1. Overview

1.1. Project overview

Altay Municipal Infrastructure and Environmental Improvement Project consist of five components distributed in five counties respectively: Burqin County, ,

Hanahe County, Jimunai County and Qinghe County. These components include road construction, water supply, and sewage treatment, refuse disposal, and central heating. 5 roads will be built in the county town, with a total length of 5,600.26m, Road including a primary road of 618.32 m and 4 secondary roads of 4,981.94m, Construction which will be provided with lighting, landscaping and traffic marking facilities, and maintenance equipment. Water A new water supply network of 4,420m will be built; in which dn400 are Supply 1,440m long, dn300 1,880m long and dn200 2,300m long. An 8,000m3/d sewage treatment plant (an access road of 0.8km and a 10KV Hanahe power line of 3.0km) and a drainage network of 15,660m will be built, in Drainage County which DN300 is 7,730m long, DN400 710m long, DN500 520m long, DN600 1,490m long and DN800 5210m long. A 60t/d refuse disposal plant and operating equipment, dustbins (420) and Refuse refuse collection points (60) will be built; an access road of 1.0km improved; Disposal a 10KV power line of 4.0km built for the refuse disposal plant. 4 heating stations and a primary heating network of 2,461m (one-way) will be Central built, in which DN250 is 1,827m long, DN300 134m long and DN400 500m Heating long. 1.2 Total Project Investment and Construction of the Project

The total investment of the project construction is 975.43 million yuan, the ADB loan is $100 million, and the rest is counterpart funds of local government. Subtotal 14984.91 Total 97543.07 According to the project implementation schedule, the implementation would start from 2012 and end in 2017; the project has to take 2 years for project preparation, mainly to complete the project preparatory work; and the project implementation period is five years (2012 to 2017). The implementation for this project would start from 2012 and end in

2017;and the implementation is divided two phases; the first phase is project preparing period, which would cost 2 years (2009 to 2010), mainly to complete the project preparatory work, such as project approval, survey and design, environmental assessment, loan negotiations and other preparatory work; the second phase is implementation period which is five years(2012 to 2017) to complete the construction of road component,, sewage treatment component, refuse disposal component, central heating component. The project will be completed construction and put into use by the end of 2017.

1.3 Independent External Monitoring for Involuntary

Resettlement

Xinjiang Branch of Sichuan Jingdu Junyi Engineering Consultation Company is responsible for the independent external monitoring and evaluation of involuntary resettlement.

2. Impact Scope

2.1. Impacts of Land Acquisition

Subprojects of five counties totally affect one state-owned farm, three township/town,

7 communities, 12 villages, 1080.87 mu collective land, permanently acquired 1319.49 mu state-owned land, 66 HHs with 376 APs were affected. During the construction period,

852.14 mu of land was temporarily expropriation, including 667.29 mu of collective land and 184.85 mu of state-owned land. Details will see in table 2-1. The land effect mainly caused by road project, the new water supply factory, sewage treatment factory and refuse disposal project. The collective land acquisition affect 23

HHs with 78 APs, acquire collective land for 261.86 mu, including cultivated land for 4.55 mu, affect 15 HHs with 59 APs, including minority 1 HHs with 4 APs. Acquire grassland for

86.38 mu (third grade first class) of the herdsman in Halagou Village, affect 6 HHs with 10

APs, all of them are Kazak. Acquire grassland for 127.5 mu (third grade first class) in

Hatai Village, affect 1 HHs with 3 APs, all of them are minority. Acquire grassland for 43.43 mu of the herdsman in Eerqisi Village, affect 1 HHS with 6 APs, including first grade first class grassland for 8.84 mu, first grade fourth class grassland for 33.31 mu and first grade fourth class grassland for 1.28 mu.

The construction of the water supply pipeline temporarily occupy forest land for 6

164.39 mu, including state-owned desert forest for 143.23 mu, with no affected people; farmers forest (Poplar trees,collective land) for 21.25 mu, affect 2 HHs with 6 APs, all of them are Kazak; temporarily occupy grassland for 646.14 mu (including first grade first class grassland for 123.75 mu, first grade third class grassland for 227.25 mu, third grade first class grassland for 115.13 mu, second grade fourth class grassland for 180 mu), affect 16 HHs with 47 APs, all of them are Kazak.

Acquire state-owned residential land for 9.65 mu, including acquired 3.25 mu state-owned residential land, affect 3 HHs with 8 APs, minority people 2 HHs with 6 APs.

The affected people in the state-owned residential land will be included in the HD affected people.

2.1.2. Habahe county

The project acquired totally 482.17 mu land, including acquired 194.46 mu state-owned land for road subproject, state-owned residential land for 5.71 mu; refuse disposal subproject acquire grassland (second grade fourth class) for 174 mu, the sewage treatment factory acquired for grassland (second grade fourth class) for 108 mu. In addition, the refuse disposal subproject acquired grassland (second grade fourth class) for 156.9 mu for the long-term construction and no not involved in the totally LA amount.

The road subproject in this project acquired state-owned cultivated land, affect 46 staffs(counted as 0 HH with46 Aps )in the state-owned farms, including 19 in-service staffs and 27 retired staffs. The sewage treatment subproject permanently acquisition affect 1 HHs with 9 APs. The refuse disposal permanently acquisition affect 4 HHs with 37

APs, temporarily occupation affect 48 HHs with 210 APs.

2.1.3. Jimunai county

The acquisition for the collective land in the project was caused by refuse disposal subject and sewage treatment subproject. Permanently acquire collective land (grassland for herds) for 356 mu, affect 1 HHs with 6 APs, including acquire 78.3 mu (third grade eighth class) collective grassland for sewage treatment subproject in Wulasite Village,

Tuoputiereke Township, with no affected people. The construction of refuse disposal needs to occupy collective grassland (third grade seventh class) for 277.7 mu in Halahaile

Village (waste yard for 262.05 mu, assesses route for 15.75 mu), affect 1 HHs with 6 APs, all of them are minorities. In addition, the sewage treatment project acquired grassland

(third grade eighth class) for 126.6 mu both short-term and long-term, but this project occupied collective grassland (third grade eighth class) only 78.3 mu, and the long-term sewage treatment acquired construction land (third grade eighth class) do not involved in this project.

The permanently occupation of state-owned land was caused by road subproject,

77.52 mu (natural pasture) state-owned unused land was acquired, which belongs to

Tuoputiereke Township. In addition, road construction acquired state-owned construction land for 67.83 mu, and will not involve in LA affect for it is now highway land.

2.1.4. Qinghe county

All subprojects in Qinghe county acquired 244.56 mu land, including 180.21 mu collective land, 34 households with 192 people were affected; 64.35 mu state-owned land, without affected people. Table 2-2 Land acquisition impact of the project

22.49 mu, affect 2 HHs with 6 APs, all of them are Kazak.

