitoring stations proposed to be set up. vi. At least 2.5% of total project cost should be utilized on Corporate Social Responsibility programme as suggested in the meeting. Specific proposal in this regard should be provided accordingly. vii.Terrestrial biodiversity protection plan to be provided. viii. Provide certificate of arrangement with local public /private hospitals/health care units within 5 Kms. of the site for workers' health, safety and emergency. It has been decided that the case will be further considered only after submission of the necessary clarification/information/documents.
