O. 441 (E). – Whereas the Central Government is of the opinion that it is necessary to appoint a Commission of Inquiry for the purpose of making an inquiry into a definite matter of public importance, namely, killing of innocent Sikhs following the assassination of Smt. Indira Gandhi, the late Prime Minister, on the 31st October, 1984; And whereas on 31st October, 1984, serious violence broke out in the National Capital Territory of Delhi and some other parts of the country and as a result of the violence, thousands of the Sikhs lost their lives and several others got seriously injured; their houses and properties were burnt down as a result of arson and many of them were rendered homeless. The riots caused a great deal of anxiety and pain to the Sikh Community and to the public; And whereas the Government of India in the Ministry of Home Affairs appointed a Commission of Inquiry headed by Mr.Justice Ranganath Misra for the purpose of making an inquiry into that definite matter of public importance, to wit, the violence that occurred and to take corrective measures to meet the ends of justice vide its notification number S.O.362 9E) dated, the 26th April, 1985; And whereas there is a widespread demand from different sections of the public, particularly, the Sikh community for an inquiry into several aspects of violence, abuse of authority, remissness and apathy of law enforcement agencies and those who were in position to exercise control over them, excesses committed and action taken or purported to be taken in the wake of criminal riots and broke out on 31st October, 1984 and afterwards, targeting the members of the Sikh community; Now, therefore, in exercise of the powers conferred by section 3 of the Commissions of Inquiry Act, 1952 (60 of 1952), the Central Government hereby appoint a Commission of Inquiry consisting of Mr. Justice G.T. Nanavati, a retired Judge of the Supreme Court of India. 2. Terms of Reference : (i) The Commission shall make an inquiry with respect to the following matters : (a) to inquire into the causes and course of the criminal violence and riots targeting members of the Sikh Community which took place in the National Capital Territory of Delhi and other parts of the country on 31st October, 1984 and thereafter ; (b) the sequence of the events leading to and all the facts relating to such violence and riots ; (c) whether these heinous crimes could have been averted and whether there were any lapses or dereliction of duty in this regard on the part of any of the responsible authorities/individuals; (d) to inquire into the adequacy of the administrative measures taken to prevent and to deal with the said violence and riots; (e) to recommend measures which may be adopted to meet the ends of the justice; (f) to consider such matters as may be found relevant in the course of the inquiry. (ii) The inquiry by the Commission shall be in regard to : (a) complaints or allegations that may be made before the Commission by any individual or association in such form and accompanied by such affidavits, as may be specified by the Commission, and (b) such instances relatable to Paragraph 2(i) (a) to (f) as may be brought to its notice either by the Central Government or the Government of the National Capital Territory of Delhi or the State Governments concerned. 3. The Commission shall submit its report to the Central Government as soon as possible but not later than six months from the date of its first sitting. 4. The Commission may, if it deems fit, make interim reports to the Central Government before said date on any of the matters mentioned in paragraph 2. 5. The headquarters of the Commission shall be at New Delhi. 6. The Central Government is of the opinion that, having regard to the nature of the inquiry to be made by the Commission and other circumstances of the case, all the provisions of sub-section (2), sub-section (3), sub-section (4) and sub-section (5) of section 5 of the Commissions of Inquiry Act, 1952 ( 60 of 1952), should be made applicable to the Commission and the Central Government, in exercise of the powers conferred by sub-section (1) of the said section 5, hereby directs that all the provisions of the said sub-sections (2), (3), (4) and (5) of that section shall apply to the Commission.     FOREWORD The need to prepare a clear and comprehensive document on the Punjab problem has been felt by the Sikh community for a very long time. With the release of this White Paper, the S.G.P.C. has fulfilled this long-felt need of the community. It takes cognisance of all aspects of the problem-historical, socio-economic, political and ideological. The approach of the Indian Government has been too partisan and negative to take into account a complete perspective of the multidimensional problem. The government White Paper focusses only on the law and order aspect, deliberately ignoring a careful examination of the issues and processes that have compounded the problem. The state, with its aggressive publicity organs, has often, tried to conceal the basic facts and withhold the genocide of the Sikhs conducted in Punjab in the name of restoring peace. Operation Black Out, conducted in full collaboration with the media, has often led to the circulation of one-sided versions of the problem, adding to the poignancy of the plight of the Sikhs. Record has to be put straight for people and posterity. But it requires volumes to make a full disclosure of the long history of betrayal, discrimination, political trickery, murky intrigues, phoney negotiations and repression which has led to blood and tears, trauma and torture for the Sikhs over the past five decades. Moreover, it is not possible to gather full information, without access to government records. This document has been prepared on the basis of available evidence to awaken the voices of all those who love justice to the understanding of the Sikh point of view.

    ‘Spice King’, Mdh Group Owner Dharampal Gulati Passed Away At 98 JNS: ‘Spice King’ and the MDH spice group owner, Dharampal Gulati (98), has passed away. He breathed his last at Mata Channan Devi Hospital on Thursday morning. Dharampal, also known as ‘Mahashay’ was admitted to Mata Channan Hospital, Delhi, for the last several days due to illness. Chief Minister of Delhi Arvind Kejriwal expressed grief over the death of Mahashay Dharampal. Expressing grief, Defense Minister Rajnath Singh said, I feel saddened by the demise of Dharmapalji, one of the eminent businessmen of India. Despite doing a small business, he made a mark of himself. He was very active in social work and remained active till the last time. “I express my condolences to his family.” Mahashay Dharampal was born on 27 March 1923 in Sialkot (now in Pakistan). In the year 1933, he left school even before completing the 5th standard. In the year 1937, he started his own business with the help of his father. However, Gulati could not continue his business for a long time, and later he started working in his father’s shop named ‘Maheshiyan Di Hatti’ known as ‘Degi Mirth Wale’. After the India- Pakistan partition, he came to Delhi and on 27 September 1947 he had only 1500 rupees. With this money, Dharmapala bought a tanga for Rs 650 and started a ferry between New Delhi Railway Station to Qutub Road. After a few days, he started selling spices by setting up a small shop on Ajmal Khan Road in Karol Bagh. The spice business went on, and the MDH brand was founded.