The water supply project of Takeshiken Township will acquire for 5.45 mu grassland

(first grade first class grassland for 3.64 mu, third grade second class grassland for 1.81 mu), affect 1 HHs with 4 APs, all of them are Kazak. In addition, the Takeshiken Township

water supply project covers an area of 5.45 mu of grassland. After PMO consultation with the affected people in the location of the water supply factory, the affected people requested that they would not agree with the PMO if the location of the water supply factory do not acquired all of the grassland. So the PMO agreed with the request provided by the affected people in the water supply project of Takeshiken Township. 10.22 mu grassland (first grade first class grassland with 3.64 mu, third grade second grassland for

1.81 mu) was expropriation by the location of water supply project in Takeshiken Township.

The construction of the project will acquire 5.54 mu grassland (first grade first class grassland with 3.64 mu, third grade second grassland for 1.81 mu), the remaining 4.77 mu grassland (first grade first class grassland with 3.33 mu, third grade second grassland for

1.44 mu) do not involved in this project.

The drainage project of Takeshiken Township will acquire third grade second class grassland for 52.33 mu, affected 2 HHs with 7APs, all of them are Kazak. In addition, the actual area of the drainage project in Takeshiken Township is third grade second class grassland for 52.33 mu. After PMO consultation with the affected people in the location sewage treatment factory, the affected people requested that they would not agree with the PMO if the location of the water supply factory do not acquired all of the grassland. So the PMO agreed with the request provided by the affected people in the sewage treatment project of Takeshiken Township. The location of the sewage treatment factory in

Takeshiken Township will acquire third grade second class grassland for 182 mu, with

2HHs. The construction of the project will acquire 52.33 mu grassland (third grade second grassland), the remaining 129.67 mu grassland are not involved in this project.

The land area of the refuse disposal project covers in 72.75 mu (including the access route), affect 20 HHs with 134 APs. In addition, the Qinghe PMO reserved grassland for

77.25 mu (second grade fourth class) for the long-term construction after the consultation with the affected people. The refuse disposal project acquired only 72.75 mu land, the reserved long-term construction land was not involved in this project. The water supply project of Qinghe County acquired grassland for 72 mu (first grade first class) in Buhaba village, Arele township, Qinghe county, affect 3 HHs with 14 APs.

The sewage treatment factory of subproject sewage treatment project in Qinghe

County acquired state-owned desert forest for 64.35 mu, with no affected people. The access route of the sewage treatment factory will occupy grassland for 11.91 mu (first grade third class), affect 6 HHs with 27 APs, all of them are Kazak.

2.2. Impacts of House Demolition

In five counties, houses with an area of 5103.22m2 were demolished, and 30 households with 104 people were affected. See Table 2-3 in details. 2.2.1. Burqin county

Demolition of houses caused by road component of Shuanghubei Road and

Baihuayuan Road, HD and compensation for Shuanghubei Road have been completed in

2.2.2. Habahe county

3008. 02 m2 urban houses (14 families with 43 people) of two communities affected by demolition of road component (Jiefang East road community, Jiefang Middle road community) are to be demolished. The brick-concrete structure covers 200.76 m2 (6.67%), brick-wood 896.53 m2 (29.8%), civil structure 1190.82 m2 (39.59%), simple brick-wood

94.59 m2 (3.15%), simple civil structure 520.31 m2 (17.3%), and shed 105.01 m2

2.2.3. Jimunai county

Road subproject has changed, the construction of Guanghui street, Xingfu street and

Caigang street (western part of flood ditch) has been canceled, and house demolition has been canceled as well;

Waste disposal treatment has been completed and put into use, house demolition has been completed. Temporary house with an area of 180 m2 and sheepfold with an area of 300 m2 of 1 household with 6 people in Halahaile village has been demolished. The distribution of HD compensation has been completed on September 30, 2011, compensation with a total of 0.38 million yuan.

After project alteration, heating project generated no house demolition, but the house demolition caused by the original plan has been completed, and the actual area of house demolition is 1121.03 m2, affected people for 11 households with 48 members.

2.2.4. Qinghe county

House demolition is caused by Ta town and county road subproject heating projects.

Up to August 2013, all the HD resettlement and compensation work has been finished.

Up to this monitoring, we found that 700.45 m2 residential houses had been demolished, affected 6 HHs with 25 people, including 150m2 of housing demolish area in

Ta Town, affected 1HH, with 4 people; 550.45m2 of housing demolish caused by county heating component, affected 5 HHs, with 21 people, compared with last monitoring the HD area and affected population has no changes. (See table 2-7) Table 2-6 Residents’ Housing Demolition

3. Project Compensation Standard

3.1. Compensation Standard of LA

3.1.1. Burqin county

1) Compensation standard for grassland

After grassland supervision of the assessment, the occupied grassland for water supply projects, waste disposal and drainage components can be divided into class1 grade1, class3 grade1, class4 grade1, class 4 grade2 and class 4 grade3. Each base level of compensation, the compensation ratio and the standard shown in Table 3-1.

The actual grassland acquisition compensation standard executed is higher than planed standard in the RP. This is because that the standard in the RP was planned in accordance with Notice on the new price [1999] No.3 and New Development and Reform

[2005] No.1138 issued by Autonomous Regional Development Planning Committee and the Finance Department. The actual compensation was paid according to the new standard of Notice on the adjustment of grassland compensation and resettlement subsidy New Development and Reform [2010] NO.2679 issued by Xinjiang Uygur

Autonomous Region Development and Reform Commission and the Finance Department.

2) Compensation standard for cultivated land

Cultivated land was new type of land acquisition identified during the land acquisition

process before the implementation of project in 2014. Provisions "agreed autonomous unified annual output value of land approved" (Deal Han [2010] No. 323) of arable land compensation standard file compensated in accordance with the autonomous region, shown as table 3-2.

The occupied arable land was mainly for vegetables, Burqin County Land and resource Bureau assessed the occupied arable land are class 1, according to quality grading standards; Since the land for Vegetable fieldVegetable fieldVegetable field is affected by the main source of family life and vegetables, land acquisition will enable the residents to lose this source, resulting in increased cost of living, the PMO and the families affected by the vegetable field after the consultation, the compensation should be 3 times of annual output (ie 4500 yuan / mu), and give 8200 yuan per mu as the landless subsidy, which determines land acquisition compensation standards are as follows (see Table 4-3):

3) Compensation standard for forest

Forest land was also new type of land acquisition identified during the land acquisition

process before the implementation of project in 2014. For the occupied state-owned forest

land, according to " approval on occupation of forest land management practices audit "

issued by Xinjiang Uygur Autonomous Region, occupation and expropriation of land units

apply woodland compensation fee, trees compensation fee, and Forest compensation,

resettlement subsidies and forest vegetation recovery fee (temporary resettlement

subsidies covering exempt)are required to pay compensation to the people's governments

of forestry authorities above the county level, According to the "notice on published on

the implementation of autonomous unified annual output value of land acquisition"

(issued by Xinjiang L&R and DRC [2011] No.19) requirements Office of Land and

4) Compensation standard for state-owned land

The Project is a public program, where state-owned land will be acquired by allocation. The compensation standard did not alter.

For the allocated state-owned land, land use rights will be acquired by paying leasing fees at a rate of 8-15 yuan/m2. The Project will involve acquisition of state-owned land within and out of the built-up area of Buerjin County, and the compensation rate is 15

yuan/m2 within the built-up area and 8 yuan/m2 out of the built-up area; for land out of the built-up area to be occupied by the Project, the land and resources authority will further collect leasing fees for construction land. According to Attached Table 1 of Document

[XJJF (2001) No.500] (Collection standard of leasing fees for new construction land of

XUAR), the rate of leasing fees for construction land of Qinghe County is 7yuan/m2.

For the state-owned land occupied by enterprises and institutions, it is necessary to pay compensation for getting the use right according to benchmark land prices. Present benchmark land prices of Buerjin County are shown in table 3-6.

(1) Collective land

The actual grassland compensation standard is consistent with the updated RP

(updated on 2011.10).The grassland compensation was stipulated based on Article 39 of the Grassland Law of the People's Republic of China, Article 9, 10, and 11 of the evaluation and approval management regulations of the prairie acquisition of Agriculture

Ministry, and [2010] NO. 2679 new Document of Xinjiang Uygur Autonomous Region

Development and Reform Commission and the Finance Department. The issuance of grassland compensation and resettlement fees are according to “the notice about the charge standard related grassland supervision” [1999] NO. 3 document issued by Xinjiang

Uygur Autonomous Region Price Bureau and Finance Department. The grassland compensation should be given to the grassland supervision institution for the grassland construction. The resettlement fees are to give back to the grassland users, but the PMO put the affected people into consideration and made negotiations with grassland supervision managers, then give all the grassland compensation and resettlement fees to the affected people.

Collective land (including only grassland) acquisition was caused by waste water treatment and waste disposal treatment, the land type of collective land is grassland. The grassland acquisition of the component of the wastewater treatment in the early three years averagely produced the value of 69 yuan/mu (i.e. the basic figure of compensation:

69 yuan/mu) through the evaluation of grassland supervision institution. Grassland compensation standard is 10 times of the average annual output value of the preceding three years before land acquisition; the resettlement fee standard is six times of the average annual output value of the preceding three years before land acquisition. (See

State-owned land acquisition caused by road components, which acquired 194.46 mu state-owned cultivated land of Liangfanchang of Habahe county. State-owned land acquisition could obtain the land use right after paying land use fee according to 15 yuan/m2, since it belongs to public utilities, LRB of Habahe county allocated free of charge to the construction unit.

3.1.3. Jimunai county

1) Compensation standard for collective land (grassland)

The actual grassland compensation standard is consistent with the updated RP

(updated on 2011.10). All the grassland acquisition compensation standard for this project was executed in accordance with the article 39 of People's Republic of Grassland Law, and article9,10,11 of Prairie levy occupation Examination and Approval Management

Measures issued by the Agriculture Ministry And standards of Notice on the adjustment of grassland compensation and resettlement subsidy New Development and Reform [2010]

2679 issued by XUAR DRC, FB; grassland compensation and resettlement subsidy will be paid according to Notice on the grassland supervision related charge (the new price

[1999] No. 3) issued by Autonomous Regional Price Bureau and the Finance Department:

Grassland compensation would be used for improving herdsmen’s’ living condition and

production, employment and grasslands construction; resettlement allowance will be

returned to grassland users.

After assessed by grassland supervision bureau, the last 3 years average annual

output value of the class 3 grade 8 grassland is 50 Yuan / mu (means compensation base

standard is 50 Yuan/mu), and grassland compensation standard is 10 times of the

average annual output of last 3 years; resettlement subsidy standard is 15 times of the

average annual output of last 3 years; the last 3 years average annual output value of the

class 3 grade 7 grassland is 69 Yuan / mu (means compensation base standard is 69

Yuan / mu), and grassland compensation standard is 10 times of the average annual

output of last 3 years; resettlement subsidy standard is 6 times of the average annual

output of last 3 years; Compensation standard of the Grassland are shown in table 3-8.

For the land occupation on the state-owned land of Store Demolition Enterprises and institutions, the compensation should be paid for the land use right base on the compensation standard. Details are shown in table 3-9.

3.1.4. Qinghe county

1) Compensation standard for collective land (grassland)

This monitoring found that the compensation work of county sewage treatment had been completed in June 2015, the county drainage treatment occupied grassland

180.64mu for permanent, including class1, grade3 grassland for 79.39mu, class2, grade4 grassland for 101.25mu.

The compensation standard was upgraded in the updated RP(Updated on 2013.07), because that the Notice about the regulations on the compensation standard was changed from the new price [1999] No.3 and New Development and Reform [2005]

No.1138 to the New Development and Reform [2010] NO. 2679, in which the compensation standard is higher. Specifically, it provides as follows:

120yuan/mu, class1, grade 2 is 262.08yuan/mu, but in the requirement of the herdsmen, and negotiation with affected people, PMO decided to compensated the 11.19mu of grassland class1, grade 3 in the compensation price of 262.08yuan/mu, grassland compensation is 10 times of it, the grassland resettlement subsidy for 6 times. See Table

3-10. 3.2. Compensation Standard of HD

3.2.1. Burqin county

The actual Compensation Standard is higher than that planed in the RP, as the

Compensation Standard in original RP was formulated based on the reference of local 23

similar housing replacement price in 2009 estimated by Real Estate Appraisal Company as well as the consultation between house owners and demolishing entity. Evaluation report of House demolition in Shuanghu North Road was finished on 3 February 2013. All the contracts work and compensation distribution from 4 April 2013 to 17 February 2014.

For “Compensation Regulation on State-owned Land Acquisition and House Demolition” was enacted on 21, January 2011, the compensation rate is executed based on that which is higher than the compensation standard in the original RP. See details in Table 3-13 and

Table 3-14.

3.2.2. Habahe county

The HD only exists in road component, and the compensation and resettlement had

been finished in June 2013. The actual compensation standard was in consistent with the

updated RP(updated on 2011.10).

By the reference of local similar housing replacement price of 2010, the resettlement

housing demolition compensation established; final compensation price of demolished

houses are to go through the real estate appraisal, on-site assessment of the surveying

and mapping company, and then the affected sides consult with the housing demolition

company based on that price. Urban housing demolition compensation includes the

compensation of state-owned lands. For specific compensation standard, see table 3-15.

3.2.3. Jimunai county

The waste disposal projects acquired 180 m2 of temporary house and of, 300 m2, of

sheepfold, and on 26, September 2011, PMO signed the contract with the Halahaile

villager, which promises, according to the conditions of demolished house, to build a new

house and sheepfold for the villager, and the Jimunai county construction bureau is

responsible for that, and location of construction is up to the villager.

demolition caused by the original plan has been completed. And the actual compensation

standard was also higher than the planned standard in RP.

3.2.4. Qinghe county

House demolition was caused by Ta town and county road subproject heating projects. Up to August 2013, all the HD resettlement and compensation work has been finished.

This monitoring found that Qinghe PMO plans to remove the civil construction of heating component from the ADB loan, but the civil construction and HD work of heating component had been completed, and the HD caused by heating component, so due diligence survey should be carried out.

The actual Compensation Standard is higher than that planed in the RP, as the

Compensation Standard in original RP was formulated based on the price of housing demolition and replacement in 2009, and the compensation price was evaluated by the real estate valuation surveying and mapping company. However, on 21, January 2011, the

Notice of “Compensation Regulation on State-owned Land Acquisition and House

Demolition” was enacted, in which the Compensation Standard is higher. And the compensation rate was executed based on that as all the contracts work and compensation distribution were implemented from March to August in 2013.

4. Resettlement

4.1. LA Resettlement

4.1.1. Burqin county

(1) Compensation for grassland

Water Supply component (water purified plant building) land acquisition began in

January 2011, 43.63mu grassland was acquired from Erqisi Village, Burqin County, (8.84 mu class 1, grade 1 natural grassland, 33.31mu class 4, grade 1 spring pasture, 1.28 mu class 4, grade 1 temporary use pasture), affected 1 household with 6 people, on June 25,

2012 has paid total compensation pastures 66,800 yuan and has been distributed to the affected people.

The construction of the water supply pipeline (33.6km) involve the acquisition of forest for 164.39 mu, including state-owned desert forest 143.23 mu, famer forest (aspen) for 21.15 mu, affect 2 HHs with 6 APs, all of them are Kazak; acquire grassland for 646.14 mu, affect 16 HHs with 47 APs, all of them are Kazak, including first grade first class grassland for 123.75 mu, first grade third class grassland for 227.25 mu, third grade first class grassland for 115.13 mu, second grade fourth class grassland for 180 mu. The LA work started in March, 2014 and the compensation was paid in July, 2014 for forest and grassland, including compensation for forest with a total of 3.1466 million yuan (1.0663 million yuan for forest compensation, 1.0180 million yuan for resettlement subsidy, 47.8 thousands yuan for wood compensation, 1.0145 million yuan for the restoration for forest and send to Forestry Department), 0.9774 million yuan for grassland compensation (first grade first class grassland for 123.75 mu with 40.54 thousands yuan; first grade third class grassland for 227.25 mu with 30.90 thousands yuan; third grade first class grassland for 115.13 mu with 13.88 thousands yuan; second grade fourth class grassland for 180 mu with 12.42 thousands yuan), the compensation had been paid to the affected people.

For the temporarily occupation for grassland, Buerjin PMO had consulted with grassland supervision institute and the affected people, because the grassland had been occupied temporarily, the construction team will level the grassland once finished the construction

and the grassland would recover two years later. So the compensation will be based on the class of grassland and will be paid 6 times than the basic compensation for resettlement subsidy, the compensation will be paid totally to these herdsman.

The construction of water supple pipeline increased 5m working plane and occupied grassland for 214.5 mu (including first grade first class grassland for 41.25 mu, first grade third class grassland for 73.75 mu, third grade first class grassland for 37.5 mu, second grade fourth class grassland for 60 mu), because the working plane was added based on the original working plane, the affected people remain the same and do not calculated again. This monitoring found that PMO consulted with the affected people in October and signed the contract on November 5, 2015 and paid the compensation.

Sewage treatment plant levied 127.5 mu class 3, grade 1 grassland, impact 1 HH with 3 people, all AP are Kazakh; land acquisition began in March 2014, 183,600 yuan in total was paid to the AP in July 2014.

Refuse disposal component levied 86.38 mu class 3, grade 1 grassland, impact 6 HH with 10 people, all AP are Kazakh; land acquisition began in March 2014, 124,400 yuan in total was paid to the AP in July 2014.

164.39 mu forest lands were occupied for Burqin County water supply pipe network,

of which 107.97 mu of Forest was permanent occupation, 56.42mu was temporary

occupation. 3146598 yuan has been paid as compensation, including: forest land

compensation fee 1066304 yuan; resettlement subsidy 1017986 yuan; forest vegetation

restoration fee 1014508 yuan; Forest compensation 47799 yuan (broadleaf forest 5826

yuan, shrubbery 41973 yuan).

(1) Resettlement of collective land

The PMO put the affected people into consideration and made negotiations with grassland supervision managers, then give all the grassland compensation and resettlement fees to the affected people. Up to this monitoring, the compensation of

CNY119, 232 has offered to the affected people for108.0 mu land acquisition caused by sewage treatment component on November 9, 2012. Besides, CNY 365313.6 has offered to affected people for 330.0 mu land acquisition caused by the garbage disposal component on April 1, 2013.

(2) Resettlement of state-owned land

Up to this monitoring, the HD only exists in road component, and the compensation and resettlement had been finished in April 2011.

Because LiangFan stock breeding Farm belongs to the state-owned land and national institution, the 194.46 mu arable land of project expropriation does not belong to the Farm workers. The workers will not be paid wages before retirement, but they get 33

economic income by working on the farm. State takes back the land use rights after the workers retired and provide them retirement pay. Habahe County land department will allocate the occupied 194.46 mu state-owned land to the construction unit free, so there is no land expropriation compensation. Combined with the actual situation, to maintain social stability, harmony, promote economic and social development, the PMO made four kinds of resettlement plan for properly solving the basic life condition and long-term livelihood problems of LiangFan stock breeding Farm on-the-job workers (family members) that affected by land requisition. The four kinds of resettlement plans respectively are:

a)Job placements for on-the-job workers

In order to ensure the basic life and long-term livelihood of the 19 affected on-the-job workers, Habahe County People's Government formulated the resettlement plan. The on-the-job workers of LiangFan stock breeding Farm after land requisition are to resettle in Habahe County and give relative jobs based on their individual capacities.

b)Contract-labor placements for non- employees of LiangFan stock breeding Farm

For the retired workers of LiangFan stock breeding Farm whose land did not hand over and that planted by their children and relatives, the project arranged the contract-labor placements to them. In order not to affect the basic life and long-term livelihood of the workers’ children or relatives, Habahe County People's Government formulated the resettlement plan. The project arranged a contract-job for each child

(relative) of the retired workers of LiangFan stock breeding Farm based on the household unit.

c)Pay for the retired workers. That is, after the staff of Breeding Farm reached their retired age, they will have no right for the lands that their working institution distributed.

According to the normal procedures, the lands given back would be distributed to other people. Workers of Breeding Farm would be paid based on the standard of retirement pension according to the government rules. (Retirees’ average wage is RMB 1700)

d)Provide skills training and employment introduction

Allowed by the policy of Habahe County, this project provides free technical training to the children and relatives of LiangFan stock breeding Farm’s staff for improving their

vocational skills and employment ability, in addition to provide free professional introduction, career guidance and other services. Under the same condition, to give priority recommend to the employers. 4.1.3. Jimunai county

(1) Sewage Treatment Component

Based on the National grassland compensation standards and the new resettlement subsidy regulated by the document of Development and Reform [2010] 2679, the grassland compensation and resettlement compensation are as following:

Grassland compensation: 127mu×50yuan/mu×10 times=63500yuan

Resettlement compensation fee: 127mu×50yuan/mu×15times=95250yuan

Land acquisition commenced in march 2013, and 1 all the grassland compensation of

157800 yuan (for the 127 mu grassland) has been paid for the village.

(2) Waste Disposal Component

The grassland exploration for Waste disposal component was assessed as grassland of class 3 grade seven by grassland supervision bureau. According to the relevant documents, the grassland compensation should be given to the grassland supervision 38

institution for the grassland construction. The resettlement fees are to give back to the grassland users, but the PMO put the affected people into consideration and made negotiations with grassland supervision managers, then give all the grassland compensation and resettlement fees to the affected people, and on 30, September 2013, they got the total compensation of 306500 yuan, including 191600 yuan of grassland compensation and 114900yuan resettlement compensation.

4.1.4. Qinghe county

(1) Resettlement of collective land

Qinghe County Project Office in order to properly resolve the pastoralists and land affected population received basic life and long-term livelihood, maintaining social stability and harmony, promote economic and social development, and to develop the appropriate compensation policy, namely:

a) To obtain the grassland compensation and resettlement subsidies;

b) During project construction, will give jobs priority to resettlement labors, which will bring the cash income of affected persons.

c)Provide skills training and employment introduction

Throughout the production recovery process, technical personnel training should be provided, such as some cash crops and farming, etc.. Invite the livestock sector and labor and social security departments of the technical staff to carry out some training herdsmen aspects related to aquaculture, making affected households received at least more than once per animal husbandry and non-agricultural production, technical training and technical training, through these measures to improve farming skills to increase the income of affected persons to restore the livelihoods of affected people. 4.2. HD Resettlement

4.2.1. Burqin county

By the end of this monitoring, 9 affected households of shuangHubei Road have been completed demolition, house demolition with an area of 914.75m2. Up to July, 2014, the house demolition compensation of Shuanghubei road and resettlement work have been completed.

The households affected by house demolition may select the resettlement mode of cash compensation or property swap. After receiving the compensation for house demolition, the displaced persons may select either resettlement mode based on their affordability or personal needs, namely cash compensation, buying commercial housing as market price or exchanging for resettlement housing.

The house demolition compensation would be determined based on the same year

and local housing market price; the final demolished house price will be compensation

after on-site assessment of a real estate appraisal survey and mapping agency to

evaluate the demolished houses. The agency would assess the house as replacement

value according to the building materials, construction techniques and house structures,

renovation etc. and then consult with APs, if they agree to get property exchange, they

can get a new house as 1:1.2 according to the original house area and remodel situation

and the affiliates; if the AP want cash compensation, according to their house situation,

they might get RMB10,000-25,000 for the decoration. For the one whose original house

is less than 40m2, they can get a resettlement house with 69m2 without paying for the

extra area.

Resettlement area is located in Wolongwanxi Road, Burqin County, it has

convenient transportation, Burqin tourist hotels are also located in the vicinity, surrounded

by green contrast with leisure square, music fountain; which is near third primary school,

county hospitals, and it takes less 10 minutes to walk to power companies, it is really

suitable for living. There are two kinds of units: two living rooms and two bedrooms, and

three bedrooms and two living rooms. Condominiums have six kinds to choose from 69m2,

74 m2,79 m2,87m2,95 m2,104 m2,113m 2.

As of this monitoring, 9 affected households of shuangHubei Road have been

completed demolition, demolition of housing area 914.75m2, has completed the

compensation of 9 affected households. Payment of compensation costs 3.7601 million

yuan. According to the survey, the quality of living of the 9 households affected by HD has

all improved. There were three households their houses were not demolished, but the

yard was partially expropriated, so they did not lose residence. The compensation fee for

the Ma Zhonghua family was 333,800 yuan. He purchased a house for his son in the city

of Buerjin county using the compensation fee to prepare for his son’s marriage. His son

has now married and has lived in a new house. The compensations of Wang Lunwu and

Xu Shuanghua were 141,100 yuan and 85,300 yuan, respectively, which were mainly

used to supplement households. They replaced some furniture and household appliances,

and their material living conditions have improved a lot.

The remaining 6 households affected by HD have all purchased new houses in the

county, and the area of the houses is all above 85 m2. Among them, the newly purchased

houses of Song Chaoxi have reached 127 m2. By now, all the newly purchased houses

have been renovated, families also moved in. The living environment and living conditions

of 6 households have improved significantly. The project office also helped Wang Yuhua’s

son to find a fixed job in the urban management brigade according to the specific

circumstances of the demolition family which provided Wang Yuhua’s son a long-term

guarantee in the living.

4.2.2. Habahe county

The house demolition was caused by road construction and the compensation and

resettlement of HD have been finished in June 2013. 42

The resettlement plan of the 14 affected households involves cash compensation, housing property rights exchange. (Through house evaluation, combined with moving fee, transition fee and other related expenses, the housing area distributed for the residents is according to the assessment of housing compensation value after the displacement of the original house, and if there is some spare area, it will be paid based on the price difference.

Residents themselves will firstly choose the house model and the direction the house facing). Equipped with two clinics, supermarket, restaurant, etc, the Resettlement

Buildings located in North resettlement community of ASheLe Street, which is the development center of Habahe county, nearby junior high school, senior middle school and county hospital; and at the same time, a new nursery school was established in the north community, which make the community convenient to live and hospital, so all the affected family choose the housing property rights exchange. For Housing property rights exchange details, see the table 4-10.

A total of house demolition costs is 2.3488 million yuan, including compensation for

HD of 1.7794 million yuan, compensation for residential land of 0.3081 million yuan, other subsidies (moving fee, transition fee, etc ) of 0.2613 million yuan, and ground attachments of 64400 yuan. PMO has distributed all compensation to affected people. 4.2.3. Jimunai county

The project office signed a demolition agreement with the affected household. in

September 26, 2011. According to the demand of the affected people,the project office promised in the agreement, Jimunai County Construction Bureau is responsible for the reconstruction of the demolished house and sheepfold, the construction area and structure should be identical with the original, and the location should be chosen by the affected household.In June 2012,Jimunai County Construction Bureau constructed new house and sheepfold using material better than before, and dig a large reservoir to improve water drinking in winter for Geaiban·Abudula.

For the 11 heating project affected households, PMO provide following compensation methods: monetary compensation and to build on the allocated residential land by himself.

For the affected people who don’t choose the property exchange, monetary compensation can satisfy their individual requirements, buying commercial house or resettlement house in Jimunai County or other places according to their willing, free from the reference of

PMO.

Allocated residential land is located in Dongshanliang Community, 2 kilometers

away from the demolish area. The community is equipped with good facilities, such as cultural entertainment, fitness equipment, hospital, educational institutions, and green fields and so on. The living condition is better than the demolition area, so there is no inconvenience to daily life.

For the affected people by central heating project are native residents for many years in Jimunai county, they have other houses except the demolished houses, and house demolition will not make them displaced, they prior to monetary compensation which will be used for other aspects.

Up to this monitoring, the resettlement of 11 households with 48 people affected by central heating project has been completed, with house demolition area of 1121.03 m2 and monetary compensation of 3.17 million. The resettlement compensation is shown in table 4-6.

4.2.4. Qinghe county

HD was caused by Ta town road component and county heating component, construction of Ta town road affected 1 HH, the compensation had completed in June

2013, county heating component affected 5 HHs, and compensation work also had been completed in August 2013.

The resettlement for affected households is as follows:

The 6 households affected by house demolition may select the resettlement mode of cash compensation or property swap. After receiving the compensation for house demolition, the displaced persons may select either resettlement mode based on their affordability or personal needs, namely cash compensation, buying commercial housing as market price or exchanging for resettlement housing.

Affected people who choose the property exchange, residents in project area is 45

according to property area (preset house area) in a way of “one demolition, one compensation”, area less than 50 m2 complement 50 m2, the largest area is 90 m2, if the original house area of affected people is over 90 m2, the area of resettlement house will not be larger than original house area. If affected people need resettlement house with an bigger area than demolition area, for this part, building area is increased within 10 m2, house payment is paid based on house construction cost price, for this part that construction area is over 10 m2, house payment is paid based on commercial house market price.

Affected people who choose the monetary compensation, monetary compensation will be formulated according to the location, purpose, construction area of house, age limit of building, building structure, the specific price of compensation is determined according to the time of local house.

1 affected household in Ta town, after the consultation with PMO, relevant leaderships of Ta town and affected households, after distributing the monetary compensation, to build homestead, homestead located in herdsmen’s settlement of

Saerbulake village, in the north of Ta town, less than 1 km; resettlement site is less than 2 km away from affected households’ present house, for affected households, there is no existing inconvenience before or after moving. The homestead area is 300 m2, in addition,

20000yuan subsidy of herdsmen resettlement project is used to construct each attachments in house and yard.

Among the 6 AHs, 5AHs chosen cash compensation,1 AH chosen property swap.

0.846 Million was paid for demolition compensation, including:

(1)1 affected HH by the road subproject in Ta town, after consultation by the PMO, the AH want to get the cash compensation, because he has a set of house in other place. after assessment, PMO paid 150,000 yuan a one-time to the affected people in June

2013;

(2)During March to August 2013, PMO had consulted and assessed with 5 HHs that affected in the county heating project and signed the resettlement agreement. The 46

resettlement work finished in August 2013. Detail sees in table 4-11.

One of the affected people Chen Qingli chose property exchange, the demolished house area is 98m2 and after the property exchange, he got a 92m2 house in Guangming road resettlement building. At the meantime, the compensation of state-owned residential land and attachments were also paid to him as well as 37080 yuan renovation costs. The remaining 4 HHs chose the monetary compensation because they owned houses downtown. The compensation standard: compensation for house 1,300 yuan/m2; compensation for residential land 41 yuan/2. Totally 0.642 million yuan was paid to 4 HHs, including compensation for residential land of 33200 yuan, compensation for house 59.60 million yuan, remove subsidy 2,000 yuan and TV relocation fee 4,300 yuan. 4.3. Resettlement for vulnerable groups

In five counties, according to this monitoring, the vulnerable group affected by the project is Li Lanying’s family, in Wenhuabei Rd. with family members of daughter in-law and grandson, Li Lanying is the family head, enjoying the minimum subsistence guarantee system, receive the subsidy of 1400yuan/year from government, and her daily life is taken care by her 3 daughters.

Affected by the housing demolition, 59.86m2 civil main house and 24.01m2 brick- wood Wing room were demolished. The compensation for the value of Li Lanying’s house is inadequate for buying a relocated residential house, however, Habahe county Bureau not only compensates her a 82m2 house, but also need no price difference after negotiation with her. The house direction is up to Lilan Ying’ decision and she chooses the

102 room, east unit, 8 building. Now Lilan Ying and her families have moved into their new home, and they are satisfied with the government resettlement plan.

Buerjin:The changes in LA and HD are mainly due to changes in the acquisition area of cultivated land、grassland and forest.

Arable land occupation was caused by the road subprojects of Phase 1 Huancheng

Road construction (Baihulin Road - Youyifeng Road). The reason for increasing is that before LA, the red line was not finalized, and during the final construction survey 4.55mu arable land was determined to acquired.

Due to the project changes of Baihuayuan Rd, the PMO has cancelled the construction of Baihuayuan Rd; therefore the HD work on Baihuayuan Rd will be called too. Since the component in Economic Development Zone was canceled, so the grassland occupation with 101.55mu was reduced for the planed road construction.

The construction width of the water supply network increased from 4m to 10m, and then increased to 15m. The occupied area of forest and grassland increased accordingly.

In addition, the grassland compensation standard and the house demolition compensation standard of Buerjin have also changed. See Sections 4.1.1 and 4.2.1 for details. Habahe: The changes in LA and HD are mainly due to changes in the types and area of the acquired land.The main reasons are as follows:

When the HaBaHe County sewage component was in the stage of preparation, the land type acquired was defined as state-owned desert forestland; as detailed survey made by HaBaHe County PMO and the Grassland Supervision Institution, the land type of the location of the waste treatment plant was identified as farmers’ second-class fourth level pastures in JiaYiLeMa Habuhatan Village of HaBaHe County. Land requisition of the construction of sewage treatment engineering will be 108 mu (including administrative zones and access road area) second-class fourth level pastures In FSR, Sewage treatment engineering design covers an area of 90.3 mu. The changes of the wastewater treatment engineering construction area were the results of the non-rigorous attitude of design personnel in the feasibility study stage. Sewage treatment engineering actually occupied 108 mu second-class fourth level pastures of Habuhatan Village of JiaYiLeMa.

HaBaHe County Garbage Disposal Component is in the preparation phase. The land type of refuse collection point defined by HaBaHe County Land Bureau belongs to state-owned desert forestland. Before the project implementation, through detailed survey made by HaBaHe County PMO and the Grassland Supervision Institution, they defined the land type of location of the waste disposal plant as farmers’ second-class fourth level pastures in HaBaHe County Saerwulen Village of Saertamu. Garbage disposal component construction will take over 174 mu of second-class fourth level pastures for use, but in order to the long-term construction need, the project reserved 156.9 mu second-class fourth level pastures for the coming construction land use. Short-and-long term using land of total garbage disposal project covers an area of 330.9 mu of second-class fourth level pastures (including the construction land of garbage disposal component).

Jimunai: The increase in the compensation for attachments in LA and HD is mainly due to changes in the compensation standards for demolition in the heating projects(See

Section 4.2.3 for details). Other costs have decreased. The main reasons are as follows:

The construction of sewage treatment plant occupied 78.3mu of collective land (the level is class 3, grade 8), but for the need of long-term construction of wastewater treatment plant, after consultation with the affected persons, jimunai County PMO set aside landfill 48.3 mu grassland (class 3, grade 8)for long-term construction.

According to the requirement of Jimunai County Urban Master Plan (2013-2030),

Jimunai County ADB project management office plans to cancel the construction of

Guanghui Rd, Xingfu Street, and Caigang Street(west section of flood control Canal), the construction of Tuanjie Rd and Caigang Street (east section of flood control Canal) will be retained, and according to amount of funds to extend Guanghui Rd; due to ADB loan.

After the road construction content was changed, the northern extension of Guanghui

Road was rebuilt on the original road, which widened the width of the road. No buildings or facilities on both sides of the red line involved land acquisition and demolition activities.

However, it occupied 145.35 mu of state-owned land. There were 77.52 mu of unutilized land (natural pasture, Toptecec Town owned the land), and 67.83 mu of state-owned construction land (for the current road land);

The construction of the boiler room was cancelled. The heat supply project was changed to 7 new heat stations, and the total length of the heat pipe network was

2,5947.1m. The newly built heat exchange station occupied 1.58 acres of state-owned unused land.

Qinghe: The changes in LA and HD are mainly due to changes in the acquisition area. Before project implementation, Qinghe County PMO, and grassland supervision department by, and land resource department and forestry Council based on the eventual design, after detailed of measurement survey, and the second national land survey defined that sewage plant located in State-owned desert woodland, which occupied area for 64.35 mu, no affected population; the access road occupied grassland (class1, 66

grade3)11.19 mu, the ownership was Akelangke Village.

The project was optimized during the implementation process. Takshiken town (Ta

Town) planned to covering 25.46 mu lands for road component, the actual land occupation is 22.49 mu, 2.99 mu less.

Ta town water supply component planned to cover 5.45 mu of meadow; Actually occupied 10.22 mu, 4.77 mu more. The reason is that: in the process of consultation with pastoralists in pastoral meadow, after the planed levy place, the rest area is small and is hard to manage, the AP hopes the rest area can be required too, PMO agreed

Ta town drainage component planned to cover 52.33 mu, actually occupied 182mu grass land, 129.67mu more. The reason for the increase is that the affected people of the pastures request that all the pastures at the location of the Wastewater

Treatment Plant be requisitioned,, the project office and the affected people have agreed to the requirements of the people affected by land acquisition in the Tacheng sewage treatment plant.

Ta town refuse disposal component planned to cover meadows 72.25mu, actually occupied 150mu grass land, 77.25mu more, The land area increased reasons were that the Qinghe County Project Office negotiated with the affected people, they reserved 77.25 mu of land for long-term construction..

The demolition area affected by the heating of the county town was reduced from 654 square meters to 550 square meters.

In addition, the grassland compensation standard and the house demolition compensation standard of Qinghe have also changed. See Sections 4.1.4 and 4.2.4 for details.

6. Resettlement Investigation on Production and Living Conditions

6.1. Resettlement for vulnerable groups

6.1.1. Survey illustration This survey looked at the living standards of migrants in production in 2017 and analysed the changes in living standards of migrants since the implementation of the project. Until December 2017, subprojects of five counties totally affect one state-owned farm, three township/town, 7 communities, 12 villages, 88 households including 462 people were affected. The sample size of the survey includes all affected residents. Table 6-3 is the changes of the structure of the per capita income of the affected

residents from the first monitoring(baseline data monitoring) to fifth monitoring.From the table, we can see that the average income per capita of the project has increased gradually during the 5 years, and the amount has increased from 9844 yuan per person in the first time monitoring(baseline data monitoring) to 16276 yuan/person in the fifth monitoring, increased by 7432 yuan, the increase rate is 75.50%.Among them, the increase of work income and animal husbandry income are obvious, indicating that the income of the affected residents is more stable, and has not changed greatly due to the interference of the project construction. At the same time, business income has also increased significantly, indicating that, after the increase in income, the residents' ability to improve their living standards through independent entrepreneurship has increased.

6.1.2.3Changes in household income and expenditure

Production is the guarantee of living. Table 6-4 is the expenditure structure table of

the affected residents. From the table, we can see that, in terms of productive expenditure, there has been a significant increase in operating expenses and grassland expenses.

Combined with the content of table 6-3, we can see that the increase of residents' productive expenditure has contributed to the increase of livestock income and business income. It also shows that the productive capacity of the population has not been reduced due to the impact of the project, providing a guarantee for the improvement of living standards.In terms of living expenses, living expenses, heating costs and clothing expenses have increased to some extent, indicating that the increase of income has promoted the improvement of material living standard to some extent, and at the same time, the quality of life has also been improved.

6.1.2.4 Analysis of family income and expenditure

Table 6-5 is the table of changes of the net income (per capita net income = per capita income - productive expenditure) for the affected residents from the first monitoring to the fifth monitored. From the table, we can see that the per capita net income of residents increased from 8214 yuan to 13913 yuan, increased by 5699 yuan, the increase rate is 67.75%, indicating that the level of production and living of households affected by land acquisition and demolition has not been reduced by the impact of the project, but on the contrary, it has been greatly improved, which indicates that the implementation of the compensation and resettlement measures has played a role in promoting the improvement of the living standard of the residents.

Her monthly income is now

2300yuan. Before the Land acquisition and demolition, her residential house is in the

cottage, the living condition and the surrounding environment is poor, The sources of income are mainly farming and odd jobs. she once had 20 acres of arable land, the main crop is wheat or corn, a year's net income was around 20,000 yuan. After the land expropriation and demolition, she and her son moved to the newly constructed building, her living conditions improved a lot accordingly, and her work is now more stable and not so tiring. and her wages have been raised in 2017. Household expenditure mainly includes educational expenses, living expenses, heating and clothing expenditure.

3) Jimunai Country

Present situation of production and life:Geaiban·Abudula lives in Hara Heller Village, affected by the project of the garbage disposal plant, 277.7 mu grassland was levied, and a 180m2 temporary housing is removed. In 2011,he received 306.50 thousand yuan for the compensation of the levied grassland. In June 2012,Jimunai

County Construction Bureau constructed new house and sheepfold using material better than before, and dig a large reservoir to improve water drinking in winter for

Geaiban·Abudula.

All members in Arataib’s have no regular jobs and their income mainly comes from grazing and odd jobs. The grazing income in 2017 was around 30,000. The income of two sons and their daughters-in-law for one month was about 3,500 yuan, and the annual income was about 25,000 yuan. Household expenses mainly depend on heating, buying fodder and daily living expenses. Araupa·Abdallah said that the land expropriation did not affect their income because they still had other pasture,

4) Qinghe Country

Basic situation of the family:Qian Wanwei, with 4 family members, his wife,

son, and daughter all of them are han nationality.

Present situation of production and life:The HD area for 3000m2, got the

compensation of 150,000yuan, Qian Wanwei has a house in Urumqi. His wife, son

and daughter live in Urumqi. He rented a house and lived in Ta town. His wife have no

job, and his daughter and son are in high school and primary school in Urumqi. Qian

Wanwei works in a property company belong to the Trade City in Ta town. His salary

is 4500 yuan/month. Qian Wanwei has four sets of storefronts in the town of Ta,

which is now rented, with a monthly rent of 1200-1500 yuan per store. Qian Wanwei

said his work was so tiring as before, and the living of his family has been greatly

improved after the demolition compensation, and is very satisfied with the

compensation.

6.2.2. Assessment of interview

Through interviews with typical households, we found that all the affected households were properly compensated and properly resettled, and they were all satisfied with the resettlement and compensation and also had a positive supportive attitude to the project.

At the same time, benefiting from reasonable resettlement and compensation, the basic living standards of all the affected households have not decreased, on the contrary, they have been improved in varying degrees.

7.2. Complaints and Appeal

To deal with issues in time and ensure smooth implementation of project construction and LA, PMO established a transparent and effective complaints and appeal channel, and the basic means of appeal is as follows:

Stage 1: If any displaced person is dissatisfied with the RP, he/she can report this to village/community committee orally or in writing. In case of an oral appeal, the village/community committee shall make a disposition and keep written records. Such appeal should be solved within 2 weeks;

Stage 2: If the displaced person is dissatisfied with the disposition of Stage 1, he/she may file an appeal to the township government/urban district office after receiving such disposition, which shall make a disposition within 2 weeks;

Stage 3: If the displaced person is dissatisfied with the disposition of Stage 2, he/she may file an appeal to the Each County’s Land and Resources Bureau (QCLRB) / House

Demolition Management Office (HDMO) after receiving such disposition, which shall make a disposition within 30 days;

Stage 4: If the displaced person is still dissatisfied with the disposition of Stage 3, he/she may apply for administrative reconsideration with the Each County’s PMO or file an administrative action in the county people’s court in accordance with the Civil

Procedure Law of the PRC after receiving such disposition.

Stage 5: Populations affected by the project can also appeal to the ADB Project Team.

If good faith efforts have been made and people are still dissatisfied and believe harm has been caused due to non-compliance with ADB’s policies, they may appeal to ADB’s

Accountability Mechanism.

Displaced persons may file an appeal on any aspect of resettlement, including compensation rates, etc. The above means of appeal, and the names, locations, persons

responsible and telephone numbers of the appeal accepting agencies will be communicated to the displaced persons at a meeting, through an announcement or the

RIB, so that the displaced persons know their right of appeal. Mass media will be used to strengthen publicity and reportage, and comments and suggestions on resettlement from all parties concerned will be compiled into messages for disposition by the resettlement organization at all levels.

8.2. Evaluation of Organization Ability

In the process of project implementation, a set of organizations from top to bottom has been set up for planning, coordinating and monitoring for the immigration plan. The main responsibility is to strengthen the management of engineering projects, take charge of design of this project resettlement policy and to organize and coordinate relationship with all levels of immigration agency. Leading group consists of office, dealing with daily affairs; the office located in the Burqin County Construction Bureau. This monitoring found that the project units mainly adopted the following measures for the ability construction of immigration agency:

(1)The priority is to satisfy the technical personnel of immigration agencies, equipped with administrative personnel, strengthen the training of the professional quality and management level

(2)Organize the major staff of institutions at all levels to conduct business training, understand the immigration policy and the requirements of ADB in our country, and improve the ability of handling service quality and policy;

(3)To strengthen information feedback in order to make two-way information flow from top to bottom;

(4)To strengthen the internal responsibility system for the monitoring, solve problems after found, and establish early warning system for relevant risk.

9 Conclusion 1)Project impact: Subprojects of five counties totally affect one state-owned farm, three township/town, 7 communities, 12 villages, 1080.07 mu collective land, permanently acquired 1319.49 mu state-owned land, 66 HHs with 376 APs were affected. During the construction period, 852.14 mu of land was temporarily expropriation, including 667.29mu of collective land and 184.85 mu of state-owned land. Demolited houses 5107.78m2, 30

HHs with 104 APs were affected.

2) Migration resettlement: Until December 2017, Land expropriation and demolition of the five counties were all completed, and all the affected persons were adequately compensated and resettled. Due to careful preparation and organization of a large number of public participation events, So far, no complaints by immigrants occurred. The total fees paid for land acquisition and demolition in all subproject counties were 35.25 million yuan, For details of the amount of land requisitioned, construction compensation fees for various types of land and housing, and actual immigration expenses for various subprojects, see Table 9-1.

3)Rehabilitation of the affected population: According to the continuous monitoring of the past 5 years, the income, expenditure and net income of affected residents have improved significantly. Production is the guarantee of living. The increase in productive expenditure indicates an increase in productive capacity, indicating that the productive capacity of the population has not been reduced as a result of the impact of the project,

which provides essential guarantee for the improvement of living standards. The increase of work income and animal husbandry income are obvious, indicating that the income of the affected residents is more stable, and has not changed greatly due to the interference of the project construction. The increase in basic demand for life, heating and clothing shows the improvement in the living standard of the residents and the improvement of the quality. Further more,the net income of residents increased from 8214 yuan to 13913 yuan, increased 67.75%.All these analyst results mentioned above indicate that the level of production and living of households affected by land acquisition and demolition has not been reduced by the impact of the project, but on the contrary, it has been greatly improved, which indicates that the implementation of the compensation and resettlement measures has played a role in promoting the improvement of the living standard of the residents.
